AMENDMENTS TO DECREE NO.
81/2021/ND-CP DATED AUGUST 27, 2021 OF THE GOVERNMENT OF VIETNAM ON TUITION
FEES OF EDUCATIONAL INSTITUTIONS AFFILIATED TO NATIONAL EDUCATION PROGRAM AND
COLLECTION, MANAGEMENT THEREOF; POLICIES ON TUITION FEE EXEMPTION, REDUCTION,
AND LEARNING COST FINANCING; SERVICE FEES IN EDUCATION AND TRAINING

At
request of the Minister of Education and Training of Vietnam;
The
Government of Vietnam hereby promulgates a Decree on amendments to Decree No.
81/2021/ND-CP dated August 27, 2021 of the Government of Vietnam on tuition
fees of educational institutions affiliated to national education program and
collection, management thereof; policies on tuition fee exemption, reduction,
and learning cost financing; service fees in education and training.
Article 1. Amendments to Decree No. 81/2021/ND-CP dated
August 27, 2021 of the Government of Vietnam on tuition fees of educational
institutions affiliated to national education program and collection,
management thereof; policies on tuition fee exemption, reduction, and learning
cost financing; service fees in education and training (hereinafter referred to
as “Decree No. 81/2021/ND-CP”)
1.
Amendments to Clause 3 Article 9:
“3.
Tuition fees from the 2023-2024 academic year:
a)
Regarding educational institutions that have yet to cover their recurrent
expenditures: Maintain the stable tuition fees of the 2023-2024 academic year
equal to the tuition fees of the 2021-2022 academic year promulgated by
provincial People's Councils that have been locally applied.
b)
Regarding educational institutions that have guaranteed their recurrent
expenditures or recurrent expenditures and investment expenditures: they shall
determine the tuition fees based on the technical-economic norms and cost norms
and submit reports to the People’s Committees for presentation to provincial
People’s Councils for consideration and approval”.

The top
tuition limit for the 2021-2022 and 2022-2023 academic years regarding training
majors of public higher education institutions shall be equal to the top
tuition limit for public higher education institutions stipulated by the State
applicable in the 2020-2021 academic year, specifically:
a) The
top tuition fee limit for majors at the higher education level in public higher
education institutions that have not guaranteed recurrent expenditures and
investment expenditures is as follows:

Amendments to the title of Clause 2 Article 28 and Point a Clause 2 Article 28:
“2. The
top limit of service fees for preschool education and general education in the
2022-2023 academic year is as follows:
a)
Preschools and general education institutions that have not guaranteed
recurrent expenditures: Up to the top tuition fee limit under Point a Clause 2
Article 9 of this Decree.”
5. Clause
3 is added to Article 28:
“3. The
top limit of service fees for preschool education and general education from
the 2023-2024 academic year is as follows:
a)
Preschools and general education institutions that have not guaranteed
recurrent expenditure entirely: Up to the top tuition fee limit under Point a
Clause 3 Article 9 of this Decree.
b)
Preschools and general education institutions that have guaranteed recurrent
expenditures and recurrent expenditures and investment expenditures: Up to the
top tuition fee limit under Point b Clause 3 Article 9 of this Decree”.

Article 3. Implementation provisions
1. This
Decree comes into force as of its date of signing.
2.
Transitional provision;
a)
Regarding public preschools and general education institution
If
provincial People’s Councils and educational institutions have issued the
tuition range or tuition fees for the 2023-2024 academic year under Decree No.
81/2021/ND-CP with increased tuition fees compared to the 2021-2022 academic
year, local budgets shall cover the increased amount compared to the tuition
fees for the 2021-2022 academic year. The rate of support for each educational
institution shall be decided by local authorities.
If
provincial People’s Councils and educational institutions have issued the
tuition range or tuition fees for the 2023-2024 academic year under Decree No.
81/2021/ND-CP with increased tuition fees compared to the 2021-2022 academic
year, but local budgets cannot cover the increased amount compared to the
tuition fees for the 2021-2022 academic year, make adjustments following this
Decree.
b)
Regarding public higher education institutions and vocational education
institutions:
Public
vocational education institutions and higher education institutions that have
issued the tuition fees for the 2023-2024 academic year under Decree No.
81/2021/ND-CP shall carry out reviews and adjustments according to this Decree.
c)
Educational institutions with approved schemes for financial autonomy under
Decree No. 60/2021/ND-CP dated June 21, 2021 of the Government of Vietnam on
financial autonomy of public service providers may continue to implement the
tuition fee collection regulation corresponding to the approved level of
financial autonomy. If the tuition fee collection according to this Decree
leads to fluctuations in revenues, which change the approved financial autonomy
level, educational institutions shall review revenues and expenditures, submit
reports to superior regulatory authorities for review and appraisal for
re-approval of schemes for financial autonomy for stability in the remaining
time of the period according to Decree No. 60/2021/ND-CP.
