DIRECTIVE
ON
CORRECTING THE CLASSIFICATION, COLLECTION, TRANSPORT AND TREATMENT OR
DESTRUCTION OF NORMAL SOLID WASTE AND HAZARDOUS WASTE APPLICABLE TO INDUSTRIAL
ZONES, INDUSTRIAL CLUSTERS IN DONG NAI PROVINCE
During last years, the collection,
transport and treatment of destruction of solid waste in urban areas,
industrial zones, industrial clusters in province have been paid attention to
implement by branches, levels and attained defined results. However, the
classification, collection, transport are not proper with regulation and the
treatment or destruction of waste are still not thoroughly, cause pollution of
surface water, underground water sources and influences on life of people.
Aiming to enhance enforcement of
state management, effectiveness of the classification, collection, transport,
treatment of destruction of normal solid waste, hazardous waste, to improve
quality of habitat, to meet the higher and higher requirement of society, to
create firm basis for sustainable development; the provincial People’s
Committee directs all provincial-level departments, sectors, People’s
Committees of districts, Long Khanh town, Bien Hoa city and companies doing
business in infrastructure of industrial zones, industrial clusters and
enterprises in industrial zones, industrial clusters in immediately correcting
activities of classification, collection, transport, handling, destruction of
normal waste and hazardous waste in Dong Nai province as follows:
1. To assign task for companies
doing business in infrastructure of industrial zones, industrial clusters in
province to classify, collect, store and transfer of normal solid waste and
hazardous waste in scope of industrial zones and industrial clusters of which
such companies are investors with content and roadmap as follows:
a) For 21 industrial zones and
industrial clusters (under the enclosed list) which have put in operation,
expeditiously implement not later than December 2010:
- Adding operation trades and
license of hazardous waste transport practicing in according to guides in the Circular
No. 12/2006/TT-BTNMT, of December 26, 2006 of the Ministry of Natural Resources
and Environment on guiding the practice conditions, procedures for compilation
of dossiers, registration and licensing of practice and hazardous waste
management identification numbers.
- To arrange human staff,
transshipment locations, storage warehouses, equipments, tools to collect,
concentrate normal solid waste, hazardous waste and to meet requirements of
receipt of waste classified at source from enterprises in industrial
zones, industrial clusters.

- To strengthen inspection,
supervision and compilation of roadmap in order to ensure 100% of enterprises
implementing classification of waste at source in accordance with regulation
and conclude contracts with functional units in order to transport, treat,
destruct and propose measures to handle enterprises in industrial zones,
industrial clusters failing to implement properly regulation.
b) 8 industrial zones and 29
industrial clusters (under the enclose list) which have not yet put into
operation: To strictly implement Article 36 - the 2005 Law on Environment
protection, the Circular No. 08/2009/TT-BTNMT, of July 15, 2009 of the Ministry
of Natural Resources and Environment, content of environmental impact
assessment reports and decision on ratify of approved environmental impact
assessment reports, including the classification, collection, storage and
transfer normal solid waste, hazardous waste in accordance with regulation
before these industrial zones, industrial clusters are put into official
operation.
2. Enterprises in industrial
zones, industrial clusters shall:
- To arrange, equip full means,
equipment for collection and storage of normal solid waste, hazardous waste; to
implement thoroughly classification of waste at source in conformity with
purpose of recycling, treatment and destruction.
- To conclude contract with
companies doing business in infrastructure of industrial zones, industrial
clusters for collection, transport of normal solid waste, hazardous waste
according to regulation, not later than December 2010.
3. The management boards of
industrial zones shall: To assume the prime responsibility for, and coordinate
with the provincial Department of Natural Resources and
Environment in inspection of classification, collection, transport, treatment,
destruction of normal solid waste, hazardous waste of enterprises in industrial
zones, industrial clusters and companies doing business in infrastructure in
accordance with regulation.
4. The provincial Transport
Department: To assume the prime responsibility for, and coordinate with
relevant branches, levels in formulation and submission to the provincial
People’s Committee for promulgation of regulations on routes and times for
transport of hazardous waste in province properly with regulations on
environmental protection in transport of hazardous waste and regulations on
road traffic.
5. The provincial Construction
Department:
- To accelerate formulation and
submission for approval and implementation of the planning on solid waste
management by 2015 and oriented till 2025 in province.

6. The provincial department of
Natural Resources and Environment:
- To assume the prime
responsibility for, and coordinate with relevant branches, levels in
supervision and inspection of the collection, transport and treatment of
hazardous waste, normal solid waste of industrial zones, industrial clusters in
province.
- Quarterly, to report situation,
result of management of hazardous waste, normal solid waste; difficulties and
propose the next handling measures, to the provincial People’s Committee.
7. People’s Committees of
districts, Long Khanh town and Bien Hoa city:
- To formulate scheme on
collection, transport, storage and treatment of normal solid waste, hazardous
waste of enterprises outside of industrial zones or clusters in province; and
make plan on closure of spontaneous garbage dumps which are not suitable with
planning and cause environment pollution; have plan on handling and restoring
of environment at polluted places persisted in these zones.
- To direct divisions of Natural
Resources and Environment in strengthening inspection, supervision of
implementation of regulations on environment protection of facilities of scrap
collection and purchase and enterprises in locality under decentralization.
- To coordinate with functional
branches in strengthening inspection, examination, timely detecting, proposing
the handling under their competence for acts violating law on environment
protection, especially being activities of collection, treatment of normal
solid waste, hazardous waste and solid waste landfills contrary to regulations.
To request departments, sectors;
People’s Committees of district, Long Khanh town and Bien Hoa city; the
companies doing business in infrastructure of industrial zones, industrial
clusters for expeditious strict implementation of this Directive. In the course
of implementation, any arising problems should be reported to the Ministry of
Natural Resources and Environment for summarizing, report and consult with the
provincial People’s Committee.
