Trả lời công văn số CVN-PR-030626 ngày 03/6/2026 của Công ty TNHH Canon Việt Nam về việc hướng dẫn thủ tục hải quan đối với hàng luân chuyển nội bộ giữa các nhà máy, Cục Hải quan có ý kiến như sau:

Hàng hóa xuất khẩu, nhập khẩu bao gồm luân chuyển, điều chuyển trong nội bộ của một DNCX được quy định tại Điều 74 Thông tư số 38/2015/TT-BTC, khoản 50 Điều 1 Thông tư số 39/2018/TT-BTC được sửa đổi, bổ sung tại khoản 45 Điều 1 Thông tư số 121/2025/TT-BTC ngày 18/12/2025 của Bộ Tài chính và hướng dẫn tại điểm 17 Phụ lục ban hành kèm theo công văn số 8444/CHQ-GSQL ngày 02/02/2026 của Cục Hải quan.

Chính sách quản lý hàng hóa thực hiện theo quy định hiện hành. Trường hợp có vướng mắc liên quan đến chính sách quản lý hàng hóa thì liên hệ với Bộ quản lý chuyên ngành để được hướng dẫn thực hiện. Trường hợp thanh lý hàng hóa của DNCX thì thực hiện theo quy định tại Điều 79 Thông tư số 38/2015/TT-BTC, khoản 55 Điều 1 Thông tư số 39/2018/TT-BTC được sửa đổi, bổ sung tại khoản 50 Điều 1 Thông tư số 121/2025/TT-BTC ngày 18/12/2025 của Bộ Tài chính.

Đề nghị Công ty căn cứ quy định dẫn trên, đối chiếu với thực tế tại Công ty để thực hiện. Trong quá trình thực hiện nếu có vướng mắc phát sinh thì liên hệ với đơn vị Hải quan quản lý DNCX để được hướng dẫn cụ thể.

Cục Hải quan có ý kiến để Công ty TNHH Canon Việt Nam biết./.

Exported and imported goods, including those internally circulated or transfer within a export processing enterprise, are stipulated in Article 74 of Circular No. 38/2015/TT-BTC, Clause 50 Article 1 of Circular No. 39/2018/TT-BTC, which is amended by Clause 45 Article 1 of Circular No. 121/2025/TT-BTC dated 18/12/2025 of the Ministry of Finance and elaborated at Point 17 of the Appendix to Official Dispatch No. 8444/CHQ-GSQL dated 02/02/2026 of Customs Department.

Policies on management of goods shall be implemented in accordance with applicable regulations. In case of difficulties related to goods management policies, contact the relevant specialize Ministry for guidance. Liquidation of goods of export processing enterprises shall be conducted in accordance with Article 79 of Circular No. 38/2015/TT-BTC, Clause 55 Article 1 of Circular No. 39/2018/TT-BTC, which is amended by Clause 50 Article 1 of Circular No. 121/2025/TT-BTC dated 18/12/2025 of the Ministry of Finance.
