1. Export tax exempted or reduced for environmental friendly products
Circular No. 128/2016/TT-BTC regulates the exemption and reduction of the export tax on products that are environmental friendly or result from the recycling and treatment of waste as defined in the Decree No. 19/2015/ND-CP as follows:
- Export tax is exempted for environmental friendly products defined in the export tax schedule and certified in writing under Vietnam Green Label.
- Export tax is reduced by 50% for products of waste recycling and treatment, which are defined in the export tax schedule and certified by competent government authorities as per the Ministry of Natural resources and Environment’s guidelines.
- Export tax is levied at 0% on environmental friendly goods and products of waste recycling and treatment, which are not stated in the export tax schedule.
Circular No. 128/2016/TT-BTC shall come into force as of September 23, 2016.
2. Validity of contractors bidding on the procurement of medicinal ingredients
Circular No. 31/2016/TT-BYT in force as of September 26, 2016, defines the form of the invitation to tender for medical institutions' procurement of medicinal ingredients and traditional medicines.
The validity of a contractor is defined as follows:
- Possess a certificate of free sale, as issued by competent authorities, for medicinal ingredients and traditional medicines.
- Contractors bidding on purchase contracts for traditional medicines must meet requirements on preliminary treatment and processing of medicinal ingredients according to Article 18 of the Decree No. 102/2016/ND-CP.
- Adopt independent financial accounting.
- Be not in a process of dissolution, be not declared bankrupt or insolvent.
- Uphold tender competition as per the Bidding Data List (BDL).
- Be not prohibited from engaging in bidding activities.
- Have been registered on the national bidding network according to the BDL.
3. Criteria for inspectors in the sector of Industry and Trade
Circular No. 15/2016/TT-BCT in effect as of September 25, 2016, on industry and trade inspection defines the following criteria for individuals who are assigned to carry out specialized inspections:
- Meet the criteria as defined in Article 12 of the Decree No. 07/2012/ND-CP.
- Be designated to the grade of specialist or at an equivalent or higher level, and be professionally fit for the inspections assigned.
- Possess a certificate of general or specialized inspector training from a competent authority.
4. Rate of financial aids for communication activities for legal support
Decision No. 32/2016/QD-TTg in effect as of September 22, 2016, defines the policies on legal and court proceeding supports for individuals that are financially distressed or of minor ethnicity from 2016 to 2020.
The rate of financial aids for communication activities for legal support is defined as follows:
- Installation of hotline for legal support in a center: VND 20,000,000.
- Each commune, hamlet or village under extreme hardship receives the following aids for setting up and broadcasting legal support programs in Vietnamese and ethnic language on radio:
+ Compilation of contents: VND 500,000/issue/6 months
+ Radio broadcast: VND 500,000/quarter (6 times/ quarter)
- Each commune, hamlet or village under extreme hardship shall receive the following aid for organizing legal support discourses at grass-root level: VND 2,000,000/discourse/year.
5. Guidance on management and utilization of ODA
Such matter is governed by the Circular No. 12/2016/TT-BKHDT in effect as of September 22, 2016 on guidelines for the Decree No. 16/2016/ND-CP on the management and utilization of official development assistance (ODA) capital and concessional loans from foreign sponsors.
