NGHỊ QUYẾT

VỀ VIỆC GHI NHẬN THỜI GIAN ĐÓNG BẢO HIỂM XÃ HỘI BẮT BUỘC CỦA CHỦ HỘ KINH DOANH ĐÃ THAM GIA TRƯỚC NGÀY LUẬT BẢO HIỂM XÃ HỘI SỐ 41/2024/QH15 CÓ HIỆU LỰC THI HÀNH

Căn cứ Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam;

Căn cứ Luật Tổ chức Quốc hội số 57/2014/QH13 đã được sửa đổi, bổ sung một số điều theo Luật số 65/2020/QH14 và Luật số 62/2025/QH15;

Căn cứ Nghị quyết số 142/2024/QH15 ngày 29/6/2024 của Quốc hội về Kỳ họp thứ 7, Quốc hội khóa XV;

Sau khi xem xét Tờ trình số 177/TTr-CP ngày 09/4/2025 của Chính phủ; Báo cáo thẩm tra số 436/BC-UBVHXH15 ngày 15/5/2025 của Ủy ban Văn hóa và Xã hội;

QUYẾT NGHỊ:

Điều 1. Ghi nhận thời gian đã đóng bảo hiểm xã hội bắt buộc của chủ hộ kinh doanh

1. Ghi nhận thời gian chủ hộ kinh doanh đã đóng bảo hiểm xã hội bắt buộc trước ngày 01 tháng 7 năm 2025 để làm căn cứ giải quyết chế độ bảo hiểm xã hội theo quy định của pháp luật về bảo hiểm xã hội.

2. Chủ hộ kinh doanh đã đủ điều kiện hưởng chế độ bảo hiểm xã hội trước ngày Nghị quyết này có hiệu lực thi hành thì được giải quyết hưởng chế độ bảo hiểm xã hội kể từ ngày đủ điều kiện hưởng chế độ bảo hiểm xã hội theo quy định.

Điều 2. Tổ chức thực hiện

1. Giao Chính phủ:

a) Chỉ đạo, hướng dẫn tổ chức thực hiện Nghị quyết này; chủ động giải quyết những vướng mắc phát sinh trong triển khai thực hiện; bảo đảm quyền lợi cho chủ hộ kinh doanh trong giải quyết chế độ bảo hiểm xã hội;

b) Báo cáo kết quả thực hiện Nghị quyết này trong báo cáo tình hình thực hiện chính sách, chế độ bảo hiểm xã hội và tình hình quản lý, sử dụng quỹ bảo hiểm xã hội theo quy định của Luật Bảo hiểm xã hội.

2. Hội đồng Dân tộc, các Ủy ban của Quốc hội, Đoàn đại biểu Quốc hội, đại biểu Quốc hội và Ủy ban Trung ương Mặt trận Tổ quốc Việt Nam, trong phạm vi nhiệm vụ, quyền hạn của mình, giám sát việc thực hiện Nghị quyết này.

Điều 3. Hiệu lực thi hành

Nghị quyết này có hiệu lực thi hành từ ngày 01 tháng 7 năm 2025.

Nghị quyết này được Ủy ban Thường vụ Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XV, phiên họp thứ 45 thông qua ngày 17 tháng 5 năm 2025.

RESOLUTION

REGARDING  RECOGNITION OF THE PERIOD OF COMPULSORY SOCIAL INSURANCE PREMIUM PAYMENT BY HOUSEHOLD BUSINESS OWNERS WHO PARTICIPATED PRIOR TO THE EFFECTIVE DATE OF THE LAW ON SOCIAL INSURANCE NO. 41/2024/QH15

STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

Pursuant to the Constitution of the Socialist Republic of Vietnam;

Pursuant to the Law on Organization of the National Assembly No. 57/2014/QH13 amended by Law No. 65/2020/QH14 and Law No. 62/2025/QH15;

Pursuant to Resolution No. 142/2024/QH15 dated June 29, 2024 of the National Assembly on the 7th meeting of the 15th National Assembly;

After consideration of the Government’s Proposal No. 177/TTr-CP dated April 09, 2025, and the Appraisal Report No. 436/BC-UBVHXH15 dated May 15, 2025 of the Committee for Culture and Social Affairs;

HEREBY RESOLVES:

1. The period during which household business owners have paid compulsory social insurance premiums prior to july 1, 2025 will be recognized as the basis for determining their entitlement to social insurance benefits in accordance with the law on social insurance.

2. Household business owners who were eligible for social insurance benefits prior to the effective date of this Resolution shall be entitled to such benefits from the date they became eligible in accordance with the law.

Article 2. Implementation

1. The Government shall:

a) Direct and provide guidance on the implementation of this Resolution; proactively address issues that arise during implementation; and ensure the legitimate rights and interests of household business owners in the settlement of social insurance benefits;

b) Include the implementation results of this Resolution in the report on the implementation of social insurance policies and benefits, and the management and use of the social insurance fund as prescribed by the Law on Social Insurance.

2. The Ethnic Council, the Committees of the National Assembly, the Delegations and Deputies of the National Assembly, and the Central Committee of the Vietnam Fatherland Front shall, within their jurisdiction, supervise the implementation of this Resolution.

Article 3. Entry into force

This Resolution comes into force  from April 1, 2025.
