Bộ Y tế nhận được phản ánh một số đơn vị, địa phương về khó khăn, vướng mắc trong thực hiện và thanh toán chi phí xét nghiệm SARS-CoV-2 bằng kỹ thuật Realtime RT-PCR (UBND thành phố Hà Nội tại công văn số 2232/UBND-KGVX ngày 13/7/2022, 2400/UBND-KGVX ngày 26/7/2022; UBND thành phố Hồ Chí Minh tại công văn 4991/SYT-KHTC ngày 22/7/2022; Sở Y tế Phú Yên tại công văn 1811/SYT-TTr ngày 19/7/2022, Sở Y tế Hải Phòng tại công văn 3069/SYT-KHTC ngày 22/8/2022); Bộ Y tế có ý kiến như sau:

1. Bộ Y tế đã ban hành các văn bản chỉ đạo, hướng dẫn chuyên môn về đối tượng xét nghiệm trong phòng, chống dịch COVID-19, việc triển khai xét nghiệm COVID-19 phụ thuộc vào tình hình thực tế và nhu cầu của từng địa phương. Đề nghị các đơn vị, địa phương nghiêm túc thực hiện việc xét nghiệm theo các chỉ đạo và hướng dẫn của Bộ Y tế bảo đảm khoa học, thiết thực, phù hợp với tình hình dịch bệnh, tránh lạm dụng, lãng phí.

2. Thực hiện chấn chỉnh việc thu, thanh toán chi phí xét nghiệm đối với từng đối tượng theo quy định của pháp luật về giá và các văn bản hướng dẫn thực hiện của Bộ Y tế gần đây nhất là công văn 1157/BYT-KHTC ngày 10/3/2022 về việc thực hiện giá dịch vụ xét nghiệm SARS-CoV-2; trong đó:

2.1. Trường hợp thanh toán chi phí xét nghiệm SARS-CoV-2 theo quy định của pháp luật về khám chữa bệnh, bảo hiểm y tế và các trường hợp được ngân sách nhà nước chi trả theo quy định của Luật phòng, chống bệnh truyền nhiễm (trừ trường hợp xét nghiệm SARS-CoV-2 tại cộng đồng): Thực hiện theo quy định và hướng dẫn tại Thông tư 02/2022/TT-BYT ngày 18/02/2022 của Bộ Y tế quy định giá dịch vụ xét nghiệm SARS-CoV-2 (trước đây là Thông tư số 16/2021/TT-BYT ngày 08/11/2021 của Bộ Y tế).

2.2. Trường hợp thực hiện xét nghiệm SARS-CoV-2 tại cộng đồng do ngân sách nhà nước chi trả và trường hợp thực hiện xét nghiệm SARS-CoV-2 không thuộc khoản 2.1 nêu trên do ngân sách nhà nước chi trả: Thực hiện theo hình thức đấu thầu, giao nhiệm vụ, đặt hàng theo quy định tại Nghị định số 32/2019/NĐ-CP ngày 10/4/2019 của Chính phủ quy định giao nhiệm vụ, đặt hàng hoặc đấu thầu cung cấp sản phẩm, dịch vụ công sử dụng ngân sách nhà nước từ nguồn kinh phí chi thường xuyên.

Đối với dịch vụ xét nghiệm SARS-CoV-2 do địa phương đặt hàng thanh toán từ ngân sách địa phương, đề nghị Ủy ban nhân dân tỉnh/thành phố quy định giá theo thẩm quyền quy định tại khoản 8 Điều 1 Nghị định 149/2016/NĐ-CP ngày 11/11/2016 của Chính phủ; căn cứ, phương pháp, trình tự định giá thực hiện theo quy định của pháp luật về giá, quy định tại điểm b khoản 1 Điều 8 Nghị định số 32/2019/NĐ-CP ngày 10/4/2019 của Chính phủ.

2.3. Trong bối cảnh cấp bách các địa phương chưa kịp ban hành mức giá để đặt hàng các đơn vị cung cấp dịch vụ xét nghiệm SARS-CoV-2, Bộ Y tế đã có công văn số 4356/BYT-KHTC ngày 28/5/2021 trong đó đề nghị tạm thanh toán chi phí đặt hàng và ký hợp đồng theo mức giá tạm thời, sau khi được cấp có thẩm quyền phê duyệt giá đặt hàng thì thực hiện thanh quyết toán theo quy định.

Trường hợp UBND tỉnh/thành phố đã tạm thanh toán chi phí đặt hàng và ký hợp đồng theo mức giá tạm thời, đề nghị UBND các tỉnh/thành phố quyết định giá đặt hàng theo quy định làm cơ sở thanh quyết toán kinh phí đặt hàng các đơn vị cung cấp dịch vụ xét nghiệm SARS-CoV-2.

3. Về việc áp dụng định mức kinh tế kỹ thuật trong xây dựng giá dịch vụ xét nghiệm COVID-19:

- Bộ Y tế đã ban hành Quyết định 1436/QĐ-BYT ngày 04/3/2021, Quyết định 4228/QĐ-BYT ngày 01/9/2021, Quyết định 4686/QĐ-BYT ngày 5/10/2021, Quyết định 5160/QĐ-BYT ngày 08/11/2021 về định mức kinh tế kỹ thuật dịch vụ xét nghiệm SARS-CoV-2 làm cơ sở để Bộ Y tế ban hành giá dịch vụ xét nghiệm SARS-CoV-2 tại Thông tư số 16/2021/TT-BYT ngày 08/11/2021 nay đã thay thế bởi Thông tư 02/2022/TT-BYT ngày 18/02/2022.

- Căn cứ quy trình kỹ thuật và tình hình thực tế thực hiện dịch vụ tại địa phương, Ủy ban nhân dân cấp tỉnh/thành phố ban hành, sửa đổi, bổ sung định mức kinh tế - kỹ thuật, định mức chi phí (nếu có) áp dụng đối với sản phẩm, dịch vụ công làm cơ sở ban hành đơn giá, giá sản phẩm, dịch vụ công theo quy định tại điểm b khoản 2 Điều 26 Nghị định số 32/2019/NĐ-CP.

Lưu ý trường hợp cấp có thẩm quyền phê duyệt điều chỉnh định mức KTKT thì mức giá dịch vụ xét nghiệm SARS-CoV-2 trong trường hợp khám chữa bệnh không thuộc phạm vi thanh toán của quỹ bảo hiểm y tế tại cơ sở khám chữa bệnh công lập do cấp có thẩm quyền tại địa phương quy định không cao hơn giá tối đa do Bộ Y tế quy định tại Thông tư 02/2022/TT-BYT ngày 18/02/2022 (đối tượng áp dụng mục 2 Điều 3 Thông tư 02/2022/TT-BYT).

4. Đối với việc thực hiện xét nghiệm tự nguyện, theo yêu cầu:

- Đối tượng thực hiện xét nghiệm tự nguyện, theo yêu cầu: đề nghị các đơn vị, địa phương căn cứ Luật phòng chống bệnh truyền nhiễm; chỉ đạo của Chính phủ, Ban Chỉ đạo quốc gia phòng chống dịch COVID-19 và việc triển khai công tác phòng, chống dịch tại đơn vị, địa phương để thực hiện theo quy định.

- Về giá dịch vụ xét nghiệm trong trường hợp này: thực hiện theo các quy định hiện hành về giá dịch vụ KBCB. Từ ngày 28/9/2021, Bộ Y tế đã có công văn 8157/BYT-KHTC đề nghị các đơn vị không thực hiện mức giá dịch vụ theo yêu cầu đối với xét nghiệm COVID-19; người xét nghiệm yêu cầu thực hiện theo mức thu áp dụng đối với đối tượng không thanh toán BHYT.

5. Đề nghị Ủy ban nhân dân các tỉnh/ thành phố chỉ đạo và tăng cường công tác thanh tra, kiểm tra. Xử lý nghiêm các vi phạm nếu có, không để tình trạng lợi dụng dịch bệnh để tăng giá dịch vụ y tế nói chung và dịch vụ xét nghiệm COVID-19 của các cơ sở y tế trên địa bàn. Trong đó lưu ý tiếp tục thực hiện các nội dung sau:

- Thực hiện phương pháp xét nghiệm tiết kiệm, hiệu quả. Trường hợp thực hiện xét nghiệm gộp mẫu phải áp dụng mức giá gộp mẫu, không được áp mức giá xét nghiệm theo mẫu đơn hoặc mức giá của mẫu gộp thấp hơn để thu và thanh toán với người bệnh.

- Trường hợp cơ sở y tế được tài trợ, hỗ trợ test, kít, vật tư thực hiện xét nghiệm từ các nguồn hỗ trợ của Bộ Y tế, các tổ chức, cá nhân thì phải loại trừ các chi phí này khi thực hiện thu và thanh toán chi phí xét nghiệm với từng trường hợp. Nếu đơn vị không loại trừ được chi phí do chưa có giá của các loại vật tư, test kít được tài trợ thì có thể thực hiện theo phương án thực thanh thực chi (chi phí thực tế xuất sử dụng những loại vật tư, hóa chất, các chi phí liên quan để thực hiện xét nghiệm).

- Các cơ sở y tế ngoài công lập đủ điều kiện xét nghiệm COVID-19 theo quy định: không được lợi dụng tình hình dịch bệnh để tăng giá dịch vụ xét nghiệm COVID-19, đồng thời phải thực hiện việc quyết định mức giá, kê khai giá, niêm yết giá theo đúng quy định.

Trên đây là ý kiến của Bộ Y tế về một số nội dung liên quan đến việc thanh toán chi phí xét nghiệm SARS-CoV-2, đề nghị UBND các tỉnh/ thành phố chỉ đạo việc triển khai thực hiện; Sở Y tế các tỉnh/thành phố, các cơ sở y tế và Y tế các Bộ/Ngành thực hiện theo quy định.

- Health Departments affiliated to the Ministry of Health of Vietnam
- Health Authorities of Ministries/Central Authorities

After receiving feedback from several units and local authorities  on difficulties in implementing and paying the cost of SARS-CoV-2 tests via Real-time RT-PCR technique (Official Dispatch No. 2232/UBND-KGVX dated July 13, 2022 and Official Dispatch No. 2400/UBND-KGVX dated July 26, 2022 of the People’s Committee of Hanoi City; Official Dispatch No. 4991/SYT-KHTC dated July 22, 2022 of the People’s Committee of Ho Chi Minh City; Official Dispatch No. 1811/SYT-TTr dated July 19, 2022 of the Health Department of Phu Yen province, and Official Dispatch No. 3069/SYT-KHTC dated August 22, 2022 of the Health Department of Hai Phong province), the Ministry of Health of Vietnam has the following suggestions:

1. The Ministry of Health of Vietnam has promulgated directive documents and professional guidelines on testing subjects in the prevention and control of the COVID-19 epidemic and the implementation of COVID-19 tests based on the actual situation and requirements of each local authority. The Ministry of Health of Vietnam requests units and local authorities to strictly implement the testing according to directives and guidelines of the Ministry of Health of Vietnam in a scientific and practical manner that is appropriate to the epidemic situation, avoiding exploits and waste.

2. The collection and payment of test costs shall be corrected according to each subject following regulations of laws on prices and guiding documents on the implementation of the Ministry of Health of Vietnam, with the latest being Official Dispatch No. 1157/BYT-KHTC dated March 10, 2022 on the implementation of the price of SARS-CoV-2 testing services, in which:

2.1. In case of paying the cost of SARS-CoV-2 tests according to regulations of laws on medical services and health insurance and cases covered by the state budget according to the Law on Prevention and Control of Infectious Diseases (except for cases where SARS-CoV-2 tests are conducted in the community): Comply with regulations and guidelines of Circular No. 02/2022/TT-BYT dated February 18, 2022 of the Ministry of Health of Vietnam on the price of SARS-CoV-2 testing services (previously is Circular No. 16/2021/TT-BYT dated November 8, 2021 of the Ministry of Health of Vietnam).

2.2. In case of conducting SARS-CoV-2 tests in the community covered by the state budget and cases of conducting SARS-CoV-2 tests not prescribed in Clause 2.1 mentioned above covered by the state budget: Comply with forms of bidding, assigning tasks, and placing orders prescribed in Decree No. 32/2019/ND-CP dated April 10, 2019 of the Government of Vietnam on assigning tasks, placing orders, or bidding for the provision of public products and services funded by the state budget’s recurrent expenditures.

Regarding COVID-19 testing services ordered by local authorities that are covered by the State Budget, People’s Committees of provinces or centrally affiliated cities shall stipulate the price according to their competence as prescribed in Clause 8 Article 1 of Decree NO. 149/2016/ND-CP dated November 11, 2016 of the Government of Vietnam; bases, methods, and the valuation order following regulations of laws on prices, regulations prescribed in Point b Clause 1 Article 8 of Decree No. 32/2019/ND-CP dated April 10, 2019 of the Government of Vietnam.

In case People’s Committees of provinces or centrally affiliated cities have temporarily paid the order price and signed the contract according to the temporary price, People's Committees of provinces or centrally affiliated cities shall decide on the order price to form a basis for payment and settlement of costs for SARS-CoV-2 testing service providers.

3. Regarding the application of economic and technical norms to the development of the price of COVID-19 testing service:

- The Ministry of Health of Vietnam has promulgated Decision No. 1436/QD-BYT dated March 4, 2021, Decision No. 4228/QD-BYT dated September 1, 2021, Decision No. 4686/QD-BYT dated October 5, 2021, and Decision No. 5160/QD-BYT dated November 8, 2021 on economic and technical norms of SARS-CoV-2 testing services as the basis for the Ministry of Health of Vietnam to promulgate the price of SARS-CoV-2 testing services in Circular No. 16/2021/TT-BYT dated November 8, 2021 which has been replaced by Circular No. 02/2022/TT-BYT dated February 18, 2022.

- People’s Committees of provinces and centrally affiliated cities shall, based on technical procedures and the actual implementation of services in their areas, issue, amend, and supplement economic and technical norms and cost norms (if any) that apply to public products or services to form a basis for the issuance of unit prices and prices of public products and services according to regulations prescribed in Point b Clause 2 Article 26 of Decree No. 32/2019/ND-CP.

Attention: In case competent authorities approve the adjustment of economic and technical norms, the price of SARS-CoV-2 testing services, in cases of disease examination and treatment not included in the payment scope of the health insurance fund at public medical service facilities, stipulated by local authorities shall not be higher than the maximum price stipulated by the Ministry of Health of Vietnam in Circular No. 02/2022/TT-BYT dated February 18, 2022 (subjects applying regulations prescribed in Section 2 Article 3 of Circular No. 02/2022/TT-BYT).

4. Regarding voluntary or requested tests:

- Subjects of voluntary or requested tests: units and local authorities shall rely on the Law on Prevention and Control of Infectious Diseases, directives of the Government of Vietnam, the National Steering Committee of COVID-19 Prevention and Control, and the implementation of their epidemic prevention and control to conduct the implementation as per regulation.

- Regarding the price of testing services in this case: comply with current regulations on medical service prices. From September 28, 2021, the Ministry of Health of Vietnam has promulgated Official Dispatch No. 8157/BYT-KHTC requesting units to not implement on-demand service prices for COVID-19 tests; testers shall request the implementation according to the collection rate applying to subjects who do not pay health insurance premiums. 

5. People’s Committees of provinces and cities shall direct and increase the inspection and examination, strictly handle violations (if any), and prevent the situation of taking advantage of the epidemic to increase the price of medical services in general and COVID-19 testing services in particular of medical facilities in their areas and pay attention to continue the implementation of the following contents:

- If medical facilities receive sponsorship and aid of testing kits and testing supplies from sources of support of the Ministry of Health of Vietnam, organizations, or individuals, they shall exclude such costs when collecting and paying testing costs for each case.  If the mentioned units fail to exclude the costs due to the lack of prices of the sponsored supplies and testing kits and supplies, they may follow the "real-payment real-expenditure" scheme (actual costs of using supplies, chemicals, and related costs to perform tests).

- Non-public medical facilities eligible for conducting COVID-19 tests as per regulation shall not take advantage of the epidemic situation to increase the price of COVID-19 testing services while implementing decisions on the price, price declaration, and price listing in compliance with regulations.

Above are the suggestions of the Ministry of Health of Vietnam regarding several contents related to the payment of the price of SARS-CoV-2 tests and the Ministry of Health of Vietnam requests People’s Committees of provinces and cities to direct the implementation of such suggestions; Health Departments of provinces and cities, medical facilities, and Health Authorities of Ministries and Central Authorities to comply with regulations.
