QUYẾT ĐỊNH

CỦA BỘ BƯU CHÍNH VIỄN THÔNG SỐ 53/2003/QĐ-BBCVT NGÀY 20 THÁNG 03 NĂM 2003 BAN HÀNH CƯỚC DỊCH VỤ THUÊ KÊNH VIỄN THÔNG LIÊN TỈNH ÁP DỤNG CHO CÁC DOANH NGHIỆP CUNG CẤP DỊCH VỤ KẾT NỐI INTERNET, DOANH NGHIỆP CUNG CẤP DỊCH VỤ TRUY NHẬP INTERNET ĐỂ CUNG CẤP DỊCH VỤ KẾT NỐI, DỊCH VỤ TRUY NHẬP INTERNET

Căn cứ Nghị định số 90/2002/NĐ-CP ngày 11/11/2002 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Bưu chính, Viễn thông;
Căn cứ Nghị định số 55/2001/NĐ-CP ngày 23/08/2001 của Chính phủ về quản lý, cung cấp và sử dụng dịch vụ Internet;
Căn cứ Quyết định số 99/1998/QĐ-TTg ngày 26/5/1998 của Thủ tướng Chính phủ về quản lý giá và cước bưu chính, viễn thông;
Căn cứ Thông tư số 03/1999/TT-TCBĐ ngày 11/5/1999 của Tổng cục trưởng Tổng cục Bưu điện hướng dẫn thi hành Nghị định số 109-CP ngày 12/11/1997 của Chính phủ về Bưu chính và Viễn thông và Quyết định số 99/1998/QĐ-TTg ngày 26/5/1998 của Thủ tướng Chính phủ về quản lý giá và cước bưu chính, viễn thông;
Căn cứ Thông tư số 04/2001/TT-TCBĐ ngày 20/11/2001 của Tổng cục trưởng Tổng cục Bưu điện hướng dẫn thực hiện Nghị định số 55/2001/NĐ-CP ngày 23/08/2001 của Chính phủ về quản lý, cung cấp và sử dụng dịch vụ kết nối Intenet, dịch vụ truy nhập Internet và dịch vụ ứng dụng Internet trong bưu chính, viễn thông;
Theo đề nghị của Vụ trưởng Vụ Kế hoạch - Tài chính,

QUYẾT ĐỊNH:

Điều 1. Ban hành cước thuê kênh viễn thông liên tỉnh của các doanh nghiệp cung cấp dịch vụ thuê kênh viễn thông trong nước áp dụng đối với các doanh nghiệp cung cấp dịch vụ kết nối Internet (IXP), doanh nghiệp cung cấp dịch vụ truy nhập Internet (ISP) thuê để cung cấp dịch vụ kết nối, dịch vụ truy nhập Internet, như sau:

1. Chi phí đầu nối, cài đặt ban đầu do doanh nghiệp cung cấp dịch vụ thuê kênh viễn thông quy định trên cơ sở giá thành.

2. Cước thuê kênh liên tỉnh (1.000đ/tháng):

- Vùng cước kênh viễn thông liên tỉnh, mức cước kênh viễn thông nội tỉnh (đã bao gồm cả phần truyền dẫn nội hạt) để kết nối kênh liên tỉnh: áp dụng theo bảng cước thuê kênh viễn thông liên tỉnh do Bộ trưởng Bộ Bưu chính, Viễn thông quy định.

- Các mức cước nêu trên chưa bao gồm thuế giá trị gia tăng (VAT).

Điều 2. Quy định này có hiệu lực thi hành kể từ 01/4/2003, thay thế Quyết định số 16/2002/QĐ-TCBĐ ngày 11/01/2002 của Tổng cục Bưu điện về việc ban hành tạm thời cước dịch vụ thuê kênh viễn thông liên tỉnh áp dụng cho các doanh nghiệp cung cấp dịch vụ kết nối Internet (IXP), doanh nghiệp cung cấp dịch vụ truy nhập Internet (ISP) thuê để cung cấp dịch vụ kết nối, dịch vụ truy nhập Internet.

Điều 3. Chánh Văn phòng, Vụ trưởng Vụ Kế hoạch - Tài chính, Thủ trưởng các đơn vị thuộc Bộ Bưu chính, Viễn thông; Tổng Giám đốc, Giám đốc các doanh nghiệp cung cấp dịch vụ viễn thông, các doanh nghiệp cung cấp dịch vụ kết nối Internet (IXP), các doanh nghiệp cung cấp dịch vụ truy nhập Internet (ISP) và Thủ trưởng các đơn vị có liên quan chịu trách nhiệm thi hành Quyết định này.

DECISION

GOVERNING THE PROMULGATION OF THE INTER-PROVINCIAL TELECOMS CIRCUIT LEASING CHARGES APPLIED TO INTERNET EXCHANGE PROVIDERS (IXPS) AND INTERNET SERVICE PROVIDERS (ISPS) TO PROVIDE INTERNET CONNECTION AND ACCESS SERVICES

MINISTER OF POSTS AND TELECOMS

Pursuant to Decree 90/2002 dated November 11, 2002 of the Government regulating the functions, duties, range of competence and organizational structure of the Ministry of Posts and Telematics;
Pursuant to Decree 55/2001/ND-CP dated August 23, 2001 of the Government on the management, provision and use of Internet services;
Pursuant to Decision 99/1998/QD-TTg dated May 26, 1998 of the Prime Minister on the management of posts and telecoms tariffs and charges;
Pursuant to Circular 03/1999/TT-TCBD dated May 11, 1999 of the Department General of Posts and Telecommunications (DGPT) providing guidance to the implementation of Decree 109/1997/ND-CP dated November 12, 1997 of the Government concerning the Posts and Telecoms sector, and Decision 99/1998/QD-TTg dated May 26, 1998 of the Prime Minister governing the management of posts and telecoms;
Pursuant to Circular 04/2001/TT-TCBD dated November 20, 2001 of the former Secretary General of DGPT guiding the implementation of Decree 55/2001/ND-CP dated August 23, 2001 of the Government on the management, provision and use of the Internet exchange service, Internet access and application services in the posts and telecoms field;
At the proposal of the Director of the Planning and Finance Department,

HEREBY DECIDES:

Article 1: The charges of the inter-provincial telecoms circuit leasing of enterprises providing the domestic telecoms circuit leasing service applied Internet exchange providers (IXPs), Internet service providers (ISPs) to provide connection and access services are regulated as follows:

1. The initial installation and connection fee will be regulated by enterprises providing the telecoms circuit leasing service on principle of real costs.

2. Inter-provincial telecoms circuit leasing charge is VND1,000/month

Inter-provincial telecoms circuit leasing charge zones and inner-provincial telecoms circuit leasing charge levels (including the local transmission part) for inter-provincial connection: Applied as the inter-provincial telecoms circuit leasing tariff table regulated by the Ministry of Posts and Telematics (MPT)

These charge levels have not included value-added tax (VAT).

Article 2: This decision takes effect from April 1, 2003 and replaces Decision 16/2002/QD-TCBD dated January 11, 2002 of DGPT governing the temporary promulgation of inter-provincial circuit leasing charges applied to IXPs, ISPs to provide Internet connection and access services.

Article 3: Chiefs of Offices, Director of the Planning and Finance, director of units under MPT; directors general, directors of enterprises providing telecoms services, IXPs, ISPs and directors of related units are due to implement this decision.
