VỀ NGƯNG HIỆU LỰC MỘT PHẦN ĐỐI VỚI QUYẾT ĐỊNH SỐ 23/2018/QĐ-UBND NGÀY 19 THÁNG 7 NĂM 2018 CỦA ỦY BAN NHÂN DÂN THÀNH PHỐ BAN HÀNH QUY ĐỊNH VỀ HẠN CHẾ VÀ CẤP PHÉP Ô TÔ CHỞ HÀNG, Ô TÔ TẢI LƯU THÔNG TRONG KHU VỰC NỘI ĐÔ THÀNH PHỐ HỒ CHÍ MINH

Căn cứ Luật Tổ chức chính quyền địa phương ngày 19 tháng 6 năm 2015;

Căn cứ Luật Ban hành văn bản quy phạm pháp luật ngày 22 tháng 6 năm 2015;

Căn cứ Nghị định số 34/2016/NĐ-CP ngày 14 tháng 5 năm 2016 của Chính phủ quy định chi tiết một số điều và biện pháp thi hành Luật ban hành văn bản quy phạm pháp luật;

Xét đề nghị của Liên Sở Tư pháp - Sở Giao thông vận tải tại Tờ trình số 11960/TTr-STP-SGTVT ngày 16 tháng 11 năm 2018 về ngưng hiệu lực một phần đối với Quyết định số 23/2018/QĐ-UBND ngày 19 tháng 7 năm 2018 của Ủy ban nhân dân thành phố ban hành quy định về hạn chế và cấp phép ô tô chở hàng, ô tô tải lưu thông trong khu vực nội đô thành phố Hồ Chí Minh,

QUYẾT ĐỊNH:

Điều 1. Ngưng hiệu lực thi hành các Điều 6, Điều 7, Điều 8, Điều 9 và Điều 11 của Quy định ban hành kèm theo Quyết định số 23/2018/QĐ-UBND ngày 19 tháng 7 năm 2018 của Ủy ban nhân dân thành phố ban hành quy định về hạn chế và cấp phép ô tô chở hàng, ô tô tải lưu thông trong khu vực nội đô thành phố Hồ Chí Minh.

Điều 2. Thời điểm ngưng hiệu lực kể từ ngày Quyết định này có hiệu lực thi hành cho đến khi nội dung tại các Điều 6, Điều 7, Điều 8, Điều 9 và Điều 11 của Quy định ban hành kèm theo Quyết định số 23/2018/QĐ-UBND ngày 19 tháng 7 năm 2018 của Ủy ban nhân dân thành phố về hạn chế và cấp phép ô tô chở hàng, ô tô tải lưu thông trong khu vực nội đô thành phố Hồ Chí Minh được sửa đổi, bổ sung hoặc bãi bỏ.

Điều 3. Giao Sở Giao thông vận tải chủ trì, phối hợp với Sở Tư pháp, Văn phòng Ủy ban nhân dân thành phố (Phòng Kiểm soát thủ tục hành chính) khẩn trương nghiên cứu, tham mưu trình Ủy ban nhân dân thành phố xem xét sửa đổi, bổ sung hoặc bãi bỏ một số nội dung của Quy định ban hành kèm theo Quyết định số 23/2018/QĐ-UBND đảm bảo phù hợp theo quy định pháp luật; thời gian thực hiện trước ngày 14 tháng 12 năm 2018.

Điều 4. Quyết định này có hiệu lực thi hành kể từ ngày ký.

Điều 5. Chánh Văn phòng Ủy ban nhân dân thành phố, Giám đốc Sở Tư pháp, Giám đốc Sở Giao thông vận tải, Chủ tịch Ủy ban nhân dân 24 quận - huyện, các tổ chức, cá nhân liên quan có trách nhiệm thi hành Quyết định này./.

DECISION

ON PARTIAL SUSPENSION OF THE DECISION NO.23/2018/QD-UBND DATED JULY 19, 2018 OF THE PEOPLE’S COMMITTEE OF HO CHI MINH CITY ON RESTRICTION OF CARGO VEHICLES AND TRUCKS AND GRANT OF LICENSES FOR OPERATION THEREOF IN URBAN AREAS OF THE CITY

Pursuant to the Law on Organization of the Local Government dated June 19, 2015;

Pursuant to the Law on Promulgation of Legislative Documents dated June 22, 2015;

Pursuant to the Government’s Decree No. 34/2016/ND-CP dated May 14, 2016 on detailing certain articles of and providing measures for implementing the Law on Promulgation of Legislative Documents;

At the request of the Department of Justice and Department of Transport in the statement No. 11960/TTr-STP-SGTVT dated November 16, 2018 on partial suspension of the Decision No. 23/2018/QD-UBND dated July 19, 2018 of the People’s Committee of Ho Chi Minh City on restriction of cargo vehicles and trucks and grant of licenses for operation thereof in urban areas of the City.

Article 2. The suspension begins from the effective date of this Decision and ends when Articles 6, 7, 8, 9 and 11 of the Regulation enclosed with the Decision No. 23/2018/QD-UBND dated July 19, 2018 are amended or annulled.

Article 3. Department of Transport shall take charge, cooperate with the Department of Justice and People’s Committee Secretariat of the City (Administrative Procedures Control Agency) and submit a report to the People's Committee of the City in order for this Committee to consider amending and annulling certain contents of the Regulation enclosed with the Decision No. 23/2018/QD-UBND as regulated; such amendment or annulment shall be carried out before December 14, 2018.

Article 4. This Decision shall come into effect from the date on which it is signed.

Article 5. Chief of the People's Committee Secretariat, Director of the Department of Justice, Director of the Department of Transport, Chairpersons of the People’s Committees of 24 districts and other related organizations and individuals shall implement this Decision./.
