Hiệp định Đối tác Kinh tế Toàn diện Khu vực (RCEP) là hiệp định thương mại tự do được 10 nước thành viên Hiệp hội các Quốc gia Đông Nam Á (ASEAN) và 05 nước đối tác của ASEAN là Nhật Bản, Hàn Quốc, Trung Quốc, Ốt-xtrây-li-a và Niu Di-lân ký kết vào ngày 15 tháng 11 năm 2020 bên lề Hội nghị Cấp cao ASEAN lần thứ 37 trong năm Việt Nam làm Chủ tịch ASEAN.

Theo quy định của Hiệp định RCEP, Hiệp định sẽ chính thức có hiệu lực sau 60 ngày kể từ thời điểm có ít nhất 06 nước ASEAN và 03 nước đối tác hoàn tất thủ tục phê duyệt/phê chuẩn Hiệp định và nộp lưu chiểu cho Tổng Thư ký ASEAN. Đến ngày 02 tháng 11 năm 2021, đã có 06 nước ASEAN, trong đó có Việt Nam, và 04 nước đối tác là Trung Quốc, Nhật Bản, Ốt-xtrây-li-a và Niu Di-lân nộp lưu chiểu văn kiện phê duyệt/phê chuẩn Hiệp định RCEP của mình cho Tổng Thư ký ASEAN. Như vậy, Hiệp định RCEP sẽ chính thức có hiệu lực từ ngày 01 tháng 01 năm 2022.

Để chuẩn bị thực hiện Hiệp định RCEP, Bộ Công Thương đề nghị quý Bộ căn cứ theo thời điểm có hiệu lực của Hiệp định như thông báo ở trên, tiến hành rà soát, triển khai việc xây dựng các văn bản quy phạm pháp luật cần thiết trong phạm vi chức năng, nhiệm vụ để thực thi Hiệp định RCEP, đảm bảo việc thực thi và tận dụng hiệu quả Hiệp định này.

The Regional Comprehensive Economic Partnership (RCEP) is a free trade agreement signed by the ten Member States of the Association of Southeast Asian Nations (ASEAN) and the five ASEAN FTA Partners, namely Japan, Korea, China, Australia and New Zealand on November 15, 2020 on the sidelines of the 37th ASEAN Summit in the year Vietnam is the ASEAN Chair.

According to the RCEP Agreement, it will enter into force 60 days after six ASEAN Member States and three ASEAN FTA Partners have deposited their instrument of ratification, acceptance or approval with the ASEAN Secretary General.  Until November 2, 2021, six ASEAN Member States, including Vietnam, and four ASEAN FTA Partners, including China, Japan, Australia and New Zealand, have deposited their instruments of ratification, acceptance or approval with the ASEAN Secretary-General.  Thus, the RCEP Agreement will officially enter into force as of January 1, 2022.

To prepare for the implementation of the RCEP Agreement, the Ministry of Industry and Trade proposes that other Ministries, based on the date of entry into force of the Agreement as announced above, review and develop necessary legislative documents within your scope of functions and tasks to implement the RCEP Agreement, ensure the effective implementation and utilization of this Agreement.
