Căn cứ Pháp lệnh phí và lệ phí và Nghị định số 57/2002/NĐ-CP ngày 03/6/2002 của Chính phủ quy định chi tiết thi hành Pháp lệnh phí và lệ phí;
Căn cứ Pháp lệnh nhập cảnh, xuất cảnh, cư trú của người nước ngoài tại Việt Nam và Nghị định số 21/2001/NĐ-CP ngày 28/5/2001 của Chính phủ quy định chi tiết thi hành Pháp lệnh nhập cảnh, xuất cảnh, cư trú của người nước ngoài tại Việt Nam;
Căn cứ Nghị định số 05/2000/NĐ-CP ngày 03/3/2000 của Chính phủ về xuất cảnh, nhập cảnh của công dân Việt Nam;
Căn cứ Quyết định số 875/TTg ngày 21/11/1996 của Thủ tướng Chính phủ về việc giải quyết cho công dân Việt Nam định cư ở nước ngoài hồi hương về Việt Nam;
Sau khi có ý kiến thống nhất của Bộ Công an, Bộ Ngoại giao và Bộ Quốc phòng, Bộ Tài chính sửa đổi, bổ sung Thông tư số 37/2003/TT-BTC ngày 24/4/2003 của Bộ Tài chính quy định chế độ thu, nộp và quản lý sử dụng lệ phí cấp hộ chiếu, thị thực và giấy tờ về nhập cảnh, xuất cảnh, quá cảnh và cư trú tại Việt Nam như sau:

1. Điểm 2, Mục I Thông tư số 37/2003/TT-BTC nêu trên được thay thế bằng điểm 2 mới như sau:

2. Công dân Việt Nam khi nộp hồ sơ đề nghị cơ quan có thẩm quyền thuộc Bộ Công an, Bộ Ngoại giao, Bộ Quốc phòng cấp hộ chiếu (bao gồm cấp mới và cấp lại do bị hư hỏng boặc bị mất hộ chiếu), giấy tờ có liên quan gắn liền việc cấp hộ chiếu (nếu có) và người nước ngoài khi được các cơ quan này cấp thị thực; hoặc người Việt Nam và người nước ngoài khi được các cơ quan này cấp các loại giấy tờ về nhập cảnh, xuất cảnh, quá cảnh hoặc cư trú tại Việt Nam phải nộp lệ phí theo quy định tại Thông tư này; Trừ những trường hợp được miễn nộp lệ phí sau đây:

a. Khách mời (kể cả vợ hoặc chồng, con) của Đảng, Nhà nước, Chính phủ, Quốc hội hoặc của lãnh đạo Đảng, Nhà nước, Chính phủ, Quốc hội mời với tư cách cá nhân.

b. Viên chức, nhân viên của các cơ quan đại diện ngoại giao, cơ quan lãnh sự nước ngoài và cơ quan đại diện tổ chức quốc tế tại Việt Nam và thành viên của gia đình họ (vợ hoặc chồng và con dưới 18 tuổi sống chung với họ thành một hộ), không phải là công dân Việt Nam và không thường trú tại Việt Nam, được miễn lệ phí trên cơ sở có đi có lại.

c. Người nước ngoài mang hộ chiếu ngoại giao, hộ chiếu công vụ hoặc hộ chiếu phổ thông do nước ngoài cấp được miễn lệ phí trên cơ sở có đi có lại.

d. Người nước ngoài thuộc diện được miễn lệ phí theo Hiệp định hoặc Thỏa thuận mà Chính phủ Việt Nam đã ký kết.

e. Người nước ngoài vào Việt Nam để thực hiện công việc cứu trợ hoặc giúp đỡ nhân đạo cho các tổ chức, cá nhân Việt Nam.

g. Những người thuộc diện được miễn thu lệ phí theo quyết định cụ thể của Bộ trưởng Bộ Ngoại giao, Bộ trưởng Bộ Công an, Bộ trưởng Bộ Quốc phòng.

Những trường hợp được miễn thu lệ phí quy định trên đây, cơ quan thu lệ phí phải đóng dấu "miễn thu lệ phí" (GRATIS) vào giấy tờ đã cấp.

Trường hợp người Việt Nam và người nước ngoài đã nộp lệ phí cấp hộ chiếu, giấy tờ có liên quan gắn liền việc cấp hộ chiếu và thị thực nhưng không đủ điều kiện được cấp những giấy tờ này thì cơ quan thu lệ phí thực hiện hoàn trả số tiền lệ phí đã thực nộp khi có thông báo không đủ điều kiện được cấp bằng nguồn tiền thu lệ phí xuất nhập cảnh.

2. Điểm 1, Phụ lục 1 Biểu mức thu lệ phí cấp hộ chiếu, thị thực và các loại giấy tờ về xuất cảnh, nhập cảnh, quá cảnh và cư trú tại Việt Nam ban hành kèm theo Thông tư số 37/2003/TT-BTC nêu trên được thay thế bằng điểm 1 mới như sau:

3. Điểm 2, Mục II Thông tư số 37/2003/TT-BTC nêu trên được sửa đổi, bổ sung như sau:

3.1. Tiết e điểm này được thay thế bằng tiết e mới như sau:

e. Chi mua sắm vật tư, công cụ, thiết bị làm việc và các khoản chi thường xuyên khác liên quan trực tiếp đến việc thu lệ phí.

3.2. Bổ sung thêm vào cuối điểm 2 này như sau:

Bộ Công an, Bộ Ngoại giao, Bộ Quốc phòng thực hiện điều hoà số tiền được trích (30% trên tổng số tiền thực thu được) giữa các đơn vị thu lệ phí xuất nhập cảnh thuộc nội bộ ngành để đảm bảo chi phí phục vụ cho việc thu lệ phí xuất nhập cảnh.

4. Thông tư này có hiệu lực thi hành sau 15 ngày kể từ ngày đăng Công báo. Những nội dung không sửa đổi, bổ sung tại Thông tư này vẫn thực hiện theo quy định tại Thông tư số 37/2003/TT-BTC ngày 24/4/2003 của Bộ Tài chính quy định chế độ thu, nộp và quản lý sử dụng lệ phí cấp hộ chiếu, thị thực và giấy tờ về nhập cảnh, xuất cảnh, quá cảnh và cư trú tại Việt Nam.

Trong quá trình thực hiện nếu có vướng mắc, đề nghị các tổ chức, cá nhân phản ánh về Bộ Tài chính để xem xét giải quyết.

CIRCULAR

AMENDING AND SUPPLEMENTING THE FINANCE MINISTRY’S CIRCULAR No. 37/2003/TT-BTC OF APRIL 24, 2003, WHICH PROVIDES FOR THE REGIME ON COLLECTION, REMITTANCE AND USE MANAGEMENT OF FEES FOR THE GRANT OF PASSPORTS, VISAS AND PAPERS FOR ENTRY, EXIT, TRANSIT AND RESIDENCE IN VIETNAM

Pursuant to the Ordinance on Charges and Fees and the Government’s Decree No. 57/2002/ND-CP of June 3, 2002, detailing the implementation of the Ordinance on Charges and Fees;
Pursuant to the Ordinance on Entry, Exit and Residence of Foreigners in Vietnam and the Government’s Decree No. 21/2001/ND-CP of May 28, 2001, detailing the implementation of the Ordinance on Entry, Exit and Residence of Foreigners in Vietnam;
Pursuant to the Government’s Decree No. 05/2000/ND-CP of March 3, 2000, on exit and entry of Vietnamese citizens;
Pursuant to the Prime Minister’s Decision No. 875/QD-TTg of November 21, 1996, permitting overseas Vietnamese to repatriate to Vietnam,
After obtaining agreements with the Ministry of Public Security, the Ministry of Foreign Affairs and the Ministry of Defense, the Ministry of Finance hereby amends and supplements its Circular No. 37/2003/TT-BTC of April 24, 2003, providing for the regime on collection, remittance and use management of fees for the grant of passports, visas and papers for entry, exit, transit and residence in Vietnam as follows:

1. Point 2, Section I of Circular No. 37/2003/TT-BTC is replaced with the following new one:

2. Vietnamese citizens, when submitting applications to competent agencies under the Ministry of Public Security, the Ministry of Foreign Affairs or the Ministry of Defense for passports (including new ones and for substitutes of damaged or lost ones) and papers related to the grant thereof (if any), and foreigners, when being granted visas by such agencies; or Vietnamese and foreigners, when being granted assorted papers for entry, exit, transit or residence in Vietnam, must pay fees according to the provisions of this Circular, except for the following cases of exemption from the payment thereof:

a/ Guests (including their spouses and children) of the Party, State, Government or National Assembly or the Party, State, Government or National Assembly leaders in their personal capacity.

b/ Officials and employees of foreign diplomatic representations, consular offices and Vietnam-based representative offices of international organizations, and their family members (spouses and under-18 children living together with them in a household) other than Vietnamese citizens and not permanently residing in Vietnam, who are eligible for fee exemption on the basis of reciprocity.

c/ Foreigners bearing diplomatic passports, official passports or general passports issued by foreign countries, who are eligible for fee exemption on the basis of reciprocity.

e/ Foreigners entering Vietnam to provide humanitarian aid or assistance to Vietnamese organizations and individuals.

g/ Those who are eligible for fee exemption under specific decisions of the Minister of Foreign Affairs, the Minister of Public Security or the Minister of Defense.

For the above-said cases of fee exemption, the fee-collecting agencies must affix the “free of charge” (GRATIS) stamps on the granted papers.

Where Vietnamese and foreigners have paid fees for the grant of passports and papers related to passport/visa grant but are ineligible for being granted such papers, the fee-collecting agencies shall refund the actually paid fee amounts from the source of exit/entry fee revenues after receiving notices on the ineligibility for such grant.

2. Point 1, Appendix I on the Table of fees for the grant of passports, visas and assorted papers for exit, entry, transit or residence in Vietnam, issued together with Circular No. 37/2003/TT-BTC, is replaced with the following new one:

3. Point 2, Section II of Circular No. 37/2003/TT-BTC is amended and supplemented as follows:

3.1. Item e of this Point is replaced with the following:

e/ Expenses for purchase of supplies, tools and working equipment, and other regular expenses directly related to the collection of fees.

3.2. To add to the end of this Point 2 the following:

The Ministry of Public Security, the Ministry of Foreign Affairs and the Ministry of Defense shall regulate the deducted fee amounts (30% of the total actually collected amounts) among the exit/entry fee-collecting units under their respective management in order to ensure sufficient funds for the collection of exit/entry fees.

4. This Circular takes effect 15 days after its publication in “CONG BAO.” The matters not amended or supplemented in this Circular shall still comply with the provisions of the Finance Ministry’s Circular No. 37/2003/TT-BTC of April 24, 2003, providing for the regime on collection, remittance and use management of fees for the grant of passports, visas and papers for exit, entry, transit and residence in Vietnam.

Should any problems arise in the course of implementation, organizations and individuals are requested to report them to the Finance Ministry for study and settlement.
