VỀ VIỆC THỰC HIỆN THU PHÍ HẢI QUAN KIỂM TRA, GIÁM SÁT ĐỐI VỚI HÀNG HÓA XUẤT KHẨU, NHẬP KHẨU CÓ YÊU CẦU BẢO HỘ QUYỀN SỞ HỮU TRÍ TUỆ

Thực hiện Thông tư số 274/2016/TT-BTC ngày 14/11/2016 của Bộ Tài chính quy định mức thu, chế độ thu, nộp, quản lý và sử dụng phí hải quan và lệ phí hàng hóa, phương tiện quá cảnh, Tổng cục Hải quan thông báo về việc tổ chức thu phí hải quan kiểm tra, giám sát đối với hàng hóa xuất khẩu, nhập khẩu có yêu cầu bảo hộ quyền sở hữu trí tuệ (sau đây gọi tắt là phí hải quan kiểm tra, giám sát) như sau:

1. Đối tượng nộp phí:

Chủ sở hữu quyền hoặc người được chủ sở hữu quyền ủy quyền nộp đơn đề nghị kiểm tra, giám sát hải quan đối với hàng hóa xuất khẩu, nhập khẩu có yêu cầu bảo hộ quyền sở hữu trí tuệ.

2. Thời điểm nộp phí:

- Phí hải quan kiểm tra, giám sát được nộp vào tài khoản kho bạc của cơ quan hải quan trước khi nộp Đơn đề nghị kiểm tra, giám sát theo quy định tại Điều 6 Thông tư số 13/2015/TT-BTC ngày 30/01/2015 của Bộ Tài chính.

- Việc nộp phí hải quan kiểm tra, giám sát thực hiện bắt đầu từ thời điểm của thông báo này.

3. Biểu mức thu phí:

Phí hải quan kiểm tra, giám sát thực hiện theo Biểu mức thu phí hải quan, lệ phí hàng hóa, phương tiện quá cảnh ban hành kèm theo Thông tư số 274/2016/TT-BTC ngày 14/11/2016 của Bộ Tài chính là 200.000 đồng/ 01 đơn.

Phí hải quan kiểm tra, giám sát đã nộp không được hoàn trả trong trường hợp đơn đề nghị kiểm tra, giám sát bị từ chối theo quy định.

4. Địa điểm thu phí:

Chủ sở hữu quyền hoặc người được chủ sở hữu quyền ủy quyền nộp đơn đề nghị kiểm tra, giám sát để phát hiện hàng hóa có dấu hiệu xâm phạm quyền sở hữu trí tuệ nộp phí vào tài khoản được thông báo dưới đây:

Chi cục Hải quan Bắc Hà Nội - Cục Hải quan thành phố Hà Nội

5. Lưu ý:

Khi nộp hồ sơ đề nghị kiểm tra, giám sát hải quan, người nộp đơn phải nộp kèm chứng từ nộp phí (bản phô tô) có xác nhận của người nộp đơn.

Tổng cục Hải quan thông báo để các tổ chức, cá nhân có liên quan biết và thực hiện./.

NOTIFICATION

COLLECTION OF FEES FOR CUSTOMS INSPECTION AND SUPERVISION OF IMPORTED AND EXPORTED GOODS SUBJECT TO INTELLECTUAL PROPERTY PROTECTION REQUIREMENTS

Complying with the Circular No. 274/2016/TT-BTC dated November 14, 2016 of the Ministry of Finance prescribing the rate, regime for collection, payment, management and use of customs fees and charges for the goods and means of transport in transit, the General Department of Vietnam Customs hereby informs organization of the collection of fees for customs inspection and supervision of exported and imported goods subject to intellectual property protection (hereinafter referred to as customs inspection and supervision) as follows:

1. Fee payers:

Holders of intellectual property rights or persons authorized by holders of intellectual property rights to lodge the application form for customs inspection and supervision of exported and imported goods subject to intellectual property protection requirements.

2. Fee payment time:

- Customs inspection and supervision fees shall be paid into the state treasury's account held by the customs authority before submission of the application form for customs inspection and supervision as provided in Article 6 of the Circular No. 13/2015/TT-BTC dated January 30, 2015 of the Ministry of Finance.

- Payment of customs inspection and supervision fees shall commence from the date of issue of this notification.

A customs inspection and supervision fee based on the schedule of rates of customs fees and charges for goods and means of transport in transit which is annexed to the Circular No. 274/2016/TT-BTC dated November 14, 2016 of the Ministry of Finance shall be VND 200,000 per an application.

Customs inspection and supervision fees which have already been paid shall not be reimbursed in the event of refusal of the application for customs inspection and supervision as provided by regulations in force.

4. Fee collection venue:

Holders of intellectual property rights or persons authorized by holders of intellectual property rights to lodge the application for customs inspection and supervision for the purpose of detecting any sign of infringement on intellectual property rights shall pay fees into the following account:
