CỦA THỦ TƯỚNG CHÍNH PHỦ SỐ 100/2004/QĐ-TTG NGÀY 02 THÁNG 6
NĂM 2004 VỀ VIỆC PHÊ DUYỆT ĐỀ ÁN THÀNH LẬP VÀ TĂNG CƯỜNG CƠ QUAN THƯƠNG VỤ VIỆT
NAM Ở NƯỚC NGOÀI GIAI ĐOẠN 2004-2005

Căn cứ Luật Tổ chức Chính phủ
ngày 25 tháng 12 năm 2001;
Căn cứ Pháp lệnh về Cơ quan đại diện nước Cộng hoà xã hội chủ nghĩa Việt Nam
ở nước ngoài ngày 02 tháng 12 năm 1993;
Theo đề nghị của Bộ trưởng Bộ Thương mại,
QUYẾT ĐỊNH:
Điều 1. Phê
duyệt Đề án Thành lập và tăng cường cơ quan thương vụ Việt Nam ở nước ngoài giai
đoạn 2004-2005 với những nội dung chủ yếu sau:
1. Mục tiêu của
Đề án:
Thành lập và tăng cường cơ quan
thương vụ Việt Nam ở nước ngoài giai đoạn 2004-2005 để từng bước hoàn thiện hệ
thống cơ quan thương vụ Việt Nam ở nước ngoài, thúc đẩy quan hệ kinh tế -
thương mại, mở rộng thị trường, đáp ứng yêu cầu hội nhập và phát triển kinh tế
của Việt Nam trong khu vực và quốc tế nhằm mục đích đạt mục tiêu tăng kim ngạch
xuất khẩu đã được đề ra trong Đề án phát triển thị trường xuất khẩu hàng hoá
giai đoạn 2004-2005 đã được Thủ tướng Chính phủ phê duyệt tại Quyết định số
266/2003/QĐ-TTg ngày 17 tháng 12 năm 2003 và Chiến lược phát triển xuất-nhập khẩu
hàng hoá và dịch vụ thời kỳ 2001-2010.
2. Nội dung chủ
yếu của Đề án:
a. Xếp sắp lại, tăng cường các bộ
phận thương vụ hiện có.
b. Thành lập mới cơ quan thương
vụ Việt nam ở các nước và vùng lãnh thổ: Tây-ban-nha, Hà-lan, Thuỵ-sỹ,
Bê-la-rus, Mê-hi-cô, Chi-lê, Bra-xin, Pa-ki-xtan, Ma-rốc, Ni-giê-ria, Li-băng,
Hồng Kông (Trung Quốc), Niu Di-lân.
Mỗi cơ quan thương vụ thành lập
mới được bố trí 02 biên chế.
c. Bộ Thương mại trao đổi, thống
nhất với Bộ Nội vụ và Bộ Tài chính về việc điều chỉnh biên chế của các cơ quan
thương vụ tại Nhật Bản, Bỉ, Trung Quốc, Nga, U-cra-i-na và U-dơ-bê-kit-xtan.
d. Hàng năm, Bộ Thương mại xây dựng
dự toán kinh phí cấp cho các cơ quan thương vụ trình cơ quan có thẩm quyền phê
duyệt căn cứ vào số lượng biên chế, nhiệm vụ được giao, địa bàn hoạt động, nhu
cầu tìm kiếm, thu thập thông tin và kế hoạch công tác của từng thương vụ.
đ. Để bảo đảm trụ sở làm việc
cho hệ thống cơ quan thương vụ, Bộ thương mại làm việc với Bộ Tài chính và Bộ
Ngoại giao lập dự toán ngân sách trình các cơ quan có thẩm quyền xem xét, quyết
định.
e. Căn cứ nhu cầu công tác của từng
địa bàn, Bộ Thương mại lựa chọn và đề nghị Bộ Ngoại giao bổ nhiệm hàm ngoại
giao cho cán bộ làm việc tại các cơ quan thương vụ theo quy định của Pháp lệnh
về hàm, cấp ngoại giao và Nghị định số 13/CP ngày 16/3/1996 của Chính phủ hướng
dẫn thi hành Pháp lệnh này.
Điều 2.
Kinh phí thực hiện Đề án này được bố trí trong dự toán ngân sách hàng năm của Bộ
Thương mại được cơ quan có thẩm quyền phê duyệt.
Điều 3.
Tổ chức thực hiện
1. Bộ Thương mại chủ trì, phối hợp
với Bộ Ngoại giao, Bộ Tài chính và Bộ Nội vụ triển khai thực hiện việc thành lập
mới các cơ quan thương vụ theo lộ trình sau:
- Trong năm 2004, thực hiện việc
thành lập các cơ quan thương vụ Việt Nam tại các nước và vùng lãnh thổ:
Tây-ban-nha, Thuỵ-sỹ, Hà-lan, Ma-rốc, Niu Di-lân, Bê-la-rus, Chi-lê và Hồng
Kông (Trung Quốc).
- Trong năm 2005, thực hiện việc
thành lập các cơ quan thương vụ Việt Nam tại các nước: Ni-giê-ria, Mê-hi-cô,
Bra-xin, Pa-ki-xtan và Li-băng.
2. Bộ Thương mại chủ trì, phối hợp
với Bộ Ngoại giao và Bộ Nội vụ bố trí biên chế, tổ chức thi tuyển và bổ nhiệm cán
bộ có đủ tiêu chuẩn, trình độ công tác tại các cơ quan thương vụ Việt Nam ở nước
ngoài.
3. Bộ Tài chính phối hợp với Bộ
Thương mại lập dự toán ngân sách của Bộ Thương mại để trình các cơ quan có thẩm
quyền phê duyệt, đáp ứng yêu cầu thực hiện các nội dung của Đề án này.
Điều 4.
Quyết định này có hiệu lực thi hành sau 15 ngày, kể từ ngày đăng Công báo.
Điều 5.
Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ
chịu trách nhiệm thi hành Quyết định này.

DECISION APPROVING THE SCHEME ON
ESTABLISHMENT AND STRENGTHENING OF VIETNAM'S FOREIGN-BASED TRADE OFFICES IN THE
2004-2005 PERIOD THE PRIME MINISTER Pursuant to the December 25, 2001 Law on Organization of the
Government;
Pursuant to the December 2, 1993 Ordinance on Representation Offices of the
Socialist Republic of Vietnam in foreign countries;
At the proposal of the Trade Minister, DECIDES: Article 1.- To approve the Scheme on
Establishment and Strengthening of Vietnam's Foreign-Based Trade Offices in the
2004-2005 period with the following principal contents: 1. The Scheme's objectives: To establish and strengthen Vietnam's trade offices overseas
in the 2004-2005 period in order to step by step perfect the system of
Vietnamese trade offices overseas, to boost trade-economic relations, expand
markets, satisfy the requirements of Vietnam's economic integration and
development in the region and the world, aiming to achieve the export turnover
growth targets set in the scheme on development of goods export market in the
2004-2005 period, already approved by the Prime Minister in Decision No. 266/2003/QD-TTg
of December 17, 2003 and the Strategy on goods and service export- import
development in the 2001-2010 period. ... ... ... Please sign up or sign in to your Pro Membership to see English documents. a) To reorganize and strengthen the existing trade offices. b) To establish Vietnam's new trade offices in the following
foreign countries and territory: Spain, the Netherlands, Switzerland, Belarus,
Mexico, Chile, Brazil, Pakistan, Morocco, Nigeria, Lebanon, Hong Kong (China),
New Zealand. Each newly-established trade office shall be staffed with 2
members. c) The Trade Ministry shall consult and reach agreement with
the Ministry of Home Affairs and the Finance Ministry on the adjustment of the
staff of trade offices in Japan, Belgium, China, Russia, Ukraine and
Uzbekistan. d) Annually, the Trade Ministry shall estimate the funding
to be allocated to trade offices and submit it to competent bodies for
approval, basing itself on the number of staff members, assigned tasks,
operation areas, information search and gathering demands and working plan of
each trade office. e) To ensure the working offices for the system of trade
offices, the Trade Ministry shall work with the Finance Ministry and the
Foreign Ministry in elaborating budget estimates and submit them to competent
bodies for consideration and decisions. f) Basing itself on the working demands of each geographical
area, the Trade Ministry shall select and propose the Foreign Ministry to
confer diplomatic titles on officials working at the trade offices under the
provisions of the Ordinance on Diplomatic Titles and Ranks and the Government's
Decree No. 13/CP of March 16, 1996 guiding the implementation of this
Ordinance. Article 2.- The funding for realization of this
Scheme shall be included in the annual budget estimate of the Trade Ministry and

following countries and territory: Spain, Switzerland, the Netherlands,
Morocco, New Zealand, Belarus, Chile and Hong Kong (China). - In 2005, to establish Vietnamese trade offices in the
following countries: Nigeria, Mexico, Brazil, Pakistan and Lebanon. 2. The Trade Ministry shall assume the prime responsibility
for, and coordinate with the Foreign Ministry and the Ministry of Home Affairs
in, arranging payroll, organizing recruitment examinations and appointing
officials fully satisfying the criteria and qualifications for working at
Vietnam's trade offices overseas. 3. The Finance Ministry shall coordinate with the Trade
Ministry in elaborating the budget estimate of the Trade Ministry for
submission to competent bodies for approval, meeting the requirements on
materialization of the contents of this Scheme. Article 4.- This Decision takes implementation
effect 15 days after its publication in the Official Gazette. Article 5.- The ministers, the heads of the
ministerial-level agencies and the heads of the Government-attached agencies
