CIRCULAR
ON DRIVER TRAINING, DRIVING TESTS, ISSUANCE OF DRIVING
LICENSES; ISSUANCE AND USE OF INTERNATIONAL DRIVING PERMITS; TRAINING,
EXAMINATION, ISSUANCE OF CERTIFICATE OF ROAD TRAFFIC ORDER AND SAFETY LAWS
Pursuant to the Law on Road
Traffic Order and Safety dated June 27, 2024;
Pursuant to Decree No.
56/2022/ND-CP dated August 24, 2022 of the Government on functions,
responsibilities, jurisdiction and organizational structure of the Ministry of
Transport;
At the request of the head
of Transport Authority and Director General of Department for Roads of Vietnam,
The Ministry of Transport
promulgates the Circular on driver training, driving tests, issuance of driving
licenses; issuance and use of international driving permits; training,
examination, issuance of certificate of road traffic order and safety laws.

This Circular promulgates
regulations on the template of driving licenses, driver training, driving
tests, issuance, revocation and using driving licenses, and standards for
driving training yards for motorcycle driving tests; template of international
driving permits, issuance and of international driving permits; standards for
training, examination, issuance, re-issuance of certificate of road traffic
order and safety laws, and standards for heavy-duty vehicle training facilities
implementing training, examination, issuance of certificate of road traffic
order and safety laws.
Article 2.
Regulated entities
1. This Circular applies to organizations
and individuals related to driver training, driving tests, issuance,
replacement, re-issuance, revocation of driving licenses, using driving
licenses and standards for driving training yards for motorcycle driving tests;
issuance and use of international driving permits; training, examination,
issuance, re-issuance of certificate of road traffic order and safety laws and
standards for heavy-duty vehicle training facilities implementing training,
examination, issuance of certificate of road traffic order and safety laws.
2. This Circular does not apply
to use of driving licenses, driving training facilities, organization of
driving training and test; issuance, replacement, re-issuance, revocation of
driving licenses; issuance and re-issuance of certificate of road traffic order
and safety laws for military and police forces carrying out national defense
and security tasks.
Article 3.
Definitions
For the purposes of this
Circular, the terms below shall be construed as follows:
1. Safe driving time is
the duration in which a licensed driver operates a vehicle without causing
serious or particularly serious road traffic accidents.
2. Driving license template
number is the number printed on the back of the driving licenses by the
manufacturer including 02 letters and a string of numbers.
3. DAT data is a
collection of information about the identification and practical driving on
roads of learners transmitted from the DAT device on training vehicle to the
training facility’s server.

5. Nighttime driving
training is from 6pm to 5am of the following day.
6. International driving
permit is a type of driving license (hereinafter referred to as
"IDP").
7. National driving license is
a driving license issued by competent authorities of each country and valid
within the territory of that country.
8. Electronic application of
international driving permits is a collection of electronic documents
related to IDP.
9. The information system on
driving tests, issuance of driving licenses and certificates of road traffic
order and safety laws is a combination of hardware, transmission lines, and
software used to manage information on driving tests, issuance of the driving
licenses and certificates of road traffic order and safety laws, including the
information system on driver training, the information system on driving tests,
the information system on driving licenses and the information system on
issuance of certificates of road traffic order and safety laws.
10. Information system on
driver training includes the information system on driver training of the
driving training facilities and the information system on driver training of
the Department of Transport.
11. Information system on
driving tests includes the information system on driving tests of the
driving test centers and the information system on driving tests of the
Department of Transport.
12. Information system on
driving licenses includes the information system on driving licenses of the
Department for Roads of Vietnam and the information system on driving licenses
of Department of Transport.
13. Information system on
issuance of certificates of road traffic order and safety laws includes the
information system on issuance of certificates of road traffic order and safety
laws of the Department for Roads of Vietnam, the information system on issuance
of certificates of road traffic order and safety laws of the Department of
Transport and the information system on issuance of driving training
facilities.

Article 4.
Reporting
1. The Department of Transport
shall report following information on driver training, driving tests, issuance of
driving licenses to the Department for Roads of Vietnam:
a) Name of the report: Report
on driver training, driving tests, issuance of driving licenses;
b) Content of the report:
Regarding driver training:
numbers of driving training facilities under management, driver training
licenses, training vehicle licenses, driving instructor licenses; evaluation of
management of driving training.
Regarding driving tests,
issuance of driving licenses: numbers of driving test centers under management,
driving test license, issuance of approval for operation of driving training
yards for motorcycle test, issued driving licenses of all categories;
evaluation of management of driving tests;
c) Methods for reporting: in
person or by post or online;
d) Deadline for reporting:
before June 20 annually for the semi-annual report for the first 6 months of
the year; before December 20 annually for annual report;
dd) Frequency of reporting:
semi-annual report for the first 6 months of the year and annual report;

2. Facilities for training road
traffic order and safety laws shall report following information on training
and issuance of certificate of road traffic order and safety laws to the
Department of Transport:
a) Name of the report: Report
on training and issuance of certificate of road traffic order and safety laws;
b) Content of the report:
numbers of training classes, learners, tests for issuance of certificates,
issued certificates;
c) Methods for reporting: in
person or by post or online;
d) Deadline for reporting:
before June 20 annually for the biannual report covering the first six months
of the year; before December 20 annually for annual summary report;
dd) Frequency of reporting:
semi-annual report for the first 6 months of the year and annual report;
e) Deadline for finalizing data
for reporting: from December 15 of the previous year to June 14 of the
reporting period for semi-annual report for the first 6 months of the year.
From December 15 of the previous year to December 14 of the reporting year for
annual summary report;
b) Template of reporting data:
in accordance with Form No. 02 attached to this Circular.

Article 5.
Methods for training
1. 1. Regarding people
obtaining driving licenses of categories A1, A and B1:
a) They shall fully learn
theory content of the training program curriculum in accordance with this
Circular by one of the following learning methods: self-study in accordance
with the law on training and driving tests, or learning at the driving training
facilities;
b) They shall receive practical
driving training at the driving training facilities.
2. 2. Regarding people
obtaining driving licenses of categories B, C1, C, D1, D2, D, BE, C1E, CE, D1E,
D2E and DE:
a) They shall fully learn
theory content of the training program curriculum in accordance with this
Circular by one of the following learning methods: learning at the driving
training facilities, or distance learning, self-study with guidelines in accordance
with the law on training and driving tests;
b) They shall receive practical
driving training at the driving training facilities.

2. Training organization
Based on the training program duration
and time allocation prescribed in clause 1 of this Article and Appendix II
attached to this Circular, the time for revision and end-of-course test, the
driving training facilities shall establish the total training time for the
driving training program, which shall not exceed 10 days (excluding holidays);
b) The number of learners on a
B1-category training vehicle of shall not exceed 05 learners. The driving
distance is calculated for each learner, and the driving time on the training
yard is calculated based on the number of learners on the training vehicle.
3. Reporting on registration
for driving tests
The driving training facilities
receiving the application of driving learners shall ensure that the application
meets the requirements and includes the necessary documents in accordance with
Articles 14 and 15 of this Circular; submit a report on registration for
driving tests (report No. 1) to the Department of Transport in person or by
post or online, and transmit the data via the information system on driving
licenses:
a) Regarding driving training
of categories A1, A: the driving training facilities shall submit a report on
registration for driving tests using the form in accordance with Appendix III
attached to this Circular to the Department of Transport. The driving training
facilities shall affix their seal on adjoining edges of pages on the report;

c) Regarding driving training
of categories B1: the driving training facilities shall submit a report on
registration for driving tests, a list of learners (report No. 1), a training
plan using Form No. 01, Form No. 02 and No. 04 of Appendix IV attached to this
Circular to the Department of Transport. The driving training facilities shall
affix their seal on adjoining edges of pages on the report;
d) The report on registration
for driving tests of A1 category of ethnic minorities who are illiterate in
Vietnamese shall be submitted to the Department of Transport at least 30 days
before the test.
4. End-of-course test
a) Learners of B1 category
shall take theory and practical test at the driving training facilities to be
considered as having qualified the training. Theory test includes questions on
law on road traffic, components and basic repair skills, driving technique. The
practical test includes operating the vehicle forward and backward in a zigzag;
b) The score of the results of
learners is based on a 10-point scale (from 1 to 10) and rounded to the nearest
tenth. A minimum score of 5.0 is required to pass each subject.
c) Learners who take all
end-of-course tests of the training program and obtain a minimum score of 5.0
or higher in each subject shall be considered as having qualified the training.

2. Training organization

B-category and C-category training vehicle of shall not exceed 05 learners and
08 learners respectively. The driving distance is calculated for each learner,
and the driving time on the training yard is calculated based on the number of
learners on the training vehicle.
3. Reporting on registration
for driving tests
The driving training facilities
receiving the application of driving learners shall ensure that the application
meets the requirements and includes the necessary documents in accordance with
Articles 14 and 15 of this Circular; send a report on registration for driving
tests (report No. 1) to the Department of Transport in person or by post or
online, and transmit the data via the information system on driving licenses:
a) Regarding driving training
of categories B, C1: the driving training facilities shall send a report on
registration for driving tests, a list of learners (report No. 1), a training
plan using Form No. 01, Form No. 02 and No. 04 of Appendix IV attached to this
Circular to the Department of Transport. The driving training facilities shall
affix their seal on adjoining edges of pages on the report;

4. End-of-course test
To be considered as having
qualified the training, the learners shall take theory and practical tests
including:
a) Theory test includes
questions on law on road traffic; components and basic repair skills; traffic
ethics and culture, prevention and control of harmful effects of alcoholic
beverages when participating in traffic; skills for fire prevention,
firefighting and rescue; driving technique; traffic situation simulation;
b) The practical test includes
continuous exams, operating the vehicle forward and backward in a zigzag and
driving on roads;
c) The content and methods of
the end-of-course tests are decided by the head of the driving training
facilities. Learners who attend a minimum of 70% of theory lessons, complete
the required time and have at least 50% of the total distance in practical
driving training on the training yard, complete the required distance and have
at least 50% of the time in practical driving training on the road are eligible
to take the end-of-course tests.
d) The score of theory tests of
learners is based on a 10-point scale (from 1 to 10) and rounded to the nearest
tenth. The score for the practical tests including continuous exams is
evaluated in accordance with Appendix XV attached to this Circular;
dd) Learners who take all
end-of-course tests of the training program and obtain a minimum score of 5.0
or higher in each subject shall be considered as having qualified the training.
5. If a learner does not meet
the requirements to be considered as having qualified the training within one
year from the date the driving training facility organizes the first
evaluation, they shall register for a new training course.

2. Training organization
Based on the training program
duration and time allocation prescribed in clause 1 of this Article and
Appendix II attached to this Circular, the time for revision and end-of-course
test, holidays, the driving training facilities shall establish the total
training time for the training program for driving license upgrade, which shall
not exceed 60 days;
b) The number of learners on 01
training vehicle for upgrading from B to BE shall not exceed 05 learners; from
B to C1, B to C, C1 to C, C1 to C1E, C to CE shall not exceed 08 learners; from
B to D1, B to D2, C1 to D1, C1 to D2, C to D2, C to D, D1 to D2, D1 to D, D1 to
D1E, D2 to D, D2 to D2E, D to DE shall not exceed 10 learners. The driving
distance is calculated for each learner, and the driving time on the training
yard is calculated based on the number of learners on the training vehicle.
3. Reporting on registration
for driving tests
The driving training facilities
receiving the application of driving learners shall ensure that the application
meets the requirements and includes the necessary documents in accordance with
Articles 14 and 15 of this Circular; send a report on registration for driving
tests (report No. 1) to the Department of Transport in person or by post or
online, and transmit the data via the information system on driving licenses:
a) Regarding driving training
of categories BE, C1E, C, CE, D1, D1E, D2, D2E, D, DE: the driving training
facilities shall send a report on registration for driving tests, a list of
learners (report No. 1), a list of documents for verification of the issued
driving licenses for cases of driving license upgrade, a training plan using
Form No. 01, No. 02, No. 03 and No. 04 of Appendix IV attached to this Circular
to the Department of Transport. The driving training facilities shall affix
their seal on adjoining edges of pages on the report;
b) The report No. 1 of BE, C1E,
C, CE, D1, D1E, D2, D2E, D, DE categories shall be submitted at least 07
working days after the opening ceremony. The head of the unit who is assigned
by the Department of Transport to manage the test and issuance of driving
licenses shall review and sign on each page including all pages of report No.
1;

To be considered as having
qualified the training, the learners shall take theory and practical tests
including:
a) Theory test includes
questions on law on road traffic; components and basic repair skills; traffic
ethics and culture, prevention and control of harmful effects of alcoholic
beverages when participating in traffic; skills for fire prevention,
firefighting and rescue; driving technique; traffic situation simulation; new
knowledge on the vehicle of the upgraded category
b) The practical test includes
continuous exams, operating the vehicle forward and backward in a zigzag and
driving on roads;
c) The content and methods of
the end-of-course tests are decided by the head of the driving training
facilities. Learners who attend a minimum of 70% of theory lessons, complete
the required time and have at least 50% of the total distance in practical
driving training on the training yard, complete the required distance and have
at least 50% of the time in practical driving training on the road are eligible
to take the end-of-course tests.
d) The score of theory tests of
learners is based on a 10-point scale (from 1 to 10) and rounded to the nearest
tenth. The score for the practical tests including continuous exams is
evaluated in accordance with Appendices XV, XVI and XVII attached to this
Circular;
dd) Learners who take all
end-of-course tests of the training program and obtain a minimum score of 5.0
or higher in each subject shall be considered as having qualified the training.
5. If a learner does not meet
the requirements to be considered as having qualified the training within one
year from the date the driving training facility organizes the first
evaluation, they shall register for a new training course.

Classroom for driving technique
subject shall be equipped with information technology devices that serve as
teaching aids for explaining the structure of the vehicle with a cutaway model
of the engine, powertrain, and electrical system. In cases where the
information technology devices are unable to deliver above information, the
classroom shall be equipped with pictures. There must be information technology
devices that serve as teaching aids for driving techniques. In cases where the
information technology devices are unable to deliver above information, the
classroom shall be equipped with pictures.
c) Classroom for practicing
maintenance and repair of B1-category vehicles shall be equipped with a
ventilation and lighting system to ensure safety and occupational hygiene
requirements. The floor is dust-free. It shall be equipped with special tools
for maintenance and repair. There must be workbenches, whiteboards, tables, and
chairs for teaching and practical training. Special tools are provided to guide
learners in practical exercises such as disassembling and assembling tires,
checking oil, and coolant.
2. Training vehicles shall be
in accordance with categories as prescribed in points a, b and c, clause 1,
Article 57 of the Law on Road Traffic Order and Safety.
3. The motorcycle training yard
has technical specifications and practice patterns that comply with the
dimensions of the practical driving test in accordance with National technical
regulations on road motor vehicle driving test center for each corresponding
vehicle category.
Article
10. Training materials and management documents of driving training facilities
1. The training materials shall
be in accordance with the framework of driver training curriculum prescribed in
Appendix II of this Circular. Driving training facilities shall follow the
regulations for compiling, evaluating, and issuing training materials in
accordance with Article 11 of this Circular.
2. Forms and documents for
automobile driving training facilities include:
a) Report on registration for
driving tests;
b) Training plan;

d) Record on automobile

3. The motor training
facilities of A1, A, B1 categories shall use training materials in accordance
with points a and e, clause 2 of this Article.
4. The automobile driving
training facilities shall use the following training materials: materials
prescribed in clause 2 of this Article, data on management for theory study
time of the subject "law on road traffic” (for training at facilities),
data on management of learners on the management software (for distance
learning, self-study with guidelines), data on supervision of time and distance
for practical driving on roads, and data of practical driving on the automobile
driving simulator.

12. Driving training for people with disabilities

Circular;
b) Learners shall learn all the
content and curriculum in accordance with Article 6 of this Circular.
2. Training for driving tests
and issuance of B-category driving license for automatic transmission vehicles
a) Training for driving tests
and issuance of B-category driving license for automatic transmission vehicles
for people with disabilities in the right foot, right hand, or left hand:
Learners shall choose the
method for driving training in accordance with clause 2 Article 5 of this
Circular;
Learners shall learn all the
content and curriculum in accordance with Article 7 of this Circular, and are
allowed to change from practicing by automobile driving simulator to practicing
by training vehicle;

13. Driving training for A1-category motorcycles for ethnic minorities who are
not literate in Vietnamese
1. Training organization
method: People who wish to obtain driving licenses shall register at driving
training facilities to learn the driving training program in accordance with
Article 6 and Section A of Appendix II attached to this Circular. Classes for
ethnic minorities who are not literate in Vietnamese shall be taught separately
with an interpreter for the ethnic minority language.
2. Training methods: Learners
shall learn through visual images, illustrations of road signs, models,
simulations, and skills for handling road traffic situations; Q&A sessions
and hands-on demonstrations.
Article
14. Requirements for learners
1. a) Vietnamese, foreigners
allowed to reside, work, or study in Vietnam;
2. Learners who wish to upgrade
their driving licenses shall meet requirements prescribed in clause 4 Article
60 of the Law on Road Traffic Order and Safety. The specific safe driving time
for each license category is regulated as follows:
a) From B1 to C1, B to C, B to
D1, B to BE, C1 to C, C1 to D1, C1 to D2, C1 to C1E, C to D1, C to D2, D1 to
D2, D1 to D, D1 to D1E, D2 to D, D2 to D2E, D to DE: The safe driving time
shall be above 02 years;

3. People who have B-category
driving license for automatic transmission vehicles are permitted to register
to learn for issuance of B-category driving license for manual transmission
vehicles. People who have B-category driving license are permitted to register
to learn for issuance of C1-category driving license. Learners shall learn all
content of driving training content and apply the application in accordance
with clause 1 Article 15 of this Circular. If they pass the test, the
test-organizing agency shall submit a written request to the license-issuing
authority to cut the corner of the old license and a written request to the
Department for Roads of Vietnam to delete the license management number that
has been issued.
Article
15. Learners’ application
1. Learners who apply for
driving training for the first time shall apply 01 set of application in person
at the driving training facilities and take a portrait photo to store in the
database on driving licenses. Application includes:
a) Request for training and
driving tests for issuance of driving license in accordance with Appendix XI
attached to this Circular;
b) Copies, certified electrical
copies, copies issued from the original documents of one of the following
papers: permanent residence card, temporary residence card, diplomacy
identification, public affair identification (for foreigners);
2. Learners who apply for
upgrade of driving licenses shall apply 01 set of application in person at the
driving training facilities and take a portrait photo to store in the database
on driving licenses. Application includes:
a) Documents as prescribed
clause 1 of this Article;
b) Copies attached with the
original, certified electrical copies, copies issued from the original
documents of lower secondary school diploma or equivalent in cases where the
learners upgrade driving licenses to D1, D2 and D categories;
c) Declaration on safe driving
time using the form in accordance with Appendix XII attached to this Circular.

Article
16. Storage of training materials and management documents of driving training
facilities which have been dissolved or have their licenses revoked
1. The driving training
facilities shall store the applications and documents related to the training
courses
a) Indefinitely store records
on qualified learners; operational plan of motorcycle training facilities of
A1, A, B1 categories.
b) Store the following
documents for 03 years: applications on inspection on course completion, data
on management for theory study time of the subject "law on road traffic”
(for automobile driver training), data on supervision of time and distance for
practical driving on roads, and data of practical driving on the automobile
driving simulator, electronic data on management for theory study time (for
distance learning, self-study with guidelines), and documents prescribed in
points a, b, c and e, clause 2, Article 10 of this Circular.
2. The Department of Transport
shall store the following documents:
a) Reports on registration of
driving tests of driving training facilities;
b) Lists of requests for
verification of issued driving licenses for cases of upgrading driving licenses
of driving training facilities;
c) Training plans of driving
training facilities;
d) Records on inspection on
driving training facilities of the Department of Transport;

3. Management of learners of
driving training facilities which have been dissolved or have their licenses
revoked
a) Dissolved driving training
facilities shall take the following responsibilities:
Within 10 days (excluding cases
where driving training facilities dissolved 01 day before the effective date of
this Circular) from the effective date of the decision on dissolution of the
training facility, the dissolved training facility shall handover the following
records to the training facility that takes over the training obligations:
reports on registration of driving tests, lists of learners (Report No. 1) and
learners’ application; and report to the Department of Transport for
supervision and management.
Within 10 days (excluding cases
where driving training facilities dissolved 01 day before the effective date of
this Circular) from the effective date of the decision on dissolution of the
training facility, the dissolved training facility shall conduct a review, list
the candidates who have been issued with vocational basic-level training
certificates or training certificates, or completion certificates, and hand
over the applications of learners that they are managing to the Department of
Transport for supervision and management.
b) Driving training facilities
which have their licenses revoked shall take the following responsibilities:
Within 10 days (excluding cases
where driving training facilities dissolved 01 day before the effective date of
this Circular) from the effective date of the decision on dissolution of the
training facility, the dissolved training facility shall conduct a review, and
list the candidates they are managing; formulate resolutions for rights of
learners and report to the Department of Transport for supervision and
management.
Ensure the rights of learners
as prescribed in the training contract. If the learner agrees to continue the
training, the training facility shall negotiate with other facilities in the
area to hand over the training obligations. If the learner do not agree with
the proposed plan for continuing the training, the training facility shall
negotiate with the learner to terminate the contract.
Within 20 days (excluding cases
where license of driving training facilities is revoked 01 day before the
effective date of this Circular) from the effective date of the decision on
revocation of the license of training facility, that training facility shall
hand over the lists of learners that they are managing attached with the
following documents: lists of learners (Report No. 1), reports on registration
for driving tests, other applications and data (if any) to the training
facility that takes over the training obligations; and report to the Department
of Transport for supervision and management;
c) The driving training
facility receiving learners from driving training facilities which have been
dissolved or have their licenses revoked shall receive the applications
prescribed in points a and b of this clause, take responsibilities to manage
the learners in accordance with the law. The hand over shall be recorded in
writing including the following content: comprehensive and clear notes on
handed over documents, commitment and responsibilities of each party (both
transferring and receiving party have obligations and responsibilities related
to handed over applications, documents, assets).

The tests shall be graded
directly by an examiner. Candidates shall drive through 05 standard cones in a
zig zag twice;
dd) Regarding category C1E, CE
The tests shall be graded
directly by an examiner. Candidates shall operate the vehicle through 02 tests:
driving through 05 standard cones in a zig zag twice; performing a vertical
parking.

b) Members includes heads of
the driving test centers, heads of the driving training facilities, head of the
examiners and a secretary. The secretary is the person assigned by the
Department of Transport to manage the driving tests and issuance of driving
licenses. If the head of driving test center is also the head driving training
facility, another head shall be assigned to the Test Council.
3. Responsibilities of the Test
council
a) Direct, inspect and request
the completion of the requirements for organizing the tests;
b) Assign and make a plan for
the tests;
c) Disseminate, instruct
regulations, internal regulations on the tests, notify the fees for the tests
and issuance of driving licenses, and essential regulations to examiners and

e) Request the candidates to
compensate for the damages if accidents occur due to the fault of candidates

20. Examiners team
1. Examiners team is
established by the Department of Transport.
a) The examiners team is under
the direct supervision of the Test Council. The examiners team responsible for
issuance of A1 and A categories is under the direct supervision of the unit
assigned by the Department of Transport to manage the driving tests and
issuance of driving licenses.
b) The examiners team shall be
automatically dissolved after the test.
2. The examiners team includes
the head and examiners
The head is an examiner and a
member of the unit assigned by the Department of Transport to manage the
driving tests and issuance of driving licenses. The head shall hold an
automobile driving license when implementing duties at an automobile driving
test.
3. Duties of the examiners team
a) Inspect test vehicles,
marking devices, test yard, methods for assurance of safety for the tests;

21. Examiners
1. Requirements for examiners
a) Examiners are members of the
Department of Transport (excluding inspectors of the Inspectorate of the
Departments of Transport) and instructors of the driving training facilities.
Instructors of driving training facilities must have teaching experience and
pay compulsory social insurance contribution for a continuous period of at
least 3 years. They are not allowed to grade learners who have been directly
trained at the facility;
b) Examiners must have been
trained in test procedures, and been granted the examiner cards the Department
for Roads of Vietnam in accordance with Appendix XIX attached to this Circular.
The examiner cards are valid for a maximum of 3 years and below the validity
period of the examiners' driving licenses of the corresponding categories that
they are in charge.
2. Standards for examiners
a) Have ethical reputation and
not being under disciplinary actions;

corresponding categories that they are in charge.
3. Implementation of training
for examiners
a) Training for issuance of
examiner cards shall be organized once every 03 years, or at the request of the
Departments of Transport, the Department for Roads of Vietnam;
b) The Department for Roads of
Vietnam shall notify the training for examiners to the Department of Transport.
c) The Department of Transport
shall review, make a list (attached with a 4 x 6 cm portrait photo with white
background) of officials, public employees and instructors of the driving
training facilities who meet the requirements in point a, clauses 1 and 2 of
this Article, and send to the Department for Roads of Vietnam online or by
post;
d) The Department for Roads of
Vietnam shall receive, make decision on organization of the training, notify
the list of eligible, organize the training and issue the examiner card.
4. Content of the training

cards; in the case where a trainee does not meet the requirements in one of the
tests, they must participate in the next training session to retake the test

22. Preparation for test
The unit assigned by the
Department of Transport to manage the driving tests and issuance of driving
licenses shall implement the following tasks:
1. Regarding the test for motorcycles
of A1 and A categories
a) The Department of Transport
shall inspect eligibility and application of the candidates in accordance with
Articles 28 and 29 of this Circular;
b) The person assigned to
review and approve the application of candidates shall make a record on
application review using Form No. 1 of Appendix XX attached to this Circular;
c) Regarding training and test
for ethnic minorities who are not literate in Vietnamese:
The Department of Transport
shall send a written document using the Form No. 02 of Appendix XX attached to
this Circular to the commune-level People's Committee where the illiterate
ethnic minorities live to collect opinions and notify the candidates. The
deadline for collecting opinions is within 15 days from the date the Department
of Transport sends the document.

If the Department of Transport
receives the response from the commune-level People's Committee after the
prescribed deadline, the Department of Transport shall include eligible people
to the list of candidates of the upcoming test;
d) Based on the list of
eligible candidates attached to the Record on review of the applications and
eligibility of the candidates in accordance with Form No. 01, written response
of the People's Committee regarding the level of education of the ethnic
minorities who are not literate in Vietnamese, and the result of the review on
the points and validity of the driving license of examiners, the Department of
Transport shall issue the decision on organization of the driving test using
the Form No. 05, and the list of candidates taking the test for issuance of
driving licenses using the Form No. 06 of Appendix XX attached to this
Circular;
dd) If the application is
invalid, the Department of Transport shall send a notification attached with
the detailed list to the driving training facilities to notify the ineligible
candidates.
2. Regarding categories B, C1,
C, D1, D2, D, BE, C1E, CE, D1E, D2E, DE
a) The driving training
facilities shall submit the request to organize the driving test attached with
the list of candidates (report No. 2) using Forms No. 08 and 09 of Appendix XX
attached to this Circular to the Department of Transport. The report No. 2
shall be submitted to the Department of Transport by post or via the
information system on driver training at least 7 working days before the test.
b) The Department of Transport
shall review the eligibility and applications of the candidates for issuance of
driving licenses of categories B1, B, C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E,
DE in accordance with Articles 28 and 29 of this Circular. The candidates must
be included in the list of learners (report No. 1);
c) The Department of Transport
shall verify the issued driving licenses in cases of upgrade of driving
licenses;
d) The person assigned to
review and approve the application of candidates shall make a record on
application review using Form No. 1 of Appendix XX attached to this Circular;
dd) Based on the list of
eligible candidates attached to the Record on review of the applications and
eligibility of the candidates in accordance with Form No. 01 of Appendix XX
attached to this Circular and the result of the review on the points and
validity of the driving license of examiners, the Department of Transport shall
approve and issue the decision on organization of the driving test using the
Form No. 05, the list of candidates taking the test for issuance of driving
licenses using the Form No. 06 of Appendix XX attached to this Circular, and
the list of candidates taking the test for re-issuance of driving licenses
using the Form No. 07 of Appendix XX attached to this Circular;

Article
23. Procedures for organization of test
1. Meeting of the Test council
and opening ceremony of the test
a) The President of the Test
council shall organize a meeting with the Test Council, examiners team,
supervising team (if any) to assign duties to each member before
organizations of the test;
b) Organize the opening
ceremony of the test to announce the decision on organization of the test and
inform relevant information to the candidates.
2. Organization of the
test in accordance with the content and procedures for driving tests
prescribed in Article 17 and Appendices XIII, XIV, XV, XVI and XVII attached to
this Circular.
3. Ending of the test
a) Regarding categories B, C1,
C, D1, D2, D, BE, C1E, CE, D1E, D2E, DE: The President of the Test council
shall organize a meeting with the council, examiners team, supervising team (if
any), the head of examiners team to report on the test result and jointly sign
the summary report on the result of the test. The President shall sign and
affix seal on the summary report on the result of the test of qualified
candidates using the Form No. 01 of Appendix XXI attached to this Circular;
b) Regarding the test for
motorcycles of A1 and A categories: The head of examiners team shall organize a
meeting with members of the examiners team, head of driving training
facilities, supervising team (if any) to approve the result of the test and
jointly sign the summary report on the result of the test. The head of the unit
who is assigned by the Department of Transport to manage the test and issuance
of driving licenses shall sign and affix seal on the summary report on the
result of the test of qualified candidates using the Form No. 02 of Appendix
XXI attached to this Circular;
The summary report on the
result of the test is the original document and reserved by the qualified
people.

1. Based on the actual
situation, the Department of Transport shall establish a supervising team to
conduct unexpected supervision of the test.
2. Members of the supervising
team are officials of the Inspectorate of the Departments of Transport. The supervising
team for a motorcycle driving test and automobile driving test include at least
02 and 03 people respectively. One of the member is assigned as the head of the
team.
3. When supervising the tests,
inspectors shall wear the uniform in accordance with the law.
4. Duties of the supervising
team during the test
a) Supervise the implementation
of test content and procedures of the Test council and examiners team to ensure
transparency, objectivity, and clarity of the test;
b) Supervise the identification
check of candidates before they enter the room for theory test, or perform
practical tests on driving training yard or on roads; prevent anyone without
duties to enter the room for theory test;
c) Supervise the organization
of practical driving test on roads to ensure the test is conducted on the
designated road as announced by the Department of Transport; observe and
collect relevant information on the test.
d) Work independently; do not
enter the room for theory test, sit in the test vehicle, perform the duties of
examiners.
5. The duties of the
supervising team during the practical driving test on driving training yard is
in accordance with clause 2 Article 18 of this Circular.

6. Powers of the supervising
team
a) Make a record when a
violation is detected, and request the Test Council and examiners team to
handle it promptly and in accordance with regulations;
b) Report to the Director of
the Department of Transport for consideration and resolution.
7. At the end of the test, the
head of the supervising team shall report the results of supervision in writing
to the Director of the Department of Transport.
Article
25. Recognition of driving test results
1. Recognition of results of
candidates of categories A1, A and B1
a) Candidates are recognized as
qualified when they pass both theory and practical tests on driving training
yard;
b) Candidates who are not
qualified may apply for a retake on the next test at the same test centers;
c) Candidates who do not pass
theory test are not allowed to participate in the practical test on driving
training yard;

dd) Candidates who carry mobile
phones or communication devices into theory test room or commit any fraud act
to falsify the driving test results shall have their tests suspended and
driving test results cancelled.
2. Recognition of results of
candidates of categories B, C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E, DE:
a) Candidates are recognized as
qualified when they pass all of the following tests: theory test, traffic
situation simulation test, practical tests on driving training yard and on
roads;
b) Candidates who are not
qualified may apply for a retake on the next test at the same test centers;
c) Candidates who fail theory
test are allowed to participate in the traffic situation simulation test. If
they fail both theory and traffic situation simulation tests, they are not
allowed to participate in the practical test on driving training yard. If they
fail the practical test on driving training yard, they are not allowed to
participate in the practical test on roads;
d) Candidates who pass theory,
traffic situation simulation tests and practical test on driving training yard
may reserve their theory result within 01 year from the date on which they pass
the above test. If they wish to retake the test, they must be included in the
record of absent and failed candidates of the previous Test Council or
examiners team, and a valid health certificate for driver issued by eligible
medical facilities in accordance with the law on medical examination and
treatment.
dd) Candidates who carry mobile
phones or communication devices into theory test room, traffic situation
simulation test room, on test vehicles or commit any fraud act to falsify the
driving test results shall have their tests suspended and driving test results
cancelled.
3. Within 03 working days from
the end of the test, the Department of Transport shall review, consolidate the
results, issue decision on recognition of qualified candidates attached to the
list of candidates qualified for issuance of driving licenses using the Form in
Appendix XXII attached to this Circular.

26. Driving tests for people with disabilities

a) Candidates shall participate
in theory and practical test on driving training yard in accordance with content

27. Test for issuance of A1-category driving licenses for ethnic minorities who
are not literate in Vietnamese
1. Content and procedures for
A1-category driving tests are implemented in accordance with clauses 1 and 2
Article 17 of this Circular.

test paper, and the record on practical test on driving training yard.
Article
28. Candidates
1. Candidates must satisfy age
requirements (as the date of the driving test) and health requirements in
accordance with clauses 1 and 2 Article 59 of the Law on Road Traffic Order and
Safety.
2. Candidates shall fully learn
the content and program in accordance with the law. The driving training
facilities shall consider for recognition of qualified candidates using the
Forms in XXIII attached to this Circular for B1, B, C1, C, D1, D2, D, BE, C1E,
CE, D1E, D2E, DE categories.
3. Candidates must be included
in the list of learners of report No. 1 for people taking the test for the
first time.
Article
29. Application for driving test
1. The driving training
facilities shall make a set of application and submit to the Department of
Transport. The set of application includes:
a) The application prescribed
in clause 1 Article 15 of this Circular;
b) Preliminary certificate,
training certificate, or certificate for completion of training course for
individuals taking the driving test for driving licenses of B1, B, C1
categories;

d) Valid health certificate
issued by an eligible medical facility that complies with the law on medical

Article
31. Template of driving licenses
1. The Department of Transport
shall issue driving licenses using Template No. 01 in Appendix XXIV attached to
this Circular from the date on which this Circular takes effect to December 31,
2025; issue driving licenses using Template No. 02 in Appendix XXIV attached to
this Circular from January 01, 2026.
2. The restriction conditions
of driving licenses apply to both Templates No. 01 and 02 in accordance with
section 2 of Template No. 03 in the Appendix XXIV attached to this Circular.
3. The list of driving license
categories and restriction condition codes apply to Template No. 02 in
accordance with section 1 and 2 of Template No. 03 in Appendix XXIV attached to
this Circular.
Article
32. Use and management of driving licenses
1. The driving license made of
PET material (hereinafter referred to as "PET driving license") is
issued to each individual with a unique management number, which is used for
both the unlimited and limited-term driving licenses.
2. If anyone wishes to
integrate data of unlimited-term driving license with unlimited driving
license, they shall register for replacement (re-issuance) of driving licenses
as prescribed in Appendix XXVI attached to this Circular, carry out procedures
for driving licenses as prescribed in Article 36 of this Circular.
3. Holders of driving licenses
are only allowed to operate types of vehicles prescribed in the driving
licenses.
4. When upgrading driving
licenses, the authorities responsible for issuing driving licenses shall
collect old driving licenses and destroy them in accordance with the law on
storage.

6. If foreigners or Vietnamese
residing overseas wishes to operate vehicles in Vietnam, they shall implement
as follows:
a) If they have national
driving license, they shall apply for transfer to the corresponding driving
licenses of Vietnam
b) In cases where an
international agreement on driving license to which Vietnam is a signatory
prescribes otherwise, such international agreement shall be applied.
7. PET driving licenses and
driving licenses issued from January 01, 2025 are driving licenses issued by
competent authorities of which validity period, template number, issuance date,
expiration date match those on the information system for management of driving
licenses, or those integrated in electrical identification accounts
(hereinafter referred to as "eID").
Article
33. Verification of driving licenses
1. Driving licenses shall be
verified in the following cases:
a) Issuance, replacement of
driving licenses issued by Transport authorities
The Department of Transport
shall search and print information on driving licenses from the information
system for management of driving licenses for cases of upgrade, replacement,
re-issuance of driving licenses. If there is no information on the information
system for management of driving licenses, the Department of Transport shall
send a written request to the authorities that issued the driving licenses for
verification.
If there is no verification
result of the driving license or if the verification result shows that the
driving license was not issued by the Department of Transport, the Department
of Transport shall not approve the upgrade, replacement, re-issuance of driving
licenses;

In case of suspicion, the
authorities responsible for replacement of driving licenses shall send a
written request to the Department of Vehicle and Machinery affiliated to the
Ministry of National Defense to verify the issued licenses.
If there is no verification
result of the driving license or if the verification result shows that the
driving license was not issued by the Ministry of National Defense, the
Department of Transport shall not approve the replacement of driving licenses;
c) Replacement of driving
licenses issued by the Ministry of Public Security to licenses issued by
Transport authorities
In case of suspicion, the
authorities responsible for replacement of driving licenses shall send a
written request to the Department of Traffic Police affiliated to the Ministry
of Public Security to verify the issued licenses.
If there is no verification result
of the driving license or if the verification result shows that the driving
license was not issued by the Ministry of Public Security, the Department of
Transport shall not approve the replacement of driving licenses.
2. Methods for verification of driving
licenses
a) Within 01 working day from
the date on which the driving training facilities receives the list of request
for verification of driving licenses or valid documents as prescribed in
Articles 36, 37 and 38 of this Circular, the Department of Transport shall send
a written request for verification of driving licenses using Form No. 01 in
Appendix XXV attached to this Circular to the authorities that issued the
driving licenses;
b) After receiving the written
request for verification, the Department of Transport shall immediately respond
via phones, emails, or fax. After 02 working days, the Department of Transport
shall send a written response using Form No. 02 in Appendix XXV attached to
this Circular.

34. Issuance of driving licenses

a) The Department of Transport
shall issue driving licenses to qualified people based on the decision on
recognition of qualified candidates. The date of qualifying the test recorded
on the back of the license is the date of signing the decision on recognition
of qualified candidates;
b) The driving licenses shall
be issued within 10 days from the end of the test if the people passed the test
has already paid the fee for issuance of driving licenses.
2. Regarding holders of expired
driving licenses
Holders of expired driving
licenses of B, C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E, DE categories
Holders shall take theory test
in accordance with point a clause 1 Article 17 of this Circular within 01 year
from the expiration date for issuance of driving licenses.
If the driving license has been
expired more than 01 year, the holder must take theory test, practical tests on
driving training yard and on roads as prescribed in clauses 1, 2 and 3, Article
17 of this Circular.
The application for driving
test shall be in accordance with clause 3 Article 29 of this Circular;
b) Holders of lost and expired
driving licenses of B, C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E, DE categories
who are listed in the record of the Department of Transport and not subject to
confiscation of driving licenses
If the driving license has been
expired more than 01 year, the holder must take theory test as prescribed in
point a clause 1 Article 17 of this Circular.

The application for driving
test shall be in accordance with clause 3 Article 29 of this Circular;
c) The date of qualifying the
test recorded on the back of the driving license is the date of qualifying the
test of the old driving license;
d) People who wish for revision
shall register at the driving training facilities for guidelines for revision.
They shall pay the fee for revision in accordance with the law. They do not
have to relearn the training program;
dd) For cases of failing the
tests, holders of expired driving licenses, holders of lost and expired driving
licenses shall register at the Department of Transport for retake.
3. People who have violated
road traffic order and safety regulations and have not resolved and handled
administrative violations in the field of road traffic order and safety as
required by competent authorities are not eligible to apply for driving tests
for issuance of driving licenses.
Article
35. Re-issuance of driving licenses
1. Holders of lost but
unexpired driving licenses are considered for re-issuance of driving licenses.
Re-issuance of lost driving licenses shall be in accordance with clauses 2, 3
and 4, Article 36 of this Circular.
2. The date of qualifying the
test recorded on the back of the driving license is the date of qualifying the
test of the old driving license;
3. Driving licenses shall not
be re-issued in the following cases: the information of driving licenses are
not on the information system on driving licenses of the Department for Roads
of Vietnam or the list of people issued with driving licenses; people who have
violated road traffic order and safety regulations and have not resolved and
handled administrative violations in the field of road traffic order and safety
as required by competent authorities.

1. Requirements for replacement

b) Holders of damaged driving
licenses issued by Transport authorities, which are no longer usable;
c) Vietnamese, foreigners who
have permanent residence card in Vietnam and Vietnamese driving licenses
transferred from foreign driving licenses, wish to renew driving licenses when
they are expired;
d) If the date of birth, full
name, nationality, place of birth, and residence address on the driving license
do not match the information on the citizen identification card or ID card, the
authority responsible for management of driving licenses shall proceed to
replace a new driving license with information matching with the citizen
identification card or ID card;
dd) Driving licenses shall not
be replaced in the following cases: the information of driving licenses are not
on the information system on driving licenses of the Department for Roads of
Vietnam or the list of people issued with driving licenses; people who have
violated road traffic order and safety regulations and have not resolved and
handled administrative violations in the field of road traffic order and safety
as required by competent authorities.
2. The application for
replacement of driving licenses issued by Transport authorities include:
a) Request for issuance
(re-issuance) of driving licenses in accordance with Appendix XXVI attached to
this Circular;
b) Unexpired health certificate
issued by a medical facility that complies with the law on medical examination
and treatment (except for holders of categories A1, A, B1 driving licenses);

d) Unexpired passport (for
foreigners and Vietnamese residing overseas).
3. Implementation procedures
a) Individuals prepare a set of
application as prescribed in clause 2 of this Article, and submit in person or
via public services portal of the Department of Transport.
If the applicants submit the
application in person, he/she shall take portrait photo at the authorities
responsible for issuing driving licenses and pay the fee after the application
is received.
If the applicants submit the
application via public services portal, he/she shall declare information as in
the guidelines, take responsibilities for the accuracy and legality of the
declared information and fully pay the fee for issuance of driving license via
the online public service payment function and other additional fees based on
individual needs. They shall return the old driving licenses when they receive
the new licenses;
b) The Department of Transport
shall review the application upon receipt, search on the violation management
software of the information system on training, examination, issuance of
driving licenses, certificates of road traffic order and safety laws, access
the database on road traffic order and safety of the Ministry of Public
Security, or search violations via the electronic identification accounts. If
the driving licenses are not eligible for replacement or the application is not
valid as prescribed by law, the Department of Transport shall notify contents
that need to be added or amended to the applicants in person, via written
document, or via public services portal within 02 working days;
c) Within 05 working days from the
receipt of valid application including the verification result of the eID via
the system of identification and electronic authentication, the Department of
Transport shall implement replacement of driving licenses. In cases of
ineligible for replacement of driving licenses, the Department of Transport
shall send a written response with clear reasons;
d) The authorities responsible
for issuing driving licenses shall store the original applications for
replacement of driving licenses issued by Transport authorities (except for
cases of replacement of driving licenses via public services portal) within 02
years from the issuance of driving licenses and revocation of old driving
license (for cases of replacement of driving licenses via full procedures on public
services portal, drivers shall take responsibility to send the old driving
licenses to the issuing authorities for destruction), except for cases of
replacement of driving licenses for individuals with revoked integrated driving
licenses.
dd) If the drivers wish to
degrade their driving licenses, they shall declare in the request for
replacement or re-issuance of driving licenses prescribed in Appendix XXVI
attached to this Circular and take responsibility for the declaration.

Article
37. Replacement of driving licenses issued by the Ministry of National Defense
to licenses issued by Transport authorities
1. Requirements for replacement
of driving licenses issued by the Ministry of National Defense to licenses
issued by Transport authorities
a) Holders of unexpired
military driving licenses upon leaving military service (discharge,
re-assignment, retirement, termination of employment contract in the military)
are eligible to replace driving licenses;
b) Unexpired driving licenses
eligible for operating various types of vehicles are allowed to be replaced by
driving licenses of corresponding types of vehicles issued by Transport
authorities; Cx-category military driving licenses are allowed to be replaced
by C-category driving licenses issued by Transport authorities;
c) Holders of damaged driving
licenses issued by the Ministry of National Defense, which are no longer
usable;
d) Replacement is not allowed
in the following cases: military driving licenses of which information is
erased; people who violate road traffic order and safety regulations and have
not completed the requirements of the competent state authorities concerning
the resolution and handling of the administrative violation in the field of
road traffic order and safety.
2. Application includes:
a) A request for issuance
(re-issuance) of driving licenses in accordance with Appendix XXVI attached to
this Circular;
b) A copy of the Decision on
leaving military service signed by the heads of Regiments. For people working in
defense enterprises under contract, they must submit a copy of the Decision on
termination of employment contract with a validity period not exceeding 6
months from the date of issuance by the competent entities of the defense
enterprises;

d) Copies, certified electrical
copies, electrical copies issued from the master register of the unexpired
military driving license.

Department of Transport; they shall take portrait photo at the place of receipt
of driving license, present the original of documents prescribed in point b
clause 2 of this Article for comparison, and pay the fee after the application
is received;
b) The Department of Transport

safety of the Ministry of Public Security, or search violations via the
electronic identification accounts. If the driving licenses are not eligible
for replacement or the application is not valid as prescribed by law, the
Department of Transport shall notify contents that need to be added or amended
to the applicants in person or via written document within 02 working days from
the receipt of the application;
c) Within 05 working days from
the receipt of valid application including the verification result of the eID
via the system of identification and electronic authentication, the Department
of Transport shall implement replacement of driving licenses. In cases of
ineligible for replacement of driving licenses, the Department of Transport
shall send a written response with clear reasons;
d) The return of driving
license shall be carried out at the authorities receiving the applications or
via postal service as requested by the applicants;
dd) If the drivers wish to

1. Requirements for replacement
of driving licenses issued by the Ministry of Public Security to licenses
issued by Transport authorities
a) Holders of unexpired
military driving licenses issued by the Ministry of Public Security before July
31, 1995 upon leaving public security service (discharge, re-assignment,
retirement, termination of employment contract in the People’s Public Security)
are eligible to replace driving licenses;
b) Holders of damaged

b) A copy of driving license; a
copy of the Decision on discharge or retirement issued by competent authorities
or a copy of the Decision on leaving public security service at the
commune-level issued by competent authorities or a copy of the Decision on
termination of employment contract or Decision on recruitment or employment
contract for a duration of over 12 months of units in People’s Public Security;

4. The application for
replacement of driving licenses of learners of civilian programs of People's
Public Security schools issued by the Ministry of Public Security before July
31, 2020:
a) Documents as prescribed
points a and c, clause 3 of this Article;
b) Copies, certified electrical
copies, electrical copies issued from the master register of the Decision on
recognition of graduation of schools, institutions of People’s Public Security;
c) The original documents
issued by the Public Security including: application for driving test,
issuance, replacement of driving licenses with approval from the heads of the
units; health certificate for driver; certificate on completion of driving
training program; record on general results of driving test.
5. Implementation procedures
a) Individuals submit in person
a set of application as prescribed in clause 2 or clause 3 or clause 4 of this
Article to the Divisions Department of Transport; they shall take portrait
photo at the place of receipt of driving license, and pay the fee after the
application is received;
b) The Department of Transport shall
review the application, search on the database on road traffic order and safety
of the Ministry of Public Security, or search violations via the electronic
identification accounts. If the driving licenses are not eligible for
replacement or the application is not valid as prescribed by law, the
Department of Transport shall notify contents that need to be added or amended

c) Within 05 working days from

Article
39. Replacement of IDP to licenses issued by Transport authorities
1. Requirements for replacement
of IDP to licenses issued by Transport authorities
a) Foreigners residing,
studying, working in Vietnam, who have unexpired national driving licenses and
have one of the following papers: diplomacy identification, public affair
identification, permanent residence card or temporary residence card with
duration of more than 03 months, are eligible for replacement of corresponding
driving licenses in Vietnam;
b) Vietnamese people (people
holding Vietnamese nationality), who are issued with national driving licenses
during the time they reside, study, work abroad, are eligible for replacement
of corresponding driving licenses in Vietnam if their national driving licenses
are unexpired.
c) Temporary driving licenses
of foreign countries are not eligible for replacement; IDP; expired, erased,
damaged driving licenses of foreign countries of which information is missing
for replacement of driving licenses, or there are discrepancies in
identification; driving licenses of foreign countries not issued by competent
authorities; Vietnamese people with foreign driving licenses who have resided
abroad for less than 3 months and their residency period does not align with
the driver training period of the country that issued the driving licenses.
2. Application includes:
a) A request for replacement
(re-issuance) of driving licenses (using the form in Appendix XXVI attached to
this Circular if the applicants are Vietnamese, using the form in Appendix
XXVII attached to this Circular if applicants are foreigners);

c) Unexpired health certificate
issued by a medical facility that complies with the law on medical examination
and treatment (except for foreigners who replace their driving license
according to the validity period in their visa or temporary residence card);
d) Copies, certified electrical
copies, copies issued from the original documents of one of the following
papers: permanent residence card, temporary residence card, diplomacy
identification, public affair identification.
3. Implementation procedures
a) Individuals submit a set of
application as prescribed in clause 2 of this Article to Department of
Transport where they register their temporary residence or permanent residence;
they shall take portrait photo at the place of receipt of driving license,
present the original of above documents (except for the originals that have
been submitted) for comparison, and pay the fee after the application is
received;
b) Within 05 working days from
the receipt of valid application including the verification result of the eID
via the system of identification and electronic authentication, the Department
of Transport shall implement replacement of driving licenses. In cases of
ineligible for replacement of driving licenses, the Department of Transport
shall send a written response with clear reasons;
c) The return of driving
license shall be carried out at the authorities receiving the applications or
via postal service as requested by the applicants.
4. The application for
replacement of driving licenses issued by the competent authorities is the
original application including documents prescribed in clause 2 of this Article
and foreign driving licenses, and preserved by the holders. The application for
replacement of driving licenses of non-permanent residents in Vietnam is
preserved by the competent authorities responsible for replacement of driving
licenses including documents prescribed in clause 2 of this Article.
5. In case there are suspicions
regarding the entry and residence of foreigners in Vietnam, the authority
responsible for replacement of driving licenses shall submit a written request
to the Ministry of Foreign Affairs, the Immigration Departments, or the
Immigration Offices under the Police Departments of provinces and
central-affiliated cities to verify the information.

b) The national driving license
issued to a person who holds multiple categories shall be replaced to a
Vietnamese driving license to operate the corresponding categories of vehicles.
Article
40. Revocation of driving licenses
1. Competent authorities
responsible for issuance of driving licenses shall implement following
procedures for revocation of driving licenses:
a) After 03 working days from
the date of discovering that a holder of a driving license falling under one of
the cases specified in clause 5 Article 62 of the Law on Road Traffic Order and
Safety, the heads of authorities responsible for issuance of driving licenses
shall issue a decision to revoke the driving licenses stating clear reasons for
revocation and cancellation;
b) Within 05 working days from the
receipt of decision on revocation of the driving license, the holder shall
submit the revoked license to the authorities responsible for revocation of the
license. The authorities responsible for issuance of driving licenses shall
receive issued license and destroy in accordance with the law;
c) If the authorities issuing
driving licenses have been merged, acquired, partially divided, dissolved or no
longer has the authority to issue, the competent authority revoking, cancelling
driving licenses is the authority managing the original copies for issuance of
driving licenses.
2. Handling cases of revocation
of driving licenses
a) The driving licenses shall
be revoked in accordance with points a and b, clause 5 Article 62 of the Law on
Road Traffic Order and Safety. The application, procedures for re-issuance of
driving licenses shall be in accordance with clauses 2, 3 and 4, Article 36 of
this Circular;
b) The driving license revoked
as prescribed in point c clause 5 Article 62 of the Law on Road Traffic Order
and Safety has no validity. The authorities managing driving licenses shall
update data on the violation on the information system on driving licenses at
the Department for Roads of Vietnam from the date of discovering of the
violation. In addition, it is not allowed to issue driving licenses to the
violator in 05 years from the date of discovering of the violation. After 05
years from the date of discovering of the violation, if that person wishes to
have his/her driving license re-issued, he/she shall study and take the tests
as in the case of obtaining a driving license for the first time.

Chapter I
ISSUANCE OF INTERNATIONAL DRIVING PERMITS
Article
41. Template of the IDP
1. IDP is a booklet with the
dimensions of A6 (148 mm x 105 mm), which has security markings, a gray cover,
and white pages inside as prescribed in Appendix XXVIII attached to this
Circular.
2. Page 1 (cover page) contains
basic information of the IDP printed in Vietnamese and English; page 2
specifies the scope of use of the IDP in Vietnamese and English; page 3
contains the driving information and classification of the IDP in Vietnamese;
page 4 is left blank; page 5 specifies the holder's information and
classification of the IDP in English; page 6 specifies the driver's information
and classification of the IDP in Russian; page 7 specifies the driver's
information and classification of the IDP in Spanish; page 8 specifies the
driver's information and classification of the IDP in French; page 9 specifies
the vehicle category in French.
3. The IDP number consists of
the distinguishing country code for Vietnam in international traffic, which is
"VN", followed by 12 digits representing the national driving license
number.

42. Vehicle categories of the IDP
The vehicle categories of the
IDP correspond to the vehicle categories specified in the national driving
license issued by Vietnam as prescribed in Appendix XXIX attached to this
Circular.

1. Vietnamese and foreigners
holding permanent residence card and temporary residence card in Vietnam, who
have unexpired PET driving licenses issued by Vietnam, implement as follows:
a) Application for issuance of
the IDP:
Request for replacement of
driving licenses in accordance with Appendix XXX attached to this Circular;
b) Procedures for issuance of
IDP:
If the individuals submit the
application in person to the Department for Roads of Vietnam or the Department
of Transport, he/she shall present the original national driving licenses
issued by Vietnam, passport (for foreigners) for authorities to review the
accuracy and legality of the IDP issuance, and pay the fee after the
application is received. If he/she submits via public services portal, he/she shall
declare as in the guidelines and take responsibilities for the accuracy and
legality of the declared information, fulfill the obligation to pay fees
through the online public service payment function, and pay fees for other
services as required. In case the application is valid, the receiving authority
is responsible for notifying the applicant in person or in writing or through
the online public service to amend or add documents within 02 working days from
the date of receipt of the application.
Within 05 working days from the
receipt of valid application for issuance of IDP, the Department for Roads of
Vietnam or the Department of Transport shall implement issuance of IDP. In
cases of ineligible for issuance of IDP, the above authorities shall send a written
response with clear reasons;
2. Vietnamese and foreigners
holding permanent residence card and temporary residence card in Vietnam, who
have unexpired driving licenses issued by signatories of international
agreement on driving license to which the Socialist Republic of Vietnam is a
signatory, shall implement as follows:
a) Application for issuance of
IDP include a request for issuance of the IDP in accordance with Appendix XXX
attached to this Circular; the translation of the foreign driving license into
Vietnamese certified for translation quality by a notary office, an Embassy, or
Consulate in Vietnam where the translator works, and affixed with a seal on
adjoining edges of pages of the translation and the copy of the driving
license; copies of temporary residence card or permanent residence card or
diplomacy identification or public affair identification (for foreigners);
b) Procedures for issuance of
IDP:

Within 05 working days from the
receipt of valid application for issuance of IDP, the Department for Roads of

Article
47. Standards for training facilities conducting training, examination,
issuance of certificate of road traffic order and safety laws for operators of
heavy-duty vehicles
Training facilities conducting
training, examination, issuance of certificate of road traffic order and safety
laws for operators of heavy-duty vehicles shall have adequate classrooms,
teaching materials, traffic simulation maps, and road traffic signs in
accordance with the law.

48. Organizations conducting training for road traffic order and safety laws
for operators of heavy-duty vehicles participating in road traffic
1. Report on opening a
refresher training on road traffic order and safety laws: The automobile
driving training facilities or heavy-duty vehicle driving training facilities
shall receive applications in accordance with point b clause 1 and clause 2 of
Article 59 of the Law on Road Traffic Order and Safety, and report to the
Department of Transport using the form in Appendix XXXI attached to this
Circular.
2. The automobile driving training
facilities or heavy-duty vehicle driving training facilities shall develop a
textbook and detailed contents of the training program based on the training
program prescribed in Article 46 of this Circular.
3. Conduct inspection, make a
record on the results of training for road traffic order and safety laws for
operators of heavy-duty vehicles participating in road traffic in accordance
with Appendix XXXII attached to this Circular and issue certificates of road
traffic order and safety laws for qualified people. If learners are not
qualified, they are eligible to retake the test after 07 working days.
4. Conduct test
a) Conduct test on the subjects
in the Program for training for road traffic order and safety laws prescribed
in clause 2 Article 46 of this Circular;

Article
49. Application of the learners
Individual shall apply 01 set
of application at the automobile driving training facility or heavy-duty
vehicle driving training facility. The application includes:
1. A written request for
training on road traffic order and safety laws using the Form in Appendix
XXXIII attached to this Circular;
2. 03 portrait photos sized 2x3
cm taken within the last 6 months in ID style.
Article
50. Printing and management of certificates of road traffic order and safety
laws
1. Based on the sample template
of the certificate of road traffic order and safety laws in accordance with
Appendix XXXIV attached to this Circular, the automobile driving training
facilities or heavy-duty vehicle driving training facilities shall design the
template of the certificate of road traffic order and safety laws with the logo
of their own facilities (if any).
2. The heads of automobile
driving training facilities or heavy-duty vehicle driving training facilities
shall approve the sample template of the certificate of road traffic order and
safety laws of their own facilities, and report to the Department of Transport,
Police Departments of provinces and central-affiliated cities where their
headquarters are located; take responsibility to manage the templates of their
own facilities.
3. The printing of certificate
templates shall be carried out in a strict, secure, and safe manner and
recorded in a management book.

52. Issuance of certificates
After 05 working days from the
issuance of the qualified results, the heads of the automobile driving training
facilities or heavy-duty vehicle driving training facilities shall issue the
certificates to the learners.

53. Re-issuance of certificates
1. Holders whose certificates
are damaged or information in the certificates is wrong with their names
included in the record at the issuing authorities are eligible for re-issuance
of certificates based on the serial number of the issued certificates.
a) Application for re-issuance
includes: A request for re-issuance using the Form in the Appendix XXXV
attached to this Circular;
b) 03 portrait photos sized 2x3
cm taken within the last 6 months.
2. Holders of lost certificates

for re-issuance of certificates based on the serial number of the issued
certificates. The application for re-issuance shall be in accordance with point

b) The automobile driving
training facilities or heavy-duty vehicle driving training facilities or
Department of Transport shall review the application. If it is not eligible for
re-issuance of certificates or the application is not valid, the above
authorities shall notify the applicants in person or in writing to amend or add
documents within 02 working days from the date of receipt of the application;
c) Within 03 working days from
the receipt of valid application, the heads of automobile driving training
facilities or heavy-duty vehicle driving training facilities or Department of
Transport shall re-issue the certificate, or send a written response with clear
reasons for not re-issuing the certificate.
d) The return of driving
license shall be carried out at automobile driving training facilities or
heavy-duty vehicle driving training facilities or the receiving-application
authorities or by post as requested by the applicants.

heavy-duty vehicles

certificates of road traffic order and safety laws; results on periodic health
test of operators.
2. Be able to receive
information prescribed in clause 1 of this Article from the information system
on driving licenses of the Department for Roads of Vietnam, the information
system on issuance of certificate of road traffic order and safety laws, the
database on health of operators of heavy-duty vehicles of the Ministry of
Health and other information systems.
3. Be able to connect, share
data with the national population database, road database and relevant
databases.
Article
56. Principles and methods for using data on the information systems
1. Principles for using the
data
a) The use of data on driving
licenses shall be in accordance with the laws on information technology and
cybersecurity;
b) Authorities in charge of
management of the information system on driving licenses as prescribed in
Articles 61 and 62 of this Circular are responsible to protect information,
personal information in the database on driving licenses on the Internet in
accordance with the law on information technology;

2. Methods for using the data
a) Direct method:
Authorities, organizations,
individuals are allowed to directly use the data on driving licenses or
certificates of road traffic order and safety laws on the website on driving
licenses (https://www.gplx.gov.vn) in accordance with regulations on security
levels and decentralization of rights for using data on driving licenses or
certificates of road traffic order and safety laws;
b) Indirect method:
Authorities, organizations,
individuals who need to use data on driving licenses or certificates of road traffic
order and safety laws are provided with information extracted from the database
on driving licenses or certificates of road traffic order and safety laws
including the information on the driving licenses (additional information about
training, testing, and traffic law violations may also be provided if it is
required by the competent authorities); the information on certificates of road
traffic order and safety laws(additional information about training, testing,
and traffic law violations may also be provided if it is required by the
competent authorities).
Article
57. Time limit for storing data on the information systems
Heads of the authorities and
organizations shall direct the implementation of management of storage of
electrical documents as follows:
1. The time limit for storing
data on driver training and driving tests at the driving training facilities
and driving test center is at least 05 years.
2. The time limit for storing
data on driver training, driving tests, issuance, replacement, re-issuance of
driving licenses at the Departments of Transport of provinces and
central-affiliated cities is at least 50 years.

Chapter II
PROCEDURES FOR USING THE INFORMATION SYSTEMS
Article
58. Procedures for using data on the information system on driving licenses
1. Regarding issuance of
driving licenses
a) Driving training facilities
shall receive the application for driver training, carry out the procedures on
the information system on driving licenses to formulate a report on
registration for driving test to send to the Department of Transport to update
the data on test results and consider for completion of training courses, and
formulate a request for organization of driving test to the Department of
Transport;
b) The Department of Transport
shall use the data on report on registration for driving tests on the
information system on driver training to approve the list of examinees eligible
for the tests; create the list of eligible examinees to participate in the
tests based on the decision on organization of the tests, and send to the
driving test centers and motorcycle driving training yards in order to
cooperate in organization of the tests; receive the results of the tests
transferred by the driving test centers and motorcycle driving training yards
on the information system to make a list of examinees qualified for issuance of
driving licenses;
c) The driving test centers and
driving training yards shall receive the list of examinees synchronized by the
Department of Transport on the information system and carry out procedures for
driving tests on the information system on driving tests; synchronize the
results of the tests on the information system on driving tests;
d) The Department for Roads of
Vietnam shall receive the data on the driving licenses synchronized by the
Departments of Transport on the information system on the Department for
Roads of Vietnam for management and use of data in accordance with the law.

the information system on the driving licenses of the Department of Transport;
review, update, authenticate the applications on the information system on
driving licenses of the Department of Transport; verify electronic signatures
of competent persons on electronic applications and print the IDP; review the
quality of printed driving licenses and synchronize the data on the system on
the driving licenses of the Department for Roads of Vietnam;
2. The Department for Roads of
Vietnam shall:
a) Receive the data on IDP
synchronized by the Departments of Transport on the information system on
driving licenses of the Department for Roads of Vietnam for management and use
of data in accordance with the law;
b) If an individual apply for
issuance of IDP, the procedures shall be in accordance with clause 1 of this
Article.
Article
60. Procedures for using data on the information system on issuance of
certificates of road traffic order and safety laws
1. 1. The automobile driving
training facilities or heavy-duty vehicle driving training facilities shall
receive the applications for issuance of certificates of road traffic order and
safety laws and use the information system on issuance of certificates of road
traffic order and safety laws to establish the training courses; update
information on examination results and the list of qualified examinees on the
information system on issuance of certificates of road traffic order and safety
laws; verify electronic signatures of competent persons on electronic
applications and print the certificates; review the quality of printed
certificates and synchronize the data on the information system in accordance
with the law;

Vietnam shall receive, manage the data of the certificates on the information
system on issuance of certificates of road traffic order and safety laws.
Part VI
IMPLEMENTATION
Article
61. Department for Roads of Vietnam
1. Regarding driver training
a) Provide professional
guidelines on driver training to ensure nationwide implementation;
b) Apply information technology
in management of driver training; formulate and transfer the question bank,
traffic situation simulation software to the driving training facilities;
c) Apply information technology
in management of driver training, information system on driver training of the
Department for Roads of Vietnam to ensure the reception, synthesis, and
analysis of DAT management data to support the use of DAT management data and
driver training management by the Departments of Transport; ensure the
continuousness and stability of the operation of information technology in
management of driver training of the Department for Roads of Vietnam, and store
DAT management data for a minimum of 3 years.
d) Announce and update the list
of automobile driving training facilities that have been issued or have had
their training licenses revoked on the website.

at the request of competent authorities; apply digital transformation for

b) Operate or hire a capable
entity to operate the information system on the Department for Roads of Vietnam
in accordance with point a of this clause;
c) Receive data on issuance,
replacement of driving licenses from the information system on driving licenses
of the Department of Transport to verify and synchronize the data to the
database on driving licenses of the Department for Roads of Vietnam; protect
information, personal information in the online database on driving licenses in
accordance with the law on cybersecurity;

this Circular and guidelines of the Department for Roads of Vietnam on driving
tests;
b) Formulate the plan for
training, refresher training and direct management and storage of documents of
examiners;
c) Direct construction,
management of operation of the driving test center in the area;
d) Deploy networking driving
test center, driving training facilities and the Department for Roads of
Vietnam;

trained for; training location; course completion time; tuition fee amount and
payment method; responsibilities for compensating damages by each party in case
of contract violation; contract termination; any other agreements that are not
illegal or against social ethics;
c) Publish enrollment
regulations, tuition fee and regulations on training management on the website of
the driving training facilities;
d) The driving training
facilities of A1-, A-, B1-category motorcycles shall maintain professional
technical standards in accordance with the law;
dd) Report the operational plan
to the Department of Transport and organize driver training for A1-, A-,
B1-category motorcycles in accordance with the registered operational plan
using the Form in Appendix XXXVIII attached to this Circular;
e) Organize training for new
operators and training for upgrade of automobile driving licenses according to
the total distance traveled, expiration date, location, and vehicle category
stated in the driver training license.
g) Apply information technology
in management of driver training to recognize and monitor the study time for
the theory lessons on traffic laws for learners learning to drive automobiles
at the facilities; ensure the infrastructure and equipment for teaching and
learning, enhance the quality of driver training; use traffic situation
simulation for driver training.

i) Organize driving tests: The
heads of driving training facilities shall formulate procedures for the tests
according to contents for the tests prescribed in clause 4 Article 6, clause 4
Article 7 and clause 4 Article 8 of this Circular;
k) Use the monitoring results
of the learning process, examination results, and practical driving test
results through the information system of the driving training facilities or
the Vietnam Road Administration. The practical driving test results from the
training vehicles shall be extracted from the training vehicle's cabin system
with information about the learner's study time and content of driving training
on the driving simulator cabin to evaluate the learners.
l) Transfer, share the DAT data
in accordance with Appendix XXXXI attached to this Circular and take
responsibilities for the accuracy, completeness, and honesty of the DAT data
and DAT management data; ensure cybersecurity for DAT data; protect username and
password for logging in the information system on driver training of the
Department for Roads of Vietnam; promptly, accurately provide information, DAT
data at the request of competent authorities;
m) Monitor, use DAT data on the
information system on driver training of the driving training facilities to
serve management of driver training; ensure the accuracy of information on
instructors, training vehicles;
n) Provide and takes
responsibilities for confirmation extracted from the training vehicle's cabin
system with information about the learner's study time and content of driving
training on the driving simulator cabin for authorities responsible for
training, driver tests, issuance of driving licenses;
o) Formulate and approve
methods and detailed programs for driver training according to the procedures
for compiling, reviewing, and issuing the training program as prescribed in
Article 11 and Appendix X of this Circular, and report to the Department of
Transport for monitoring and management. The development of a distance learning
system, self-learning materials, and remote training methods with guidelines,
and the application of a remote training management system shall be in
accordance with the Appendix XXXXII attached to this Circular;
p) Cooperate with the driving
test center to settle accidents prescribed in point e clause 3 Article 19 of
this Circular.
2. Regarding management of the
information systems
a) Invest, maintain, upgrade
the hardware, software, and data transmission network of the information system
on driver training at the driving training facilities;

Formulate, compare, take
responsibilities for the accuracy of learners’ information, training process,
results, report No. 1, report No 2 in accordance with the law. Receive the
results of driver tests of learners trained at the facilities that and organize
a retake for learners in accordance with the law;
c) Take responsibilities for
the accuracy, legality of the electronic applications sent or transferred to
the Department of Transport and the Department for Roads of Vietnam.
d) Fully store information
prescribed in clause 1 Article 57 of this Circular;
dd) Issue cybersecurity
regulations, regulations on using hardware, software, and accounts to ensure
cybersecurity.
e) Use data on the information
system installed at the driving training facilities to inspect, review and
provide information to competent authorities when they have a request.
Article
64. Driving test centers
1. Regarding management of
driver tests
a) Maintain the infrastructure,
testing equipment, and grading in accordance with the law to conduct accurate
and objective testing; report to the Department of Transport when the testing
equipment and vehicles are not functioning properly or are unstable, or when
there are changes in the testing equipment and vehicles to handle promptly.
b) Cooperate and create all
necessary conditions for driving training facilities to help students review
and for the Testing council to conduct driver tests conveniently and on
schedule;

d) Announce the fee for driver
tests and price of other services on the websites of the driving test centers.
dd) Ensure safety for the
driver tests; cooperate with relevant units, authorities to resolve accidents
and safety incidents;
e) Announce the report and
schedule on the websites of the driving test centers, store the results of the
driver tests in accordance with clause 3 Article 30 of this Circular;
g) Transfer, share the data on supervision
of driver tests to the Department of Transport (the authority directly managing
operations of driving test centers) and the Division of Traffic Police of
Police Departments of provinces and central-affiliated cities where the
headquarters of driving test center are located and Department of Traffic
Police, the Ministry of Public Security; store and take responsibility on the
accuracy, completeness, and integrity of the data on supervision of driver
tests; ensure safety of cybersecurity; secure the usernames, passwords, and
software access for the information system on supervision of driver tests of
the Department of Transport; promptly and accurately provide information, data
on supervision of driver tests to the competent authorities;
h) Receive, use the application
for driver tests, application for traffic situation simulation transferred by
the Department for Roads of Vietnam for driver tests, and application for
professional management transferred by the Department for Roads of Vietnam for
implementation of driver tests.
2. Regarding management of the
information systems
a) Invest, maintain, upgrade
the hardware, software, and data transmission network of the information system
on driver tests at the driving test centers;
b) Receive, organize implementation
of the professional application on the information system on driving tests of
driving test centers transferred by the Department for Roads of Vietnam;
c) Receive, install, use
applications transferred by the Department for Roads of Vietnam; prohibit
interference, installation of devices, installation of applications that may
affect the testing process or lead to inaccurate results of driver tests;

65. Automobile driving training facilities or heavy-duty vehicle driving
training facilities
1. Regarding training,
examination, issuance of certificates of road traffic order and safety laws for
operators of heavy-duty vehicles
a) Conduct enrollment and
refresher training on road traffic order and safety laws in accordance with the
program prescribed in this Circular;
b) Submit report on opening
courses for training on road traffic order and safety laws to the Department of
Transport using the Form in Appendix XXXI attached to this Circular;
c) Make a record on management
of issuance of certificates of road traffic order and safety laws using the
Form in Appendix XXXXIII attached to this Circular;
d) Notify operational plan to
the Department of Transport and organize training on road traffic order and
safety laws in accordance with registered operational plan using the Form in
Appendix XXXXIV attached to this Circular.
