PRODUCTS AND SERVICES, CERTIFICATES OF CONFORMITY OF CIVILIAN CRYPTOGRAPHY
PRODUCTS WITH REGULATIONS AND STANDARDS; CHARGES FOR LICENSING IMPORT OF
CIVILIAN CRYPTOGRAPHY PRODUCTS; COLLECTION, TRANSFER, MANAGEMENT AND USE
THEREOF
Pursuant to the Law on Fees and Charges dated
November 25, 2015;
Pursuant to the Law on Cyberinformation Security
dated November 19, 2015;
Pursuant to the Law on State Budget dated June
25, 2015;
Pursuant to the Government's Decree No.
120/2016/ND-CP dated August 23, 2016 elaborating the Law on Fees and Charges;
Pursuant to the Government's Decree No.
58/2016/ND-CP dated July 01, 2016 on sale and provision of civil cryptography
products and services, export and import of civil cryptography products;
Pursuant to the Government's Decree No.
215/2013/ND-CP dated December 23, 2013 defining the functions, tasks,
entitlements and organizational structure of the Ministry of Finance;

The Minister of Finance promulgates a Circular
on fees for assessment of applications for licenses to sell civilian
cryptography products and services, certificates of conformity of civilian
cryptography products with regulations and standards; charges for licensing
import of civilian cryptography products; collection, transfer, management and
use thereof.
Article 1. Scope and regulated
entities
1. This Circular provides for the fees for
assessment of applications for licenses to sell civilian cryptography products
and services, certificates of conformity of civilian cryptography products with
regulations and standards; charges for licensing import of civilian
cryptography products; collection, transfer, management and use thereof.
2. This Circular applies to enterprises applying
for licenses to sell civilian cryptography products and services, certificates
of conformity of civilian cryptography products with regulations and standards,
licenses for import of civilian cryptography products; Vietnam Government
Certificate Authority (VGCA), organizations and individuals relevant to the
issuance of licenses to sell civilian cryptography products and services,
certificates of conformity of civilian cryptography products with regulations
and standards, licenses for import of civilian cryptography products.
Article 2. Fee and charge
payers
The enterprises applying for licenses to sell
civilian cryptography products and services, certificates of conformity of
civilian cryptography products with regulations and standards, licenses for
import of civilian cryptography products shall pay the fees and charges
specified in this Circular. The fees and charges shall be paid in cash to the
collecting organization or transferred to the collecting organization’s account
at the State Treasury.
Article 3. Collecting
organization
VGCA shall be the collecting organization mentioned
in Article 2.

Article 5. Declaring and
transferring collected fees and charges
1. By the 5th of each month, VGCA shall
transfer the fees collected in the previous month to the collection account at
the State Treasury.
2. VGCA shall monthly declare and transfer the
collected fees and charges, and prepare annual statements of fee and charge
collection in accordance with Clause 3 Article 19 and Clause 2 Article 26 of
Circular No. 156/2013/TT-BTC dated November 06, 2013 of the Minister of Finance
elaborating the Law on Tax Administration; the Law on amendments to the Law on
Tax Administration and the Government’s Decree No. 83/2013/ND-CP dated July 22,
2013. VGCA shall transfer 10% of the collected fees and 100% of the collected
charges to state budget according to the state budget laws.
Article 6. Management and use
of collected fees
VGCA may retain 90% of the collected fees to cover
the verification and collection costs. Retained fees shall be managed and used
in accordance with Article 5 of the Government’s Decree No. 120/2016/ND-CP dated
August 23, 2016 elaborating the Law of Fees and Charges.
1. This Circular comes into force from January 01,
2017 and replaces Circular No. 88/2015/TT-BTC dated June 09, 2015 of the
Minister of Finance.
2. The Law on Fees and Charges, the Government’s
Decree No. 120/2016/ND-CP, Circular No. 156/2013/TT-BTC, the Law on amendments
to the Law on Tax Administration and the Government’s Decree No. 83/2013/ND-CP,
Circular No. 153/2012/TT-BTC shall apply to other issues relevant the
collection, transfer, management, use, documents and disclosure of fees and
charges that are not mentioned in this Circular.
3. Difficulties that arise during the
implementation of this Circular should be reported to the Ministry of Finance for
consideration./.
