Bộ Tài chính nhận được công văn của
một số Cục Thuế vướng mắc về sử dụng hóa đơn GTGT cho hoạt động xuất khẩu. Về vấn
đề này, Bộ Tài chính có ý kiến như sau:
Tại điểm c khoản 2 Điều
3 Thông tư số 153/2010/TT-BTC ngày 28/9/2010 của Bộ Tài chính hướng dẫn về
hóa đơn bán hàng hóa, cung ứng dịch vụ hướng dẫn:
“c) Hóa đơn xuất khẩu là hóa đơn
dùng trong hoạt động kinh doanh xuất khẩu hàng hóa, cung ứng dịch vụ ra nước
ngoài, xuất vào khu phi thuế quan và các trường hợp được coi như xuất khẩu,
hình thức và nội dung theo thông lệ quốc tế và quy định của pháp luật về thương
mại”.
Ngày 25/01/2011, Tổng cục Thuế đã
có công văn số 339/TCT-CS gửi Cục Thuế các tỉnh, thành phố trực thuộc Trung
ương hướng dẫn:
“Từ ngày 01/01/2011 doanh nghiệp xuất
khẩu hàng hóa, dịch vụ phải sử dụng hóa đơn xuất khẩu.
Trường hợp trong năm 2010 doanh
nghiệp đã tự in (đặt in) hóa đơn GTGT hoặc đã mua hóa đơn GTGT để sử dụng cho
bán hàng trong nước và xuất khẩu còn tồn chưa sử dụng hết được tiếp tục sử dụng
để bán hàng trong nước và xuất khẩu đến hết ngày 31/03/2011. Doanh nghiệp phải
gửi đăng ký theo mẫu số 3.12 Phụ lục 3 Thông tư 153 chậm nhất là ngày
20/01/2011”.
Điểm 1.3 mục III phần
B Thông tư số 129/2008/TT-BTC ngày 26/12/2008 của Bộ Tài chính hướng dẫn về
điều kiện khấu trừ thuế GTGT đầu vào.
Căn cứ các hướng dẫn nêu trên, đối
với hoạt động xuất khẩu thì doanh nghiệp phải sử dụng hóa đơn xuất khẩu.
Tuy nhiên, trong thời gian đầu khi
thực hiện quy định mới về hóa đơn, trong tình hình chung các công ty in đủ điều
kiện in hóa đơn chưa đáp ứng kịp nhu cầu, một số doanh nghiệp chưa kịp in hóa
đơn xuất khẩu cho hoạt động xuất khẩu, vì vậy để tạo điều kiện cho doanh nghiệp
trong việc thực hiện hoạt động kinh doanh, Bộ Tài chính hướng dẫn: các doanh
nghiệp xuất khẩu đã dùng hóa đơn GTGT khi xuất khẩu từ 31/8/2011 về trước thì
được chấp nhận.
Bộ Tài chính hướng dẫn để các Cục
Thuế được biết.

THE MINISTRY OF FINANCE ON USING VALUED ADDED TAX (VAT) INVOICE FOR THE EXPORT
OF GOODS To:
Departments of Tax of provinces and centrally run cities The Ministry of
Finance has received some official dispatches from Departments of Tax on
problems arising on using VAT invoice for the export of goods: At point c, clause 2, Article 3
of the Circular No. 153/2010/TT-BTC dated September 28, 2010 of the Ministry of
Finance on goods sale and service provision invoices” “Export invoice, which is an
invoice used in the export of goods or provision of services abroad or into
non-tariff zones and cases regarded as export. The form and contents of an
export invoice comply with international practices and the commercial law.” On January 25, 2011, the General
Department of Tax has the Official Dispatch No. 339/TCT-CS to Departments of
Tax of provinces and centrally run cities to instruct: “From January 01, 2011,
enterprises must use export invoices when exporting goods and services. In the case that enterprises has
self-printed (ordered to print) VAT invoices or bought VAT invoices for stored
domestic sales and exports which have not been used out and used for selling
domestically or exporting to the end of March 31, 2011. Enterprises must apply
registration form in accordance with the form No. 3.12, Appendix 3 of the

enterprises must use export invoices for export activities. However, in the beginning time
of implementing new regulations on invoices, the fact that companies having
enough conditions to print invoices cannot satisfy demands, and some
enterprises do not timely print export invoices for export activities, the
Ministry of Finance guides that: export enterprises who used VAT export
invoices from August 31, 2011 and earlier are accepted to create favorable
conditions for enterprises in business operations. FOR
