NGHỊ ĐỊNH

QUY ĐỊNH CHI TIẾT MỘT SỐ ĐIỀU CỦA LUẬT ĐIỆN ẢNH

Căn cứ Luật Tổ chức Chính phủ ngày 19 tháng 6 năm 2015; Luật sửa đổi, bổ sung một số điều của Luật Tổ chức Chính phủ và Luật Tổ chức chính quyền địa phương ngày 22 tháng 11 năm 2019;

Căn cứ Luật Điện ảnh ngày 15 tháng 6 năm 2022;

Theo đề nghị của Bộ trưởng Bộ Văn hóa, Thể thao và Du lịch;

Chính phủ ban hành Nghị định quy định chi tiết một số điều của Luật Điện ảnh.

Chương I

QUY ĐỊNH CHUNG

Điều 1. Phạm vi điều chỉnh

Nghị định này quy định chi tiết điểm d và điểm e khoản 2 Điều 5; khoản 1 và điểm a khoản 3 Điều 14; điểm a và điểm c khoản 3 Điều 19; khoản 2 Điều 20; điểm b, điểm c, điểm d, điểm đ khoản 2, điểm a khoản 3 và khoản 4 Điều 21; khoản 2 Điều 22; khoản 2 Điều 38; khoản 2 Điều 42 Luật Điện ảnh, gồm các nội dung sau:

1. Nhận chuyển giao quyền sở hữu, quyền sử dụng kịch bản phim, phim có giá trị tư tưởng, nghệ thuật cao để tuyên truyền, giáo dục, nghiên cứu, lưu trữ và phục vụ nhiệm vụ chính trị; biên tập, dịch, làm phụ đề phim để phục vụ hoạt động giới thiệu đất nước, con người Việt Nam.

2. Nghiên cứu, ứng dụng thành tựu khoa học và công nghệ tiên tiến trong hoạt động điện ảnh.

3. Sản xuất phim sử dụng ngân sách nhà nước để phục vụ nhiệm vụ chính trị được thực hiện bằng phương thức giao nhiệm vụ hoặc đặt hàng hoặc đấu thầu; quy trình thực hiện lựa chọn dự án sản xuất phim.

4. Tỷ lệ suất chiếu phim Việt Nam, khung giờ chiếu phim Việt Nam, thời lượng và khung giờ chiếu phim cho trẻ em phổ biến trong rạp chiếu phim.

5. Miễn, giảm giá vé cho người cao tuổi, người khuyết tật, người có công với cách mạng, trẻ em, người có hoàn cảnh đặc biệt khó khăn và các đối tượng khác theo quy định của pháp luật.

6. Tỷ lệ thời lượng phát sóng phim Việt Nam so với phim nước ngoài, khung giờ phát sóng phim Việt Nam, thời lượng và khung giờ phát sóng phim cho trẻ em trên các kênh truyền hình trong nước.

7. Điều kiện thực hiện phân loại phim để phổ biến trên không gian mạng.

8. Thông báo danh sách phim sẽ phổ biến và kết quả phân loại phim cho Bộ Văn hóa, Thể thao và Du lịch trước khi thực hiện phổ biến phim trên không gian mạng.

9. Thực hiện biện pháp kỹ thuật cần thiết và hướng dẫn để cha, mẹ hoặc người giám hộ của trẻ em tự kiểm soát, quản lý, bảo đảm trẻ em xem phim phổ biến trên không gian mạng phù hợp với độ tuổi xem phim; để người sử dụng dịch vụ báo cáo về phim vi phạm quy định của Luật Điện ảnh.

10. Cung cấp đầu mối, thông tin liên hệ để tiếp nhận, xử lý yêu cầu của cơ quan quản lý nhà nước; phản ánh, khiếu nại, tố cáo của người sử dụng dịch vụ.

11. Triển khai các giải pháp kỹ thuật, phối hợp với cơ quan quản lý nhà nước có thẩm quyền gỡ bỏ, ngăn chặn phim vi phạm.

12. Trách nhiệm ngăn chặn truy cập phim vi phạm theo yêu cầu của cơ quan nhà nước có thẩm quyền của tổ chức, doanh nghiệp có mạng viễn thông.

13. Cơ quan nhà nước có thẩm quyền tiếp nhận thông báo về việc chiếu phim công cộng.

14. Điều kiện cơ quan, tổ chức Việt Nam tổ chức liên hoan phim, liên hoan phim chuyên ngành, chuyên đề, giải thưởng phim, cuộc thi phim, chương trình phim và tuần phim tại Việt Nam.

15. Quỹ hỗ trợ phát triển điện ảnh.

Điều 2. Đối tượng áp dụng

Nghị định này áp dụng đối với cơ quan, tổ chức, cá nhân Việt Nam tham gia hoạt động điện ảnh tại Việt Nam và ở nước ngoài; tổ chức, cá nhân nước ngoài tham gia hoạt động điện ảnh tại Việt Nam và cơ quan quản lý nhà nước về điện ảnh, cơ quan, tổ chức, cá nhân có liên quan đến hoạt động điện ảnh.

Điều 3. Giải thích từ ngữ

1. Chủ đầu tư dự án sản xuất phim sử dụng ngân sách nhà nước (sau đây gọi là Chủ đầu tư) là cơ quan, đơn vị được quy định tại khoản 2 Điều 14 Luật Điện ảnh.

2. Cơ quan, đơn vị quản lý dự án sản xuất phim sử dụng ngân sách nhà nước (sau đây gọi là Cơ quan quản lý dự án) là cơ quan, đơn vị thuộc chủ Chủ đầu tư có chức năng quản lý, tham mưu, tư vấn giúp Chủ đầu tư quản lý dự án sản xuất phim, được Chủ đầu tư giao nhiệm vụ thực hiện.

3. Hệ thống dữ liệu về phân loại phim trên không gian mạng là ứng dụng của cơ quan nhà nước có thẩm quyền về điện ảnh của Bộ Văn hóa, Thể thao và Du lịch sử dụng để quản lý hoạt động phân loại phim của các doanh nghiệp, đơn vị sự nghiệp, tổ chức thực hiện hoạt động phổ biến phim trên không gian mạng.

Chương II

QUY ĐỊNH CỤ THỂ

Điều 4. Nhận chuyển giao quyền sở hữu, quyền sử dụng kịch bản phim, phim có giá trị tư tưởng, nghệ thuật cao để tuyên truyền, giáo dục, nghiên cứu, lưu trữ và phục vụ nhiệm vụ chính trị

1. Cơ quan, tổ chức Nhà nước nhận chuyển giao quyền sở hữu, quyền sử dụng kịch bản phim, phim có giá trị tư tưởng, nghệ thuật cao để tuyên truyền, giáo dục, nghiên cứu, lưu trữ và phục vụ nhiệm vụ chính trị bằng các hình thức mua hoặc nhận tặng cho kịch bản phim, phim.

2. Cơ quan, tổ chức Nhà nước mua kịch bản phim, phim bao gồm:

a) Bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ và Ủy ban nhân dân cấp tỉnh;

b) Cơ quan trung ương của tổ chức chính trị, tổ chức chính trị - xã hội và tổ chức chính trị xã hội - nghề nghiệp.

3. Trình tự, thủ tục đánh giá tư tưởng, nghệ thuật kịch bản phim, phim nhận chuyển giao như sau:

a) Cơ quan, tổ chức quy định tại khoản 2 Điều này thành lập Hội đồng đánh giá tư tưởng, nghệ thuật kịch bản phim, phim. Hội đồng làm việc theo nguyên tắc tập trung, dân chủ, thảo luận để đi đến thống nhất, Hội đồng có ít nhất từ 05 thành viên (là số lẻ) bao gồm:

- Chủ tịch Hội đồng là đại diện lãnh đạo cơ quan nhận chuyển giao quyền sở hữu, quyền sử dụng kịch bản phim, phim;

- Các Ủy viên khác của Hội đồng gồm đại diện cơ quan nhận chuyển giao quyền sở hữu, quyền sử dụng kịch bản phim, phim; biên kịch, đạo diễn, các nhà chuyên môn về điện ảnh có kinh nghiệm, uy tín nghề nghiệp và các chức danh khác phù hợp do cơ quan nhận chuyển giao lựa chọn;

- Thư ký của Hội đồng do cơ quan nhận chuyển giao quyết định.

b) Thành viên Hội đồng nhận xét, đánh giá kịch bản phim, phim, chấm điểm theo thang điểm 10, bội số là 0,5 theo tiêu chí sau:

- Xuất sắc: Chấm các điểm 9,0 đến 10 đối với kịch bản phim, phim có nội dung tư tưởng sâu sắc, giá trị nhân văn cao, khái quát được những vấn đề lớn của đời sống xã hội, có phát hiện độc đáo về cuộc sống và con người; ngôn ngữ điện ảnh, kỹ thuật cao, đặc sắc;

- Tốt: Chấm các điểm 7,5 đến 8,5 đối với kịch bản phim, phim có nội dung tư tưởng tốt, có tính nhân văn và giá trị xã hội; ngôn ngữ điện ảnh, kỹ thuật tốt, tạo được sức hấp dẫn;

- Khá: Chấm các điểm 6,0 đến 7,0 đối với kịch bản phim, phim có nội dung tư tưởng tốt, có ý nghĩa xã hội nhất định; ngôn ngữ điện ảnh, kỹ thuật còn hạn chế;

- Trung bình: Chấm các điểm từ 5,5 trở xuống đối với kịch bản phim, phim có nội dung tư tưởng, ngôn ngữ điện ảnh, kỹ thuật còn nhiều hạn chế.

c) Điểm số của thành viên Hội đồng chấm cho kịch bản phim, phim là cơ sở để tư vấn cho người đứng đầu cơ quan nhận chuyển giao đánh giá tư tưởng, nghệ thuật kịch bản phim, phim.

d) Người đứng đầu cơ quan, tổ chức nhận chuyển giao căn cứ vào tư vấn của Hội đồng tư vấn để quyết định mua hoặc nhận tặng cho kịch bản phim, phim và chỉ mua bản phim, phim theo tiêu chí đánh giá Khá trở lên (có số điểm trung bình cộng từ 6,0 trở lên).

đ) Việc định giá (nếu có) trước khi tiếp nhận quyền sở hữu, quyền sử dụng kịch bản phim, phim để tuyên truyền, giáo dục, nghiên cứu, lưu trữ và phục vụ nhiệm vụ chính trị thực hiện trên cơ sở thoả thuận giữa tổ chức, cá nhân chuyển giao và cơ quan, tổ chức nhận chuyển giao quyền sở hữu, quyền sử dụng kịch bản phim, phim.

4. Trường hợp nhận chuyển giao kịch bản phim, phim trong hoạt động quan hệ quốc tế do người đứng đầu cơ quan, tổ chức tiếp nhận chuyển giao quyết định.

5. Trong trường hợp kịch bản phim, phim sử dụng ngôn ngữ, tiếng nước ngoài, cơ quan, tổ chức tiếp nhận chuyển giao có trách nhiệm tổ chức dịch, biên tập và làm phụ đề để sử dụng.

Điều 5. Dịch, biên tập và làm phụ đề phim để phục vụ hoạt động giới thiệu đất nước, con người Việt Nam

1. Cơ quan, tổ chức Nhà nước tổ chức thực hiện nhiệm vụ dịch, biên tập và làm phụ đề phim để phục vụ hoạt động giới thiệu đất nước, con người Việt Nam bao gồm:

a) Bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ và Ủy ban nhân dân cấp tỉnh;

b) Cơ quan trung ương của tổ chức chính trị, tổ chức chính trị - xã hội và tổ chức chính trị xã hội - nghề nghiệp.

2. Việc dịch, biên tập và làm phụ đề phim để phục vụ hoạt động giới thiệu đất nước, con người Việt Nam phải bảo đảm:

a) Hiệu quả, chất lượng và đúng mục đích;

b) Tuân thủ quy định của pháp luật về quyền tác giả, quyền liên quan.

Điều 6. Đầu tư, hỗ trợ nghiên cứu, ứng dụng thành tựu khoa học và công nghệ tiên tiến trong hoạt động điện ảnh

1. Đầu tư công nghệ tiên tiến phục vụ các hoạt động điện ảnh và công tác quản lý nhà nước.

2. Số hóa phim, kịch bản, dữ liệu, tài liệu khác và xây dựng hệ thống hạ tầng lưu trữ của các cơ sở lưu trữ phim và các cơ quan quản lý nhà nước về điện ảnh.

3. Xây dựng, đầu tư hệ thống hạ tầng, trang thiết bị kỹ thuật, công nghệ tiên tiến phục vụ công tác lưu trữ, thống kê dữ liệu hoạt động điện ảnh.

4. Nghiên cứu, ứng dụng trí tuệ nhân tạo, hệ thống dữ liệu lớn, thành tựu khoa học và công nghệ tiên tiến, hiện đại phù hợp với xu thế phát triển điện ảnh.

5. Hiện đại hóa công nghệ và đầu tư thiết bị kỹ xảo, thiết bị kỹ thuật đồng bộ chuyên dụng, bảo đảm đủ điều kiện sản xuất phim, phát hành, phổ biến phim theo công nghệ hiện đại.

Điều 7. Sản xuất phim sử dụng ngân sách nhà nước

Phim sản xuất sử dụng ngân sách nhà nước là sản phẩm văn hóa đặc thù, gắn với quyền tác giả từ khâu sáng tác đến khi hoàn thành. Việc sản xuất phim sử dụng ngân sách nhà nước quy định như sau:

1. Đối với phim tài liệu, phim khoa học, phim hoạt hình theo kế hoạch phục vụ nhiệm vụ chính trị về đề tài lịch sử, cách mạng, lãnh tụ, danh nhân, anh hùng dân tộc, trẻ em, vùng cao, miền núi, biên giới, hải đảo, vùng đồng bào dân tộc thiểu số, bảo tồn và phát huy các giá trị văn hóa Việt Nam thực hiện phương thức giao nhiệm vụ hoặc đặt hàng.

2. Đối với phim truyện, phim kết hợp nhiều loại hình:

a) Thực hiện phương thức giao nhiệm vụ, đặt hàng đối với các dự án sản xuất phim theo kế hoạch phục vụ nhiệm vụ chính trị về đề tài lịch sử, cách mạng, lãnh tụ, danh nhân, anh hùng dân tộc, trẻ em, vùng cao, miền núi, biên giới, hải đảo, vùng đồng bào dân tộc thiểu số;

b) Thực hiện phương thức đấu thầu đối với các dự án sản xuất phim theo kế hoạch phục vụ nhiệm vụ chính trị về đề tài bảo tồn và phát huy các giá trị văn hóa Việt Nam.

Điều 8. Quy trình lựa chọn dự án sản xuất phim sử dụng ngân sách nhà nước

Căn cứ kế hoạch sản xuất phim đã được phê duyệt và kết quả thẩm định kịch bản của Hội đồng thẩm định kịch bản sản xuất phim sử dụng ngân sách nhà nước, chủ đầu tư và cơ quan quản lý dự án tổ chức lựa chọn dự án sản xuất phim như sau:

1. Đối với phương thức giao nhiệm vụ, đặt hàng:

a) Cơ sở điện ảnh sản xuất phim có kịch bản được tuyển chọn lập Hồ sơ dự án sản xuất phim gửi cơ quan quản lý dự án trình Hội đồng lựa chọn dự án sản xuất phim sử dụng ngân sách nhà nước, gồm:

- Hồ sơ theo quy định của pháp luật về giao nhiệm vụ, đặt hàng sản phẩm, dịch vụ công sử dụng ngân sách nhà nước.

- Hồ sơ chứng minh năng lực tài chính, kế hoạch, tiến độ sản xuất.

- Dự toán chi phí sản xuất phim (đối với phương thức giao nhiệm vụ) hoặc phương án giá đặt hàng sản xuất phim (đối với phương thức đặt hàng), bao gồm:

+ Tổng dự toán chi phí sản xuất phim;

+ Danh mục trang thiết bị kỹ thuật (nêu rõ mã ký hiệu, tính năng, thông số kỹ thuật) phục vụ dự án sản xuất phim (bao gồm trang thiết bị có sẵn và thuê, mướn);

+ Chi phí tiền công, tiền lương.

- Phương án phát hành, phổ biến phim.

- Văn bản cam đoan về quyền tác giả đối với kịch bản phim.

- Hồ sơ đối với phim truyện và phim kết hợp nhiều loại hình gồm có:

+ Kịch bản, kịch bản phân cảnh và phương án sản xuất phim;

+ Danh sách một số chức danh sáng tạo tác phẩm điện ảnh gồm đạo diễn, biên kịch, quay phim, giám đốc sản xuất phim.

- Hồ sơ đối với phim tài liệu, phim khoa học và phim hoạt hình gồm có:

+ Kịch bản, kịch bản phân cảnh các cụm bối cảnh quay;

+ Danh sách một số chức danh sáng tạo tác phẩm điện ảnh gồm đạo diễn, biên kịch, họa sĩ (đối với phim hoạt hình), quay phim, giám đốc sản xuất phim.

b) Hội đồng lựa chọn dự án sản xuất phim sử dụng ngân sách nhà nước do chủ đầu tư thành lập, tiếp nhận Hồ sơ và thực hiện thẩm định theo quy định của Bộ trưởng Bộ Văn hóa, Thể thao và Du lịch. Kết quả thẩm định của Hội đồng để tư vấn cho chủ đầu tư xem xét, quyết định lựa chọn dự án sản xuất phim sử dụng ngân sách nhà nước, quyết định lựa chọn phương thức giao nhiệm vụ, đặt hàng; trong trường hợp lựa chọn phương thức đặt hàng, việc quyết định giá tối đa, giá cụ thể theo quy định của pháp luật về giá;

c) Cơ quan quản lý dự án ký hợp đồng đặt hàng sản xuất phim với cơ sở điện ảnh hoặc trình chủ đầu tư quyết định giao nhiệm vụ cho cơ sở điện ảnh có dự án sản xuất phim được lựa chọn.

2. Đối với phương thức đấu thầu thực hiện theo quy định của pháp luật về đấu thầu và hồ sơ quy định như sau:

- Hồ sơ theo quy định của pháp luật về đấu thầu.

- Hồ sơ chứng minh năng lực tài chính, kế hoạch, tiến độ sản xuất.

- Dự toán chi phí sản xuất phim bao gồm:

+ Tổng dự toán chi phí sản xuất phim;

+ Danh mục trang thiết bị kỹ thuật (nêu rõ mã ký hiệu, tính năng, thông số kỹ thuật) phục vụ dự án sản xuất phim (bao gồm trang thiết bị có sẵn và thuê, mướn);

+ Chi phí tiền công, tiền lương.

- Phương án phát hành, phổ biến phim và phương án phân chia lợi nhuận.

+ Dự kiến chi phí phát hành;

+ Dự kiến doanh thu phát hành.

- Văn bản cam đoan về quyền tác giả đối với kịch bản phim.

- Hồ sơ đối với phim truyện và phim kết hợp nhiều loại hình gồm có:

+ Kịch bản, kịch bản phân cảnh và phương án sản xuất phim;

+ Danh sách một số chức danh sáng tạo tác phẩm điện ảnh gồm đạo diễn, biên kịch, quay phim, giám đốc sản xuất phim.

- Hồ sơ đối với phim tài liệu, phim khoa học và phim hoạt hình gồm có:

+ Kịch bản, kịch bản phân cảnh các cụm bối cảnh quay;

+ Danh sách một số chức danh sáng tạo tác phẩm điện ảnh gồm đạo diễn, biên kịch, họa sĩ (đối với phim hoạt hình), quay phim, giám đốc sản xuất phim.

Điều 9. Tỷ lệ suất chiếu phim Việt Nam, khung giờ chiếu phim Việt Nam, thời lượng và khung giờ chiếu phim cho trẻ em trong hệ thống rạp chiếu phim

1. Phim Việt Nam phải được chiếu trong hệ thống rạp chiếu phim, đặc biệt vào các đợt phim kỷ niệm các ngày lễ lớn của đất nước, phục vụ nhiệm vụ chính trị, xã hội, đối ngoại theo yêu cầu của cơ quan nhà nước có thẩm quyền.

2. Phim Việt Nam được ưu tiên chiếu vào khung thời gian từ 18 đến 22 giờ.

3. Tỷ lệ suất chiếu phim Việt Nam trong hệ thống rạp chiếu phim được thực hiện theo lộ trình sau:

a) Giai đoạn 1: Từ ngày 01 tháng 01 năm 2023 đến hết ngày 31 tháng 12 năm 2025, bảo đảm đạt ít nhất 15% tổng số suất chiếu trong năm;

b) Giai đoạn 2: Từ ngày 01 tháng 01 năm 2026, bảo đảm đạt ít nhất 20% tổng số suất chiếu trong năm.

4. Giờ chiếu phim cho trẻ em dưới 13 tuổi tại rạp kết thúc trước 22 giờ, cho trẻ em dưới 16 tuổi kết thúc trước 23 giờ.

Điều 10. Miễn, giảm giá vé cho người cao tuổi, người khuyết tật, người có công với cách mạng, trẻ em, người có hoàn cảnh đặc biệt khó khăn và các đối tượng khác theo quy định của pháp luật

1. Người cao tuổi, người có công với cách mạng, trẻ em, người có hoàn cảnh đặc biệt khó khăn và các đối tượng khác theo quy định của pháp luật được giảm ít nhất 20% giá vé xem phim khi trực tiếp sử dụng dịch vụ xem phim tại rạp chiếu phim.

2. Người khuyết tật đặc biệt nặng được miễn giá vé; người khuyết tật nặng được giảm tối thiểu 50% giá vé xem phim khi trực tiếp sử dụng dịch vụ xem phim tại rạp chiếu phim.

Điều 11. Tỷ lệ thời lượng phát sóng phim Việt Nam so với phim nước ngoài, khung giờ phát sóng phim Việt Nam, thời lượng và khung giờ phát sóng phim cho trẻ em trên các kênh có phát phim trên kênh truyền hình trong nước

1. Phim Việt Nam được phát sóng trên các kênh truyền hình trong nước phải được:

a) Tăng thời lượng chiếu vào các ngày lễ lớn của đất nước, phục vụ nhiệm vụ chính trị, xã hội, đối ngoại;

b) Chiếu theo yêu cầu của cơ quan nhà nước có thẩm quyền để kỷ niệm các ngày lễ lớn của đất nước, phục vụ nhiệm vụ chính trị, xã hội, đối ngoại.

2. Phim Việt Nam được ưu tiên phát sóng vào khung thời gian từ 18 đến 22 giờ.

3. Thời lượng phát sóng phim Việt Nam trên các kênh truyền hình được thực hiện theo lộ trình sau:

a) Giai đoạn 1: Từ ngày 01 tháng 01 năm 2023 đến hết ngày 31 tháng 12 năm 2025, bảo đảm đạt ít nhất 15% thời lượng phát sóng phim Việt Nam so với tổng thời lượng phát sóng phim trên các kênh truyền hình trong nước, loại trừ dịch vụ truyền hình theo yêu cầu trên không gian mạng của cơ quan báo chí có giấy phép hoạt động truyền hình;

b) Giai đoạn 2: Từ ngày 01 tháng 01 năm 2026, bảo đảm đạt ít nhất 20% thời lượng phát sóng phim Việt Nam so với tổng thời lượng phát sóng phim trên các kênh truyền hình trong nước, loại trừ dịch vụ truyền hình theo yêu cầu trên không gian mạng của cơ quan báo chí có giấy phép hoạt động truyền hình.

4. Phim cho trẻ em được ưu tiên phát sóng vào khung thời gian từ 18 đến 22 giờ. Thời lượng phát sóng phim cho trẻ em dưới 16 tuổi đạt ít nhất 5% so với tổng số thời lượng phát sóng phim trên các kênh truyền hình trong nước.

Điều 12. Điều kiện thực hiện phân loại phim để phổ biến trên không gian mạng

1. Điều kiện thực hiện phân loại phim để phổ biến trên không gian mạng bao gồm:

a) Có hội đồng phân loại phim hoặc có phần mềm kỹ thuật hoặc có cơ chế để thực hiện việc phân loại phim theo quy định về phân loại phim của Việt Nam và chịu trách nhiệm về kết quả phân loại phim;

b) Có phương án sửa đổi, cập nhật kết quả phân loại phim khi có yêu cầu của cơ quan nhà nước có thẩm quyền về điện ảnh của Bộ Văn hóa, Thể thao và Du lịch. Công cụ quản trị phải hỗ trợ việc phân loại phim theo từng tiêu chí và hiển thị linh hoạt ngay sau khi phim được cập nhật thay đổi về phân loại;

c) Có phương án kỹ thuật và quy trình thực hiện tạm dừng phổ biến, gỡ bỏ phim theo yêu cầu của cơ quan nhà nước có thẩm quyền về điện ảnh của Bộ Văn hóa, Thể thao và Du lịch. Sau khi có yêu cầu gỡ bỏ phim, bộ phận vận hành phải thực hiện quy trình để triển khai thao tác gỡ bỏ phim trên công cụ quản trị.

2. Hồ sơ đề nghị công nhận đủ điều kiện phân loại phim phổ biến trên không gian mạng:

a) Tài liệu cung cấp đầu mối, thông tin liên hệ để tiếp nhận, xử lý yêu cầu của cơ quan nhà nước có thẩm quyền về điện ảnh của Bộ Văn hóa, Thể thao và Du lịch;

b) Báo cáo thuyết minh các nội dung theo quy định tại khoản 1 Điều này.

3. Trình tự, thủ tục đề nghị công nhận đủ điều kiện phân loại phim phổ biến trên không gian mạng:

a) Doanh nghiệp, đơn vị sự nghiệp, tổ chức thực hiện phổ biến phim trên không gian mạng nộp 01 bộ hồ sơ qua Cổng dịch vụ công quốc gia hoặc qua đường bưu điện hoặc nộp trực tiếp đến cơ quan nhà nước có thẩm quyền về điện ảnh của Bộ Văn hóa, Thể thao và Du lịch;

b) Trong thời hạn 15 ngày kể từ ngày nhận đủ hồ sơ hợp lệ, cơ quan nhà nước có thẩm quyền về điện ảnh của Bộ Văn hóa, Thể thao và Du lịch tiếp nhận báo cáo, trả lời bằng văn bản và đăng tải công khai tên doanh nghiệp, đơn vị sự nghiệp, tổ chức đủ điều kiện phân loại phim trên không gian mạng trên Hệ thống dữ liệu về phân loại phim trên không gian mạng; trường hợp hồ sơ không đủ điều kiện phải trả lời bằng văn bản và nêu rõ lý do.

4. Trường hợp thay đổi nội dung quy định tại điểm a khoản 2 Điều này, doanh nghiệp, đơn vị sự nghiệp, tổ chức thực hiện phổ biến phim trên không gian mạng có trách nhiệm gửi thông báo những nội dung thay đổi cho cơ quan nhà nước có thẩm quyền về điện ảnh của Bộ Văn hóa, Thể thao và Du lịch. Trong thời hạn 05 ngày làm việc kể từ ngày nhận được thông báo, nếu không đồng ý, cơ quan nhà nước có thẩm quyền về điện ảnh của Bộ Văn hóa, Thể thao và Du lịch phải trả lời bằng văn bản và nêu rõ lý do.

Trường hợp thay đổi nội dung quy định tại điểm b khoản 2 Điều này, doanh nghiệp, đơn vị sự nghiệp, tổ chức thực hiện phổ biến phim trên không gian mạng phải thực hiện lại trình tự, thủ tục quy định tại khoản 3 Điều này.

5. Trường hợp doanh nghiệp, đơn vị sự nghiệp, tổ chức đủ điều kiện thực hiện phân loại phim phổ biến trên không gian mạng có kết quả phân loại phim không phù hợp với kết quả do cơ quan nhà nước có thẩm quyền về điện ảnh của Bộ Văn hoá, Thể thao và Du lịch thực hiện khi kiểm tra:

a) Thực hiện sửa đổi, cập nhật kết quả phân loại phim theo yêu cầu của cơ quan nhà nước có thẩm quyền về điện ảnh của Bộ Văn hóa, Thể thao và Du lịch;

b) Được coi là chưa bảo đảm điều kiện thực hiện phân loại phim khi kết quả phân loại, hiển thị kết quả phân loại không phù hợp với kết quả phân loại phim của cơ quan nhà nước có thẩm quyền về điện ảnh của Bộ Văn hoá, Thể thao và Du lịch quá 05 lần trong vòng 01 tháng đối với Loại P, Loại T18, Loại T16, Loại T13 và 02 lần trong 06 tháng đối với Loại C thì phải thực hiện phân loại phim theo quy định tại điểm b khoản 2 Điều 21 Luật Điện ảnh;

Sau thời hạn 03 tháng, thực hiện quy định tại khoản 2, khoản 3 Điều này để tiếp tục triển khai phân loại phim.

Điều 13. Thông báo danh sách phim sẽ phổ biến và kết quả phân loại phim cho Bộ Văn hóa, Thể thao và Du lịch trước khi thực hiện phổ biến phim trên không gian mạng

Doanh nghiệp, đơn vị sự nghiệp, tổ chức thực hiện hoạt động phổ biến phim trên không gian mạng thông báo danh sách phim sẽ phổ biến và kết quả phân loại phim thông qua Hệ thống dữ liệu về phân loại phim trên không gian mạng của cơ quan nhà nước có thẩm quyền về điện ảnh của Bộ Văn hóa, Thể thao và Du lịch trước khi phổ biến phim trên không gian mạng.

Điều 14. Thực hiện các biện pháp kỹ thuật cần thiết của doanh nghiệp, đơn vị sự nghiệp, tổ chức thực hiện phổ biến phim trên không gian mạng

1. Doanh nghiệp, đơn vị sự nghiệp, tổ chức thực hiện hoạt động phổ biến phim trên không gian mạng phải thiết lập các biện pháp kỹ thuật cần thiết để cha, mẹ hoặc người giám hộ của trẻ em có khả năng dùng các biện pháp kỹ thuật đó để kiểm soát, quản lý, bảo đảm trẻ em xem phim phù hợp với độ tuổi bằng một trong các biện pháp sau:

a) Xây dựng cơ chế tài khoản đa người dùng bao gồm tài khoản dành riêng cho đối tượng trẻ em, trong đó: các tài khoản phải có mật khẩu bảo vệ, có cơ chế xác nhận khi chuyển tài khoản, có cơ chế báo cáo cho chủ tài khoản về lịch sử xem và hành vi của tài khoản trẻ em;

b) Khi truy cập phim gắn nhãn không dành cho trẻ em được truy cập sẽ có thông báo hiển thị xác nhận về độ tuổi truy cập;

c) Biện pháp có tính chất tương tự khác.

2. Doanh nghiệp, đơn vị sự nghiệp, tổ chức thực hiện hoạt động phổ biến phim trên không gian mạng phải thiết lập các biện pháp kỹ thuật cần thiết, hiển thị phần báo cáo nội dung không phù hợp trong màn hình trình chiếu nội dung hoặc nội dung không phù hợp với phân loại độ tuổi người dùng được dán nhãn để người sử dụng dịch vụ khiếu nại, phản ánh, báo cáo phim vi phạm đối với chính doanh nghiệp, đơn vị sự nghiệp, tổ chức khi người sử dụng dịch vụ có lý do để phản hồi trong các trường hợp sau:

a) Có nội dung và hành vi vi phạm quy định tại Điều 9 Luật Điện ảnh;

b) Biện pháp kỹ thuật quy định tại khoản 1 Điều này vi phạm quy định pháp luật có liên quan;

c) Các hành vi vi phạm pháp luật khác liên quan đến hoạt động phổ biến phim trên không gian mạng của doanh nghiệp, đơn vị sự nghiệp, tổ chức thực hiện hoạt động phổ biến phim trên không gian mạng.

3. Trách nhiệm của doanh nghiệp, đơn vị sự nghiệp, tổ chức thực hiện hoạt động phổ biến phim trên không gian mạng khi thực hiện các biện pháp kỹ thuật cần thiết:

a) Công khai hướng dẫn cách sử dụng các biện pháp kỹ thuật tại khoản 1 và 2 Điều này trên các ứng dụng hoặc trang thông tin điện tử phổ biến phim trên không gian mạng của mình;

b) Bảo đảm các biện pháp kỹ thuật quy định tại khoản 1 và 2 Điều này phải rõ ràng, minh bạch, dễ sử dụng;

c) Xử lý phản ánh, khiếu nại, báo cáo của người sử dụng dịch vụ chậm nhất trong 48 giờ kể từ khi nhận được phản ánh, khiếu nại, báo cáo nếu phản ánh, khiếu nại, báo cáo có căn cứ cụ thể, rõ ràng và kèm theo thông tin liên hệ của người sử dụng dịch vụ.

Điều 15. Cung cấp đầu mối, thông tin liên hệ để tiếp nhận, xử lý yêu cầu của cơ quan quản lý nhà nước

1. Doanh nghiệp, đơn vị sự nghiệp, tổ chức thực hiện hoạt động phổ biến phim trên không gian mạng phải cung cấp các thông tin sau cho cơ quan nhà nước có thẩm quyền về điện ảnh của Bộ Văn hoá, Thể thao và Du lịch:

a) Tên doanh nghiệp, đơn vị sự nghiệp, tổ chức;

b) Đầu mối liên hệ: tên cơ quan, tổ chức hoặc người đại diện tại Việt Nam, địa chỉ email, điện thoại liên hệ.

2. Doanh nghiệp, đơn vị sự nghiệp, tổ chức phổ biến phim trên không gian mạng sau khi tiếp nhận yêu cầu phải thực hiện dừng, gỡ bỏ phim vi phạm chậm nhất trong 24 giờ đối với các phim có nội dung bị nghiêm cấm theo quy định tại Điều 9 Luật Điện ảnh và các quy định khác của pháp luật có liên quan, trong vòng 03 đến 05 ngày đối với các nội dung vi phạm khác theo yêu cầu của cơ quan nhà nước có thẩm quyền về điện ảnh của Bộ Văn hóa, Thể thao và Du lịch.

Điều 16. Trách nhiệm của tổ chức, doanh nghiệp có nền tảng truyền thông số trong việc gỡ bỏ, ngăn chặn phim vi phạm

1. Triển khai các giải pháp kỹ thuật cần thiết để ngăn chặn, gỡ bỏ phim vi phạm quy định tại Điều 9 của Luật Điện ảnh và quy định khác của pháp luật có liên quan.

2. Ngăn chặn, gỡ bỏ phim vi phạm chậm nhất trong 24 giờ kể từ thời điểm có yêu cầu của cơ quan nhà nước có thẩm quyền về điện ảnh của Bộ Văn hóa, Thể thao và Du lịch.

3. Các nội dung của phim vi phạm liên quan đến xâm phạm quyền tác giả, quyền liên quan thực hiện theo quy định của pháp luật về quyền tác giả, quyền liên quan.

Điều 17. Trách nhiệm của tổ chức, doanh nghiệp có mạng viễn thông

Tổ chức, doanh nghiệp có mạng viễn thông phải bảo đảm thực hiện các nghĩa vụ sau đây:

1. Trường hợp phát hiện phim phổ biến trên không gian mạng có nội dung vi phạm pháp luật và ảnh hưởng đến an ninh quốc gia Việt Nam, cơ quan nhà nước có thẩm quyền về điện ảnh của Bộ Văn hóa, Thể thao và Du lịch có quyền yêu cầu tổ chức, doanh nghiệp có mạng viễn thông thực hiện ngay các biện pháp ngăn chặn truy cập phim vi phạm pháp luật. Biện pháp ngăn chặn chỉ được gỡ bỏ sau khi các vi phạm đã được xử lý theo yêu cầu của cơ quan nhà nước có thẩm quyền.

2. Triển khai các biện pháp kỹ thuật cần thiết để ngăn chặn việc truy cập phim vi phạm pháp luật theo yêu cầu của cơ quan nhà nước có thẩm quyền về điện ảnh của Bộ Văn hóa, Thể thao và Du lịch. Thời gian hoàn thành chậm nhất không quá 03 giờ kể từ khi nhận được yêu cầu.

3. Các nội dung của phim vi phạm liên quan đến xâm phạm quyền tác giả, quyền liên quan thực hiện theo quy định của pháp luật về quyền tác giả, quyền liên quan.

Điều 18. Cơ quan nhà nước có thẩm quyền tại địa phương tiếp nhận thông báo về việc chiếu phim công cộng

1. Ủy ban nhân dân cấp tỉnh tiếp nhận thông báo của các nhà hát, nhà văn hóa, nhà triển lãm, trung tâm văn hóa, câu lạc bộ, sân vận động, nhà thi đấu thể thao, quảng trường.

2. Ủy ban nhân dân cấp huyện tiếp nhận thông báo của các cơ sở cung cấp dịch vụ lưu trú, các cơ sở cung cấp dịch vụ ăn uống, vũ trường, cửa hàng, cửa hiệu và địa điểm công cộng khác.

Điều 19. Điều kiện cơ quan, tổ chức Việt Nam tổ chức liên hoan phim, liên hoan phim chuyên ngành, chuyên đề, giải thưởng phim, cuộc thi phim, chương trình phim và tuần phim tại Việt Nam

Cơ quan, tổ chức Việt Nam quy định tại khoản 2 Điều 38 Luật Điện ảnh khi tổ chức liên hoan phim, liên hoan phim chuyên ngành, chuyên đề, giải thưởng phim, cuộc thi phim, chương trình phim và tuần phim tại Việt Nam phải đáp ứng các điều kiện sau đây:

1. Có đăng ký kinh doanh hoặc có chức năng, nhiệm vụ liên quan đến hoạt động điện ảnh hoặc được cấp có thẩm quyền giao hoặc được phê duyệt tổ chức.

2. Người đứng đầu cơ quan, tổ chức phải có ít nhất 05 năm kinh nghiệm hoạt động điện ảnh. Trường hợp người đứng đầu cơ quan, tổ chức chưa đáp ứng được điều kiện này thì phải kết hợp với cơ quan, tổ chức tại khoản 1 Điều này có người đứng đầu đáp ứng đủ tiêu chuẩn có ít nhất 05 năm kinh nghiệm hoạt động điện ảnh.

3. Có năng lực tài chính bảo đảm cho công tác tổ chức liên hoan phim, liên hoan phim chuyên ngành, chuyên đề, giải thưởng phim, cuộc thi phim, chương trình phim và tuần phim tại Việt Nam.

4. Có đề án tổ chức liên hoan phim, liên hoan phim chuyên ngành, chuyên đề, giải thưởng phim, cuộc thi phim, chương trình phim và tuần phim tại Việt Nam gửi cùng thông báo cho Bộ Văn hóa, Thể thao và Du lịch theo quy định tại điểm c khoản 1 Điều 38 Luật Điện ảnh.

Điều 20. Thành lập Quỹ hỗ trợ phát triển điện ảnh

1. Quỹ hỗ trợ phát triển điện ảnh hoạt động theo mô hình công ty trách nhiệm hữu hạn một thành viên do Nhà nước nắm giữ 100% vốn điều lệ và Bộ Văn hóa, Thể thao và Du lịch là đại diện chủ sở hữu.

2. Quỹ hỗ trợ phát triển điện ảnh được hình thành từ các nguồn sau:

a) Vốn điều lệ của Quỹ hỗ trợ phát triển điện ảnh do ngân sách nhà nước cấp. Việc cấp vốn thực hiện sau khi Thủ tướng Chính phủ quyết định thành lập, phê duyệt Điều lệ tổ chức và hoạt động của Quỹ;

b) Huy động đóng góp tự nguyện, tài trợ của cơ quan, tổ chức, cá nhân trong nước, nước ngoài và các nguồn thu nhập hợp pháp khác;

c) Tiền lãi từ tiền gửi của Quỹ tại ngân hàng;

d) Các nguồn thu hợp pháp khác theo quy định của pháp luật.

Chương III

ĐIỀU KHOẢN THI HÀNH

Điều 21. Điều khoản thi hành

1. Nghị định này có hiệu lực thi hành từ ngày 01 tháng 01 năm 2023.

2. Nghị định này thay thế Nghị định số 54/2010/NĐ-CP ngày 21 tháng 5 năm 2010 của Chính phủ quy định chi tiết thi hành một số điều của Luật Điện ảnh số 62/2006/QH11 và Luật sửa đổi, bổ sung một số điều của Luật Điện ảnh số 31/2009/QH12.

3. Bãi bỏ quy định tại Điều 3 Nghị định số 142/2018/NĐ-CP ngày 09 tháng 10 năm 2018 của Chính phủ sửa đổi một số quy định về điều kiện đầu tư kinh doanh thuộc phạm vi quản lý nhà nước của Bộ Văn hóa, Thể thao và Du lịch.

4. Bãi bỏ quy định tại điểm b khoản 1 Điều 8, cụm từ “bản dịch tóm tắt nội dung phim” tại điểm b khoản 2 Điều 9 tại Nghị định số 32/2012/NĐ-CP ngày 12 tháng 4 năm 2012 của Chính phủ về quản lý xuất khẩu, nhập khẩu văn hóa phẩm không nhằm mục đích kinh doanh.

5. Bãi bỏ Nghị định số 22/2022/NĐ-CP ngày 25 tháng 3 năm 2022 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 32/2012/NĐ-CP ngày 12 tháng 4 năm 2012 của Chính phủ về quản lý xuất khẩu, nhập khẩu văn hóa phẩm không nhằm mục đích kinh doanh.

6. Phim đã được phổ biến trên không gian mạng trước ngày 31 tháng 12 năm 2023 thì đến ngày 01 tháng 01 năm 2024 phải hoàn thành bổ sung cảnh báo và hiển thị mức phân loại phim đến người xem trong trường hợp tiếp tục phổ biến.

Điều 22. Trách nhiệm thi hành

Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương và cơ quan, tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Nghị định này.

ELABORATING A NUMBER OF ARTICLES OF THE LAW ON CINEMATOGRAPHY

Pursuant to the Law on Organization of the Government of Vietnam dated June 19, 2015; the Law on Amendments to the Law on Organization of the Government of Vietnam and the Law on Organization of the Local Government of Vietnam dated November 22, 2019;

Pursuant to the Law on Cinematography dated June 15, 2022;

At the request of the Minister of Culture, Sports and Tourism of Vietnam; 

The Government of Vietnam hereby promulgates the Decree elaborating on a number of Articles of the Law on Cinematography.

Chapter I

GENERAL PROVISIONS

This Decree provides for Point d and Pont e Clause 2 Article 5; Clause 1 and Point a Clause 3 Article 14; Point a and Point c Clause 3 Article 19; Clause 2 Article 20; Point b, Point c, Point d, Point dd Clause 2, Point a Clause 3, and Clause 4 of Article 21; Clause 2 Article 22; Clause 2 Article 38; Clause 2 Article 42 of the Law on Cinematography, including:

1. Receipt of the transfer of ownership and rights to use film scripts and films with high ideological and artistic values for dissemination, education, research, archive, and political tasks; processes of editing, translating, and subtitling films to introduce Vietnam and its citizens.

2. Research and application of scientific and technological achievements in cinematographic activities

3. Production of films with funding from the state budget for political tasks performed in the form of task assignment, ordering, or bidding; processes of selecting film production projects.

4. Percentage of Vietnamese film screening sessions, Vietnamese film screening time frames, and duration and time frame of children’s films disseminated in cinemas.

5. Ticket price exemption or discount for the elderly, the disabled, revolutionary contributors, children, people in especially difficult circumstances, and other subjects as prescribed by law.

6. Broadcast time ratio of Vietnamese films to foreign films, broadcast time frames of Vietnamese films, and duration and broadcast time frames of children’s films on domestic television channels.

7. Conditions for film rating for dissemination in cyberspace.

8. Submission of notifications of the list of films to be disseminated and the results of film rating to the Ministry of Culture, Sports and Tourism of Vietnam before the dissemination of such films in cyberspace.

10. Provision of focal points and contact information to receive and process requests from state management agencies and feedback, complaints, and denunciations from service users.

11. Implementation of technical solutions and cooperation with competent state management agencies in removing and preventing violating films.

12. Responsibilities to prevent access to violating films at the request of competent state agencies and enterprises with telecommunications networks.

13. State agencies competent to receive notifications of public movie screenings.

14. Conditions for Vietnamese agencies and organizations to organize film festivals, specialized and thematic film festivals, film awards, film competitions, film programs, and film weeks in Vietnam.

15. Cinematographic development support fund

Article 2. Regulated entities

This Decree applies to Vietnamese agencies, organizations, and individuals engaging in cinematographic activities in Vietnam and abroad; foreign organizations and individuals engaging in cinematographic activities in Vietnam, state management agencies of cinematography, and agencies, organizations, and individuals related to cinematographic activities.

2. Agencies and units that manage film production projects with funding from the state budget (hereinafter referred to as “Project Management Agencies”) are agencies and units affiliated with Investors with functions of managing and providing advisory services to assist Investors in managing film production projects with tasks assigned by Investors.

3. The System of Data on Film Rating in Cyberspace is an application of competent state agencies of cinematography of the Ministry of Culture, Sports and Tourism of Vietnam used for managing activities of film rating of enterprises, public service providers, and organizations that disseminate films in cyberspace.

Chapter II

SPECIFIC PROVISIONS

Article 4. Receipt of the transfer of ownership and rights to use film scripts and films with high ideological and artistic values for dissemination, education, research, archive, and political tasks

1. State agencies and organizations receive the transfer of ownership and rights to use film scripts and films with high ideological and artistic values for dissemination, education, research, archive, and political tasks via purchase or gifts of film scripts or films.

2. State agencies and organizations that purchase film scripts and films include:

a) Ministries, ministerial agencies, governmental agencies, and provincial People’s Committees;

b) Central agencies of political organizations, socio-political organizations, and social-political-vocational organizations

a) Agencies and organizations prescribed in Clause 2 of this Article shall establish a Council for assessing ideological and artistic values of film scripts and films. The Council will work based on principles of concentration, democracy, and discussion to come to an agreement, the Council shall have at least 5 (odd number) members, including:

- The Chairman of the Council is the representative of the agency that receives the transfer of ownership and rights to use film scripts and films;

- Other members of the Council include representatives of the agency that receives the transfer of ownership and rights to use film scripts and films; screenwriters, directors, and cinematographic specialists with professional experience and reputation and other appropriate titles selected by the agency that receives the transfer;

- The Secretary of the Council shall be decided by the agency that receives the transfer.

b) Members of the Council shall provide comments and assessments of film scripts and films, and mark them based on a 10-point scale with a multiple of 0,5 following the below criteria:

- Excellent: Marking points from 9,0 to 10 regarding film scripts and films with profound ideological contents, high humanistic values, generalizing major issues of social life and having unique discoveries about life and human; high and unique cinematographic languages and techniques;

- Very good: Marking points from 7,5 to 8,5 regarding film scripts and films with good ideological contents, humanistic values, and social values; good and attractive cinematographic languages and techniques;

- Good: Marking points from 6,0 to 7,0 regarding film scripts and films with good ideological contents and certain social values; limited cinematographic languages and techniques;

- Average: Marking points from 5,5 to below regarding film scripts and films with ideological contents and cinematographic languages and techniques that have many limitations;

d) The head of the agency or organization that receives the transfer shall rely on the counseling provided by the Council to decide on the purchase or receipt of gifts that are film scripts and films and shall only purchase film scripts and films if they are marked Good or higher following the mentioned criteria (having an average point of at least 6,0).

dd) The valuation (if any) before receiving the ownership and rights to use film scripts and films for dissemination, education, research, archive, and political tasks shall be performed based on the agreement between the transferring organization or individual and the organization or agency receiving the ownership and rights to use film scripts and films.

4. In international relations activities, the receipt of the transfer of film scripts and films shall be decided by the heads of organizations or agencies that receive the transfer.

5. If film scripts and films use foreign languages, agencies and organizations that receive the transfer shall organize the translation, compilation, and subtitling process of such film scripts and films for use.

Article 5. Translation, compilation, and subtitling process for introducing Vietnam and its people

1. State agencies and organizations shall perform tasks of translating, compiling, and subtitling films to introduce Vietnam and its people, including:

a) Ministries, ministerial agencies, governmental agencies, and provincial People’s Committees;

b) Central agencies of political organizations, socio-political organizations, and social-political-vocational organizations

2. The translation, compilation, and subtitling process for introducing Vietnam and its people shall:

b) Comply with regulations of laws on copyright and relevant rights.

Article 6. Investment in and support for research and application of advanced scientific and technological achievements in cinematographic activities

1. Invest in advanced technology to serve cinematographic activities and state management work.

2. Digitalize films, film scripts, data, and other documents and develop an archive infrastructure system of film archives and state management agencies of cinematography.

3. Develop and invest in the infrastructure system and advanced technical equipment and technology to serve the archive and statistical work of data on cinematographic activities.

4. Research and apply artificial intelligence, major data systems, and advanced and modern scientific and technological achievements in accordance with cinematographic development trends.

5. Modernize technology and invest in special effect equipment and specialized synchronous technical equipment, ensuring sufficient conditions for producing, distributing, and disseminating films according to modern technology.

Article 7. Production of films with funding from the state budget

Films produced by using funding from the state budget are specific cultural products associated with copyright, from the composition to completion. The production of films with funding from the state is stipulated as follows:

2. Regarding feature films and films of combined genres:

a) Perform methods of assigning tasks and ordering regarding film production projects according to the plans to serve political tasks on the topics of history, revolution, leaders, notables, national heroes, children, highlands, mountainous areas, borders, islands, and ethnic minority areas;

b) Perform bidding methods regarding film production projects according to the plans to serve political tasks on topics of the preservation and promotion of Vietnam’s cultural values.

Article 8. Procedure for selecting film production projects with funding from the state budget

According to the approved film production plan and the script assessment result of the Council assessing film production scripts with funding from the state budget, the investor and project management agency shall select film production projects as follows:

1. Regarding methods of assigning tasks and ordering:

a) A film production cinematographic facilities with selected scripts shall prepare a Film Production Project Dossier and submit it to the project management agency for presentation to the Council for selection of film production projects with funding from the state budget, including: 

- Documents following laws on task assignment, product orders, and public services using the state budget.

- Documents proving financial capacity, plans, and production progress.

+ Total film production cost estimate;

+ A list of technical equipment (with specific codes, symbols, features, and specifications) serving the film production project (including existing equipment and hired or rented equipment);

+ Cost of wages and salaries.

- Schemes for film distribution and dissemination.

- Written guarantee of copyright for the film script.

- Regarding feature films and films of combined genres, the documents shall include:

+ Scripts, storyboards, and film production schemes;

+ A list of several titles of cinematographic work creation, including director, screenwriter, cinematographer, and film producer.

- Regarding documentaries, scientific films, and cartoons, the documents shall include:

+ A list of several titles of cinematographic work creation, including director, screenwriter, artist (regarding cartoons), cinematographer, and film producer.

b) The Council selecting film production projects with funding from the state budget established by the investor shall receive the Dossier and perform the assessment following regulations promulgated by the Minister of Culture, Sports and Tourism of Vietnam. The assessment result of the Council shall be used to provide advisory services for the investor to consider and decide on the selection of film production projects with funding from the state budget and the method or decide on the selection between the method of assigning tasks or the method of ordering. If the method of ordering is selected, the decision on the maximum and specific price shall comply with laws on prices;

c) The project management agency shall sign the contract of ordering the film production with the cinematographic facility or present it to the investor to assign tasks to the cinematographic facility with the selected film production project.

2. Regarding the bidding methods, comply with laws on procurement, and Dossiers are stipulated as follows:

- Documents following laws on procurement.

- Documents proving financial capacity, plans, and production progress.

- Film production cost estimates, including:

+ Total film production cost estimate;

+ A list of technical equipment (with specific codes, symbols, features, and specifications) serving the film production project (including existing equipment and hired or rented equipment);

- Schemes for distribution and dissemination and profit sharing schemes. 

+ Expected distribution costs;

+ Expected distribution profits.

- Written guarantee of copyright for the film script.

- Regarding feature films and films of combined genres, the documents shall include:

+ Scripts, storyboards, and film production schemes;

+ A list of several titles of cinematographic work creation, including director, screenwriter, cinematographer, and film producer.

- Regarding documentaries, scientific films, and cartoons, the documents shall include:

+ Scripts, storyboards, and clusters of filming backgrounds;

Article 9. Percentage of Vietnamese film screening sessions, Vietnamese film screening time frames, and duration and time frame of children’s films disseminated in cinema systems.

1. Vietnamese films shall be screened in cinema systems, especially films celebrating major national holidays and serving political, social, and foreign affairs tasks at the request of competent state agencies.

2. Vietnamese films shall be prioritized for screening during the time frame from 6 pm to 10 pm.

3. The percentage of Vietnamese film screening sessions in cinema systems shall be conducted according to the following roadmap:

a) Stage 1: From January 1, 2023 to the end of December 31, 2025, ensure at least 15% of the total screening session in a year;

b) Stage 2: From January 1, 2026, ensure at least 20% of the total screening session in a year;

4. The time frame for the screening of films for children under 13 years old shall end before 10 pm and before 11 pm for children under 16 years old.

Article 10. Ticket price exemption or discount for the elderly, the disabled, revolutionary contributors, children, people in especially difficult circumstances, and other subjects as prescribed by law

1. The elderly, the disabled, revolutionary contributors, children, people in especially difficult circumstances, and other subjects as prescribed by law may receive at least a 20% discount on film ticket prices when directly using film viewing services at cinemas.

Article 11. Broadcast time ratio of Vietnamese films to foreign films, broadcast time frames of Vietnamese films, and duration and broadcast time frames of children’s films on domestic film broadcasting television channels.

1. Vietnamese films broadcasted on domestic television channels shall:

a) Have their broadcasting duration increased during major national holidays, serving political, social, and foreign affairs tasks;

b) Be broadcasted at the request of competent state agencies to celebrate major national holidays and serve political, social, and foreign affairs tasks.

2. Vietnamese films shall be prioritized for broadcasting during the time frame from 6 pm to 10 pm.

3. The broadcasting duration of Vietnamese films on television channels shall be conducted according to the following roadmap:

a) Stage 1: From January 1, 2023 to the end of December 31, 2025, ensure at least 15% of the broadcasting duration of Vietnamese films compared to the total broadcasting time of films on domestic television channels, excluding on-demand television services in cyberspace of press agencies licensed to engage in television operations;

b) Stage 2: From January 1, 2026, ensure at least 20% of the broadcasting duration of Vietnamese films compared to the total broadcasting time of films on domestic television channels, excluding on-demand television services in cyberspace of press agencies licensed to engage in television operations.

4. Children's films shall be prioritized for broadcasting during the time frame from 6 pm to 22 pm. The broadcasting duration of films for children under 16 years old shall reach at least 5% compared to the total broadcasting duration on domestic television channels.

1. Conditions for film rating for dissemination in cyberspace include:

a) Having film rating councils or technical software or mechanisms for performing film rating according to regulations on film rating of Vietnam and be responsible for film rating results;

b) Having schemes for amendments to and update on film rating results at the request of competent state agencies of cinematography of the Ministry of Culture, Sports and Tourism of Vietnam. Having administration tools that support film rating following each criterion with flexible display as soon as the film rating is updated or changed;

c) Having technical schemes and procedures for suspending the dissemination or removing films at the request of competent state agencies of cinematography of the Ministry of Culture, Sports and Tourism of Vietnam. After receiving requests for film removal, operating departments shall perform procedures for removing films on administration tools.

2. Applications for film rating eligibility for dissemination in cyberspace:

a) Documents providing focal points and contact information to receive and process requests of competent state agencies of cinematography of the Ministry of Culture, Sports and Tourism of Vietnam;

b) Reports presenting contents following Clause 1 of this Article.

3. Procedures for applying for film rating eligibility for dissemination in cyberspace:

a) Enterprises, public service providers, and organizations that disseminate films in cyberspace shall apply 1 dossier via the National Public Service Portal or by post or directly to competent state agencies of cinematography of the Ministry of Culture, Sports and Tourism of Vietnam;

4. In case of changes to contents prescribed in Point a Clause 2 of this Article, enterprises, public service providers, and organizations that disseminate films in cyberspace shall submit notifications of changed contents to competent state agencies of cinematography of the Ministry of Culture, Sports and Tourism of Vietnam. Within 5 working days after receiving notifications, in case of disagreement, competent state agencies of cinematography of the Ministry of Culture, Sports and Tourism of Vietnam shall provide answers and explanations in writing.

In case of changes to contents prescribed in Point b Clause 2 of this Article, enterprises, public service providers, and organizations that disseminate films in cyberspace shall re-perform the procedures prescribed in Clause 3 of this Article.

5. If enterprises, public service providers, and organizations eligible for performing film rating for dissemination in cyberspace have film rating results inconsistent with results provided by competent state agencies of cinematography of the Ministry of Culture, Sports and Tourism of Vietnam during inspection:

a) The mentioned entities shall amend and update film rating results at the request of competent state agencies of cinematography of the Ministry of Culture, Sports and Tourism of Vietnam;

b) The mentioned entities are considered ineligible for performing film rating when the film rating results or the display of film rating results are inconsistent with the results provided by competent state agencies of cinematography of the Ministry of Culture, Sports and Tourism of Vietnam for more than 5 times in a month regarding Type P, Type T18, Type T16, and Type T13. If the mentioned results are inconsistent for 2 times in 6 months regarding Type C, perform film rating procedures prescribed in Point b Clause 2 Article 21 of the Law on Cinematography;

After 3 months, comply with Clause 2 and Clause 3 of this Article to continue performing film rating.

Article 13. Submission of notifications of the list of films to be disseminated and the results of film rating to the Ministry of Culture, Sports and Tourism of Vietnam before the dissemination of such films in cyberspace

Enterprises, public service providers, and organizations that disseminate films in cyberspace shall submit notifications of the list of films to be disseminated and film rating results via the System of Data on Film Rating in Cyberspace of competent state agencies of cinematography of the Ministry of Culture, Sports and Tourism of Vietnam before disseminating such films in cyberspace.

Article 14. Performance of necessary technical measures of enterprises, public service providers, and organizations that disseminate films in cyberspace

a) Develop multi-user account mechanisms, including accounts exclusive for children: accounts must have protection passwords, verification mechanisms when switching accounts, and mechanisms for providing reports for account owners on viewing history and behaviors of children's accounts;

b) Display a notification verifying the age of access when accessing films labeled not for children;

c) Other measures with similar nature.

2. Enterprises, public service providers, and organizations that disseminate films in cyberspace shall establish necessary technical measures, display reports on inappropriate contents in content display screens, or label contents that are inappropriate with the age of the user for service users to provide complaints, feedback, and reports on violating films in the following cases: 

a) There are contents or acts that violate Article 9 of the Law on Cinematography;

b) Technical measures prescribed in Clause 1 of this Article violate regulations of relevant laws;

c) Other illegal acts related to the dissemination of films on the internet of enterprises, public service providers, and organizations engaged in film dissemination in cyberspace.

3. When performing necessary technical measures, enterprises, public service providers, and organizations that disseminate films in cyberspace shall:

a) Disclose the instruction on how to use the established technical measures prescribed in Clause 1 and Clause 2 of this Article on their popular applications or websites that disseminate films;

c) Process complaints, feedback, and reports of service users within 48 hours after receiving them if they have specific and clear bases enclosed with contact information of the service users.

Article 15. Provision of focal points and contact information to receive and handle requests from state management agencies 

1. Enterprises, public service providers, and organizations that disseminate films in cyberspace shall provide the following information for competent state agencies of cinematography of the Ministry of Culture, Sports and Tourism of Vietnam:

a) Names of enterprises, public service providers, and organizations;

b) Focal contacts: names of agencies, organizations, or representatives in Vietnam, email addresses, and phone numbers.

2. Enterprises, public service providers, and organizations that disseminate films in cyberspace shall, after receiving requests, suspend or remove violating films within 24 hours regarding films with prohibited contents according to Article 9 of the Law on Cinematography and other regulations of relevant laws or within 3 to 5 days regarding other violating contents at the request of competent state agencies of cinematography of the Ministry of Culture, Sports and Tourism of Vietnam.

Article 16. Organizations and enterprises with digital communication platforms in removing and preventing violating films shall:

1. Implement necessary technical measures to prevent and remove films violating regulations prescribed in Article 9 of the Law on Cinematography and other regulations of relevant laws.

2. Prevent and remove violating films within 24 hours after receiving requests from competent state agencies of cinematography of the Ministry of Culture, Sports and Tourism of Vietnam.

Article 17. Responsibilities of organizations and enterprises with telecommunications networks

Organizations and enterprises with telecommunications networks shall ensure the implementation of the following obligations:

1. In case of detecting films disseminated in cyberspace have contents that violate the law and affect the national security of Vietnam, competent state agencies of cinematography of the Ministry of Culture, Sports and Tourism of Vietnam may request organizations and enterprises with telecommunications networks to immediately implement measures to prevent access to films that violate the law. The measures may only be removed after all violations have been handled at the request of competent state agencies.

2. Implementation of necessary technical measures to prevent access to films that violate the law at the request of competent state agencies of cinematography of the Ministry of Culture, Sports and Tourism of Vietnam. The time for completion is within 3 hours after receiving requests.

3. Comply with regulations of laws on copyright and relevant laws regarding contents of related films infringing on copyright and relevant rights.

Article 18. Local competent state agencies that receive notifications of public film screenings

1. Provincial People's Committees shall receive notifications from theatres, houses of culture, exhibition places, cultural centers, clubs, stadiums, arenas, and squares.

2. Commune-Level People’s Committees shall receive notifications from accommodation service establishments, catering establishments, disco clubs, shops, stores, and other public locations.

Article 19. Conditions for Vietnamese agencies and organizations to organize film festivals, specialized and thematic film festivals, film awards, film competitions, film programs, and film weeks in Vietnam.

1. Have business registration, functions, or tasks related to cinematographic activities or are assigned or approved to organize the mentioned events by competent authorities.

2. Heads of agencies and organizations shall have at least 5 years of experience in cinematographic activities. If heads of agencies and organizations fail to satisfy this condition, cooperate with agencies and organizations prescribed in Clause 1 of this Article, which have heads that satisfy the requirement for at least 5 years of experience in cinematographic activities.

3. Have the financial capacity to ensure the organization of film festivals, specialized and thematic film festivals, film awards, film competitions, film programs, and film weeks in Vietnam.

4. Have schemes to organize film festivals, specialized and thematic film festivals, film awards, film competitions, film programs, and film weeks in Vietnam enclosed with notifications for the Ministry of Culture, Sports and Tourism of Vietnam as prescribed in Point c Clause 1 Article 38 of the Law on Cinematography.

Article 20. Establishment of Cinematographic Development Support Fund

1. The Cinematographic Development Support Fund shall operate under the model of a one-member limited liability company with 100% of its capital charter owned by the State, and the Ministry of Culture, Sports and Tourism of Vietnam is the owner representative.

2. The Cinematographic Development Support Fund shall be established from the following sources:

a) The capital charter of the Cinematographic Development Support Fund shall be provided by the state budget. The funding shall be performed after the Prime Minister of Vietnam decides to establish or approve the charter of the organization and operation of the Fund;

b) Mobilization of voluntary contributions and sponsorship of domestic and foreign agencies, organizations, individuals, and other legal income sources;

d) Other legal revenue sources as prescribed by law. 

Chapter III

IMPLEMENTATION PROVISIONS

Article 21. Implementation provisions

1. This Decree comes into force as of January 1, 2023.

2. This Decree replaces Decree No. 54/2010/ND-CP dated May 21, 2010 of the Government of Vietnam elaborating on a number of Articles of the Law on Cinematography No. 62/2006/QH11 and the Law on amendments to the Law on Cinematography No. 31/2009/QH12.

3. Annulment of Article 3 of Decree No. 142/2018/ND-CP dated October 9, 2018 of the Government of Vietnam on amendments to several regulations on conditions for business investment within the state management scope of the Ministry of Culture, Sports and Tourism of Vietnam.

4. Annulment of Point b Clause 1 Article 8 and the phrase “bản dịch tóm tắt nội dung phim” (film summary translation) in Point b Clause 2 Article 9 of Decree No. 32/2012/ND-CP dated April 12, 2012 of the Government of Vietnam on the management of import and export of cultural products for non-commercial purposes.

5. Annulment of Decree No. 22/2022/ND-CP dated March 25, 2022 of the Government of Vietnam on amendments to Decree No. 32/2012/ND-CP dated April 12, 2012 of the Government of Vietnam on the management of import and export of cultural products for non-commercial purposes.

Article 22. Implementation responsibilities

Ministers, Directors of ministerial agencies, Directors of governmental agencies, Chairmen of the People’s Committees of provinces, centrally affiliated cities, and relevant agencies, organizations, and individuals shall implement this Decree.
