CIRCULAR

ON APPLICATION OF STANDARDS AND TECHNOLOGY ASSISTING PERSONS WITH DISABILITIES TO ACCESS AND USE INFORMATION AND COMMUNICATIONS PRODUCTS AND SERVICES

Pursuant to the Law on Technical Regulations and Standards dated June 29, 2006;

Pursuant to the Law on Information Technology dated June 29, 2006;

Pursuant to the Law on Persons with Disabilities dated June 17, 2010;

Pursuant to the Government’s Decree No. 64/2007/ND-CP dated April 10, 2007 on information technology application in state agencies' operations;

Pursuant to the Government’s Decree No. 17/2017/ND-CP dated February 17, 2017 on functions, duties, powers and organizational structure of the Ministry of Information and Communications;

Implementing the Prime Minister’s Decision No. 753/QD-TTg dated June 03, 2020 promulgating plan for implementation of Directive No. 39-CT/TW dated November 01, 2019 by the Secretariat of the 12th Central Steering Committee of the Communist Party on enhancement of leadership of the Communist Party in affairs concerning persons with disabilities;

The Minister of Information and Communications hereby promulgates a Circular on application of standards and technology assisting persons with disabilities to access and use information and communications products and services.

Article 1. Scope

This Circular provides for application of standards and technology assisting persons with disabilities to access and use information and communications products and services.

Article 2. Regulated entities

This Circular is applicable to:

1. Enterprises manufacturing and distributing information and communications products and services, including hardware, software and digital content.

2. State agencies, including ministries, ministerial-level agencies, Governmental agencies, People's Committees at all levels and service providers using state budget to design and build websites/web portals/public services portals.

3. Press agencies holding the radio or broadcasting license; press agencies having a website/an online newspaper.

4. Public service/public administrative service providers.

1. Standards assisting persons with disabilities to access and use information and communications products and services are either mandatory or recommended, which is elaborated in Appendix enclosed therewith.

2. Organizations and enterprises are encouraged to apply new versions of the abovementioned standards to assist persons with disabilities to access and use information and communications products and services.

3. List of standards assisting persons with disabilities to access and use information and communications products and services shall be updated and revised periodically as appropriate to how they are applied to real life.

Article 4. Regulations for press agencies holding broadcasting or radio license

1. Press agencies holding the broadcasting or radio license and providing television channels performing essential propagation and political tasks shall apply standards and technology assisting persons with disabilities to access daily news programs on these channels.

2. Press agencies holding the broadcasting or radio license of provinces and central-affiliated cities are encouraged to apply standards and technology assisting persons with disabilities to listen to their programs.

Article 5. Regulations for websites/web portals/public services portals

1. Websites/web portals/public services portals of the regulatory bodies and organizations mentioned in Clauses 2 and 3 Article 2 of this Circular shall apply the standards and technology assisting persons with disabilities to access and use information and communications products and services provided for in Appendix enclosed therewith.

2. Other organizations and individuals are encouraged to apply the standards and technology assisting persons with disabilities to access and use information and communications products and services provided for in Appendix enclosed therewith to their websites/web portals.

1. This Circular takes effect from January 01, 2021 and supersedes Circular No. 28/2009/TT-BTTTT dated September 14, 2009 by the Minister of Information and Communications on application of standards and technology assisting persons with disabilities to access and use information and communications technology.

2. For any regulatory body or organization mentioned in Clauses 2, 3 and 4 Article 2 of this Circular that has yet to upgrade its website/web portal/public services portal in compliance with regulations in Appendix enclosed therewith, within 12 months starting from the entry into force of this Circular, the regulatory body or organization shall finish upgrading its website/web portal/public services portal in accordance with regulations of this Circular.

Article 7. Implementation

1. Head of the Ministry Office, Director General of Department of Science and Technology, heads of affiliates of the Ministry of Information and Communications, heads of Departments of Information and Communications and relevant organizations and individuals shall implement this Circular.

2. During the implementation of this Circular, any difficulty arising should be promptly reported to the Ministry of Information and Communications (Department of Science and Technology) for consideration and resolution./.
