DECREE

FUNCTIONS, DUTIES, POWERS AND ORGANIZATIONAL STRUCTURE OF MINISTRY OF CONSTRUCTION

Pursuant to the Law on Government Organization dated February 18, 2025;

At the request of the Minister of Construction;

The Government promulgates Decree on functions, duties, powers and organizational structure of the Ministry of Construction.

Article 1. Position and functions

The Ministry of Construction is a governmental authority in charge of performing state management of planning for construction or architecture; investment in construction; urban development; technical infrastructure; housing; real estate market; construction materials; road, railway, inland waterway, maritime and civil aviation transport on a nationwide scale; state management of public services rendered in the fields within the scope of its management in accordance with regulations of law.

1. Submit bills, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the National Assembly Standing Committee; draft decrees and resolutions of the Government according to its annual law-making programs and plans that have been approved and resolutions, projects, plans and programs as assigned by the Government and the Prime Minister to the Government; submit strategies, plannings, projects, long-term, medium-term and annual development plans and projects and works of national importance to the Government and the Prime Minister within the scope of its state management and in accordance with regulations of law.

2. Submit draft decisions, directives and other documents to the Government and the Prime Minister as assigned.

3. Issue circulars and other documents within the scope of its state management; formulate and issue within its jurisdiction or request competent authorities to issue technical regulations, national standards, economic-technical norms, typical designs, sample designs, technical instructions, indicators and criteria in the fields of its state management; provide guidance on and inspect the implementation of such documents.

4. Direct and organize provision of information on, dissemination of and education about laws within the scope of its state management; direct, provide guidance on and inspect the organization of enforcement and monitor the enforcement of laws related to sectors and fields that have been assigned on a nationwide scale; review, assess and organize the implementation of strategies, plannings and plans within the fields of its state management.

5. Regarding planning and architecture:

a) Organize establishment and appraisal of a general planning for urban and rural systems; preside over establishment and appraisal of urban and rural planning component included in the national general planning, national marine spatial planning, regional planning and other plannings according to regulations of the law on planning;

b) Organize appraisal of planning tasks, urban and rural plannings within the approval jurisdiction of the Prime Minister or appraise and approve urban and rural plannings as assigned by the Prime Minister;

c) Issue norms and methods for estimation and management of costs for planning, and formulation of regulations on management of architecture;

d) Develop and organize the implementation of the Orientation for the development of Vietnamese architecture in each stage, submit the Orientation to the Prime Minister for approval and issuance; provide guidance on establishment of a list of and management of architectural structures of value;

e) Give guidance on and inspect the compliance with regulations of law on planning, architecture, space management and landscape architecture according to planning and architectural management rules (including aboveground and underground spaces);

g) Produce architectural design models for public works, rural housing and other architectural structures in accordance with regulations;

h) Issue regulations and provide guidance on organization of planning idea contests and architectural plan tests and management of operation of urban planning, rural planning and architecture practitioners.

6. Regarding investment in construction:

a) Formulate and promulgate within its jurisdiction or request competent authorities to promulgate mechanisms, policies and regulations on establishment of projects on investment in construction of works, construction survey, construction design, construction, construction supervision, project management, contractor selection, acceptance, handover of works to be put into operation and use, warranty, maintenance of construction works and other operations related to construction of works; construction capacity; foreign construction contractors in Vietnam; construction information system and national construction database;  

b) Give guidelines and inspect the implementation of mechanisms, policies and regulations mentioned in point a of this clause;

c) Set up and manage construction information system and national construction database;

d) Provide guidelines for application of building information modeling (BIM) to construction; and construction contractor selection as per law on construction and bidding;

dd) Appraisal construction investment feasibility study reports and construction designs carried out after fundamental designs in accordance with regulations of law on construction;

d) Perform functions and duties of investment deciders and investors in construction investment projects within its jurisdiction as per law;

h) Recognize socio-professional organizations to be eligible to issue construction practicing certificates and eligibility certificates;

i) Issue, provide guidelines and inspect the implementation of regulations on management of construction investment cost; prescribe application of necessary tools to management of construction investment costs; give guidance on contents and methods of determination and management of  construction investment cost; promulgate regulations on determination of new norms and adjustment to norms; stipulate construction price indices of construction works that span across two or more provinces; issue construction norms; publicize construction investment rates, mixed construction prices, national construction price indices, norms on depreciations and basic data to determine machinery cost per shift;

k) Give guidance on and inspect management of quality of construction works in stages of survey, design, construction, acceptance, handover, warranty, maintenance of construction works; conduct periodic and ad hoc inspections, handle or propose handling violations against regulations on quality of construction works; terminate or propose terminating construction and request investors, consultants and contractors to implement remedial measures if construction works fail to meet quality requirements or construction does not comply with regulations on labor safety; organize inspection of acceptance of construction works as per law;

l) Provide guidelines for experiment in and inspection of construction; carry out inspection and assessment and issue certificates of eligibility for performing construction experiments; give guidance on and organize, within its jurisdiction, construction inspection, construction-related judicial expertise, and inspection of causes of incidents in construction and during operation and use of works;

m) Fulfill duties of the Council for state inspection of acceptance of construction works; preside over organizing and considering approval for construction quality awards;

n) Give guidelines for, inspect maintenance of construction works and assess safety during operation and use of works; announce and provide guidance on how to handle expired works in accordance with regulations of law;

o) Manage numbers of construction practicing certificates and eligibility certificates; publicly post list of individuals and organizations issued with certificates according to regulations; make and issue the question bank used in examinations for issuance of practicing certificate; develop and manage operation of examination software;

p) Set up and manage database on construction norms, work construction prices and construction price indices as per law.

a) Formulate urban development strategies, programs, plans and projects of national importance; determine urban development targets included in the national socio-economic development task in each period;

b) Formulate and promulgate within its jurisdiction or request competent authorities to promulgate mechanisms, policies and regulations on urbanization management; management and investment in the development of urban space (including aboveground and underground spaces), urban development models; management of plans and programs for upgradation, renovation, and improvement of urban areas, and improvement of climate resilience of urban areas; operation, use, and handover of management of urban areas; a system of criteria and standards for urban classification; estimation and management of costs of utility services in urban areas, and costs for establishment and appraisal of urban development areas, urban development programs and urban classification projects and reports;

c) Appraise programs and plans for urban development, urban development areas, urban construction investment projects so that competent authorities approve them as per law;

d) Carry out appraisal of, and request the Prime Minister to decide to recognize types of urban areas with regard to special urban areas and type I and type II urban areas; decide to recognize types of urban areas with regard to type III and type IV urban areas; decide to recognize that areas planned to establish districts and wards meet standards of urban infrastructure development;

dd) Give guidance and inspect implementation of mechanisms, policies and regulations of law on urban development and investment in urban development according to planning and plans; provide guidelines, inspect and organize assessment and classification of urban areas on an annual basis according to criteria and standards regulated by competent authorities; give instructions on management of urban construction order;

e) Give guidance on and inspect management of use of urban construction land according to urban development plannings and plans that have been approved;

g) Organize operations to mobilize, promote and allocate domestic and foreign resources for investment in urban development according to regulations of law and as assigned by the Government;

h) Organize establishment, integration, management and operation of national urban data.

8. Regarding technical infrastructure, including clean water supply (except for rural clean water); wastewater treatment and drainage (except for on-site wastewater treatment; drainage for agricultural production and salt production); parks, urban trees; urban lighting; cemeteries (except for martyrs' cemeteries) and crematoriums; urban transport infrastructure; underground construction space management; management of common use of urban technical infrastructure works and rural residential areas:

b) Provide guidance on formulation of technical infrastructure development plans according to technical infrastructure development orientation, regional planning, provincial planning, urban planning and rural planning; projects on investment in construction of technical infrastructure works as assigned by the Prime Minister;

c) Establish mechanisms, policies and regulations on development, management of operation, use and handover of technical infrastructure systems and provision of technical infrastructure services; give guidance on procedures for technical infrastructure services;

d) Provide guidelines for and inspect clean water business and ensure water supply safety; provide crematorium management and operation services;

dd) Set and promulgate technical standards applied to construction of urban transport infrastructure; issue regulations on classification and categorization of urban roads; set and request competent authorities to promulgate national standards of construction of urban roads;

e) Make and promulgate within its jurisdiction or request competent authorities to promulgate regulations on assessment of the suitability and ability to meet technical infrastructure requirements applied to construction investment projects;

g) Provide guidelines, monitor and inspect compliance with regulations of law on technical infrastructure.

9. Regarding road, railway, inland waterway, maritime and civil aviation transport infrastructure:

a) Request the Government to promulgate regulations on management and protection of road, railway, inland waterway, maritime, and civil aviation infrastructure in accordance with regulations of law; direct the organization of the implementation of plannings and plans for development of transport infrastructure systems that have been approved by the Government and the Prime Minister;

b) Issue national technical regulations on transport infrastructure and regulations on management, operation and maintenance of transport infrastructure within its jurisdiction.

d) Organize, give guidance on, and inspect management, operation and maintenance of transport infrastructure; manage and operate road infrastructure assets under its management as per law;

dd) Request the Government and the Prime Minister to decide or decide, within its jurisdiction, to announce, classify, name, modify, close, open, dismantle, put into operation, terminate, and suspend the operation of road, railway, inland waterway, maritime, and civil aviation works according to regulations of law;

e) Organize application for and issuance of certificates and licenses within its jurisdiction and in accordance with law.

10. Regarding housing:

a) Formulate mechanisms and policies and produce solutions to development of housing forms, national target programs including support for housing and public investment programs regarding housing; organize the direction of the implementation of social housing development programs and national target programs including support for housing;

b) Draw up a national strategy for housing development for each period, and determine basic targets for housing development in the socio-economic development task from time to time; organize implementation after the Prime Minister grants approval.  Issue regulations on funding for provincial housing development programs and plans; and inspect such programs and plans in accordance with regulations;

c) Promulgate sample contracts for purchase/sale, lease purchase, lease of social housing, relocation housing, state-owned housing; and forms of documents proving eligibility for, and beneficiaries of social housing support policies;

d) Act as ownership representatives of official houses and social housing invested by using central government budget; dorms for students of public education institutions under its management;

dd) Appraise contents related to housing in respect of housing investment and construction projects of which investment guidelines are subject to the Prime Minister’s decision or approval as per law; preside over appraising decision on investment guidelines, decision on investment in project on construction of official house, project on purchase of commercial housing to be used as official house of which investment guidelines are subject to the Prime Minister’s decision; give opinions about official house investment and construction projects set up by the Ministry of National Defense and the Ministry of Public Security;

g) Establish and request the Prime Minister to issue standards in terms of area and norms of equipment and furniture of official houses, and decisions on subjects eligible to use official houses of ministries and central authorities; carry out appraisal or provide opinions on demands for official houses and plans to develop official houses as per law.

Organize construction, management of operation, maintenance, renovation, repair of official housing for lease by officials working for central authorities as assigned by the Prime Minister;

h) Make regulations on determination of rent of official house; sale price, rent, lease purchase price of social housing not funded by public investment capital or union funding; prices of state-owned social housing and housing for people's armed forces; methods for determining state-owned apartment building operation management service fees and submit such regulations to the Government;

i) Promulgate regulations on requirements for construction of private multi-storey or multi-unit houses;

k) Inspect reservation of land fund and conformity thereof for development of social housing, worker housing in industrial parks, housing for people’s armed forces in plannings in accordance with regulations;

l) Approve or request the Prime Minister to decide repurposing of houses as per law.

11. Regarding real estate market:

a) Preside over and cooperate with ministries, ministerial authorities, and provincial People's Committees in setting up projects and policies on development, implementation, and management of real estate business; and implementing methods for regulating real estate market;

b) Manage issuance of practicing certificates for real estate brokers and real estate brokerage services; establishment and organization of operations of real estate trading floor;

c) Provide guidelines for, inspect compliance with the law on real estate business, fulfillment of conditions for real estate business by organizations and individuals and conditions attached to real estate to be put on market and cooperate with provincial People's Committees to conduct inspection and review of real estate business according to regulations;

d) Preside over and cooperate with ministries, ministerial authorities, and provincial People's Committees in establishing, managing and operating the national housing and real estate market information system; connecting and sharing housing and real estate market database with national database and other relevant specialized databases as per law; formulating and announcing criteria for evaluation of the real estate market nationwide;

dd) Appraise or give opinions about transfer of entire or partial real estate project within the Prime Minister’s jurisdiction over consideration and decision; offer opinions about appraisal of investment guidelines and adjustments to investment guidelines for real estate projects of which investment guidelines are subject to the Prime Minister’s approval in accordance with the law on real estate business;

e) Preside over and cooperate with relevant authorities in implementing measures to prevent and control money laundering in the real estate business as per law.

12. Regarding construction materials:

a) Organize formulation of, and request competent authorities to promulgate legislative documents and policies on management of development of construction materials;

b) Formulate, appraise and request competent authorities to approve group II mineral planning and make adjustment thereof according to regulations of laws on planning and minerals; give guidance on and inspect the implementation of mineral planning after the Prime Minister grants approval;

c) Recommend and request the Prime Minister to encourage or restrict development, production, use, import and export of construction materials; issue regulations on specifications and provide guidance on export of minerals used as construction materials as per law;

d) Recommend and request the Prime Minister to introduce a roadmap to limit and dissolve construction material producers applying obsolete technologies which consume too much fuel and energy and cause environmental pollution; a roadmap for use of unbaked construction materials, natural resource- and energy-saving and environmentally-friendly construction materials and construction materials domestically produced;

e) Instruct and inspect local authorities and enterprises’ compliance with regulations of law on quality of construction material products and goods;

g) Provide guidelines for appraisal and assessment of quality of construction material products and goods; quality of minerals used as construction materials; appointment and management of operations conducted by conformity assessment bodies for fulfillment of requirements for state management of quality of construction material products and goods; inspection and certification of conformity of construction material products and goods and building components;

h) Promulgate, within its jurisdiction, or request competent authorities to promulgate list of, conditions and technical standards applied to construction materials eligible for export/import; construction materials from import/export; restricted building materials; and provide guidance on and inspect the implementation;

i) Instruct and inspect local authorities and enterprises’ compliance with regulations of law on production and use of natural resource- and energy-saving and environmentally-friendly construction materials for construction works.

13. Regarding vehicles, parts, systems of components, and spare parts of motor vehicles; vessels and equipment for exploration, extraction and transport at sea; loading and construction vehicles and equipment; machinery, devices, and supplies subject to strict regulations on occupational safety and hygiene in transport (except for vehicles serving national defense and security purposes and fishing vessels) and specialized technical devices and equipment:

a) Promulgate regulations on registration and issuance of license plates to railway vehicles, inland waterway vessels and construction machinery participating in traffic; organize registration of railway vehicles, inland waterway and maritime vessels and civil aircrafts within its jurisdiction and in accordance with regulations of law;

b) Issue regulations on technical safety quality, environmental protection and occupational safety and hygiene applicable to vehicles; vessels and equipment for exploration, extraction and transport at sea;

c) Introduce regulations and offer guidance on compliance with technical standards and regulations, inspection, experiment, certification of technical safety and environmental protection quality, management of declaration and certification of conformity of road motor vehicles, parts, systems of components, and spare parts of motor vehicles; railway vehicles, inland waterway and maritime vessels and civil aircrafts; vessels and equipment for exploration, extraction, and transportation at sea; loading and construction vehicles and equipment, specialized works, means and equipment used for transportation and other purposes as prescribed by law;

d) Issue certificates of airworthiness; issue export certificates of airworthiness to aircrafts and their engines and propellers when exported; issue or recognize type certificates to aircrafts and their engines and propellers when domestically produced or imported;

e) Grant licenses to establishments engaged in design, manufacture, repair, maintenance or experiment in aircrafts and their engines, propellers and equipment in Vietnam; prescribe conditions and procedures for issuance of operation permits to establishments providing air navigation assurance services, and technical systems and equipment for air navigation assurance; promulgate national technical regulations applicable to establishments building and repairing seagoing vessels and inland waterway vessels; impose conditions and establish standards to be satisfied by facilities inspecting technical safety quality and environmental protection regarding vehicles, vessels and equipment for exploration, extraction and transport at sea and other vehicles, equipment and works as per law;

g) Compile a list of potentially unsafe commodities in accordance with regulations; establish procedures for inspecting and managing kinds of machinery, equipment, materials and substances subject to strict occupational safety and hygiene requirements under its management; organize issuance, re-issuance, extension and revocation of certificates of eligibility to conduct motorized vehicle inspection and certificates of eligibility to conduct technical inspection of occupational safety within its jurisdiction.

14. Regarding occupational safety for construction works:

a) Preside over setting national occupational safety and hygiene standards and formulate and promulgate national technical regulations on occupational safety and hygiene under its management;

b) Perform state management of machinery, equipment, materials and substances subject to strict occupational safety and hygiene requirements and used for construction works; compile a detailed list of machinery, equipment, materials and substances subject to strict occupational safety and hygiene requirements; establish and promulgate procedures for inspecting, providing guidance and examining inspection of machinery, equipment, materials and substances subject to strict occupational safety and hygiene requirements under its management after competent authorities give their opinions.

Build, manage and update database of technical inspection of occupational safety for machinery, equipment and materials subject to strict occupational safety requirements an used for construction works;

c) Organize training, advanced training and examinations in professional inspection of machinery, equipment and materials subject to strict occupational safety and hygiene requirements for subjects of inspection under its management;

d) Issue, extend, re-issue and revoke certificates of eligibility to conduct technical inspection of occupational safety and issue/re-issue inspector certificates under its management and make public announcement on its website;

dd) Provide guidelines for production of statistic, declaration, investigation and report on safety threat under its management; give guidance and inspect occupational safety and hygiene under its management.

16. Regarding road, railway, inland waterway, maritime and civil aviation transport and multimodal transport:

a) Give guidelines for and inspect fulfillment of transport business conditions and implementation of mechanisms and policies on development of transport and transport support services according to the Government’s regulations;

b) Formulate and promulgate national technical standards applicable to the transport operation field;

c) Announce civilian airway after the Prime Minister grants permission; announce road, rail, inland waterway and maritime transport routes and public transport networks as per law;

d) Give guidelines for multimodal transport according to the Government’s regulations;

dd) License civil flight operation; direct and inspect compliance with regulations on cooperation in management of civil flight operation;

e) Elaborate management of operations conducted at airports and aerodromes (excluding aviation), seaports, dry ports, ports, inland waterway wharves, railway stations and management of railway, inland waterway and maritime transport routes.

17. Regarding transport safety and security (except for assurance of aviation security in aircraft and on the ground):

a) Preside over or cooperate in organization of implementation of overall projects, strategies, programs and plans for assurance of transport safety on a nationwide scale after they are approved by the Government and the Prime Minister; give guidance on and inspect the implementation of regulations of law on assurance of road, railway, inland waterway, maritime, and civil aviation transport safety within its functions and duties;

c) Organize investigation into aircraft and maritime incidents and accidents within its jurisdiction and in accordance with regulations of law;

d) Preside over or cooperate in organization of search and rescue, and response to oil spill in road, rail, inland waterway, maritime and civil aviation transport within its jurisdiction.

18. Regarding environment in construction and transport:

a) Direct and provide guidance on integration of planning, plans and programs for environmental protection, digital transformation, green transformation, response to climate change, and efficient and economical use of energy into strategies, planning, plans and programs for development of various fields under its state management;

b) Organize performance of state management of environmental protection in terms of construction, management, operation and use of transport infrastructure, and management of vehicles and other operations within its assigned powers and in accordance with regulations of law and international treaties to which the Socialist Republic of Vietnam is a signatory;

c) Regulate issuance of certificates of conformity with environment standards to road and railway vehicles, inland waterway and maritime vessels, vessels and equipment for exploration, extraction, and transportation at sea and civil aircrafts (except for vehicles owned by military and public security forces and used for national defense and security purposes and fishing vessels); preside over provision of guidelines for inspection and certification of conformity with environment standards by automobiles and other vehicles; 

dd) Formulate and promulgate, within its jurisdiction, legislative documents on environmental protection, response to climate change and efficient and economical use of energy in fields under its management as per law;

dd) Issue national technical regulations on technical safety quality and environmental protection applicable to vehicles within its jurisdiction in accordance with regulations of law;

e) Issue technical regulations and norms of consumption of energy and provide guidance on and inspection of conformity with energy consumption norms by vehicles as per law;

h) Develop and manage specialized hydrometeorological monitoring station networks in the transport field.

19. Draw up, provide guidance on and implement the science, technology and innovation strategy; organize implementation of plans for scientific research, development, transfer and application of science and technology in construction fields; organize appraisal, assessment and recognition of construction technologies, and scientific and technical advances under its state management; develop, provide guidance on and inspect measurement and management of the quality of goods and products in the fields and sectors under its management; direct establishment and performance of duties related to digital transformation, programs and projects on application of information technology, and development of e-Government in the construction sector; build and manage databases and provide information services which serve state management and meet the demands of organizations and individuals participating in construction and transport; build and manage operation of online public service systems in the fields under its state management.

20. Produce statistics, store documents and data on fields under its management as per law. 

21. Regarding public services:     

a) Carry out state management of public services in fields and sectors under its state management and in accordance with regulations of law;

b) Promulgate regulations on criteria and standards of quality of public services; mechanisms for inspection, assessment and appraisal of quality of public services and efficiency in operations conducted by public service providers under its management;

c) Instruct organizations to provide public services as per law.

22. Regarding enterprises and cooperatives:

a) Request competent authorities to promulgate mechanisms and policies incentivizing and assisting development of enterprises and cooperatives under its state management as per law and cooperate with relevant authorities and organizations in directing, providing guidance on and inspecting the organization of implementation;

c) Provide guidelines for enforcement of regulations for conditional business lines and services, inspect such enforcement and handle violations within its jurisdiction;

d) Exercise rights and fulfill responsibilities and obligations pertaining to state ownership for state-owned enterprises and state capital invested in other enterprises as prescribed by law.

23. Regarding public – private partnership:

a) Issue or request competent authorities to issue legal documents, strategies, and plans for investment of capital sources other than state budget in transport infrastructure projects;

b) Request the Government and the Prime Minister to approve or approve, within its jurisdiction, mechanisms and policies on attraction of capital sources other than state budget for projects on investment in transport infrastructure and services in the form public – private partnership;

c) Organize promotion of investment and increase in capital other than state budget in conformity with strategies, plans and list of projects that have been approved;

d) Provide guidelines, inspect and consolidate prioritized items, programs and projects to attract investment capital other than state budget; monitor and assess programs and projects in terms of implementation and efficiency in attraction and use of investment capital other than state budget;

dd) Manage and give guidance on public – private partnership investment under its state management as per law on public-private partnership.

24. Develop and organize the implementation of projects, programs and plans to encourage, support and promote the development of mechanical construction and transport products.

26. Develop and organize the implementation of plans and programs for international cooperation and integration in the fields under its state management as assigned by the Government; organize negotiation, conclusion and implementation of international treaties in the name of the Government as authorized by the Government; organize negotiation, conclusion and implementation of international agreements in the name of the Ministry of Construction as prescribed by law; participate in international organizations as assigned by the Government.

27. Decide and direct the implementation of its administrative reform programs according to objectives and contents included in the state administrative reform program approved by the Prime Minister; request competent authorities to decide or decide, within its jurisdiction, devolution of powers to local governments to perform some duties under its state management.

28. Perform duties and powers over associations and non-governmental organizations under its state management and in accordance with regulations of law.

29. Conduct inspection, receive citizens, resolve complaints and denunciations, respond to reflections, and implement recommendations sent by organizations and citizens; prevent and control corruption and extravagance, and handle violations against the law in fields under its state management according to regulations of law.

30. Manage organizational apparatus, payroll, officials, public employees, and employees; comply with regulations on salary and implement other policies on benefits, commendation and discipline applicable to officials, public employees, and employees; provide training and advanced training for officials, public employees, and employees under its state management.

31. Manage and organize the implementation of state finance- and property-related works as well as development and construction investment under its management; organize management of state budget allocated according to regulations of law.

32. Perform other duties when assigned or authorized by the Government, the Prime Minister and in accordance with regulations of law.

23. Academy of Construction Strategy and Cadres Training.

Organizations referred to in clauses 1-19 of this Article shall assist the Minister of Construction of Vietnam in performing state management functions; organizations referred to in clauses 20-23 of this Article are public service providers serving the Ministry’s state management functions.

Department of Planning and Finance is comprised of 05 divisions.

Vietnam Maritime and Waterways Administration, Civil Aviation Authority of Vietnam or Department for Roads of Vietnam has its own seal bearing the national emblem.

The Minister of Construction of Vietnam shall issue a decision defining functions, duties, powers and organizational structures of units affiliated to the Ministry of Construction; and request the Prime Minister to promulgate a decision on list of other public service providers affiliated to the Ministry of Construction in accordance with regulations.

Article 4. Effect

1. This Decree comes into force from March 01, 2025.

2. This Decree replaces the following Decrees:

a) Government's Decree No. 52/2022/ND-CP dated August 08, 2022;

3. Department for Roads of Vietnam, Vietnam Expressway Authority, Vietnam Maritime Administration, Vietnam Inland Waterway Administration and Civil Aviation Authority of Vietnam shall continue to operate according to applicable regulations until the Minister of Construction completes the arrangement and issues a decision defining functions, duties, powers and organizational structures of such units in accordance with regulations before March 31, 2025. The Enterprises Management Department shall maintain its operations to initiate legal procedures related to the restructuring of the Shipbuilding Industry Corporation and terminate its operations before December 31, 2030.

Article 5. Responsibility for implementation

The Minister of Construction, Ministers, Heads of ministerial authorities, Heads of Governmental authorities, Chairpersons of People's Committees of provinces and central-affiliated cities shall be responsible for implementing this Decree.
