NGHỊ QUYẾT

SỬA ĐỔI, BỔ SUNG MỘT SỐ ĐIỀU CỦA NGHỊ QUYẾT SỐ 55/2010/QH12 VỀ MIỄN, GIẢM THUẾ SỬ DỤNG ĐẤT NÔNG NGHIỆP

Căn cứ Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam;

Căn cứ Luật tổ chức Quốc hội số 57/2014/QH13;

Căn cứ Luật thuế sử dụng đất nông nghiệp năm 1993;

Sau khi xem xét Tờ trình số 368/TTr-CP ngày 30 tháng 9 năm 2016 của Chính phủ; Báo cáo thẩm tra số 163/BC-UBTCNS14 ngày 10 tháng 10 năm 2016 của Ủy ban Tài chính - Ngân sách; ý kiến của các vị đại biểu Quốc hội và Báo cáo giải trình, tiếp thu, chỉnh lý số 55/BC-UBTVQH14 ngày 11 tháng 11 năm 2016 của Ủy ban thường vụ Quốc hội về dự thảo Nghị quyết sửa đổi, bổ sung một số điều của Nghị quyết số 55/2010/QH12 về miễn, giảm thuế sử dụng đất nông nghiệp,

QUYẾT NGHỊ:

Điều 1

Sửa đổi, bổ sung một số điều của Nghị quyết số 55/2010/QH12 về miễn, giảm thuế sử dụng đất nông nghiệp.

1. Sửa đổi khoản 3 Điều 1 và bổ sung khoản 4 vào Điều 1 như sau:

“3. Miễn thuế sử dụng đất nông nghiệp đối với toàn bộ diện tích đất nông nghiệp cho các đối tượng sau đây:

a) Hộ gia đình, cá nhân được Nhà nước giao đất để sản xuất nông nghiệp, bao gồm cả đất được thừa kế, tặng cho, nhận chuyển quyền sử dụng đất;

b) Hộ gia đình, cá nhân là thành viên hợp tác xã sản xuất nông nghiệp, nông trường viên, lâm trường viên đã nhận đất giao khoán ổn định của hợp tác xã, nông trường quốc doanh, lâm trường quốc doanh để sản xuất nông nghiệp theo quy định của pháp luật;

c) Hộ gia đình, cá nhân sản xuất nông nghiệp góp quyền sử dụng đất nông nghiệp của mình để thành lập hợp tác xã sản xuất nông nghiệp theo quy định của Luật hợp tác xã.

4. Miễn thuế sử dụng đất nông nghiệp đối với diện tích đất nông nghiệp được Nhà nước giao cho tổ chức kinh tế, tổ chức chính trị, tổ chức chính trị - xã hội, tổ chức xã hội - nghề nghiệp, đơn vị sự nghiệp và các đơn vị khác đang trực tiếp sử dụng đất để sản xuất nông nghiệp.

Đối với diện tích đất nông nghiệp mà Nhà nước giao cho tổ chức kinh tế, tổ chức chính trị, tổ chức chính trị - xã hội, tổ chức xã hội - nghề nghiệp, đơn vị sự nghiệp và các đơn vị khác đang quản lý nhưng không trực tiếp sử dụng đất để sản xuất nông nghiệp mà giao cho tổ chức, cá nhân khác nhận thầu theo hợp đồng để sản xuất nông nghiệp thì thực hiện thu hồi đất theo quy định của Luật đất đai; trong thời gian Nhà nước chưa thu hồi đất thì phải nộp 100% thuế sử dụng đất nông nghiệp.”

2. Sửa đổi, bổ sung Điều 4 như sau:

“Điều 4. Thời hạn miễn thuế

Thời hạn miễn thuế sử dụng đất nông nghiệp quy định tại Nghị quyết này được thực hiện từ ngày 01 tháng 01 năm 2017 đến hết ngày 31 tháng 12 năm 2020 ”

3. Bãi bỏ Điều 2, Điều 3 và khoản 2 Điều 5; bỏ từ “giảm” tại tên Nghị quyết số 55/2010/QH12.

Điều 2

1. Nghị quyết này có hiệu lực thi hành từ ngày 01 tháng 01 năm 2017.

2. Kể từ ngày Nghị quyết này có hiệu lực thi hành, đối tượng được miễn thuế sử dụng đất nông nghiệp không quy định tại Nghị quyết này và tại khoản 1, khoản 2 Điều 1 Nghị quyết số 55/2010/QH12 về miễn, giảm thuế sử dụng đất nông nghiệp thì tiếp tục thực hiện theo quy định của Luật thuế sử dụng đất nông nghiệp.

3. Chính phủ chỉ đạo các bộ, ngành và địa phương rà soát, chấn chỉnh, thực hiện thu hồi đất nông nghiệp do vi phạm pháp luật đất đai theo đúng quy định của pháp luật về đất đai.

4. Chính phủ quy định chi tiết Nghị quyết này.

Nghị quyết này đã được Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XIV, kỳ họp thứ 2 thông qua ngày 11 tháng 11 năm 2016.

AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF RESOLUTION NO. 55/2010/QH12 ON AGRICULTURAL LAND USE TAX EXEMPTION AND REDUCTION[1]

THE NATIONAL ASSEMBLY
OF THE SOCIALIST REPUBLIC OF VIETNAM

Pursuant to the Constitution of the Socialist Republic of Vietnam;

Pursuant to Law No. 57/2014/QH13 on Organization of the National Assembly;

Pursuant to the 1993 Law on Agricultural Land Use Tax;

Considering the Government’s Report No. 368/TTr-CP of September 30, 2016; the Finance-Budget Committee’s Appraisal Report No. 163/BC-UBTCNS14 of October 10, 2016; National Assembly deputies’ opinions and the National Assembly Standing Committee’s Report No. 55/BC-UBTVQH14 of November 11, 2016, explaining the acceptance of contributed opinions and revision of the draft Resolution amending and supplementing a number of articles of Resolution No. 55/2010/QH12 on agricultural land use tax exemption and reduction.

RESOLVES:

To amend and supplement a number of articles of Resolution No. 55/2010/QH12 on agricultural land use tax exemption and reduction.

1. To amend Clause 3 of Article 1 and add Clause 4 to Article 1 as follows:

“3. Agricultural land use tax is exempt for the whole agricultural land areas allocated to the following subjects:

a/ Households and individuals allocated land by the State for agricultural production, including inherited, donated and transferred land;

b/ Households and individuals that are members of agricultural cooperatives and state-run agricultural farms or forestry farms and have been stably contracted land by cooperatives, state-run agricultural farms or forestry farms for agricultural production in accordance with law;

c/ Agricultural production households and individuals that contribute their agricultural land use rights for the establishment of agricultural production cooperatives under the Law on Cooperatives.

4. Agricultural land use tax is exempt for agricultural land areas allocated by the State to economic organizations, political organizations, socio-political organizations, socio-professional organizations, non-business units and other units currently using directly land for agricultural production.

Agricultural land areas allocated by the State to economic organizations, political organizations, socio-political organizations, socio-professional organizations, non-business units or other units that currently manage but do not directly use land for agricultural production and assign land to other organizations or individuals for agricultural production under contracts shall be recovered in accordance with the Land Law; pending land recovery by the State, 100% agricultural land use tax shall be paid.”

2. To amend and supplement Article 4 as follows:

The agricultural land use tax exemption duration prescribed in this Resolution shall be implemented from January 1, 2017, through December 31, 2020.”

3. To annul Articles 2 and 3, and Clause 2 of Article 5; and remove the “reduction” term from the title of Resolution No. 55/2010/QH12.

Article 2.

1. This Resolution takes effect on January 1, 2017.

2. From the effective date of this Resolution, subjects eligible for agricultural land use tax exemption other than those specified in this Resolution and in Clauses 1 and 2, Article 1 of Resolution No. 55/2010/QH12 on agricultural land use tax exemption and reduction shall continue to comply with the Law on Agricultural Land Use Tax.

3. The Government shall direct ministries, sectors and localities to review, reorganize and recover agricultural land acquired from violations of the land law in accordance with the land law.

4. The Government shall detail this Resolution.

This Resolution was adopted on November 11, 2016, by the XIV^th National Assembly of the Socialist Republic of Vietnam at its 2^nd session.-
