DECREE

REGARDING MANAGEMENT AND PROTECTION OF SECURITY AND ORDER AT PORT CHECKPOINTS UNDER THE MANAGEMENT OF THE MINISTRY OF PUBLIC SECURITY

Pursuant to the Vietnam Maritime Code No. 95/2015/QH13;

Pursuant to the Law on Government Organization No.63/2025/QH15;

Pursuant to the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam No. 47/2014/QH13 amended by Law No. 51/2019/QH14, Law No. 23/2023/QH15, Law No. 103/2025/QH15, and Law No. 118/2025/QH15;

Pursuant to the Law on Exit and Entry of Vietnamese Citizens No. 49/2019/QH14 amended by Law No. 23/2023/QH15 and Law No. 118/2025/QH15;

At the request of the Minister of Public Security;

The Government hereby issues the Decree on the management and protection of security and order at port checkpoints under the management of the Ministry of Public Security.

Chapter I

GENERAL PROVISIONS

Article 1. Scope

1. This Decree provides for:

a) The procedures for control; inspection and supervision; issuance of the shore pass for crew members, the boarding pass, and the permits; and the management and control of activities relating to security and order of Vietnamese and foreigners, Vietnamese ships and ships flying a foreign flag (hereinafter collectively referred to as "foreign ships"), and other Vietnamese and foreign types of vehicles/craft at port checkpoints managed by the Ministry of Public Security, including the ports of My Tho, Vinh Long, Can Tho, and Hau Giang (hereinafter referred to as "port checkpoints managed by the Ministry of Public Security");

2. Exit, entry, transit, port transfer, and the export and import of goods serving national defense and security tasks do not fall within the scope of this Decree.

Article 2. Regulated entities

1. Vietnamese and foreign agencies, organizations, individuals, ships, and other types of vehicles/craft that depart from, enter, or operate at port checkpoints managed by the Ministry of Public Security.

2. This Decree does not apply to persons using and being transported by ships and other types of vehicles/craft that depart from, enter, or operate at port checkpoints managed by the Ministry of Public Security for the performance of national defense and security tasks.

Article 3. Term interpretation

For the purposes of this Decree, the terms below shall be construed as follows:

1. Port Checkpoint Police authority means the specialized unit under the Ministry of Public Security that performs the tasks of exit-entry control and the management and protection of security and order at port checkpoints managed by the Ministry of Public Security in accordance with law.

2. Specialized state regulatory authorities at port checkpoints managed by the Ministry of Public Security include: the Maritime Port Authority, the Inland Waterway Port Authority, Customs authorities at border checkpoints, the Police authorities at port checkpoints, Health quarantine centers, Animal quarantine centers and Plant quarantine centers.

3. Control procedures at a port checkpoint managed by the Ministry of Public Security means the procedures, method of implementation, documentation, requirements, and conditions satisfied by persons carrying out the procedures and Police authorities at port checkpoints  for carrying out the procedures for exit or entry of Vietnamese persons and ships; the operation of Vietnamese seagoing ships on domestic routes; and the entry, exit, transit, or port transfer of foreigners and ships at the port checkpoints.

4. Control procedures carried out by electronic means the performance of control procedures by the person carrying out the procedures and the Police authority at a port checkpoint through electronic declaration forms.

5. Control procedures carried out in person means the performance of control procedures by the person carrying out the procedures and the Police authority at a port checkpoint in person.

6. Inspection and supervision at a port checkpoint managed by the Ministry of Public Security means the application by the Port Border Checkpoint Police of professional measures to review, assess, and determine the validity and lawfulness of documents and the activities of persons and vehicles/craft departing from and entering the port checkpoint to maintain law, protect security and order, and prevent, detect, deter, and handle violation against the law at the port checkpoint.

7. Permits/licenses prescribed at Point a, Clause 1, Article 1 of this Decree refer to documents issued by Police authorities at port checkpoints, permitting: Vietnamese persons and foreigners to board a foreign ships, and foreigners to board Vietnamese ships moored at the port to carry out press, scientific research, or sightseeing activities; Vietnamese persons and foreigners operating a vehicle/craft coming alongside a foreign ships; and foreign crew members to stay ashore overnight or to board other ships moored at the port.

Chapter II

SPECIFIC PROVISIONS

Section 1. CONTROL PROCEDURES

Article 4. Application of control procedures for ships entering, departing, transiting, or transferring ports

1. An inbound ship and the on-board crew members and passengers, when entering the maritime border area of Vietnam, must carry out entry procedures at the first port checkpoint the ship reaches.

3. An outbound Vietnamese ship and the on-board crew members and passengers must, before leaving Vietnamese waters, carry out exit procedures at the last port checkpoint the ship departs from.

4. A transiting ship must carry out transit procedures upon entering the maritime border area of Vietnam.

During the period of transit, throughout the transit voyage, the master shall manage the on-board crew members, passengers, and cargo and maintain the condition of the seal and the entry-exit dossier; no person shall be permitted to board or disembark the ship, no vehicle/craft shall be permitted to come alongside the ship and no other activities shall be permitted without the permission of the competent Vietnamese authority, except for cadres/officers, staff, and vehicles/craft of specialized state regulatory authorities at the port, pilots, and on-duty person carrying out the procedures, and medical staff boarding the ship to provide emergency treatment to crew members or passengers.

5. A ship transferring ports must carry out outbound port transfer procedures before leaving one port checkpoint to move to another port checkpoint of Vietnam; and inbound port transfer procedures upon arriving at a port checkpoint from another port checkpoint of Vietnam.

Article 5. Performance of control procedures by electronic means

1. Applicable subjects

a) Inbound and outbound Vietnamese ships; Vietnamese seagoing ships operating on domestic routes;

b) Foreign ships entering, departing, transiting, or transferring ports;

c) Ships issued a permit/license or a written authorization by the competent Vietnamese authority to call at the port, including: foreign ships powered by nuclear energy, or ships carrying radioactive substances; foreign ships calling at the port to carry out scientific research, cultural, sports, fishing, search and rescue, salvage of sunken property, towing assistance, construction, survey, or repair of marine works; and foreign ships entering Vietnamese waters to carry out survey, exploration, resource extraction, or environmental activities;

dd) Vietnamese fishing vessels and Vietnamese crew members that apply the in-person control procedures may carry out control procedures by electronic means where the Police authority of port checkpoint and specialized state regulatory authorities satisfy the information technology infrastructure and professional management requirements.

2. Control procedures by electronic means shall be carried out through the National Single-Window Portal in accordance with the laws on the national single-window mechanism.

3. If the National Single Window Portal experiences a technical failure, the person carrying out the procedure may carry out control procedures in person as prescribed in Article 6 of this Decree.

Article 6. Performance of control procedures in person

1. Applicable subjects

a) Vietnamese fishing vessels;

b) Foreign ships requesting entry for an emergency reason to shelter from a storm or provide emergency treatment to a crew member or passenger or foreign ships that have suffered an accident;

c) Ships unable to carry out control procedures by electronic means due to a technical failure of the National Single-Window Portal;

d) Vietnamese crew members;

2. Performance of control procedures in person for ships entering, departing, or transiting

a) Place of performance:

At the head office or representative office of the Maritime Port Authority or the Inland Waterway Port Authority, or on board the ship in accordance with laws on the management of maritime activities;

In addition to cases where the procedure is carried out on board the ship in accordance with laws on the management of maritime activities, the Police authority of port checkpoint shall notify and reach agreement with the Maritime Port Authority or the Inland Waterway Port Authority to carry out control procedures on board the ship in the following cases: there is a stowaway on board; the ship shows clear signs of violating the laws on security and order; there are grounds to determine that the declaration of crew members or passengers is incomplete or inaccurate; or there are grounds to determine that a crew member or passenger is using a forged passport or a forged international travel document to enter, exit, or transit.

b) Time limit for performance and application components: In accordance with the law on the management of maritime activities;

c) A foreign crew member may use a seaman's book to present when entering, exiting, or transiting, in cases where they do not have a passport or a international travel document or where such document is no longer valid;

d) When carrying out exit procedures for a ship, the person carrying out the procedure must return to the Police authority of port checkpoint the crew members' shore pass (if any), except for crew members on board ships prescribed at Point b of Clause 2 of Article 10 of this Decree.

3. Performance of control procedures in person for ships transferring ports

a) Place of performance: As prescribed at Point a of Clause 2 of this Article;

Application components and the time limit for performance shall be in accordance with laws on the management of maritime activities;

When carrying out outbound port transfer procedures for a ship, the person carrying out the procedure must return to the Police authority of port checkpoint the crew members' shore pass (if any), except for crew members on board ships prescribed at Point b of Clause 2 of Article 10 of this Decree.

c) For a ship undergoing inbound port transfer:

No later than 02 hours after the ship arrives and is safely moored at the wharf or no later than 04 hours after the ship arrives and is safely moored at another location within the port waters, the person carrying out the procedure shall submit the port transfer application from the Police authority of the Port Checkpoint of the departure port to the Police authority of the Port Checkpoint or the Border Guard at the arrival port;

No later than 30 minutes thereafter, the Police authority of the Port Checkpoint at the arrival port must complete the inspection of the port transfer application and permit the ship undergoing inbound port transfer to carry out cargo loading/unloading and other activities according to its program and plan.

4. Control procedures carried out in person for ships, crew members, and passengers on board international cruise ships

a) Comply with Clause 2 of this Article;

b) No later than 12 hours before the ship arrives at the port, the international travel enterprise receiving the passengers must submit the following documents to the Police authority of the Port Checkpoint:

01 original of the written response to the application for visa issuance at an international border checkpoint from the Immigration Department of the Ministry of Public Security, except for passengers holding a passport already bearing a Vietnamese visa and passengers holding a passport falling within the category exempt from entry visas to Vietnam (where any passenger has requested visa issuance at the port checkpoint);

If, for objective reasons, there is insufficient time to submit the original document, the Police authority of the Port Checkpoint shall, upon the written request of the international travel enterprise, permit the enterprise to submit a fax copy or photocopy in order to carry out the procedure for the passengers; within 03 days from the submission of the fax copy or photocopy, the travel enterprise must submit the original of the written response to the application for visa issuance at the international border checkpoint from the Immigration Department of the Ministry of Public Security to the Police authority of the Port Checkpoint;

If a passenger has had the international travel enterprise carry out the procedure for visa issuance at one port checkpoint, but the ship's itinerary results in arrival at a different port checkpoint, the Police authority of the Port Checkpoint at the arrival port shall receive the written response to the application for visa issuance at the international border checkpoint from the Immigration Department of the Ministry of Public Security and shall issue the visa to the passenger as prescribed without requiring the performance of the procedure of re-approval of personnel.

c) The Police authority of the Port Checkpoint shall issue visas to passengers on board the ship in accordance with laws on entry and exit;

d) For an international passenger ship issued a permit to carry domestic tourists between port checkpoints of Vietnam:

Before the ship receives passengers, the person carrying out the procedure shall submit to the Police authority of the Port Checkpoint 01 copy of the permit/license from the competent Vietnamese authority permitting the ship to receive domestic tourists between ports of Vietnam; the travel enterprise shall submit to the Police authority of the Port Checkpoint 01 original of the domestic tour program and 01 original of the passenger list;

A foreign passenger traveling domestically who boards the ship must present to the Police authority of the Port Checkpoint a passport or a international travel document; a Vietnamese passenger traveling domestically who boards the ship must present to the Police authority of the Port Checkpoint their 9-digit ID card, Citizen Identification Card, or 12-digit ID card or passport or other document equivalent to a passport.

5. Control procedures carried out in person for sailing ships, sports ships, and yachts, and for persons on board sailing ships, sports ships, and yachts

a) The place, application components, and time limit for implementation shall be as prescribed at Points a and b of Clause 2 of this Article;

c) A person on board a sailing ship, sports ship, or yacht who holds a seaman's passport or seaman's book and is part of the crew member planning under laws on maritime shall be subject to the control procedures and shore-going activities applicable to crew members.

6. Control procedures for Vietnamese fishing vessels, and crew members and passengers on board Vietnamese fishing vessels engaging in fishing activities in waters outside Vietnam's waters

a) A Vietnamese fishing vessel engaging in fishing activities in waters outside Vietnamese waters must carry out exit procedures before leaving Vietnamese waters, and entry procedures upon returning to maritime border area of Vietnam;

b) Place of performance: As prescribed at Point a of Clause 2 of this Article;

c) Application components:

Documents the person carrying out exit procedures must submit: 02 originals of the General Declaration, the Crew member list, the Passenger list (if any), the Declaration of weapons and explosive materials (if any), and the Declaration of Stowaways (if any);

Documents the person carrying out entry procedures must submit: 01 original of the above documents;

Documents the person carrying out exit procedures must submit: the original Permit/License for the fishing vessel to engage in fishing activities in waters outside Vietnamese waters issued by the Department of Fisheries and Fisheries Surveillance; the crew members' ordinary passports and fishing vessel seaman's books; and the passports of passengers (if any);

Documents the person carrying out entry procedures must submit: Documents the person carrying out entry procedures must present: the crew members' ordinary passports and fishing vessel seaman's books; and the passports of passengers (if any);

The Police authority of the Port Checkpoint shall return to the person carrying out the procedure 01 original of the documents submitted by such person after such documents have been verified for exit.

d) Time limit for performance:

No later than 12 hours before the ship's expected departure, after the ship has entered, the person carrying out the procedure must submit and present to the Police authority of the Port Checkpoint the documents prescribed at Point c of Clause 6 of this Article;

No later than 01 hour from the receipt of all documents submitted and presented by the person carrying out the procedure, the Police authority of the Port Checkpoint must complete the exit and entry procedures for the ship, crew members, and passengers (if any).

Article 7. Time of completion of control procedures

1. For ships

a) The time of completion of control procedures by electronic means shall be the time the person carrying out the procedure receives confirmation of completion of the electronic control procedures for a ship entering, departing, transiting, or transferring ports;

b) The time of completion of control procedures carried out in person shall be the time the Police authority of the Port Checkpoint completes verification of the General Declaration for a ship entering, departing, or transiting; the time of sealing the port transfer application for a ship undergoing outbound port transfer; or the time of completing receipt and inspection of the port transfer application for a ship undergoing inbound port transfer.

2. For crew members and passengers

b) The time of completion of control procedures for a foreign crew member on board a ship carrying out control procedures carried out in person shall be the time the Police authority of the Port Checkpoint completes verification of the Crew List;

c) The time of completion of control procedures for Vietnamese crew members and passengers shall be the time the Police authority of the Port Checkpoint completes verification of the passports of the crew members and passengers.

Article 8. Responsibilities in carrying out control procedures

1. Responsibilities of the Police authority of the Port Checkpoint

a) Perform control procedures 24 hours a day;

b) Receive, inspect the legality and validity of, and verify as prescribed the documents submitted and presented by the person carrying out the procedure;

c) After completing the control procedures, the Police authority of the Port Checkpoint shall return the documents presented by the person carrying out the procedure, except where there is a decision to temporarily confiscate the document as an exhibit or means of violation in accordance with law to ensure the handling of the violation, or to temporarily confiscate the document until the violating individual or organization has fully complied with the penalty decision of the competent authority;

d) Receive and resolve, within its prescribed authority, the requests of the person carrying out the procedure.

2. Responsibilities of the person carrying out the procedure

b) Comply with the decisions and requirements of the Police authority of the Port Checkpoint in accordance with law when carrying out control procedures;

c) Before, during, or after carrying out control procedures, if a stowaway is discovered on board, the master must apply the necessary preventive measures appropriate to each specific case and condition; shall prepare a case file, preserve documents and physical evidence, and closely manage and supervise the stowaway, and shall simultaneously notify the Police authority of the Port Checkpoint immediately to cooperate with the relevant agencies in handling within their authority.

Section 2. PROCEDURES FOR ISSUING VARIOUS TYPES OF LICENSES/PERMITS

Article 9. Types of permits/licenses issued by the Police authority of the port checkpoint

1. Boarding pass

a) A 12-month boarding pass, using Form No. 01 in the Appendix attached hereto;

b) A 03-month boarding pass, using Form No. 02 in the Appendix attached hereto;

2. Permits, using Form No. 03 in the Appendix attached hereto.

3. A crew member's shore pass, using Form No. 04 in the Appendix attached hereto.

1. Entities eligible to be granted shore pass for crew members

Foreign crew members working on board Vietnamese ships or foreign ships that have completed entry procedures or inbound port transfer procedures, who wish to go ashore during the period the ship is moored at the port checkpoint.

2. Period of validity of the shore pass for crew members

a) Valid for use in a single voyage only;

b) For foreign crew members on board ships operating on a fixed route or ships operating in waters outside the port checkpoint's waters, at the request of the master, the Police authority of the port checkpoint shall permit the crew member to use the shore pass across multiple voyages for a period not exceeding 01 month from the date of issuance;

c) The person carrying out the procedure shall be responsible for retrieving the crew member's shore pass once it has expired and for returning it to the Police authority of the port checkpoint.

3. Procedure for issuing the crew member's shore pass

a) The person carrying out the procedure shall register for shore leave for the crew member in the note section of the General Declaration;

Where this has not been registered in the General Declaration, if a crew member wishes to go ashore, the master must submit a written request to the Police authority of the port checkpoint.

c) The charge for issuing the crew member's shore pass shall be in accordance with laws on fees and charges.

Article 11. Issuance of the boarding pass

1. Persons eligible for issuance of the boarding pass

a) 12-month boarding pass:

Issued to Vietnamese and foreign persons from agencies, organizations, or enterprises who regularly need to board foreign ships to work for a period not exceeding 12 months, except for cadres/officers and staff of specialized state regulatory authorities at the port;

b) 03-month boarding pass:

Issued to Vietnamese and foreign persons from agencies, organizations, or enterprises who regularly need to board foreign ships to work for a period not exceeding 03 months, except for cadres/officers and staff of specialized state regulatory authorities at the port.

2. Period of validity of the boarding pass

a) A boarding pass issued by a given unit of the Police authority of the port checkpoint shall be valid for use only at the port checkpoint managed by that unit;

3. Procedure for issuing the boarding pass

a) The person applying for the Permit or a representative of the governing agency or enterprise shall submit and present to the Police authority of the port checkpoint the following documents:

Documents to be submitted: a letter of introduction or an official request from the governing agency or enterprise for issuance of the boarding pass; 01 list of persons applying for the Permit, using Form No. 05 in the Appendix issued together with this Decree; person apply for a 12-month boarding pass must additionally submit 01 color photograph, size 2 cm x 3 cm.

Documents to be presented, for foreigners: a passport or a document of value for international travel;

b) Immediately upon receiving all documents prescribed at Point a of this Clause, the Police authority of the port checkpoint shall issue the boarding pass;

c) The charge for issuing the boarding pass shall be in accordance with laws on fees and charges.

4. A person granted a boarding pass must strictly comply with the law of Vietnam and the conditions stated in the boarding pass.

5. The Police authority of the port checkpoint shall refuse to issue a boarding pass, and must respond in writing, clearly stating the reasons, in the following cases:

a) For national defense or security purpose;

c) Where necessary to ensure social order and safety, or to prevent and control epidemics.

Article 12. Issuance of Permits to Vietnamese persons and foreigners boarding foreign ships, foreigners boarding Vietnamese ships moored at the port; persons operating Vietnamese or foreign craft coming alongside foreign ships; and foreign crew members staying ashore overnight or boarding other ships moored at the port

1. Entities eligible to be granted the Permit

a) Vietnamese persons and foreigners boarding a foreign ship moored at the port to carry out press, scientific research, or sightseeing activities;

b) Foreigners boarding a Vietnamese ship moored at the port to carry out press, scientific research, or sightseeing activities;

c) Persons operating a Vietnamese or foreign craft coming alongside a foreign ship;

d) Foreign crew members requesting to stay ashore overnight or to board other ships moored at the port.

2. Period of validity of the Permit

a) A Permit granted to the persons prescribed at Points a, b, and c of Clause 1 of this Article shall be valid for use during a single voyage for a period not exceeding 10 days;

c) The holder of the Permit may only board the foreign ship specified in the Permit; and shall present the Permit, together with an identification document bearing the document number recorded in the Permit, to the supervisory force of the Police authority of the port checkpoint;

d) For cadres/officers and workers of agencies, enterprises, and seagoing ship agencies who work with, or transact with, ships operating offshore, and workers at drilling platform areas, at the request of the governing agency or enterprise, the Police authority of the port checkpoint may permit the holder of the Permit to board all foreign ships moored or operating in that area.

3. Procedure for issuing the Permit:

a) The person applying for the Permit for the Permit or a representative of the governing agency or enterprise shall submit and present to the Police authority of the port checkpoint the following documents:

Documents to be submitted: A letter of introduction or official dispatch from the governing agency or enterprise, or a letter of invitation or written request from the master; if the agency or enterprise apply for issuance of the Permit for 02 or more persons: 01 summary list of the persons applying for the Permit, containing: full name; nationality; place of birth; date of birth; position; and the number of the 9-digit ID card, Citizen ID card, 12-digit ID card, passport, or international travel document.

Documents to be presented: For foreigners prescribed at Points a, b, and c of Clause 1 of this Article: a passport or an international travel document; for Vietnamese persons prescribed at Points a and c, Clause 1 of this Article: a 9-digit ID card, Citizen ID card, 12-digit ID card, passport, or document of value in lieu of a passport;

b) Immediately upon receiving all documents prescribed at Point a of this Clause, the Police authority of the port checkpoint shall issue the Permit;

c) The charge for issuing the Permit shall be in accordance with laws on fees and charges.

4. A person granted boarding pass must strictly comply with the law of Vietnam and the conditions stated in the pass.

a) For national defense or security purpose;

b) The applicant of issuance of the Permit falls within the category subject to suspension of exit from Vietnam, or uses a forged or expired identification document;

c) Where necessary to ensure social order and safety, or to prevent and control epidemics.

Section 3. MANAGEMENT AND CONTROL OF OPERATION OF PERSONNEL AND VEHICLES

Article 13. Vietnamese persons and foreigners operating at a port checkpoint managed by the Ministry of Public Security

1. A Vietnamese person boarding a foreign ship, except for cadres/officers and employees of specialized state regulatory authorities at the port performing their duties, and medical staff boarding a foreign ship to provide emergency treatment to crew members or passengers; and a foreigner  boarding a foreign or Vietnamese ship to work or carry out activities during the period the ship is moored at the port checkpoint must hold a permit/license issued by the Police authority of the port checkpoint under Articles 11 and 12 of this Decree and must comply with the inspection and supervision of the Police authority of the port checkpoint.

2. A foreigner coming to work or operate at a port checkpoint managed by the Ministry of Public Security

a) Must hold a passport or an international travel document;

b) Must comply with the inspection and supervision of the Police authority of the port checkpoint, specialized state regulatory authorities at the port, and related functional forces;

3. A Vietnamese person or foreigner may not board or disembark a ship before or during the ship's entry or inbound port transfer procedures, or during or after the ship's exit or outbound port transfer procedures, except for cadres/officers and employees of specialized state regulatory authorities at the port, pilots, and persons carrying out procedures on duty, and medical staff boarding the ship to examine or treat crew members or passengers.

4. For a ship carrying out electronic seaport control procedures, immediately after the ship is safely moored at the port, relevant Vietnamese persons and foreigners may board or disembark the ship to carry out activities serving cargo loading/unloading and other activities under the program and plan, until the ship departs the port.

5. A crew member or passenger who does not meet the conditions for entry under Vietnamese law may not disembark the ship, except in the case prescribed in Article 15 of this Decree.

The master shall manage such crew members or passengers on board the ship until the ship leaves Vietnamese waters.

Article 14. Crew members or passengers who must be taken for emergency treatment at a Vietnamese health facility on board a ship that has not yet completed entry or inbound port transfer procedures

1. Before the ship arrives at the port, the person carrying out the procedure must notify the Police authority of the port checkpoint of arrival of the number and health condition of the crew members or passengers requiring emergency treatment, and of the ship's expected time of arrival at the port and mooring position at the port.

2. After the crew member or passenger is taken for emergency treatment, the person carrying out the procedure must report to the Police authority of the port checkpoint and fully declare information on the crew member or passenger to carry out entry or inbound port transfer procedures for that crew member or passenger in accordance with this Decree and other relevant laws.

3. Where a crew member or passenger, upon discharge from hospital, does not return to the ship and wishes to exit through a different border checkpoint, the master must, before the ship departs the port, submit a written request for the crew member or passenger to exit through a different border checkpoint, and shall present the crew member's or passenger's hospital discharge certificate or hospital transfer certificate to the Police authority of the port checkpoint, so that exit procedures through the different border checkpoint may be carried out for such crew member or passenger as prescribed.

4. If a foreign crew member must be taken for emergency treatment at a health facility outside the province or centrally affiliated city where the ship is moored, after the crew member is taken for emergency treatment, the person carrying out the procedure must report to the Police authority of the port checkpoint to carry out the procedure for visa issuance for the crew member that is exempt from entry visas to Vietnam.

1. After the crew member or passenger is taken for emergency treatment, the master must submit a written document to the Police authority of the port checkpoint containing the following content:

a) A full declaration of the information and health condition of the crew member or passenger;

b) A commitment to bear full responsibility for paying all costs relating to the medical treatment of the crew member or passenger, the supervision by Vietnamese functional agencies, and the costs of the crew member's or passenger's departure from Vietnamese territory after being discharged from hospital.

2. The Police authority of the port checkpoint shall receive the master's document, compile a case file, and shall not carry out entry procedures for the crew member or passenger; shall notify relevant functional agencies; and shall assign an officer to conduct supervision during the period the crew member or passenger is undergoing medical treatment.

3. During the period of medical treatment, the crew member or passenger must not leave the health facility without authorization and be placed under the inspection and supervision of the Police authority of the port checkpoint.

4. Upon discharge, the crew member or passenger shall be forced to exit Vietnam

a) If the ship has not yet exited, the Police authority of the port checkpoint shall cooperate with the person carrying out the procedure to return the crew member or passenger to the ship for exit with the ship;

b) If the ship has already exited, the crew member or passenger shall be forced to exit through a different border checkpoint in accordance with Vietnamese law.

2. A crew member may go ashore after the ship has completed entry or inbound port transfer procedures and must return to the ship before the ship carries out exit or outbound port transfer procedures.

For a ship carrying out electronic seaport control procedures, a crew member may go ashore immediately after the ship is safely moored at the port.

The master shall be accountable for cases where exit or outbound port transfer procedures are delayed because a crew member who went ashore has not yet returned to the ship.

3. A crew member going ashore or exiting through a different border checkpoint

a) When going ashore within the province or centrally affiliated city where the ship is moored:

The crew member must carry the crew member's shore pass and the identification document declared and presented when carrying out entry procedures; must comply with the guidance of, and be placed under the inspection and supervision of the Police authority of the port checkpoint; and must comply with relevant Vietnamese law.

A crew member staying ashore overnight must have a written request from the master and must be issued a Permit/License by the Police authority of the port checkpoint under Article 12 of this Decree;

b) When going ashore outside the province or centrally affiliated city where the ship is moored, or exiting through a different border checkpoint:

The crew member must hold a visa, except cases exempt from a visa, and comply with laws on exit and entry. The Police authority of the port checkpoint shall issue the visa in accordance with laws on exit and entry.

4. A crew member who commits a violation against the law while ashore shall be handled in accordance with Vietnamese law.

Article 17. Ships and other types of vehicles/craft operating at the port checkpoint

1. Outbound and inbound Vietnamese ships, and foreign ships entering, departing, transiting, or transferring ports, must be authorized by the competent Vietnamese authority and must pass through the correct border checkpoint, maritime channel, transit route, and transit area.

2. Vietnamese and foreign craft, except for craft of specialized state regulatory authorities at the port, pilot craft, and towing craft performing their duties, may not come alongside a ship before or during that ship's entry or inbound port transfer procedures, or during or after that ship's exit or outbound port transfer procedures.

For a ship carrying out electronic seaport control procedures, immediately after the ship is safely moored at the port, relevant Vietnamese and foreign craft may come alongside the ship to carry out activities serving cargo loading/unloading and other activities under the program and plan, until that ship departs the port.

3. Other types of vehicles/craft departing from, entering, or operating at the port checkpoint must comply with this Decree and other relevant laws, and shall be placed under control, inspection, and supervision of the Police authority of the port checkpoint and related functional forces.

Article 18. Vietnamese seagoing ships operating domestic routes, and inland waterway craft, arriving at or departing from the port checkpoint

1. Vietnamese seagoing ships operating domestic routes, and inland waterway craft, arriving at or departing from the port checkpoint

a) A Vietnamese seagoing ship operating a domestic route must carry out arrival and departure procedures in accordance with laws on the management of maritime activities and shall be placed under control, inspection, and supervision of the Police authority of the port checkpoint during the period it is moored at the port checkpoint;

2. During departure, arrival, and operation at the port checkpoint, the master of a Vietnamese seagoing ship operating a domestic route, and of an inland waterway craft, must provide the Police authority of the port checkpoint with information on the craft, cargo, and other information relevant to security and order, upon request.

3. Place for carrying out procedures and registering departure and arrival

At the head office or representative office of the Maritime Port Authority or the Inland Waterway Port Authority.

4. Time limit for carrying out procedures and registering departure and arrival

a) For a Vietnamese seagoing ship operating a domestic route: In accordance with the law on the management of maritime activities;

b) For an inland waterway craft:

No later than 02 hours after the inland waterway craft is safely moored at the wharf, or no later than 04 hours after the inland waterway craft is safely moored at another location within the port waters, the master or ship owner, or an authorized person (hereinafter collectively referred to as the "registrant"), must register the craft's arrival at the port.

No later than 01 hour before the inland waterway craft's expected departure from the port checkpoint, the registrant must register the craft's departure from the port.

No later than 30 minutes from the receipt of all documents submitted and presented by the registrant under Clause 5 of this Article, the Police authority of the port checkpoint must complete the arrival/departure registration for the inland waterway craft and shall return 01 copy of the declared documents bearing the arrival/departure control stamp that the registrant submitted under Point a, Clause 5 of this Article.

a) Documents to be submitted:

For a Vietnamese seagoing ship operating a domestic route: In accordance with the law on the management of maritime activities;

For an inland waterway craft: 02 originals of the Crew member list, 02 originals of the Passenger list (if any);

b) Documents to be presented:

For crew members: seaman's book or seaman's passport.

For passengers (if any): a passport or an international travel document, a 9-digit ID card, Citizen ID card, 12-digit ID card.

6. When carrying out procedures, registration, inspection, and supervision in respect of a Vietnamese seagoing ship operating a domestic route and an inland waterway craft, the Police authority of the port checkpoint may inspect:

a) The voyage logbook;

b) Documents relating to cargo, where cargo is on board the Vietnamese seagoing ship operating a domestic route or the inland waterway craft, including: the cargo transport contract; the goods sale and purchase contract and the value-added tax invoice, or the internal transfer and delivery note; and the transport permit from the competent Vietnamese authority for conditionally transported goods if signs of violation are detected;

7. For a Vietnamese seagoing ship operating a domestic route or an inland waterway craft undergoing procedures and registration for arrival or departure by electronic means through the National Single Window Portal in accordance with the National Single Window Mechanism, the registrant is not required to submit the documents prescribed at Point a of Clause 5 of this Article, and shall only present the documents prescribed at Point b of Clause 5 of this Article.

8. During the process of registration, control, inspection, and supervision, if a Vietnamese seagoing ship operating a domestic route or an inland waterway craft, is found to show clear signs of violating the law, or if there are grounds to determine that the declared information on the craft, crew members, passengers, or cargo is incomplete or inaccurate, the Head of the Port Checkpoint Police Station shall issue a decision to conduct a direct inspection on board the craft and shall be accountable to the law for their decision.

Chapter III

IMPLEMENTATION AND EFFECT

Article 19. Effect

This Decree comes into force from November 01, 2026.

Article 20. Responsibilities of the Ministry of Public Security

1. Take charge and cooperate with relevant ministries and central authorities and the People's Committees of Can Tho City, Dong Thap Province, and Vinh Long Province in implementing measures to protect security and order and to control exit and entry at port checkpoints managed by the Ministry of Public Security.

2. Direct the Police authority of the port checkpoint to take charge and cooperate with relevant agencies and organizations in carrying out work to ensure security and order, and in developing and implementing cooperation regulations at port checkpoints managed by the Ministry of Public Security; to implement the application of science and technology in exit-entry control activities and the issuance of permits/license; and to carry out administrative procedure reform to enable persons and vehicles/crafts’ departure from, entry, and operation at the port checkpoint.

1. The People's Committees of Can Tho City, Dong Thap Province, and Vinh Long Province shall, within the scope of their jurisdiction, shall direct functional agencies and units to cooperate with specialized state regulatory authorities in managing and protecting security and order at port checkpoints managed by the Ministry of Public Security.

2. Relevant ministries and central authorities shall, within the scope of their jurisdiction, cooperate with the Ministry of Public Security in the management and protection of security and order at port checkpoints managed by the Ministry of Public Security; and shall direct their subordinate agencies, units, and forces to closely cooperate with the Police authority of the port checkpoint in protecting security and order at port checkpoints managed by the Ministry of Public Security.
