CIRCULAR
ON ENERGY LABELING FOR ENERGY-USING
EQUIPMENT UNDER MANAGEMENT OF THE MINISTRY OF CONSTRUCTION
Pursuant to the Law on
Economical and Efficient Use of Energy No. 50/2010/QH12; the Law providing
amendments to 11 Laws concerning planning No. 28/2018/QH14; the Law providing
amendments to the Law on Economical and Efficient Use of Energy No.
77/2025/QH15;
Pursuant to the Decree
elaborating and providing measures for implementation of the Law on Economical
and Efficient Use of Energy;
Pursuant to the
Government’s Decree No. 33/2025/ND-CP dated February 25, 2025 defining
functions, tasks, powers and organizational structure of the Ministry of
Construction of Vietnam;
At the request of the
Director of Vietnam Register;
The Minister of
Construction of Vietnam promulgates a Circular prescribing energy labeling for
energy-using equipment under the management of the Ministry of Construction.

1. Scope
1. This Circular provides
guidelines for implementation of provisions of clause 3 Article 39 of the Law
on Economical and Efficient Use of Energy No. 50/2010/QH12, as amended by
clause 17 Article 1 of the Law No. 77/2025/QH15 providing amendments to the Law
on Economical and Efficient Use of Energy regarding energy labeling for
energy-using equipment.
2. This Circular shall not
apply to:
a) Manufactured, installed
or assembled, or imported equipment under the management of the Ministry of
National Defence of Vietnam or the Ministry of Public Security of Vietnam;
b) Equipment temporarily
imported for re-export; in transit or transshipped; equipment of diplomatic or
consular missions.
This Circular applies to
manufacturers, importers, distributors and traders of energy-using equipment,
including those operating on e-commerce platforms, as well as testing laboratories
responsible for determining the energy consumption of such equipment falling
under the management of the Ministry of Construction of Vietnam.

LABELING FOR EQUIPMENT
Article
3. General provisions on energy labeling for equipment
The energy consumption
rate indicated on the energy label of any equipment shall be consistent with
that specified in the energy consumption test report, in accordance with
regulations of the Minister of Construction on procedures for certification of
technical safety quality and environmental protection for manufactured,
assembled, and imported motor vehicles, special-purpose vehicles, and motor
vehicle parts.

Mandatory information and
specifications of energy labels of equipment shall comply with the form in Appendix
II enclosed herewith.
Testing laboratories
responsible for determining the energy consumption of equipment are
laboratories of organizations providing product and goods quality testing
services that meet the requirements set forth in Article 5 of the Government’s
Decree No. 107/2016/ND-CP dated July 01, 2016 regarding conditions for
provision of conformity assessment services, as amended by the Government’s Decree
No. 154/2018/ND-CP providing amendments to and abrogating certain regulations
on investment and business conditions in the fields falling under management of
Ministry of Science and Technology and certain regulations on specialized
inspections.
1. Receipt of applications
for declaration of energy labeling for equipment
Manufacturers, importers,
distributors and traders shall submit their applications for energy labeling
declaration directly, by post or online, as prescribed in the Government’s
Decree elaborating and providing measures for implementation of the Law on
Economical and Efficient Use of Energy, to Vietnam Register.
2. The form of energy
labeling declaration shall be made using the form in Appendix III enclosed
herewith.
3. Vietnam Register shall
publish information on energy labeling for equipment of a manufacturer,
importer, distributor or trader on its web portal within 05 working days from
its receipt of an application for energy labeling declaration.
4. Guidelines on energy
labeling
a) Importers and
manufacturers shall print energy labels which must comply with the form in
Appendix II enclosed herewith, and affix them to their equipment.

For a vehicle equipped
with neither fixed side windows nor a rear windscreen, or where affixing the
energy label on the inside does not ensure clear visibility, the energy label
may be affixed on the outside of the vehicle at a readily visible position.
1. Foreign energy labels
on imported equipment shall be recognized in accordance with international
treaties to which the Socialist Republic of Vietnam is a signatory.
2. Where the energy label of
imported equipment is recognized in accordance with international treaties to
which the Socialist Republic of Vietnam is a signatory, the importer,
distributor, or trader of such equipment shall affix a supplementary label
displaying the Vietnamese translation of the information contained on the
foreign energy label at a position adjacent to the foreign energy label.
1. Vietnam Register shall
suspend the energy labeling for equipment in accordance with provisions of the
Government’s Decree elaborating and providing measures for implementation of
the Law on Economical and Efficient Use of Energy. Such suspension shall be
made using the form in the Appendix V enclosed with.
2. Vietnam Register shall
request manufacturers, importers, distributors and traders of equipment to
carry out recall of energy labels in accordance with provisions of the
Government’s Decree elaborating and providing measures for implementation of
the Law on Economical and Efficient Use of Energy. Such request for recall of
energy labels issued by Vietnam Register shall be made using the form in
Appendix V enclosed with.
RESPONSIBILITIES
OF RELEVANT ORGANIZATIONS AND INDIVIDUALS
Article
10. Responsibilities of manufacturers, importers,
distributors and traders
1. Comply with the
regulations on energy labeling for equipment as prescribed in this Circular.
2. Prepare reports as
prescribed in the Government’s Decree elaborating and providing measures for
implementation of the Law on Economical and Efficient Use of Energy, and submit
them to Vietnam Register. The report form is available in Appendix IV enclosed
herewith.

2. Inspect the conduct of
equipment testing for energy labeling at testing laboratories.
3. Carry out suspension
and recall of energy labels of equipment as prescribed.
IMPLEMENTATION
Article
12. Implementation
1. This Circular comes
into force from January 01, 2026.
2. Energy labels of
equipment types which have been granted certificates of energy consumption
rates or certificates of technical safety and environmental protection, and
energy consumption rates before the effective date of this Circular shall
continue to be used until December 31, 2027 inclusively.
3. Testing laboratories
conducting energy consumption testing for energy-using equipment under the
management of the Ministry of Construction before the effective date of this
Circular may continue to carry out such testing until December 31, 2027
inclusively.
4. The following Circulars
and Articles are abrogated from the effective date of this Circular:
a) The Joint Circular No.
43/2014/TTLT-BGTVT-BCT dated September 24, 2014 of the Minister of Transport of
Vietnam and the Minister of Industry and Trade of Vietnam;

c) Appendix XIX of the
Circular No. 54/2024/TT-BGTVT dated November 15, 2024 of the Minister of
Transport of Vietnam;
d) Article 18 of the
Circular No. 55/2024/TT-BGTVT dated November 15, 2024 of the Minister of
Transport of Vietnam;
dd) Appendix XV of the
Circular No. 55/2024/TT-BGTVT dated November 15, 2024 of the Minister of
Transport of Vietnam./.
