QUYẾT ĐỊNH

PHÊ DUYỆT ĐỀ ÁN ĐẨY MẠNH XỬ LÝ, SỬ DỤNG TRO, XỈ, THẠCH CAO CỦA CÁC NHÀ MÁY NHIỆT ĐIỆN, NHÀ MÁY HÓA CHẤT, PHÂN BÓN LÀM NGUYÊN LIỆU SẢN XUẤT VẬT LIỆU XÂY DỰNG VÀ TRONG CÁC CÔNG TRÌNH XÂY DỰNG

Căn cứ Luật tổ chức Chính phủ ngày 19 tháng 6 năm 2015;

Căn cứ Luật bảo vệ môi trường ngày 23 tháng 6 năm 2014;

Căn cứ Nghị định số 24a/2016/NĐ-CP ngày 05 tháng 4 năm 2016 của Chính phủ về quản lý vật liệu xây dựng;

Xét đề nghị của Bộ trưởng Bộ Xây dựng,

QUYẾT ĐỊNH:

Điều 1. Phê duyệt Đề án đẩy mạnh xử lý, sử dụng tro, xỉ, thạch cao của các nhà máy nhiệt điện, nhà máy hóa chất, phân bón làm nguyên liệu sản xuất vật liệu xây dựng và trong các công trình xây dựng với những nội dung chủ yếu sau đây:

I. QUAN ĐIỂM VỀ XỬ LÝ, SỬ DỤNG TRO, XỈ, THẠCH CAO

1. Tro, xỉ, thạch cao (bao gồm thạch cao được thu hồi từ khói lò đốt của các nhà máy nhiệt điện, viết tắt là thạch cao FGD - Flue Gas Desulfurization; thạch cao được thải ra từ các nhà máy hóa chất, phân bón, viết tắt là thạch cao PG - Phosphogypsum) phải được xử lý, sử dụng hiệu quả. Việc sử dụng tro, xỉ, thạch cao FGD, thạch cao PG làm nguyên liệu sản xuất vật liệu xây dựng và trong các công trình xây dựng nhằm mục đích bảo vệ môi trường, tiết kiệm diện tích đất làm bãi chứa, giảm sử dụng tài nguyên khoáng sản để sản xuất vật liệu xây dựng, đảm bảo phát triển bền vững.

2. Các chủ cơ sở phát thải chịu trách nhiệm tổ chức xử lý, tiêu thụ tro, xỉ, thạch cao FGD, thạch cao PG phát sinh trong quá trình sản xuất.

3. Tro, xỉ, thạch cao FGD, thạch cao PG (trước hoặc sau khi xử lý) đáp ứng các tiêu chuẩn, quy chuẩn kỹ thuật, hướng dẫn kỹ thuật làm nguyên liệu sản xuất vật liệu xây dựng và sử dụng trong các công trình xây dựng được coi là sản phẩm hàng hóa vật liệu xây dựng và được điều chỉnh theo quy định của pháp luật về sản phẩm hàng hóa.

4. Ưu tiên sử dụng tro, xỉ, thạch cao FGD, thạch cao PG đáp ứng tiêu chuẩn, quy chuẩn kỹ thuật, hướng dẫn kỹ thuật làm nguyên liệu sản xuất vật liệu xây dựng và cho các công trình xây dựng (công trình dân dụng, công nghiệp, giao thông, nông nghiệp và phát triển nông thôn, hoàn nguyên mỏ...).

5. Nhà nước tạo điều kiện thuận lợi để các tổ chức, cá nhân tham gia xử lý sử dụng tro, xỉ, thạch cao FGD, thạch cao PG làm nguyên liệu sản xuất vật liệu xây dựng và sử dụng trong các công trình xây dựng.

II. MỤC TIÊU

1. Mục tiêu chung: Đến năm 2020 phải xử lý, sử dụng tro, xỉ, thạch cao đảm bảo đáp ứng lượng tồn trữ tại bãi chứa của từng nhà máy nhiệt điện, nhà máy hóa chất, phân bón nhỏ hơn tổng lượng phát thải của 2 năm sản xuất.

2. Mục tiêu cụ thể: Đến năm 2020 xử lý và sử dụng tro, xỉ, thạch cao FGD, thạch cao PG làm nguyên liệu sản xuất vật liệu xây dựng và sử dụng trong các công trình xây dựng đạt khoảng 52% tổng lượng tích luỹ (khoảng 75 triệu tấn, bao gồm 56 triệu tấn tro, xỉ nhiệt điện; 2,5 triệu tấn thạch cao FGD; 16,5 triệu tấn thạch cao PG) trong đó:

- Đối với tro, xỉ nhiệt điện: Làm phụ gia khoáng cho sản xuất xi măng khoảng 14 triệu tấn; thay thế một phần sét để sản xuất clanhke xi măng khoảng 8 triệu tấn; thay thế một phần sét để sản xuất gạch đất sét nung khoảng 7 triệu tấn; làm phụ gia khoáng cho sản xuất bê tông và gạch không nung khoảng 2 triệu tấn; làm vật liệu san lấp mặt bằng công trình, hoàn nguyên mỏ và làm đường giao thông khoảng 25 triệu tấn;

- Đối với thạch cao FGD: Làm phụ gia điều chỉnh thời gian đông kết cho xi măng khoảng 1,5 triệu tấn; làm nguyên liệu sản xuất tấm thạch cao xây dựng khoảng 1 triệu tấn;

- Đối với thạch cao PG: Làm phụ gia điều chỉnh thời gian đông kết cho xi măng khoảng 3 triệu tấn; làm nguyên liệu sản xuất tấm thạch cao xây dựng khoảng 1,5 triệu tấn; làm vật liệu san lấp mặt bằng công trình, hoàn nguyên mỏ và làm đường giao thông khoảng 12 triệu tấn.

III. CÁC NHIỆM VỤ VÀ GIẢI PHÁP THỰC HIỆN

1. Hoàn thiện các văn bản quy phạm pháp luật, tiêu chuẩn và quy chuẩn kỹ thuật

- Rà soát, sửa đổi, bổ sung các văn bản quy phạm pháp luật liên quan đến xử lý, sử dụng tro, xỉ, thạch cao làm nguyên liệu sản xuất vật liệu xây dựng và trong các công trình xây dựng;

- Biên soạn và ban hành các tiêu chuẩn, quy chuẩn kỹ thuật, hướng dẫn kỹ thuật, định mức kinh tế kỹ thuật cho việc xử lý, sử dụng tro, xỉ, thạch cao FGD, thạch cao PG làm nguyên liệu sản xuất vật liệu xây dựng và sử dụng trong các công trình xây dựng. Thời gian hoàn thành trước ngày 30 tháng 6 năm 2018;

- Ban hành, hướng dẫn hạch toán chi phí liên quan đến xử lý, tiêu thụ tro, xỉ, thạch cao FGD, thạch cao PG của nhà máy nhiệt điện, nhà máy hóa chất, phân bón làm nguyên liệu sản xuất vật liệu xây dựng và sử dụng trong các công trình xây dựng;

- Nhà nước bố trí ngân sách để thực hiện việc biên soạn và ban hành các văn bản quy phạm pháp luật, tiêu chuẩn, quy chuẩn kỹ thuật, hướng dẫn kỹ thuật, định mức kinh tế kỹ thuật về xử lý, sử dụng tro, xỉ, thạch cao làm nguyên liệu sản xuất vật liệu xây dựng và trong các công trình xây dựng theo quy định của pháp luật.

2. Nghiên cứu, ứng dụng khoa học công nghệ

- Đẩy mạnh việc nghiên cứu, hoàn thiện công nghệ xử lý và sử dụng tro, xỉ, thạch cao FGD, thạch cao PG làm nguyên liệu sản xuất vật liệu xây dựng và trong các công trình xây dựng. Cơ bản hoàn thiện các công nghệ xử lý và ứng dụng trước tháng 6 năm 2019;

- Nhà nước hỗ trợ ngân sách theo quy định; đồng thời khuyến khích các chủ cơ sở phát thải tham gia, hỗ trợ kinh phí để đẩy nhanh tiến độ nghiên cứu, ứng dụng khoa học công nghệ trong xử lý, sử dụng tro, xỉ, thạch cao FGD, thạch cao PG làm nguyên liệu sản xuất vật liệu xây dựng và sử dụng trong các công trình xây dựng;

- Các đề tài, dự án nghiên cứu, ứng dụng, sản xuất thử nghiệm đối với việc xử lý, sử dụng tro, xỉ, thạch cao PGD, thạch cao PG được hưởng các chính sách ưu đãi theo quy định của Luật khoa học và công nghệ.

3. Xử lý, sử dụng tro, xỉ, thạch cao

- Các chủ cơ sở phát thải, chủ đầu tư các dự án đầu tư xây dựng và các cơ quan chủ quản quản lý nhà máy nhiệt điện, hóa chất, phân bón có trách nhiệm lập đề án xử lý và tiêu thụ tro, xỉ, thạch cao trình Bộ Công Thương phê duyệt. Đảm bảo yêu cầu đến năm 2020 diện tích bãi thải không quá 2 năm sản xuất trung bình. Cụ thể: (1) Đối với các nhà máy đang hoạt động trình Đề án trước ngày 31 tháng 12 năm 2018; (2) Đối với các dự án đang trong quá trình xây dựng, lập bổ sung và trình đề án trước khi đưa vào vận hành; (3) Đối với các dự án đang chuẩn bị đầu tư, lập đề án và trình phê duyệt cùng với dự án đầu tư;

- Các dự án đầu tư xử lý tro, xỉ, thạch cao FGD, thạch cao PG được hưởng chính sách ưu đãi và hỗ trợ đầu tư của nhà nước như đối với các dự án xử lý chất thải rắn theo quy định hiện hành;

- Các sản phẩm cơ khí chế tạo trong nước phục vụ cho dây chuyền thiết bị xử lý tro, xỉ, thạch cao FGD, thạch cao PG làm nguyên liệu sản xuất vật liệu xây dựng và sử dụng trong các công trình xây dựng được hưởng chính sách ưu đãi như đối với các dự án cơ khí trọng điểm;

- Các dự án đầu tư xây dựng công trình, sử dụng vốn nhà nước phải ưu tiên sử dụng tro, xỉ, thạch cao hoặc các sản phẩm vật liệu xây dựng có tro, xỉ, thạch cao FGD, thạch cao PG nếu các vật liệu, sản phẩm này bảo đảm hiệu quả kinh tế, kỹ thuật tương đương như các loại vật liệu khác;

- Các chủ cơ sở phát thải và các cơ sở xử lý, sử dụng tro, xỉ, thạch cao FGD, thạch cao PG làm nguyên liệu cho sản xuất vật liệu xây dựng và sử dụng trong các công trình xây dựng phải tuân thủ các quy định tại Điều 40 của Nghị định 24a/2016/NĐ-CP;

- Trường hợp tro, xỉ, thạch cao FGD, thạch cao PG không thể xử lý, sử dụng làm nguyên liệu sản xuất vật liệu xây dựng hoặc sử dụng trong các công trình xây dựng thì được xử lý như chất thải rắn không thể tái chế.

4. Tăng cường công tác thông tin, giáo dục, truyền thông

- Xây dựng các chương trình, tài liệu, tổ chức phổ biến, tập huấn, đào tạo, bồi dưỡng cho cán bộ và nhân viên trong việc quản lý, xử lý và sử dụng tro, xỉ, thạch cao FGD, thạch cao PG;

- Phổ biến các tiêu chuẩn, quy chuẩn kỹ thuật, hướng dẫn kỹ thuật, định mức kinh tế, kỹ thuật về sản phẩm vật liệu xây dựng có sử dụng tro, xỉ, thạch cao FGD, thạch cao PG làm nguyên liệu sản xuất vật liệu xây dựng và sử dụng trong các công trình xây dựng;

- Tăng cường và đa dạng hóa hình thức truyền thông nhằm nâng cao nhận thức của cán bộ các cấp chính quyền, doanh nghiệp và người dân về vấn đề xử lý, tái sử dụng tro, xỉ, thạch cao FGD, thạch cao PG;

- Tăng cường, phát triển hợp tác quốc tế về nghiên cứu, trao đổi khoa học công nghệ trong lĩnh vực xử lý, sử dụng tro, xỉ, thạch cao FGD, thạch cao PG làm nguyên liệu sản xuất vật liệu xây dựng và sử dụng trong các công trình xây dựng.

IV. TỔ CHỨC THỰC HIỆN

1. Bộ Xây dựng

- Chủ trì, phối hợp với các bộ, cơ quan liên quan, Ủy ban nhân dân các tỉnh, thành phố trực thuộc trung ương tổ chức triển khai, kiểm tra việc thực hiện, báo cáo hàng năm và báo cáo tổng kết việc thực hiện Đề án trình Chính phủ vào cuối năm 2020;

- Ban hành theo thẩm quyền hoặc phối hợp với các bộ, cơ quan liên quan sửa đổi, bổ sung hoặc trình cấp có thẩm quyền ban hành các văn bản quy phạm pháp luật, tiêu chuẩn, quy chuẩn kỹ thuật, hướng dẫn kỹ thuật, định mức kinh tế quy định việc xử lý, sử dụng tro, xỉ, thạch cao FGD, thạch cao PG làm nguyên liệu sản xuất vật liệu xây dựng và sử dụng trong các công trình xây dựng;

-Tổ chức, triển khai các đề tài nghiên cứu; dự án sản xuất thử nghiệm trong việc xử lý, sử dụng tro, xỉ, thạch cao FGD, thạch cao PG làm nguyên liệu sản xuất vật liệu xây dựng và sử dụng trong các công trình xây dựng;

- Chủ trì, phối hợp với các bộ, cơ quan liên quan, Ủy ban nhân dân các tỉnh, thành phố trực thuộc trung ương giải quyết hoặc trình cấp có thẩm quyền giải quyết các vấn đề phát sinh trong quá trình triển khai thực hiện Đề án;

- Chỉ đạo các chủ đầu tư công trình xây dựng dân dụng, công nghiệp sử dụng vốn nhà nước ưu tiên sử dụng tro, xỉ, thạch cao hoặc các sản phẩm vật liệu xây dựng có tro, xỉ, thạch cao FGD, thạch cao PG.

2. Bộ Công Thương

- Chủ trì, phối hợp với các Bộ: Xây dựng, Tài nguyên và Môi trường, Khoa học và Công nghệ và các cơ quan liên quan hướng dẫn lập, phê duyệt đề án xử lý, tiêu thụ tro, xỉ, thạch cao FGD, thạch cao PG của các nhà máy nhiệt điện, nhà máy hóa chất phân bón theo quy định tại điểm c khoản 3 Điều 1 Quyết định này; giám sát việc xử lý, tiêu thụ tro, xỉ, thạch cao FGD, thạch cao PG trong quá trình thực hiện; có giải pháp xử lý các chủ cơ sở phát thải không thực hiện đúng các quy định của Đề án này;

- Ban hành văn bản hướng dẫn về hạch toán chi phí liên quan đến xử lý, tiêu thụ tro, xỉ, thạch cao FGD, thạch cao PG của nhà máy nhiệt điện, nhà máy hóa chất, phân bón;

- Phối hợp với Bộ Xây dựng nghiên cứu, hoàn thiện công nghệ xử lý tro, xỉ, thạch cao của các nhà máy nhiệt điện, nhà máy hóa chất, phân bón làm nguyên liệu sản xuất vật liệu xây dựng và sử dụng trong các công trình xây dựng;

- Phối hợp với Bộ Xây dựng kiểm tra, đánh giá việc thực hiện Quyết định này đối với các nhà máy nhiệt điện, nhà máy hóa chất, phân bón.

3. Bộ Tài nguyên và Môi trường

- Hướng dẫn, kiểm tra việc thu gom, vận chuyển, lưu trữ, xử lý và tiêu thụ tro, xỉ, thạch cao FGD, thạch cao PG tuân thủ các quy định về bảo vệ môi trường; hướng dẫn việc đồng xử lý tro, xỉ, thạch cao trong sản xuất vật liệu xây dựng, coi quá trình sản xuất vật liệu xây dựng có sử dụng tro, xỉ, thạch cao trực tiếp là quá trình xử lý tro, xỉ, thạch cao;

- Hoàn thiện, bổ sung, các tiêu chuẩn, quy chuẩn kỹ thuật, hướng dẫn kỹ thuật, quy định sử dụng tro, xỉ, thạch cao để hoàn nguyên mỏ;

- Hướng dẫn việc chôn lấp tro, xỉ, thạch cao trong trường hợp tro, xỉ, thạch cao không thể sử dụng được.

4. Bộ Khoa học và Công nghệ

- Chủ trì, phối hợp với Bộ Xây dựng và các bộ, ngành, địa phương liên quan hỗ trợ nghiên cứu các nhiệm vụ khoa học và công nghệ cấp quốc gia về xử lý, sử dụng tro, xỉ, thạch cao của các nhà máy nhiệt điện, phân bón hóa chất để làm nguyên liệu sản xuất vật liệu xây dựng và sử dụng trong các công trình xây dựng;

- Tổ chức thẩm định tiêu chuẩn, quy chuẩn kỹ thuật quốc gia; công bố tiêu chuẩn quốc gia về xử lý, sử dụng tro, xỉ, thạch cao FGD, thạch cao PG làm nguyên liệu sản xuất vật liệu xây dựng và sử dụng trong các công trình xây dựng.

5. Bộ Giao thông vận tải

- Hoàn thiện, bổ sung các tiêu chuẩn, quy chuẩn kỹ thuật, hướng dẫn kỹ thuật, quy định sử dụng tro, xỉ, thạch cao làm vật liệu xây dựng đường giao thông;

- Chỉ đạo các chủ đầu tư công trình giao thông vận tải sử dụng vốn nhà nước ưu tiên sử dụng tro, xỉ, thạch cao hoặc các sản phẩm vật liệu xây dựng có tro, xỉ, thạch cao FGD, thạch cao PG.

6. Bộ Nông nghiệp và Phát triển nông thôn

- Hoàn thiện, bổ sung các tiêu chuẩn, quy chuẩn kỹ thuật, hướng dẫn kỹ thuật, quy định sử dụng tro, xỉ, thạch cao để xây dựng các công trình thủy lợi và các ứng dụng khác trong xây dựng các công trình nông nghiệp và phát triển nông thôn;

- Chỉ đạo các chủ đầu tư công trình nông nghiệp và phát triển nông thôn sử dụng vốn nhà nước ưu tiên sử dụng tro, xỉ, thạch cao hoặc các sản phẩm vật liệu xây dựng có tro, xỉ, thạch cao FGD, thạch cao PG.

7. Ủy ban nhân dân các tỉnh, thành phố trực thuộc trung ương

- Chủ trì, phối hợp với Bộ Công Thương và các cơ quan liên quan thu hồi phần diện tích bãi thải vượt quá diện tích chứa của 2 năm sản xuất trung bình theo quy mô, công suất của từng nhà máy trên địa bàn;

- Chỉ đạo các chủ đầu tư công trình xây dựng sử dụng vốn ngân sách địa phương phải ưu tiên sử dụng tro, xỉ, thạch cao hoặc các sản phẩm vật liệu xây dựng có tro, xỉ, thạch cao FGD, thạch cao PG;

- Phối hợp với các bộ, cơ quan liên quan kiểm tra, giám sát xử lý kịp thời các đơn vị, tổ chức, cá nhân trên địa bàn không thực hiện nghiêm túc các quy định về quản lý, xử lý, sử dụng tro, xỉ, thạch cao FGD, thạch cao PG làm nguyên liệu sản xuất vật liệu xây dựng và sử dụng trong các công trình xây dựng và kịp thời tháo gỡ những khó khăn phát sinh;

- Đôn đốc, kiểm tra, giám sát các hoạt động phát thải, xử lý các nguồn tro, xỉ, thạch cao trên địa bàn. Khuyến khích các doanh nghiệp trên địa bàn sử dụng tro, xỉ, thạch cao FGD, thạch cao PG làm nguyên liệu sản xuất vật liệu xây dựng và sử dụng trong các công trình xây dựng;

- Tổng hợp các trường hợp không thực hiện nghiêm túc các nội dung trong Đề án gửi Bộ Xây dựng, Bộ Công Thương để tổng hợp báo cáo Chính phủ.

8. Chủ các cơ sở phát thải

Chủ các cơ sở phát thải chịu trách nhiệm thực hiện nghiêm các nội dung của Đề án này và các quy định liên quan.

9. Thời gian thực hiện Đề án: Từ năm 2017 đến năm 2020.

Điều 2. Quyết định này có hiệu lực thi hành kể từ ngày ký ban hành.

Điều 3. Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc trung ương, Chủ tịch Hội đồng thành viên, Tổng giám đốc các tập đoàn kinh tế, tổng công ty nhà nước chịu trách nhiệm thi hành Quyết định này./.

Pursuant to the Government’s Decree No. 24a/2016/ND-CP dated April 5, 2016 on management of building materials;

In light of the request made by the Minister of Construction,

HEREBY DECIDES

I. VIEWPOINTS ON TREATMENT AND USAGE OF ASH, SLAG AND GYPSUM

1. Ash, slag and gypsum (including gypsum obtained from furnace fumes emitted from thermal power plants, abbreviated as FGD (Flue Gas Desulfurization) gypsum; gypsum discharged from chemical and fertilizer plants, abbreviated as PG (Phosphogypsum) gypsum) must be treated and used in an effective manner.  Using ash, slag, FGD and PG gypsum for production of building materials and in construction projects is to serve the purpose of environmental protection and reduction in use of land areas as storage yards and in use of natural resources and minerals for production of building materials as well as assurance of sustainable development.

2. Plant owners shall have the burden of taking necessary actions to treat and consume ash, slag and FGD and PG gypsum produced during the production process.

3. Ash, slag or FGD and PG gypsum, whether pre-treated or post-treated, which conforms to technical standards, regulations and instructions to serve as raw materials used for production of building materials and in construction projects shall be classified as building material commodities and subject to applicable laws and regulations on commodity products.

4. Ash, slag or FGD and PG gypsum conforming to technical standards, regulations and instructions shall be preferred to be used as raw materials for production of building materials and in engineering and construction projects (civil, industrial engineering and construction, traffic and transportation, agriculture and rural development and mine backfilling works, etc.).

5. The Government shall provide preferential treatment policies for organizations or individuals involved in processing and use of ash, slag, FGD and PG gypsum as raw materials for production of building materials or in engineering and construction projects.

II. OBJECTIVES

1. General objectives: By 2020, the amount of ash, slag and gypsum deposited in storage yards of each thermal power plant, chemical and fertilizer plant must be treated and consumed so that such amount is less than total volume thereof discharged within 2 years of production.

2. Specific objectives: By 2020, the amount of ash, slag, FGD and PG gypsum treated and used as raw materials for production of building materials and in construction projects will be expected to account for 52% of total accumulated volume thereof (approximately 75 million tonnes, including 56 million tonnes of ash and slag produced from thermal power plants; 2.5 million tonnes of FGD gypsum; 16.5 million tonnes of PG gypsum) with the following estimates:

- About 1.5 million tonnes of FGD gypsum will be used as additives to adjust the setting time of hydraulic cement mortar; about 1 million tonnes thereof will be used as materials for manufacturing of construction plasterboards;

- About 3 million tonnes of PG gypsum will be used as additives to adjust the setting time of hydraulic cement mortar; about 1.5 million tonnes thereof will be used as materials for manufacturing of construction plasterboards; about 12 million tonnes thereof will be used as materials for leveling work at construction sites, mine backfilling and road construction projects.

III. MISSIONS AND SOLUTIONS

1. Further improvement of legislative documents, technical standards and regulations.

- Revise, amend and supplement legislative documents regarding treatment and use of ash, slag and gypsum for manufacturing of building materials and construction projects;

- Prepare and issue technical standards, regulations, instructions and economic-technical productivity norms for treatment and use of ash, slag, FGD and PG gypsum as materials for manufacturing of building materials and construction projects.  This mission must be due for completion by June 30, 2018;

- Issue and provide instructions for regulations on record-keeping of costs incurred from treatment and consumption of ash, slag and gypsum discharged from thermal power plants, chemical and fertilizer plants for production of building materials and construction projects;

- Use the state budget allocations for preparing and issuing technical standards, regulations, instructions and economic-technical productivity norms for treatment and use of ash, slag, FGD and PG gypsum as materials for manufacturing of building materials and construction projects in accordance with applicable laws and regulations.

2. Science and technology research and application

- Use funds allocated by the state budget in accordance with applicable laws and regulations; simultaneously, provide incentive policies for owners of facilities releasing wastes shall be obliged to make their financial contributions and provide their financial support to accelerate the science and technology study and application process for treatment and use of ash, slag, FGD and PG gypsum for manufacturing of building materials and construction projects;    

- Apply incentive policies to research, application and trial production projects and programs for treatment and use of ash, slag, PGD and PG gypsum in accordance with the Law on Science and Technology.

3. Treatment and usage of ash, slag and gypsum

- Owners of waste-discharging facilities and stakeholders of construction and investment projects, and host entities of thermal power plants, chemical and fertilizer plants, shall be held responsible for submitting their proposals for treatment and consumption of ash, slag and gypsum to the Ministry of Industry and Trade. By 2020, ensure that an area of each dumping ground will not exceed the amount of wastes released within 2 years of mean production.  This regulation shall be specifically applied to (1) active plants from which proposals for treatment and use of ash, slag and gypsum produced have been submitted before December 31, 2018; (2) projects that are under construction, require modified proposals and submission of the accepted proposals before officially being put into operation; (3) projects that are at the stage of pre-investment arrangement, proposal formulation and submission of the request for approval of the proposal and the investment project;

- The Government’s incentive and support policies applied to investment projects on treatment of ash, slag, FGD and PG gypsum shall be the same as those so applied to investment projects on solid waste treatment in accordance with applicable laws and regulations;

- Incentive and preferential treatment policies applied to locally-manufactured mechanical engineering products used in the technological line to process ash, slag, FGD and PG gypsum for manufacturing of building materials and for use in construction projects shall be the same as those so applied to priority mechanical engineering projects;

- State-funded investment and construction projects must prefer to use ash, slag and gypsum or building materials made from ash, slag, FGD and PG gypsum provided these materials or products have the same economic and technical efficiency as other ones;

- Owners of waste-discharging facilities and facilities for processing and use of ash, slag, FGD and PG gypsum as raw materials for production of building materials or for use in engineering and construction projects shall be obligated to comply with regulations laid down in Article 40 of the Decree No. 24a/2016/ND-CP;

- Where it is unlikely that ash, slag, FGD or PG gypsum is processed, used as raw materials for manufacturing of building materials or for use in construction projects, they may be treated like non-recyclable solid wastes.

- Design programs, prepare materials, carry out information dissemination, organize training, drilling and career development sessions or courses attended by public officers and employees charged with management, treatment and use of ash, slag, FGD and PG gypsum;

- Make available for the public information about technical standards, regulations, instructions and economic-technical productivity norms for treatment and use of ash, slag, FGD and PG gypsum as raw materials for manufacturing of building materials and for use in construction projects;

- Increase and diversify communications methods in order to ensure that public officers at all administrative levels, enterprises and population are all aware of significance of processing and reuse of ash, slag, FGD and PG gypsum;

- Stimulate international cooperation in science and technology research and exchange in the field of treatment and use of ash, slag, FGD and PG gypsum as raw materials for manufacturing of building materials and for use in engineering and construction projects.    

IV. IMPLEMENTATION

1. The Ministry of Construction

- Undertake and cooperate with relevant Ministries and authorities, People’s Committees of centrally-affiliated cities and provinces in necessary arrangements for and inspection of implementation of this Decision and submission of annual and final review reports on execution of the Proposal to the Government by end of 2020;

- Issue within its jurisdiction or cooperate with relevant Ministries or authorities in revision, supplementation or request for competent authorities’ approval of release of technical standards, regulations, instructions and economic-technical productivity norms for treatment and use of ash, slag, FGD and PG gypsum as raw materials for manufacturing of building materials and for use in construction projects;

-Undertake and conduct researches or projects on trial production relating to treatment and use of ash, slag, FGD and PG gypsum as raw materials for manufacturing of building materials and for use in engineering and construction projects;

- Command that State-funded civil and industrial construction projects must prefer to use ash, slag and gypsum or building materials made from ash, slag, FGD and PG gypsum.

2. The Ministry of Industry and Trade

- Undertake and cooperate with the Ministry of Construction, Natural Resources and Environment, the Ministry of Science and Technology and relevant entities in provision of guidance on formulation, approval of the proposal for treatment and consumption of ash, slag, FGD and PG gypsum produced by thermal power plants, chemical and fertilizer plants as provided in Point c Clause 3 Article 1 hereof; supervise treatment and consumption of ash, slag, FGD and PG gypsum during the implementation process; impose any necessary sanction on owners of waste-discharging facilities in breach of regulations laid down in this Proposal;

- Issue instructional manuals for record-keeping of costs incurred from treatment and consumption of ash, slag and gypsum discharged from thermal power plants, chemical and fertilizer plants;

- Cooperate with the Ministry of Construction in research and improvement of the technology for treatment and use of ash, slag and gypsum discharged from thermal power plants, chemical and fertilizer plants for production of building materials and for use in construction projects;

- Cooperate with the Ministry of Construction in inspection and assessment of compliance of thermal power plants, chemical and fertilizer plants with this Decision.

3. The Ministry of Natural Resources and Environment

- Provide guidance on and inspect collection, handling, storage, process and consumption of ash, slag, FGD and PG gypsum to ensure compliance with regulations on environmental protection; provide instructions for co-processing of ash, slag and gypsum for manufacturing of building materials, and resemblance of the process of manufacturing building materials directly made from ash, slag and gypsum to the process of treatment of ash, slag and gypsum;

- Reinforce, revise and amend technical standards, regulations and instructions for use of ash, slag and gypsum for mine backfilling activities;

4. The Ministry of Science and Technology

- Undertake and cooperate with the Ministry of Construction and other relevant Ministries, sectoral departments and local authorities in offer of support for research on science and technology missions relating to treatment and use of ash, slag and gypsum discharged from thermal power plants, chemical and fertilizer plants for production of building materials and for use in construction projects;

- Conduct audit of national technical standards and regulations; issue national standards for treatment and use of ash, slag, FGD and PG gypsum as raw materials for manufacturing of building materials and for use in construction projects.

5. The Ministry of Transport

- Improve and revise technical standards, regulations and instructions for use of ash, slag and gypsum as building materials in the road construction process;

- Command that State-funded road infrastructure project investors must prefer to use ash, slag and gypsum or building materials made from ash, slag, FGD and PG gypsum.

6. The Ministry of Agriculture and Rural Development

- Improve and revise technical standards, regulations and instructions for use of ash, slag and gypsum as building materials in irrigational works and for other purposes relating to construction of agriculture and rural development infrastructure facilities;

- Command that State-funded agriculture and rural development project investors must prefer to use ash, slag and gypsum or building materials made from ash, slag, FGD and PG gypsum.

- Undertake and cooperate with the Ministry of Industry and Trade and relevant entities in recall of a portion of the dumping ground exceeding the permitted area for storage of ash, slag and gypsum produced on average within 2 years after considering the operational scale and capacity of each plant located within their jurisdictions;

- Command that State-funded construction project investors must prefer to use ash, slag and gypsum or building materials made from ash, slag, FGD and PG gypsum;

- Cooperate with relevant Ministries, authorities in inspection, supervision and timely imposition of sanctions on entities, organizations or individuals within their jurisdictions that fail to strictly comply with regulations on management, treatment and use of ash, slag, FGD and PG gypsum as raw materials for manufacturing of building materials and for use in construction projects, and take immediate actions to deal with any difficulty that may arise;

- Expedite, examine and supervise release of wastes and treatment of ash, slag and gypsum sources within their jurisdictions. Encourage enterprises within their jurisdictions to use ash, slag, FGD and PG gypsum as raw materials for production of building materials or in engineering and construction projects;

- Prepare a consolidated report on cases of failure to strictly comply with requirements set out in the Proposal for submission to the Ministry of Construction and the Ministry of Industry and Trade prior to filing of a final report to the Government.

8. Owners of waste-discharging facilities

Owners of waste-discharging facilities shall assume responsibility for stringently complying with requirements set forth in this Proposal and other relevant regulations.

9. The duration to implement the Proposal: From 2017 to 2020.

Article 2. This Decision shall enter into force from the signature date.
