Bộ Tài chính nhận được Công văn
của một số cục thuế; doanh nghiệp đề nghị được khấu trừ thuế giá trị gia tăng đầu
vào, xét hoàn thuế giá trị gia tăng khi chưa có đủ các chứng từ thanh toán qua
ngân hàng theo hợp đồng xuất khẩu trong đó có ghi thời hạn bên nước ngoài thanh
toán trả chậm. Về vấn đề này, Bộ Tài chính có ý kiến như
sau:
1. Tại Điểm 2, Mục
II, Phần D Thông tư số 120/2003/TT-BTC ngày 12/12/2003 của Bộ Tài chính quy
định về điều kiện, thủ tục để được khấu trừ, xét hoàn thuế GTGT đầu vào của
hàng hoá, dịch vụ xuất khẩu, trong đó có bảng kê chứng từ đã thanh toán tiền
hàng hóa, dịch vụ xuất khẩu qua ngân hàng.
Tuy nhiên, các cơ sở kinh doanh
thực hiện xuất khẩu theo hợp đồng trong đó có ghi thời hạn bên nước ngoài thanh
toán trả chậm nếu phải chờ có đầy đủ chứng từ thanh toán qua ngân hàng mới lập
bảng kê để được khấu trừ, xét hoàn thuế thì sẽ khó khăn về vốn, nhất là trong
trường hợp có doanh số xuất khẩu và số thuế được khấu trừ, xét hoàn thuế lớn.
Để tháo gỡ khó khăn cho các cơ sở
kinh doanh, đối với hợp đồng xuất khẩu trong đó có ghi thời hạn bên nước ngoài
thanh toán trả chậm, cơ sở kinh doanh làm bản cam kết sẽ xuất trình bảng kê chứng
từ đã thanh toán tiền hàng hoá, dịch vụ xuất khẩu qua ngân hàng thay cho bảng
kê chứng từ đã thanh toán tiền hàng hoá, dịch vụ xuất khẩu qua ngân hàng trong
hồ sơ hoàn thuế GTGT.
2. Đến thời hạn cam kết mà cơ sở
kinh doanh không xuất trình được bảng kê chứng từ đã thanh toán tiền hàng hoá,
dịch vụ xuất khẩu qua ngân hàng thì cơ quan thuế thu hồi lại tiền thuế giá trị
gia tăng đã cho khấu trừ, hoàn thuế và xử phạt hành vi chiếm dụng tiền hoàn thuế
của Nhà nước theo chế độ hiện hành.
Bộ Tài chính thông
báo để Cục thuế các tỉnh, thành phố trực thuộc Trung ương được biết và hướng dẫn
các cơ sở kinh doanh thực hiện.

To: Provincial/municipal Tax
Departments The Ministry of Finance has received official letters from
several provincial/municipal Tax Departments and enterprises, requesting for
the credit of input value added tax and the refund of value added tax for
export contracts which state the deadline for foreign parties to make deferred
payment pending the submission of all via-bank payment vouchers. Regarding this
issue, the Ministry of Finance gives the following opinions: 1. According to Point 2, Section II, Part D of the Finance
Ministry’s Circular No. 120/2003/TT-BTC of December 12, 2003, providing for the
conditions and procedures for the credit and refund of input VAT for export
goods or services, a list of via-bank payment vouchers for export goods or
services is required. However, if business establishments exporting goods and/or
services under contracts which state the deadline for foreign parties to make
deferred payment must wait for all via-bank payment vouchers to make a list
thereof for tax credit and refund, they may face difficulties with their
capital, especially in case of large export turnovers and large creditable and
refundable tax amounts. In order to remove difficulties for business establishments,
for export contracts which state the deadline for foreign parties to make
deferred payment, business establishments may make a written commitment to
produce a list of via-bank payment vouchers for goods or services, instead of
such list in VAT refund dossiers. 2. By the committed deadline, if business establishments
fail to produce the list of via-bank payment vouchers for export goods or
services, tax offices shall recover the credited or refunded VAT amounts and
impose sanctions on acts of appropriating state’s refunded tax amounts
according to current regulations. The Ministry of Finance hereby notifies the aforesaid
guidance to provincial/municipal Tax Departments for guiding business
