QUYẾT ĐỊNH

CỦA THỦ TƯỚNG CHÍNH PHỦ SỐ 176/1999/QĐ-TTG NGÀY 26 THÁNG 8 NĂM 1999 VỀ VIỆC MIỄN THUẾ NHẬP KHẨU ĐỐI VỚI NGUYÊN VẬT LIỆU

Căn cứ Luật Tổ chức Chính phủ ngày 30 tháng 9 năm 1992;
Căn cứ Nghị định số 10/1998/NĐ-CP ngày 23 tháng 01 năm 1998 của Chính phủ;
Căn cứ Quyết định số 29/1998/QĐ-TTg ngày 09 tháng 02 năm 1998 của Thủ tướng Chính phủ;
Căn cứ Quyết định số 53/1999/QĐ-TTg ngày 26 tháng 3 năm 1999 của Thủ tướng Chính phủ;
Theo đề nghị của Bộ trưởng Bộ Tài chính tại công số 3529/TC-TCT ngày 19 tháng 7 năm 1999,

QUYẾT ĐỊNH:

Điều 1. Các dự án đầu tư thuộc danh mục dự án khuyến khích đầu tư và dự án đầu tư vào vùng núi, vùng sâu, vùng xa được miễn thuế nhập khẩu nguyên vật liệu, bán thành phẩm trong nước chưa sản xuất được hoặc sản xuất không đạt tiêu chuẩn chất lượng.

Thời hạn miễn thuế là 5 năm kể từ khi bắt đầu sản xuất và được áp dụng cho doanh nghiệp có vốn đầu tư nước ngoài và doanh nghiệp Việt Nam.

Điều 2. Nguyên vật liệu được miễn thuế quy định tại Điều 1 phải sử dụng vào sản xuất; nếu sử dụng vào mục đích khác phải truy thu số thuế được miễn.

Điều 3. Bộ Kế hoạch và Đầu tư chủ trì phối hợp với các Bộ liên quan ban hành và công bố danh mục nguyên vật liệu trong nước đã sản xuất được.

Điều 4. Quyết định này có hiệu lực sau 15 ngày kể từ ngày ký.

Điều 5. Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ và Chủ tịch Uỷ ban nhân dân tỉnh, thành phố trực thuộc Trung ương chịu trách nhiệm thi hành Quyết định này.

DECISION

ON TAX EXEMPTION FOR IMPORTED RAW MATERIALS AND MATERIALS

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government of September 30, 1992;
Pursuant to Decree No. 10/1998/ND-CP of January 23, 1998 of the Government;
Pursuant to Decision No. 29/1998/QD-TTg of February 9, 1998 of the Prime Minister;
Pursuant to Decision No. 53/1999/QD-TTg of March 26, 1999 of the Prime Minister;
At the proposal of the Minister of Finance in Official Dispatch No. 3529/TC-TCT of July 19, 1999,

DECIDES:

Article 1.- The investment projects on the list of projects where investment is encouraged and the investment projects in mountainous, remote and deep-lying areas are entitled to import tax exemption for raw materials, materials and semi-finished products which cannot be produced at home or have been produced but failed to meet the quality criteria.

The tax exemption period shall be five (5) years from the commencement of production and apply to both foreign-invested and Vietnamese enterprises.

Article 2.- The raw materials and materials eligible for import tax exemption as prescribed in Article 1 must be used for production; if they are used for other purposes, the exempt tax amount shall be retrospectively collected.

Article 4.- This Decision takes effect 15 days after its signing.

Article 5.- The ministries, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government and the presidents of the People’s Committees of the provinces and centrally-run cities shall have to implement this Decision.
