1. Amendment to the rate of managerial allowance
Decree No. 117/2016/ND-CP in effect as of September 15, 2016, amends the Decree No. 204/2004/ND-CP on remunerations for public officials, public employees and armed forces’ personnel.
The amendment thereof to certain details of the List of allowance for the holding of a managerial position (through voting or designation) includes:
- The unified rate of allowance for managerial positions in departments (or bureaus) under a Ministry:
+ Head of a department (or bureau) under a Ministry: 1.00
+ Vice head of a department (or bureau) under a Ministry: 0.80
+ Manager of an office (division) or equivalent organization: 0.60
+ Vice manager of an office (division) or equivalent organization: 0.40
- The added rate of allowance for managerial positions in an administrative organization of a department (or bureau) under a Ministry:
+ Director: 0.60
+ Vice Director: 0.40
+ Manager: 0.30
+ Vice manager: 0.20
2. Amendment to the regulation on tissue banks
Decree No. 118/2016/ND-CP in effect as of September 15, 2016, amends the Decree No. 56/2008/ND-CP on the organization and operation of tissue banks and the National Coordinating Center for Human Organ Transplantation, as follows:
- Added is Clause 2a on the scope of tissue banks’ professional activities.
- Added is Clause 3a on the conditions and licensing of tissue banks’ operations.
- Amended are Article 2, Article 3 and Article 4 on the types of tissue banks, the establishment of tissue banks, and the application and formalities for licensing of tissue banks.
3. Thirty nine new standards for state audit
State Audit Office of Vietnam promulgated the system of state audit standards under the Decision No. 02/2016/QD-KTNN dated July 15, 2016.
The system consists of 39 standards for state audit, in which there is a terminology list with codes and names specified.
Decision No. 02/2016/QD-KTNN comes into force as of September 15, 2016 and replaces the Decision No. 06/2010/QD-KTNN , the Decision No. 01/2014/QD-KTNN , the Decision No. 02/2014/QD-KTNN , the Decision No. 03/2014/QD-KTNN and the Decision No. 04/2014/QD-KTNN .
4. Audited organizations' filing of complaints
Decision No. 03/2016/QD-KTNN in effect as of September 11, 2016, regulates the settlement of complaints lodged by audited organizations, as follows:
- A complaint shall be filed in writing, sealed and signed by the legal representative (or an authorized person) of the audited organization.
- A complaint can be lodged in 30 days upon the receipt of the audit report.
- An initial complaint shall be processed in at most 65 days upon its admission. The processing time for a complex case may take at most 90 days upon the admission of the written complaint.
5. New regulation on penalties for administrative violations in the chemical industry
As of September 15, 2016, the Decree No. 115/2016/ND-CP amends the Decree No. 163/2013/ND-CP on penalties for administrative violations in the industries of chemicals, fertilizer and industrial explosives.
Added are penalties for certain violations of chemicals, insecticides and disinfectants for household and medical use (referred to as chemicals):
- Fine of up to VND 50 million against violations of regulations on the sale of chemicals.
- Fine of up to VND 3 million against violations of regulations on the use of chemicals.
- Fine of up to VND 1 million against violations of regulations on the transportation of chemicals.
- Fine of up to VND 40 million against violations of regulations on the importation of chemicals.
- Fine of up to VND 20 million against violations of regulations on the testing, labeling and advertising of chemicals.
