QUYẾT ĐỊNH

PHÊ DUYỆT KHUNG GIÁ PHÁT ĐIỆN NHÀ MÁY ĐIỆN SINH KHỐI NĂM 2025

Căn cứ Luật Điện lực ngày 30 tháng 11 năm 2024;

Căn cứ Nghị định số 40/2025/NĐ-CP ngày 26 tháng 02 năm 2025 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Công Thương;

Căn cứ Thông tư số 09/2025/TT-BCT ngày 01 tháng 02 năm 2025 của Bộ trưởng Bộ Công Thương quy định hồ sơ, trình tự, thủ tục, phương pháp xác định, phê duyệt khung giá phát điện; quy định hồ sơ, trình tự, thủ tục xây dựng, phê duyệt khung giá nhập khẩu điện;

Xét đề nghị của Tập đoàn Điện lực Việt Nam tại văn bản số 1771/EVN-TTĐ ngày 20 tháng 3 năm 2025;

Theo đề nghị của Cục trưởng Cục Điện lực.

QUYẾT ĐỊNH:

Điều 1. Ban hành khung giá phát điện nhà máy điện sinh khối năm 2025

Khung giá phát điện năm 2025 áp dụng cho nhà máy điện sinh khối quy định tại điểm a khoản 2 Điều 1 Thông tư số 09/2025/TT-BCT ngày 01 tháng 02 năm 2025 của Bộ trưởng Bộ Công Thương quy định hồ sơ, trình tự, thủ tục, phương pháp xác định, phê duyệt khung giá phát điện; quy định hồ sơ, trình tự, thủ tục xây dựng, phê duyệt khung giá nhập khẩu điện được quy định như sau:

Khung giá phát điện cho nhà máy điện sinh khối năm 2025 là: 0 - 2.091,74 đồng/kWh (chưa bao gồm thuế giá trị gia tăng). Trong đó, mức giá tối đa là 2.091,74 đồng/kWh.

Điều 2. Tổ chức thực hiện

Căn cứ khung giá phát điện nhà máy điện sinh khối quy định tại Điều 1 Quyết định này, Tập đoàn Điện lực Việt Nam và đơn vị phát điện ký kết hợp đồng mua bán điện trên cơ sở tuân thủ quy định về phương pháp xác định giá dịch vụ phát điện do Bộ trưởng Bộ Công Thương ban hành.

Điều 3. Điều khoản thi hành

1. Quyết định này có hiệu lực thi hành kể từ ngày ký.

2. Khung giá phát điện cho nhà máy điện sinh khối năm 2025 tại Quyết định này được áp dụng kể từ ngày các Quyết định số 24/2014/QĐ-TTg ngày 24 tháng 3 năm 2014 của Thủ tướng Chính phủ về cơ chế hỗ trợ phát triển các dự án điện sinh khối tại Việt Nam, Quyết định số 08/2020/QĐ-TTg ngày 05 tháng 3 năm 2020 của Thủ tướng Chính phủ sửa đổi, bổ sung một số điều của Quyết định số 24/2014/QĐ-TTg hết hiệu lực.

3. Chánh Văn phòng Bộ, Cục trưởng Cục Điện lực, Vụ trưởng Vụ Pháp chế, Thủ trưởng các đơn vị thuộc Bộ, Tổng Giám đốc Tập đoàn Điện lực Việt Nam và Thủ trưởng các đơn vị phát điện có liên quan chịu trách nhiệm thi hành Quyết định này./.

DECISION

APPROVING THE GENERATION PRICE BRACKET FOR BIOMASS POWER PLANTS IN 2025

THE MINISTER OF INDUSTRY AND TRADE

Pursuant to Law on Electricity dated November 30, 2024;

Pursuant to Decree No. 40/2025/ND-CP dated February 26, 2025, of the Government on the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to Circular No. 09/2025/TT-BCT dated February 1, 202,5 of the Minister of Industry and Trade on the documentation, procedures, methods for determining and approving the price bracket for electricity generation; documentation, procedures for developing and approving the price bracket for imported electricity;

Considering the request of the Vietnam Electricity (EVN) in document No. 1771/EVN-TTD dated March 20, 2025;

At the request of Director General of Electricity Authority of Vietnam.

Article 1. Issuance of the generation price bracket for biomass power plants in 2025

The generation price bracket for biomass power plants in 2025 specified in Point a of Clause 2 of Article 1 of Circular No. 09/2025/TT-BCT dated February 1, 2025 of the Minister of Industry and Trade on the documentation, procedures, methods for determining and approving the price bracket for electricity generation; documentation, procedures for developing and approving the price bracket for imported electricity is specified as follows:

The generation price bracket for biomass power plants in 2025: 0 - 2.091,74 VND/kWh (VAT not included). Where: the maximum price is 2.091,74 VND/kWh.

Article 2. Implementation

Pursuant to the generation price bracket for biomass power plants specified in Article 1 hereof, EVN and the power generating unit shall sign a power purchase agreement in compliance with the regulations on the method of determining the electricity generation service price issued by the Minister of Industry and Trade.

Article 3. Implementation clauses

1. This Decision comes into force from the date on which it is signed

2. The generation price bracket for biomass power plants in 2025 specified herein shall apply from the date of expiry of Decision No. 24/2014/QD-TTg dated March 24, 2014 of the Prime Minister on support development mechanism for biomass power projects in Vietnam and Decision No. 08/2020/QD-TTg dated March 5, 2020 of the Prime Minister amending Decision No. 24/2014/QD-TTg.

3. The Chief of the Ministry Office, Director General of the Department of Legal Affairs, Heads of units affiliated to the Ministry, General Director of EVN and Heads of relevant power generating units are responsible for implementing this Decision./.
