QUYẾT ĐỊNH

BAN HÀNH KHUNG GIÁ PHÁT ĐIỆN NHÀ MÁY ĐIỆN MẶT TRỜI, ĐIỆN GIÓ CHUYỂN TIẾP

Căn cứ Luật Điện lực ngày 03 tháng 12 năm 2004 và Luật sửa đổi, bổ sung một số điều của Luật Điện lực ngày 20 tháng 11 năm 2012;

Căn cứ Nghị định số 96/2022/NĐ-CP ngày 29 tháng 11 năm 2022 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Công Thương;

Căn cứ Nghị định số 137/2013/NĐ-CP ngày 21 tháng 10 năm 2013 của Chính phủ quy định chi tiết thi hành một số điều của Luật Điện lực và Luật sửa đổi, bổ sung một số điều của Luật Điện lực;

Căn cứ Thông tư số 15/2022/TT-BCT ngày 03 tháng 10 năm 2022 của Bộ trưởng Bộ Công Thương quy định phương pháp xây dựng khung giá phát điện nhà máy điện mặt trời, điện gió chuyển tiếp;

Theo đề nghị của Cục trưởng Cục Điều tiết điện lực.

QUYẾT ĐỊNH:

Điều 1. Ban hành khung giá phát điện nhà máy điện mặt trời, điện gió chuyển tiếp quy định tại điểm b khoản 2 Điều 1 Thông tư số 15/2022/TT-BCT ngày 03 tháng 10 năm 2022 của Bộ trưởng Bộ Công Thương quy định phương pháp xây dựng khung giá phát điện nhà máy điện mặt trời, điện gió chuyển tiếp.

Điều 2. Căn cứ khung giá phát điện quy định tại Điều 1 Quyết định này, Tập đoàn Điện lực Việt Nam và đơn vị phát điện mặt trời, điện gió chuyển tiếp quy định tại điểm b khoản 2 Điều 1 Thông tư số 15/2022/TT-BCT để thoả thuận giá phát điện theo quy định.

Điều 3. Điều khoản thi hành

1. Quyết định này có hiệu lực thi hành kể từ ngày ký.

2. Chánh Văn phòng Bộ, Cục trưởng Cục Điều tiết điện lực, Cục trưởng Cục Điện lực và Năng lượng tái tạo, Chánh Thanh tra Bộ, Tổng Giám đốc Tập đoàn Điện lực Việt Nam và Giám đốc các đơn vị nhà máy điện mặt trời, điện gió quy định tại Điều 1 chịu trách nhiệm thi hành Quyết định này./.

DECISION

PROMULGATION OF THE TRANSITIONAL FRAMEWORK FOR ELECTRICITY PRICES OF SOLAR POWER PLANTS WIND POWER PLANTS

THE MINISTER OF INDUSTRY AND TRADE

Pursuant to the Law on Electricity dated December 3, 2004 and the Law on Amendment to certain Articles of the Law on Electricity dated November 20, 2012;

Pursuant to the Government's Decree No. 96/2022/NĐ-CP dated November 29, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 137/2013/NĐ-CP dated October 21, 2013 elaborating on the implementation of certain articles of the Law on Electricity and the Law on Amendments to certain Articles of the Law on Electricity;

Pursuant to Circular No. 15/2022/TT-BCT dated October 03, 2022 of the Minister of Industry and Trade on method for determination of framework for electricity prices of transitional solar power plants wind power plants;

At the request of the Director of the Electricity Regulatory Authority.

Article 1. Promulgation of the transitional framework for electricity prices of transitional solar power plants wind power plants mentioned in Point b Clause 2 Article 1 of Circular No. 15/2022/TT-BCT dated October 03, 2022 of the Minister of Industry and Trade on method for determination of framework for electricity prices of transitional solar power plants wind power plants.

Article 2. On the basis of the pricing framework mentioned in Article 1 of this Decision, Vietnam Electricity (EVN) shall negotiate electricity prices with transitional solar power plants and wind power plants mentioned in Point b Clause 2 Article 1 of Circular No. 15/2022/TT-BCT as per regulations.

Article 3. Implementation clauses

1. This Decision comes into force from the day on which it is signed.

2. the Chief of the Ministry Office, Director of Electricity Regulatory Authority, Director of Electricity and Renewable Energy Authority, the Ministerial Chief Inspector, General Director of EVN, Directors of solar power plants and wind power plants mentioned in Article 1 shall be responsible for the implementation of this Decision./.
