CẢNH SÁT BIỂN VIỆT NAM

Căn cứ Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam;

Quốc hội ban hành Luật Cảnh sát biển Việt Nam.

Chương I

NHỮNG QUY ĐỊNH CHUNG

Điều 1. Phạm vi điều chỉnh

Luật này quy định về vị trí, chức năng, nhiệm vụ, quyền hạn, tổ chức và hoạt động của Cảnh sát biển Việt Nam; chế độ, chính sách đối với Cảnh sát biển Việt Nam; trách nhiệm của cơ quan, tổ chức, cá nhân có liên quan.

Điều 2. Giải thích từ ngữ

Trong Luật này, các từ ngữ dưới đây được hiểu như sau:

1. Bảo vệ chủ quyền, quyền chủ quyền, quyền tài phán quốc gia trong vùng biển Việt Nam là hoạt động phòng ngừa, phát hiện, đấu tranh và xử lý cơ quan, tổ chức, cá nhân vi phạm quy định của pháp luật về chủ quyền, quyền chủ quyền, quyền tài phán quốc gia trong vùng biển của nước Cộng hòa xã hội chủ nghĩa Việt Nam.

2. Cán bộ, chiến sĩ Cảnh sát biển Việt Nam bao gồm sĩ quan, quân nhân chuyên nghiệp, hạ sĩ quan, binh sĩ, công nhân và viên chức thuộc biên chế Cảnh sát biển Việt Nam.

Điều 3. Vị trí, chức năng của Cảnh sát biển Việt Nam

1. Cảnh sát biển Việt Nam là lực lượng vũ trang nhân dân, lực lượng chuyên trách của Nhà nước, làm nòng cốt thực thi pháp luật và bảo vệ an ninh quốc gia, trật tự, an toàn trên biển.

2. Cảnh sát biển Việt Nam có chức năng tham mưu cho Bộ trưởng Bộ Quốc phòng ban hành theo thẩm quyền hoặc đề xuất với Đảng, Nhà nước về chính sách, pháp luật bảo vệ an ninh quốc gia, trật tự, an toàn trên biển; bảo vệ chủ quyền, quyền chủ quyền, quyền tài phán quốc gia trong vùng biển Việt Nam; quản lý về an ninh, trật tự, an toàn và bảo đảm việc chấp hành pháp luật Việt Nam, điều ước quốc tế mà nước Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên, thỏa thuận quốc tế theo thẩm quyền.

Điều 4. Nguyên tắc tổ chức và hoạt động của Cảnh sát biển Việt Nam

1. Đặt dưới sự lãnh đạo tuyệt đối, trực tiếp về mọi mặt của Đảng Cộng sản Việt Nam, sự thống lĩnh của Chủ tịch nước, sự thống nhất quản lý nhà nước của Chính phủ và sự chỉ đạo, chỉ huy trực tiếp của Bộ trưởng Bộ Quốc phòng.

2. Tuân thủ Hiến pháp và pháp luật Việt Nam, điều ước quốc tế mà nước Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên.

3. Tổ chức tập trung, thống nhất theo phân cấp từ Bộ Tư lệnh Cảnh sát biển Việt Nam đến đơn vị cấp cơ sở.

4. Chủ động phòng ngừa, phát hiện, ngăn chặn, đấu tranh và xử lý hành vi vi phạm pháp luật.

5. Kết hợp nhiệm vụ bảo vệ chủ quyền, quyền chủ quyền, quyền tài phán quốc gia, quản lý an ninh, trật tự, an toàn trên biển với phát triển kinh tế biển.

6. Dựa vào Nhân dân, phát huy sức mạnh của Nhân dân và chịu sự giám sát của Nhân dân.

Điều 5. Xây dựng Cảnh sát biển Việt Nam

1. Nhà nước xây dựng Cảnh sát biển Việt Nam cách mạng, chính quy, tinh nhuệ, hiện đại; ưu tiên nguồn lực phát triển Cảnh sát biển Việt Nam.

2. Cơ quan, tổ chức, công dân Việt Nam có trách nhiệm tham gia xây dựng Cảnh sát biển Việt Nam trong sạch, vững mạnh.

Điều 6. Trách nhiệm và chế độ, chính sách đối với cơ quan, tổ chức, cá nhân tham gia, phối hợp, cộng tác, hỗ trợ, giúp đỡ Cảnh sát biển Việt Nam

1. Cơ quan, tổ chức, cá nhân khi hoạt động trong vùng biển Việt Nam có trách nhiệm tham gia, phối hợp, cộng tác, hỗ trợ, giúp đỡ Cảnh sát biển Việt Nam thực hiện chức năng, nhiệm vụ, quyền hạn.

2. Cơ quan, tổ chức, công dân Việt Nam có trách nhiệm phối hợp với Cảnh sát biển Việt Nam thực hiện quyết định huy động nhân lực, tàu thuyền và phương tiện, thiết bị kỹ thuật dân sự của cơ quan có thẩm quyền để bảo vệ chủ quyền, quyền chủ quyền, quyền tài phán quốc gia trong vùng biển Việt Nam.

3. Cơ quan, tổ chức, cá nhân tham gia, phối hợp, cộng tác, hỗ trợ, giúp đỡ Cảnh sát biển Việt Nam được Nhà nước bảo vệ và giữ bí mật khi có yêu cầu; có thành tích thì được khen thưởng; bị thiệt hại về tài sản thì được đền bù; bị tổn hại về danh dự, nhân phẩm thì được khôi phục; người bị thương tích, tổn hại về sức khoẻ, tính mạng thì bản thân hoặc gia đình được hưởng chế độ, chính sách theo quy định của pháp luật.

Điều 7. Các hành vi bị nghiêm cấm

1. Chống đối, cản trở hoạt động của Cảnh sát biển Việt Nam; trả thù, đe dọa, xâm phạm tính mạng, sức khỏe, danh dự, nhân phẩm của cán bộ, chiến sĩ Cảnh sát biển Việt Nam trong thi hành công vụ hoặc vì lý do công vụ.

2. Mua chuộc, hối lộ hoặc ép buộc cán bộ, chiến sĩ Cảnh sát biển Việt Nam làm trái chức trách, nhiệm vụ, quyền hạn.

3. Giả danh cán bộ, chiến sĩ Cảnh sát biển Việt Nam; giả mạo tàu thuyền, phương tiện của Cảnh sát biển Việt Nam; làm giả, mua bán, sử dụng trái phép trang phục, con dấu, giấy tờ của Cảnh sát biển Việt Nam.

4. Lợi dụng, lạm dụng chức vụ, quyền hạn, vị trí công tác của cán bộ, chiến sĩ Cảnh sát biển Việt Nam để vi phạm pháp luật; xâm phạm quyền và lợi ích hợp pháp của cơ quan, tổ chức, cá nhân.

5. Cán bộ, chiến sĩ Cảnh sát biển Việt Nam nhũng nhiễu, gây khó khăn đối với cơ quan, tổ chức, cá nhân hoạt động hợp pháp trên biển.

6. Hành vi khác vi phạm quy định của Luật này.

Chương II

NHIỆM VỤ, QUYỀN HẠN CỦA CẢNH SÁT BIỂN VIỆT NAM

Điều 8. Nhiệm vụ của Cảnh sát biển Việt Nam

1. Thu thập thông tin, phân tích, đánh giá, dự báo tình hình để đề xuất chủ trương, giải pháp, phương án bảo vệ an ninh quốc gia và thực thi pháp luật trên biển; nghiên cứu, phân tích, dự báo, tham mưu với cấp có thẩm quyền ban hành chính sách, pháp luật về bảo vệ chủ quyền, quyền chủ quyền, quyền tài phán quốc gia, an ninh quốc gia trong vùng biển Việt Nam, bảo đảm trật tự, an toàn và đấu tranh phòng, chống tội phạm, vi phạm pháp luật trên biển.

2. Bảo vệ chủ quyền, quyền chủ quyền, quyền tài phán quốc gia, an ninh, lợi ích quốc gia, dân tộc; bảo vệ tài nguyên, môi trường biển; bảo vệ tài sản, quyền và lợi ích hợp pháp của cơ quan, tổ chức, cá nhân trên biển.

3. Đấu tranh phòng, chống tội phạm, vi phạm pháp luật, giữ gìn an ninh, trật tự, an toàn trên biển; tìm kiếm, cứu hộ, cứu nạn và tham gia khắc phục sự cố môi trường biển.

4. Tham gia xây dựng thế trận quốc phòng, an ninh và xử lý các tình huống quốc phòng, an ninh trên biển.

5. Thực hiện tuyên truyền, phổ biến, giáo dục pháp luật.

6. Tiếp nhận, sử dụng nhân lực, tàu thuyền và phương tiện, thiết bị kỹ thuật dân sự được huy động tham gia bảo vệ chủ quyền, quyền chủ quyền, quyền tài phán quốc gia trong vùng biển Việt Nam.

7. Thực hiện hợp tác quốc tế trên cơ sở điều ước quốc tế mà nước Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên và thỏa thuận quốc tế có liên quan đến chức năng, nhiệm vụ, quyền hạn của Cảnh sát biển Việt Nam.

Điều 9. Quyền hạn của Cảnh sát biển Việt Nam

1. Tuần tra, kiểm tra, kiểm soát người, tàu thuyền, hàng hóa, hành lý trong vùng biển Việt Nam theo quy định của Luật này và quy định khác của pháp luật có liên quan.

2. Sử dụng vũ khí, vật liệu nổ và công cụ hỗ trợ theo quy định tại Điều 14 của Luật này.

3. Sử dụng phương tiện, thiết bị kỹ thuật nghiệp vụ theo quy định tại Điều 15 của Luật này và quy định khác của pháp luật có liên quan.

4. Xử lý vi phạm hành chính theo quy định của pháp luật về xử lý vi phạm hành chính.

5. Tiến hành một số hoạt động điều tra hình sự theo quy định của pháp luật về tổ chức cơ quan điều tra hình sự, pháp luật về tố tụng hình sự.

6. Truy đuổi tàu thuyền vi phạm pháp luật trên biển.

7. Huy động người, tàu thuyền và phương tiện, thiết bị kỹ thuật dân sự của cơ quan, tổ chức, công dân Việt Nam trong trường hợp khẩn cấp.

8. Đề nghị tổ chức, cá nhân nước ngoài hoạt động trong vùng biển Việt Nam hỗ trợ, giúp đỡ trong trường hợp khẩn cấp.

9. Bắt giữ tàu biển theo quy định của pháp luật.

10. Áp dụng biện pháp công tác theo quy định tại Điều 12 của Luật này.

Điều 10. Nghĩa vụ và trách nhiệm của cán bộ, chiến sĩ Cảnh sát biển Việt Nam

1. Tuyệt đối trung thành với Tổ quốc, Nhân dân, với Đảng và Nhà nước; nghiêm chỉnh chấp hành chủ trương, đường lối của Đảng, chính sách, pháp luật của Nhà nước, chỉ thị, mệnh lệnh của cấp trên.

2. Kiên quyết bảo vệ chủ quyền, quyền chủ quyền, quyền tài phán quốc gia trong vùng biển Việt Nam; đấu tranh phòng, chống tội phạm, vi phạm pháp luật, bảo đảm an ninh, trật tự, an toàn xã hội, giữ gìn vùng biển Việt Nam hòa bình, ổn định và phát triển.

3. Cảnh giác, giữ bí mật nhà nước, bí mật công tác; thực hiện nghiêm biện pháp công tác của Cảnh sát biển Việt Nam.

4. Tuân thủ điều ước quốc tế mà nước Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên và thỏa thuận quốc tế có liên quan đến chức năng, nhiệm vụ, quyền hạn của Cảnh sát biển Việt Nam.

5. Thường xuyên học tập nâng cao bản lĩnh chính trị, kiến thức pháp luật, trình độ chuyên môn, nghiệp vụ, ý thức tổ chức kỷ luật và rèn luyện thể lực.

6. Chịu trách nhiệm trước pháp luật và cấp trên về quyết định, hành vi của mình khi thực hiện nhiệm vụ.

Chương III

HOẠT ĐỘNG CỦA CẢNH SÁT BIỂN VIỆT NAM

MỤC 1. PHẠM VI HOẠT ĐỘNG VÀ BIỆN PHÁP CÔNG TÁC CỦA CẢNH SÁT BIỂN VIỆT NAM

Điều 11. Phạm vi hoạt động của Cảnh sát biển Việt Nam

1. Cảnh sát biển Việt Nam hoạt động trong vùng biển Việt Nam để thực hiện chức năng, nhiệm vụ, quyền hạn theo quy định của Luật này.

2. Trong trường hợp vì mục đích nhân đạo, hòa bình, đấu tranh phòng, chống tội phạm, vi phạm pháp luật, Cảnh sát biển Việt Nam được hoạt động ngoài vùng biển Việt Nam; khi hoạt động phải tuân thủ pháp luật Việt Nam, điều ước quốc tế mà nước Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên, thoả thuận quốc tế có liên quan đến chức năng, nhiệm vụ, quyền hạn của Cảnh sát biển Việt Nam.

Điều 12. Biện pháp công tác của Cảnh sát biển Việt Nam

1. Cảnh sát biển Việt Nam thực hiện các biện pháp vận động quần chúng, pháp luật, ngoại giao, kinh tế, khoa học - kỹ thuật, nghiệp vụ, vũ trang để bảo vệ an ninh quốc gia, bảo đảm trật tự, an toàn trên biển theo quy định của pháp luật.

2. Tư lệnh Cảnh sát biển Việt Nam quyết định việc sử dụng các biện pháp công tác theo quy định tại khoản 1 Điều này, chịu trách nhiệm trước pháp luật và cấp trên về quyết định của mình.

MỤC 2. THỰC THI PHÁP LUẬT TRÊN BIỂN CỦA CẢNH SÁT BIỂN VIỆT NAM

Điều 13. Tuần tra, kiểm tra, kiểm soát

1. Cảnh sát biển Việt Nam tuần tra, kiểm tra, kiểm soát người, tàu thuyền, hàng hóa, hành lý nhằm phát hiện, ngăn chặn, xử lý hành vi vi phạm pháp luật trên biển.

2. Các trường hợp dừng tàu thuyền để kiểm tra, kiểm soát bao gồm:

a) Trực tiếp phát hiện hành vi vi phạm pháp luật hoặc dấu hiệu vi phạm pháp luật;

b) Thông qua phương tiện, thiết bị kỹ thuật nghiệp vụ phát hiện, ghi nhận được hành vi vi phạm pháp luật hoặc dấu hiệu vi phạm pháp luật;

c) Có tố cáo, tố giác, tin báo về tội phạm, hành vi vi phạm pháp luật;

d) Có văn bản đề nghị của cơ quan có thẩm quyền về truy đuổi, bắt giữ người, tàu thuyền và phương tiện vi phạm pháp luật;

đ) Người vi phạm tự giác khai báo về hành vi vi phạm pháp luật.

3. Khi tuần tra, kiểm tra, kiểm soát, Cảnh sát biển Việt Nam phải thể hiện màu sắc của tàu thuyền, máy bay và phương tiện khác; cờ hiệu, phù hiệu, dấu hiệu nhận biết và trang phục theo quy định tại Điều 29 và Điều 31 của Luật này.

4. Cơ quan, tổ chức, cá nhân hoạt động trong vùng biển Việt Nam có trách nhiệm chấp hành sự kiểm tra, kiểm soát của Cảnh sát biển Việt Nam.

5. Bộ trưởng Bộ Quốc phòng quy định quy trình tuần tra, kiểm tra, kiểm soát của Cảnh sát biển Việt Nam.

Điều 14. Sử dụng vũ khí, vật liệu nổ và công cụ hỗ trợ

1. Khi thi hành nhiệm vụ, cán bộ, chiến sĩ Cảnh sát biển Việt Nam sử dụng vũ khí quân dụng, vật liệu nổ, công cụ hỗ trợ và được nổ súng quân dụng theo quy định của Luật Quản lý, sử dụng vũ khí, vật liệu nổ và công cụ hỗ trợ.

2. Ngoài các trường hợp nổ súng quân dụng theo quy định của Luật Quản lý, sử dụng vũ khí, vật liệu nổ và công cụ hỗ trợ, khi thi hành nhiệm vụ đấu tranh phòng, chống tội phạm, vi phạm pháp luật, bảo đảm an ninh, trật tự, an toàn, cán bộ, chiến sĩ Cảnh sát biển Việt Nam được nổ súng vào tàu thuyền trên biển, trừ tàu thuyền của cơ quan đại diện ngoại giao, cơ quan lãnh sự nước ngoài, cơ quan đại diện tổ chức quốc tế, tàu thuyền có chở người hoặc có con tin, để dừng tàu thuyền, thuộc một trong các trường hợp sau đây:

a) Đối tượng điều khiển tàu thuyền đó tấn công hoặc đe dọa trực tiếp đến tính mạng người thi hành công vụ hoặc người khác;

b) Khi biết rõ tàu thuyền do đối tượng phạm tội điều khiển cố tình chạy trốn;

c) Khi biết rõ tàu thuyền chở đối tượng phạm tội hoặc chở vũ khí, vật liệu nổ trái phép, tài liệu phản động, bí mật nhà nước, ma tuý, bảo vật quốc gia cố tình chạy trốn;

d) Khi tàu thuyền có đối tượng đã thực hiện hành vi cướp biển, cướp có vũ trang theo quy định của điều ước quốc tế mà nước Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên, quy định của pháp luật về hình sự cố tình chạy trốn.

3. Trường hợp nổ súng theo quy định tại khoản 2 Điều này, cán bộ, chiến sĩ Cảnh sát biển Việt Nam phải cảnh báo bằng hành động, mệnh lệnh, lời nói hoặc bắn chỉ thiên trước khi nổ súng vào tàu thuyền; phải tuân theo mệnh lệnh của người có thẩm quyền khi thực hiện nhiệm vụ có tổ chức.

Điều 15. Sử dụng phương tiện, thiết bị kỹ thuật nghiệp vụ

1. Cảnh sát biển Việt Nam sử dụng phương tiện, thiết bị kỹ thuật nghiệp vụ và kết quả thu thập được để phân tích, đánh giá, dự báo tình hình trong bảo vệ chủ quyền, quyền chủ quyền, quyền tài phán quốc gia, bảo vệ an ninh, lợi ích quốc gia, dân tộc trên biển; phát hiện, bắt giữ, điều tra, xử lý tội phạm, vi phạm pháp luật theo quy định của pháp luật về bảo vệ an ninh quốc gia, pháp luật về xử lý vi phạm hành chính, pháp luật về tố tụng hình sự.

2. Phương tiện, thiết bị kỹ thuật nghiệp vụ của Cảnh sát biển Việt Nam trước khi đưa vào sử dụng phải được kiểm định, hiệu chuẩn, thử nghiệm và thực hiện đúng quy trình, bảo đảm an toàn theo quy định của pháp luật.

3. Chính phủ quy định việc quản lý, sử dụng và danh mục các phương tiện, thiết bị kỹ thuật nghiệp vụ của Cảnh sát biển Việt Nam.

Điều 16. Huy động người, tàu thuyền và phương tiện, thiết bị kỹ thuật dân sự

1. Trong trường hợp khẩn cấp để bắt giữ người, tàu thuyền và phương tiện vi phạm pháp luật; tìm kiếm cứu nạn; ứng phó, khắc phục sự cố môi trường biển nghiêm trọng, cán bộ, chiến sĩ Cảnh sát biển Việt Nam được huy động người, tàu thuyền và phương tiện, thiết bị kỹ thuật dân sự của cơ quan, tổ chức, công dân Việt Nam.

2. Việc huy động theo quy định tại khoản 1 Điều này phải phù hợp với khả năng thực tế của người, tàu thuyền và phương tiện, thiết bị kỹ thuật dân sự được huy động và phải hoàn trả ngay khi tình thế khẩn cấp chấm dứt.

Trường hợp người, tài sản được huy động làm nhiệm vụ mà bị thiệt hại thì được hưởng chế độ, chính sách, đền bù theo quy định tại khoản 3 Điều 6 của Luật này; đơn vị có cán bộ, chiến sĩ huy động có trách nhiệm giải quyết việc đền bù theo quy định của pháp luật.

3. Cơ quan, tổ chức, công dân Việt Nam có trách nhiệm thực hiện việc huy động của Cảnh sát biển Việt Nam.

4. Trong trường hợp khẩn cấp để bắt giữ người, tàu thuyền và phương tiện vi phạm pháp luật; tìm kiếm cứu nạn; ứng phó, khắc phục sự cố môi trường biển nghiêm trọng, cán bộ, chiến sĩ Cảnh sát biển Việt Nam đề nghị hỗ trợ, giúp đỡ của tổ chức, cá nhân nước ngoài đang hoạt động trong vùng biển Việt Nam.

Điều 17. Thực hiện quyền truy đuổi tàu thuyền trên biển

1. Cảnh sát biển Việt Nam thực hiện quyền truy đuổi tàu thuyền trên biển trong các trường hợp sau đây:

a) Vi phạm chủ quyền, quyền chủ quyền, quyền tài phán quốc gia;

b) Không chấp hành tín hiệu, hiệu lệnh dừng tàu thuyền của Cảnh sát biển Việt Nam trong trường hợp quy định tại khoản 2 Điều 13 của Luật này;

c) Thực hiện hợp tác quốc tế trong hoạt động truy đuổi;

d) Trường hợp khác theo quy định của pháp luật.

2. Phạm vi, thẩm quyền và trình tự truy đuổi tàu thuyền trên biển của Cảnh sát biển Việt Nam thực hiện theo quy định của pháp luật Việt Nam và điều ước quốc tế mà nước Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên.

Điều 18. Công bố, thông báo, thay đổi cấp độ an ninh hàng hải

Bộ Tư lệnh Cảnh sát biển Việt Nam công bố cấp độ hoặc thay đổi cấp độ an ninh hàng hải và thực hiện việc thông báo cho cơ quan có thẩm quyền; tiếp nhận, xử lý thông tin an ninh hàng hải; thông báo các biện pháp an ninh hàng hải phù hợp cần áp dụng đối với tàu thuyền hoạt động trong vùng biển Việt Nam.

MỤC 3. HỢP TÁC QUỐC TẾ CỦA CẢNH SÁT BIỂN VIỆT NAM

Điều 19. Nguyên tắc hợp tác quốc tế

1. Thực hiện hợp tác quốc tế trên cơ sở tuân thủ pháp luật Việt Nam, điều ước quốc tế mà nước Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên và thỏa thuận quốc tế theo thẩm quyền; tôn trọng các nguyên tắc cơ bản của pháp luật quốc tế; bảo đảm độc lập, chủ quyền, quyền chủ quyền, quyền tài phán quốc gia; bảo vệ lợi ích quốc gia, dân tộc, quyền và lợi ích hợp pháp của cơ quan, tổ chức, cá nhân trên biển.

2. Phát huy sức mạnh nội lực và sự ủng hộ, giúp đỡ của cộng đồng quốc tế, bảo đảm thực thi pháp luật trên biển.

Điều 20. Nội dung hợp tác quốc tế

1. Phòng, chống cướp biển, cướp có vũ trang chống lại tàu thuyền.

2. Phòng, chống tội phạm ma túy, mua bán người, mua bán vũ khí trái phép, khủng bố, hoạt động xuất cảnh, nhập cảnh bất hợp pháp, buôn bán, vận chuyển hàng hóa trái phép qua biên giới, khai thác hải sản bất hợp pháp và tội phạm, vi phạm pháp luật khác trên biển trong phạm vi nhiệm vụ, quyền hạn của Cảnh sát biển Việt Nam.

3. Phòng, chống ô nhiễm và phòng ngừa, ứng phó, khắc phục sự cố môi trường biển; kiểm soát bảo tồn các nguồn tài nguyên biển; bảo vệ đa dạng sinh học và hệ sinh thái biển; phòng, chống, cảnh báo thiên tai; hỗ trợ nhân đạo, ứng phó thảm họa; tìm kiếm, cứu hộ, cứu nạn trên biển trong phạm vi nhiệm vụ, quyền hạn của Cảnh sát biển Việt Nam.

4. Đào tạo, bồi dưỡng, tập huấn nghiệp vụ, trao đổi kinh nghiệm, chuyển giao trang bị, khoa học và công nghệ để tăng cường năng lực của Cảnh sát biển Việt Nam.

5. Các nội dung hợp tác quốc tế khác theo quy định của pháp luật Việt Nam, điều ước quốc tế mà nước Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên và thỏa thuận quốc tế có liên quan đến nhiệm vụ, quyền hạn của Cảnh sát biển Việt Nam.

Điều 21. Hình thức hợp tác quốc tế

1. Trao đổi thông tin về an ninh, trật tự, an toàn trên biển.

2. Tổ chức hoặc tham dự hội nghị, hội thảo quốc tế về an ninh, trật tự, an toàn và thực thi pháp luật trên biển.

3. Tham gia ký kết thỏa thuận quốc tế với lực lượng chức năng của quốc gia khác, tổ chức quốc tế theo quy định của pháp luật.

4. Phối hợp tuần tra, kiểm tra, kiểm soát giữ gìn an ninh, trật tự, an toàn và bảo đảm chấp hành pháp luật trên biển.

5. Tham gia diễn tập, huấn luyện; tổ chức đón, thăm xã giao lực lượng thực thi pháp luật trên biển của các quốc gia trong khu vực và trên thế giới.

6. Thực hiện các hoạt động của cơ quan thường trực, cơ quan đầu mối liên lạc của nước Cộng hòa xã hội chủ nghĩa Việt Nam theo quy định của pháp luật Việt Nam, điều ước quốc tế mà nước Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên và thỏa thuận quốc tế.

7. Các hình thức hợp tác quốc tế khác theo quy định của pháp luật Việt Nam, điều ước quốc tế mà nước Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên và thỏa thuận quốc tế.

Chương IV

PHỐI HỢP HOẠT ĐỘNG GIỮA CẢNH SÁT BIỂN VIỆT NAM VỚI CƠ QUAN, TỔ CHỨC, LỰC LƯỢNG CHỨC NĂNG

Điều 22. Phạm vi phối hợp

1. Cảnh sát biển Việt Nam chủ trì, phối hợp với cơ quan, tổ chức, lực lượng chức năng thuộc Bộ, cơ quan ngang Bộ, Ủy ban nhân dân cấp tỉnh để thực hiện nhiệm vụ, quyền hạn của Cảnh sát biển Việt Nam theo quy định của Luật này và quy định khác của pháp luật có liên quan.

2. Bộ trưởng Bộ Quốc phòng quy định việc phối hợp giữa Cảnh sát biển Việt Nam và các lực lượng thuộc Bộ Quốc phòng.

Điều 23. Nguyên tắc phối hợp

1. Việc phối hợp phải trên cơ sở nhiệm vụ, quyền hạn của cơ quan, tổ chức, lực lượng chức năng thuộc Bộ, cơ quan ngang Bộ và Ủy ban nhân dân cấp tỉnh theo quy định của pháp luật; không làm cản trở hoạt động hợp pháp của cơ quan, tổ chức, cá nhân trên biển.

2. Cảnh sát biển Việt Nam và cơ quan, tổ chức, lực lượng chức năng thuộc Bộ, cơ quan ngang Bộ và Ủy ban nhân dân cấp tỉnh trực tiếp phối hợp để giải quyết kịp thời các vụ việc và hỗ trợ nhau thực hiện nhiệm vụ, quyền hạn do pháp luật quy định.

3. Bảo đảm sự chủ trì, điều hành tập trung, thống nhất, giữ bí mật thông tin về quốc phòng, an ninh và biện pháp nghiệp vụ của cơ quan, tổ chức, lực lượng chức năng trong quá trình phối hợp.

4. Bảo đảm chủ động, linh hoạt, cụ thể và hiệu quả, gắn với trách nhiệm của người đứng đầu cơ quan chủ trì, phối hợp.

5. Trên cùng một vùng biển, khi phát hiện hành vi vi phạm pháp luật liên quan đến nhiệm vụ, quyền hạn của nhiều cơ quan, tổ chức, lực lượng thì cơ quan, tổ chức, lực lượng nào phát hiện trước phải xử lý theo thẩm quyền do pháp luật quy định; trường hợp vụ việc không thuộc thẩm quyền của mình thì chuyển giao hồ sơ, người, tang vật, tàu thuyền và phương tiện vi phạm pháp luật cho cơ quan, tổ chức, lực lượng có thẩm quyền chủ trì giải quyết. Cơ quan, tổ chức, lực lượng tiếp nhận có trách nhiệm thông báo kết quả điều tra, xử lý cho cơ quan, tổ chức, lực lượng chuyển giao biết.

Điều 24. Nội dung phối hợp

1. Trao đổi thông tin, tài liệu; đề xuất xây dựng văn bản quy phạm pháp luật.

2. Bảo vệ an ninh quốc gia, chủ quyền, quyền chủ quyền và quyền tài phán quốc gia trên biển.

3. Bảo vệ tài nguyên, môi trường biển; bảo vệ tài sản của Nhà nước, tổ chức, cá nhân; tính mạng, sức khỏe, danh dự, nhân phẩm của cá nhân hoạt động hợp pháp trên biển.

4. Tuần tra, kiểm tra, kiểm soát giữ gìn an ninh, trật tự, an toàn trên biển; phòng ngừa, phát hiện, ngăn chặn, đấu tranh chống tội phạm, vi phạm pháp luật; đấu tranh, phòng, chống cướp biển, cướp có vũ trang chống lại tàu thuyền.

5. Phòng, chống thiên tai; tìm kiếm, cứu hộ, cứu nạn và ứng phó, khắc phục sự cố môi trường biển.

6. Đào tạo, tập huấn, bồi dưỡng cán bộ, chiến sĩ Cảnh sát biển Việt Nam; tuyên truyền, phổ biến, giáo dục pháp luật cho Nhân dân.

7. Thực hiện hợp tác quốc tế.

8. Thực hiện các hoạt động phối hợp khác có liên quan.

Điều 25. Trách nhiệm của Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Chủ tịch Ủy ban nhân dân cấp tỉnh trong phối hợp hoạt động đối với Cảnh sát biển Việt Nam

Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Chủ tịch Ủy ban nhân dân cấp tỉnh, trong phạm vi nhiệm vụ, quyền hạn của mình, có trách nhiệm phối hợp với Bộ trưởng Bộ Quốc phòng về hoạt động của Cảnh sát biển Việt Nam theo quy định của Chính phủ.

Chương V

TỔ CHỨC CỦA CẢNH SÁT BIỂN VIỆT NAM

Điều 26. Hệ thống tổ chức của Cảnh sát biển Việt Nam

1. Hệ thống tổ chức của Cảnh sát biển Việt Nam bao gồm:

a) Bộ Tư lệnh Cảnh sát biển Việt Nam;

b) Bộ Tư lệnh Vùng Cảnh sát biển và các đơn vị trực thuộc Bộ Tư lệnh Cảnh sát biển Việt Nam;

c) Đơn vị cấp cơ sở.

2. Chính phủ quy định chi tiết Điều này.

Điều 27. Ngày truyền thống của Cảnh sát biển Việt Nam

Ngày 28 tháng 8 hằng năm là Ngày truyền thống của Cảnh sát biển Việt Nam.

Điều 28. Tên giao dịch quốc tế

Tên giao dịch quốc tế của Cảnh sát biển Việt Nam là Vietnam Coast Guard.

Điều 29. Màu sắc, cờ hiệu, phù hiệu và dấu hiệu nhận biết phương tiện của Cảnh sát biển Việt Nam

1. Tàu thuyền, máy bay và các phương tiện khác của Cảnh sát biển Việt Nam có màu sắc, cờ hiệu, phù hiệu và dấu hiệu nhận biết riêng. Khi làm nhiệm vụ, tàu thuyền phải treo quốc kỳ Việt Nam và cờ hiệu Cảnh sát biển Việt Nam.

2. Chính phủ quy định chi tiết Điều này.

Điều 30. Con dấu của Cảnh sát biển Việt Nam

Cảnh sát biển Việt Nam sử dụng con dấu có hình Quốc huy trong thực hiện chức năng, nhiệm vụ, quyền hạn được giao.

Điều 31. Trang phục của Cảnh sát biển Việt Nam

Cảnh hiệu, cấp hiệu, phù hiệu, cảnh phục, lễ phục của cán bộ, chiến sĩ Cảnh sát biển Việt Nam theo quy định của Chính phủ.

Chương VI

BẢO ĐẢM HOẠT ĐỘNG VÀ CHẾ ĐỘ, CHÍNH SÁCH ĐỐI VỚI CẢNH SÁT BIỂN VIỆT NAM

Điều 32. Kinh phí và cơ sở vật chất bảo đảm cho Cảnh sát biển Việt Nam

1. Nhà nước bảo đảm kinh phí và cơ sở vật chất, đất đai, trụ sở, công trình cho hoạt động của Cảnh sát biển Việt Nam.

2. Nhà nước ưu tiên đầu tư trang bị hiện đại, nghiên cứu, ứng dụng thành tựu khoa học và công nghệ cho Cảnh sát biển Việt Nam.

Điều 33. Trang bị của Cảnh sát biển Việt Nam

1. Cảnh sát biển Việt Nam được trang bị tàu thuyền, máy bay và phương tiện khác; các loại vũ khí, vật liệu nổ, công cụ hỗ trợ và thiết bị kỹ thuật nghiệp vụ để thực hiện chức năng, nhiệm vụ, quyền hạn được giao.

2. Bộ trưởng Bộ Quốc phòng quy định chi tiết Điều này.

Điều 34. Cấp bậc, quân hàm, chức vụ, chế độ phục vụ, chế độ chính sách và quyền lợi của cán bộ, chiến sĩ Cảnh sát biển Việt Nam

1. Việc bổ nhiệm, miễn nhiệm, cách chức, phong, thăng, giáng, tước cấp bậc, quân hàm, nâng lương, hạ bậc lương, đào tạo, bồi dưỡng, tuyển dụng, chế độ phục vụ, thôi phục vụ, chế độ chính sách, quyền lợi và các quy định khác đối với cán bộ, chiến sĩ Cảnh sát biển Việt Nam được thực hiện theo quy định của Luật Sĩ quan Quân đội nhân dân Việt Nam, Luật Quân nhân chuyên nghiệp, công nhân, viên chức quốc phòng, Luật Nghĩa vụ quân sự và quy định khác của pháp luật có liên quan.

2. Cán bộ, chiến sĩ Cảnh sát biển Việt Nam khi phục vụ tại ngũ được hưởng chế độ ưu đãi phù hợp với tính chất nhiệm vụ, địa bàn hoạt động theo quy định của Chính phủ.

Điều 35. Điều kiện, tiêu chuẩn tuyển chọn công dân vào Cảnh sát biển Việt Nam

1. Công dân Việt Nam từ đủ 18 tuổi trở lên, không phân biệt nam, nữ, có phẩm chất chính trị, đạo đức, sức khỏe, lý lịch rõ ràng và tự nguyện phục vụ lâu dài trong Cảnh sát biển Việt Nam.

2. Có văn bằng, chứng chỉ chuyên môn kỹ thuật, nghiệp vụ, có kỹ năng phù hợp với yêu cầu nhiệm vụ của Cảnh sát biển Việt Nam.

3. Bộ trưởng Bộ Quốc phòng quy định chi tiết Điều này.

Điều 36. Đào tạo, bồi dưỡng cán bộ, chiến sĩ Cảnh sát biển Việt Nam

Cán bộ, chiến sĩ Cảnh sát biển Việt Nam được đào tạo, bồi dưỡng về chính trị, chuyên môn, nghiệp vụ, pháp luật, ngoại ngữ và kiến thức cần thiết khác phù hợp với nhiệm vụ và quyền hạn được giao; khuyến khích phát triển tài năng để phục vụ lâu dài trong Cảnh sát biển Việt Nam.

Chương VII

QUẢN LÝ NHÀ NƯỚC VÀ TRÁCH NHIỆM CỦA BỘ, CƠ QUAN NGANG BỘ, CHÍNH QUYỀN ĐỊA PHƯƠNG ĐỐI VỚI CẢNH SÁT BIỂN VIỆT NAM

Điều 37. Nội dung quản lý nhà nước đối với Cảnh sát biển Việt Nam

1. Ban hành, trình cấp có thẩm quyền ban hành và tổ chức thực hiện văn bản quy phạm pháp luật về Cảnh sát biển Việt Nam.

2. Tổ chức, chỉ đạo hoạt động của Cảnh sát biển Việt Nam.

3. Đào tạo, bồi dưỡng cán bộ, chiến sĩ Cảnh sát biển Việt Nam.

4. Thực hiện chế độ, chính sách đối với Cảnh sát biển Việt Nam.

5. Kiểm tra, thanh tra, giải quyết khiếu nại, tố cáo; sơ kết, tổng kết, khen thưởng, xử lý vi phạm pháp luật trong hoạt động của Cảnh sát biển Việt Nam.

6. Tuyên truyền, phổ biến, giáo dục pháp luật.

7. Hợp tác quốc tế của Cảnh sát biển Việt Nam.

Điều 38. Trách nhiệm quản lý nhà nước đối với Cảnh sát biển Việt Nam

1. Chính phủ thống nhất quản lý nhà nước đối với Cảnh sát biển Việt Nam.

2. Bộ trưởng Bộ Quốc phòng chịu trách nhiệm trước Chính phủ thực hiện quản lý nhà nước đối với Cảnh sát biển Việt Nam.

Tư lệnh Cảnh sát biển Việt Nam chịu trách nhiệm trước Bộ trưởng Bộ Quốc phòng về tổ chức, quản lý, chỉ huy, điều hành hoạt động của Cảnh sát biển Việt Nam.

3. Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, trong phạm vi nhiệm vụ, quyền hạn của mình, có trách nhiệm phối hợp với Bộ trưởng Bộ Quốc phòng thực hiện quản lý nhà nước đối với Cảnh sát biển Việt Nam.

Điều 39. Trách nhiệm của Hội đồng nhân dân, Ủy ban nhân dân các cấp

Hội đồng nhân dân, Ủy ban nhân dân các cấp, trong phạm vi nhiệm vụ, quyền hạn của mình, tạo điều kiện cho Cảnh sát biển Việt Nam sử dụng quỹ đất tại địa phương để xây dựng trụ sở đóng quân, trú đậu tàu thuyền, kho tàng, bến bãi; tuyên truyền, phổ biến, giáo dục pháp luật về Cảnh sát biển Việt Nam; thực hiện chính sách về nhà ở xã hội cho cán bộ, chiến sĩ Cảnh sát biển Việt Nam theo quy định của pháp luật.

Điều 40. Trách nhiệm của Mặt trận Tổ quốc Việt Nam và các tổ chức thành viên của Mặt trận

Mặt trận Tổ quốc Việt Nam và các tổ chức thành viên của Mặt trận, trong phạm vi nhiệm vụ, quyền hạn của mình, có trách nhiệm phối hợp với cơ quan, tổ chức có liên quan tuyên truyền, vận động Nhân dân thực hiện pháp luật về Cảnh sát biển Việt Nam; giám sát đối với hoạt động của Cảnh sát biển Việt Nam theo quy định của pháp luật.

Chương VIII

ĐIỀU KHOẢN THI HÀNH

Điều 41. Hiệu lực thi hành

1. Luật này có hiệu lực thi hành từ ngày 01 tháng 7 năm 2019.

2. Pháp lệnh Lực lượng Cảnh sát biển Việt Nam số 03/2008/PL-UBTVQH12 hết hiệu lực kể từ ngày Luật này có hiệu lực thi hành.

Luật này được Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XIV, kỳ họp thứ 6 thông qua ngày 19 tháng 11 năm 2018.

VIETNAM COAST GUARD

Pursuant to the Constitution of the Socialist Republic of Vietnam;

The National Assembly hereby passes the Law on Vietnam Coast Guard.

Chapter I

GENERAL PROVISIONS

Article 1. Scope

This Law prescribes the status, functions, roles, powers, organization and operation of the Vietnam Coast Guard; compensation package and other policies for the Vietnam Coast Guard; responsibilities of involved entities and persons.

For the purposes of this Law, terms used herein shall be construed as follows:

1. Defending state sovereignty, sovereign rights and jurisdiction in the territorial waters of Vietnam refers to duties of preventing, detecting, combating and sanctioning entities or persons in contravention of legislation on national sovereignty, sovereign rights and jurisdiction in the territorial waters of the Socialist Republic of Vietnam.  

2. Vietnam Coast Guard’s officers and soldiers include military officers, professional soldiers, non-commissioned officers, servicemen, workers and civil servants belonging to the established staff of the Vietnam Coast Guard.

Article 3. Status and functions of Vietnam Coast Guard

1. Vietnam Coast Guard shall be a People’s armed force and a specialized force under the State management, shall play core roles in enforcing laws and maintaining national security, order and safety at sea.

2. Vietnam Coast Guard shall perform the function of counseling the Minister of Defense to promulgate, according to his/her competence, or make representations to the Party and the State on the policies and laws on protection of national security, order and safety at sea; protecting state sovereignty, sovereign rights and jurisdiction in the territorial waters of Vietnam; managing security, order and safety and ensuring observance of Vietnamese laws and treaties to which the Socialist Republic of Vietnam is a contracting party or international agreements within its competence.

Article 4. Principles of organization and operation of Vietnam Coast Guard

1. Be put under the ultimate and direct leadership of the Communist Party of Vietnam in all aspects, the domination of the State President, the unified State management of the Government and the direct command and administration of the Minister of Defense.

2. Abide by the Constitution and laws of Vietnam and treaties to which the Socialist Republic of Vietnam is a contracting party.

4. Act on its own initiative in preventing, detecting, preventing, combating and handling violations against laws.

5. Combine the tasks of protecting state sovereignty, sovereign rights and jurisdiction, and managing security, order and safety at sea with the marine economic development tasks.

6. Depend upon people, promote the people’s strength and be put under the people’s surveillance.

Article 5. Building of Vietnam Coast Guard

1. The State shall build the Vietnam Coast Guard in a revolutionary, formal, elite and modern manner; shall prioritize resources necessary for development of the Vietnam Coast Guard.

2. Vietnamese entities and citizens shall be held responsible for getting involved in building the immaculate and powerful Vietnam Coast Guard.

Article 6. Responsibilities of and compensation package and other policies granted to entities and persons joining, cooperating and collaborate with and supporting the Vietnam Coast Guard 

1. Entities and persons operating in the territorial waters of Vietnam shall have responsibility to participate in, cooperate with, collaborate with, support and assist the Vietnam Coast Guard in performing its functions, tasks and powers.

2. Vietnamese entities and citizens shall have to cooperate with the Vietnam Coast Guard in implementing decisions on mobilization of manpower, vessels and civil technical equipment and facilities of competent authorities for protection of national sovereignty, sovereign rights and jurisdiction in the territorial waters of Vietnam.

Article 7. Prohibited acts

1. Opposing and hindering the activities of the Vietnam Coast Guard; taking revenge on, threatening, invading life, health, honor and dignity of officers and soldiers of the Vietnam Coast Guard while on duty or for reasons pertaining to performing its duties.

2. Squaring, bribing or coercing officers and soldiers of the Vietnam Coast Guard to abuse their functions, tasks and powers.

3. Impersonating officers and soldiers of the Vietnam Coast Guard; using counterfeit vessels and other water transport equipment under the ownership of the Vietnam Coast Guard; faking, trading and illegally using uniforms, seals and documents as property of the Vietnam Coast Guard.

4. Misusing and abusing official titles, powers and positions of officers and soldiers of the Vietnam Coast Guard so as to violate laws; invading legitimate rights and benefits of entities and persons.

5. Officers and soldiers of the Vietnam Coast Guard harass and make trouble for legally licensed entities and persons.

6. Committing other acts of violation against provisions enshrined herein.

Chapter II

DUTIES AND POWERS OF VIETNAM COAST GUARD

1. Collect information, analyze, evaluate and forecast the situation so as to propose guidelines, solutions and plans for national security protection and law enforcement at sea; study, analyze, forecast and counsel competent authorities to promulgate policies and legislation on the protection of national sovereignty, sovereign rights, jurisdiction and national security in the territorial waters of Vietnam, maintain order, safety, prevent and combat crimes and violations against legislation on the sea.

2. Defend national sovereignty, sovereign rights, jurisdiction, security, and interests of the state and people; conserve marine resources and environment; protect legitimate property, rights and interests of entities and persons at sea.

3. Strive for the prevention and control of crimes, violations of law, maintenance of security, order and safety at sea; search, rescue and participate in mitigation of marine environmental emergencies.

4. Participate in the building of the defense and security posture and respond to defense and security situations at sea.

5. Carry out propaganda, dissemination and education of law.

6. Receive and utilize personnel, vessels and civil engineering equipment mobilized to defend national sovereignty, sovereign rights and jurisdiction in the territorial waters of Vietnam.

7. Implement international cooperation based on treaties to which the Socialist Republic of Vietnam is a contracting party and international agreements related to the functions, tasks and powers of the Vietnam Coast Guard.

Article 9. Powers of Vietnam Coast Guard

1. Patrol, inspect and control people, vessels, cargo and luggage in the territorial waters of Vietnam under the provisions of this Law and other relevant law provisions.

3. Use professional technical means and equipment under the provisions of Article 15 of this Law and other relevant law provisions.

4. Impose legal penalties for administrative violations.

5. Conduct a number of criminal investigation activities in accordance with the law on organization of criminal investigation agencies and criminal procedure law.

6. Chase vessels in violation of law at sea.

7. Mobilize people, vessels and civil technical means and equipment of Vietnamese entities and citizens in case of emergency.

8. Request foreign organizations and individuals operating in the territorial waters of Vietnam to provide support and assistance in case of emergency.

9. Arrest seagoing vessels in accordance with law.

10. Apply working measures prescribed in Article 12 hereof.

Article 10. Obligations and responsibilities of Vietnam Coast Guard’s officers and soldiers

2. Express their determination to defend national sovereignty, sovereign rights and jurisdiction in the Vietnamese territorial waters; combat crimes, violations of law, maintain security, social order and safety, keep the Vietnamese waters peaceful, stable and developed.

3. Watch out for and protect state and on-duty secret; strictly implement the working measures of the Vietnam Coast Guard.

4. Strictly abide by international treaties to which the Socialist Republic of Vietnam is a contracting party and international agreements related to the functions, tasks and powers of the Vietnam Coast Guard.

5. Frequently train themselves to improve political competence, legal knowledge, professional qualifications, a sense of discipline, and take more physical exercises.

6. Assume responsibility before law and to the superiors for their decisions and performance during the on-duty period.

Chapter III

ACTIVITIES OF VIETNAM COAST GUARD

SECTION 1. SCOPE OF ACTIVITIES AND WORKING MEASURES OF VIETNAM COAST GUARD

Article 11. Scope of activities performed by Vietnam Coast Guard

2. In the case of serving humanitarian or peaceful purposes, combating, preventing and controlling crimes and violations of law, the Vietnam Coast Guard may operate outside the territorial waters of Vietnam; while on duty, shall be required to comply with the laws of Vietnam, international treaties to which the Socialist Republic of Vietnam is a contracting party or international agreements related to the functions, tasks and powers of the Vietnam Coast Guard.

Article 12. Working measures of Vietnam Coast Guard

1. Vietnam Coast Guard shall implement mass mobilization, diplomatic, economic, scientific-technical, professional and armed measures to defend national security, maintain order and safety at sea as provided in law.

2. The Vietnam Coast Guard’s Commander shall decide to use working measures as provided for in clause 1 of this Article and take responsibility before law and the superior for its decision.

SECTION 2. ENFORCEMENT OF LAW AT SEA BY VIETNAM COAST GUARD

Article 13. Patrol, inspection and control

1. Vietnam Coast Guard shall patrol, inspect and control people, vessels, cargoes and luggage in order to detect, prevent and handle law violations at sea.

2. Cases of stopping boats and vessels for inspection shall include:

a) Directly discovering violations of law or signs of violation of law;

c) Filing accusations, denunciations and reports of crimes and violations of law;

d) Submitting written requests by competent authorities for the chase and detention of persons, boats, vessels and means in violation of law;

dd) The violator voluntarily testifies about violations of law.

3. While performing the tasks of patrol, inspection and control, the Vietnam Coast Guard must display the colors of its vessels, aircraft and other means; pennants, insignia, identity signs and uniform in accordance with Article 29 and 31 hereof.

4. Entities and persons operating in the territorial waters of Vietnam shall be responsible for submitting to the inspection and control of the Vietnam Coast Guard.

5. The Minister of National Defense shall regulate the procedures for patrol, inspection and control of the Vietnam Coast Guard.

Article 14. Use of weapons, explosives and other accessories

1. While on duty, officers and soldiers of the Vietnam Coast Guard shall be entitled to use military weapons, explosive materials and other accessories, and may fire military guns, under the provisions of the Law on Management and Usage of Weapons, Explosives and Other Accessories.

2. Apart from cases of firing military guns as per the Law on Management and Use of Weapons, Explosives and Other Accessories, when performing the task of fighting against crimes and law violations, and maintaining security, order and safety, officers and soldiers of the Vietnam Coast Guard shall be allowed to open fire on ships and boats at sea, except for vessels, boats or ships of foreign diplomatic missions, consulates and representative missions of international organizations, vessels carrying passengers or holding hostage, in order to stop vessels, boats or ships:

b) If it is determined that the ship or vessel operated by the offender is trying to run away; 

c) If it is determined that the ship or vessel carrying offenders or illegally transporting weapons, explosives, reactionary documents, state secrets, drugs or national treasure is attempting to run away;

d) If a person committing the act of piracy or armed robbery under the provisions of international treaties to which the Socialist Republic of Vietnam is a contracting party or criminal legislation tries to run away aboard the ship or vessel.

3. In case of firing under clause 2 of this Article, officers and soldiers of the Vietnam Coast Guard must warn by actions, orders, speech or shoot into the air before opening fire on boats or vessels; must obey the orders of competent persons when performing organized tasks.

Article 15. Use of technical and professional means and equipment

1. The Vietnam Coast Guard shall use the technical and professional means and equipment and the achieved results to analyze, evaluate and forecast the situation that may happen in the course of the protection of national sovereignty, sovereign rights, jurisdiction and national security and interests of the Homeland and people at sea; detect, arrest, investigate and handle crimes and law violations according to legislation on handling of administrative violations and violations against the criminal procedure law.

2. Technical and professional means and equipment of the Vietnam Coast Guard before being put to use must be inspected, calibrated, tested and strictly follow the prescribed process, and ensure safety according to the provisions of law.

3. The Government shall regulate the management, utilization and list of technical and professional means and equipment of the Vietnam Coast Guard.

Article 16. Mobilization of persons, boats, vessels, civil engineering means and equipment

2. The mobilization stated in clause 1 of this Article must depend on the actual capabilities of mobilized persons, boats, vessels or civil engineering means or equipment which must be returned immediately after emergency situations no longer exit.

In cases where the persons and properties mobilized to perform those tasks are damaged, they shall enjoy compensation and other remuneration policies under the provisions of clause 3 of Article 6 hereof; those entities whose officers and soldiers are mobilized shall be obliged to deal with compensation issues that may arise according to the provisions of law.

3. Vietnamese entities and citizens shall take responsibility for submitting to the mobilization by the Vietnam Coast Guard.

4. Under certain emergency situations, in order to arrest persons, vessels and means in violation of law; carry out search and rescue missions; respond to and mitigate serious marine environmental incidents, officers and soldiers of the Vietnam Coast Guard may request any aid or support from foreign entities and persons operating in the territorial waters of Vietnam.

Article 17. Exercise of the right to chase boats and vessels at sea

1. Vietnam Coast Guard shall exercise the right to chase a boat and vessel at sea in the following situations:

a) It breaches national sovereignty, sovereign rights and jurisdiction;

b) It does not follow stop signals or commands of the Vietnam Coast Guard in the case specified in clause 2 of Article 13 herein;

c) The Vietnam Coast Guard implements international cooperation in chasing activities;

2. The scope, competence and order of chasing ships at sea by ​​the Vietnam Coast Guard shall conform to the provisions of Vietnamese law and treaties to which the Socialist Republic of Vietnam is a contracting party.

Article 18. Announcement, notice and change of maritime security levels

The Vietnam Coast Guard’s Command Board shall announce the level or change of level of maritime security and notify the competent authority thereof; receive and process information on maritime security; notify the appropriate maritime security measures to be applicable to vessels operating in the Vietnamese territorial waters.

SECTION 3. INTERNATIONAL COOPERATION OF THE VIETNAM COAST GUARD

Article 19. International cooperation principles

1. Carry out international cooperation on the basis of complying with the laws of Vietnam, treaties to which the Socialist Republic of Vietnam is a contracting party and international agreements under its jurisdiction; adhere to the basic principles of international law; maintain national independence, sovereignty, sovereign rights and jurisdiction; protect interests of the Homeland and people, legitimate rights and benefits of entities and persons at sea.

2. Promote the internal strength and support and assistance of the international community, and ensure the enforcement of law at sea.

Article 20. Contents of international cooperation

1. Prevention and combating of piracy and armed robbery against boats and vessels.

3. Prevention and control of pollution, marine environmental incident prevention, response and remediation; control of the conservation of marine resources; protection of marine biodiversity and ecosystems; prevention, response to and warning against natural disasters; provision of humanitarian assistance and response to disasters; search, rescue and salvage at sea within the scope of tasks and powers of the Vietnam Coast Guard.

4. Organization of training and refresher courses, experience exchanges and transfers of equipment, scientific and technological know-how for the purpose of strengthening the capacity of Vietnam Coast Guard.

5. Other international cooperation contents under Vietnamese law and treaties to which the Socialist Republic of Vietnam is a contracting party and international agreements related to the duties and powers of the Vietnam Coast Guard.

Article 21. International cooperation approaches

1. Exchanging information about security, order and safety at sea.

2. Holding or participating in international seminars or workshops on security, order, safety and enforcement of law at sea.

3. Participating in conclusion of international agreements with competent forces of other countries or international organizations in accordance with laws.

4. Cooperating in performing the patrol, inspection and control tasks to maintain security, order, safety as well as ensure compliance with law at sea.

5. Joining training courses or practices; welcoming and pay courteous visits to law enforcement forces on the seas of ​​countries in the region and the world.

7. Taking other international cooperation approaches under Vietnamese law and treaties to which the Socialist Republic of Vietnam is a contracting party and other international agreements.

Chapter IV

COOPERATION IN PERFORMING ACTIVITIES BETWEEN VIETNAM COAST GUARD AND OTHER COMPETENT AUTHORITIES, BODIES OR FORCES

Article 22. Cooperation scope

1. The Vietnam Coast Guard shall assume the prime responsibility for, and cooperate with competent authorities, bodies or forces affiliated to the ministries, ministerial-level agencies and provincial-level People's Committees in performing the tasks and powers of the Vietnam Coast Guard under the provisions of this Law and other relevant legislation.

2. The Minister of National Defense shall regulate the cooperation between Vietnam Coast Guard and other forces under the management of the Ministry of National Defense.

Article 23. Cooperative principles

1. The cooperation must be based on the tasks and powers of competent authorities, bodies and forces under the control of the ministries, ministerial-level agencies and provincial-level People's Committees according to the provisions of law; must not hinder the lawful activities of entities and persons at sea.

2. Vietnam Coast Guard and other competent authorities, bodies and forces under the management of the ministries, ministerial-level agencies and provincial-level People's Committees shall directly enter into a cooperation in promptly dealing with cases and assisting in performing the tasks and powers prescribed by law.

4. Ensure proactive, flexible, specific and effective cooperation associated with responsibilities of heads of presiding and cooperating bodies.

5. In the same sea, when detecting acts of law violation related to the tasks and powers of multiple authorities, bodies and forces, authorities, bodies or forces that first detect such acts must take actions under their jurisdiction prescribed by law; if the case falls beyond the competence of an authority, body or force, dossiers, persons, material evidences, boats and means in violation of law shall be transferred to authorities, bodies or forces having competence in presiding over handling of such cases. Receiving authorities, bodies or forces shall be responsible for informing investigation and handling results to referring authorities, bodies or forces.

Article 24. Cooperative contents

1. Exchanging information and materials; proposing the formulation of legislative documents.

2. Protecting national security, sovereignty, sovereign rights and jurisdiction in the territorial waters.

3. Defending marine resources and environment; protecting property of the State, entities and persons; human lives, health, honor and dignity of persons at sea.

4. Patrolling, inspecting and controlling the maintenance of security, order and safety at sea; preventing, detecting, controlling and combating crimes and law violations; combating, preventing and controlling piracy and armed robbery against boats and vessels.

5. Preventing and controlling natural disasters; carrying out search, rescue and responding to and mitigating marine environmental incidents.

6. Holding training and practices for officers and soldiers of the Vietnam Coast Guard; disseminating, communicating and raising awareness of laws for the people.

8. Performing other relevant cooperation activities.  

Article 25. Responsibilities of Ministers, Heads of Ministry-level agencies and Chairpersons of provincial People's Committees for cooperation in performing activities with the Vietnam Coast Guard

Ministers, Heads of Ministry-level agencies and provincial People’s Committees shall, within their respective duties and powers, have responsibility for cooperating with the Minister of National Defense in terms of activities performed by the Vietnam Coast Guard under the Government’s regulations.

Chapter V

STRUCTURING OF VIETNAM COAST GUARD

Article 26. Organization structure of Vietnam Coast Guard

1. The organization structure of Vietnam Coast Guard shall include:

a) Vietnam Coast Guard’s Command Board;

b) Regional Command Board of the Coast Guard and other affiliates of the Vietnam Coast Guard’s Command Board;

2. The Government shall issue specific regulations of this Article.

Article 27. Anniversary day of Vietnam Coast Guard

August 28 of each year shall become the anniversary day of Vietnam Coast Guard.

Article 28. International transaction name

The international transaction name of “Cảnh sát biển Việt Nam” shall be Vietnam Coast Guard.

Article 29. Colors, pennants, insignia and identity signs of means of the Vietnam Coast Guard

1. Ships, vessels, aircraft and other means of the Vietnam Coast Guard shall have particular colors, pennants, insignia and identity signs. While on duty, its vessels and ships must fly the Vietnamese flag and pennant of the Vietnam Coast guard.

2. The Government shall issue specific regulations of this Article.

Article 30. Seal of Vietnam Coast Guard

Article 31. Uniform of Vietnam Coast Guard

Service badges, rank insignia, emblems, service uniform and ceremonial dress of officers and soldiers of the Vietnam Coast shall be subject to the Government’s regulations.

Chapter VI

ASSURANCE OF OPERATIONS OF VIETNAM COAST GUARD AND COMPENSATION OR OTHER POLICIES FOR VIETNAM COAST GUARD

Article 32. Funds and infrastructure facilities for assurance of operations of Vietnam Coast Guard

1. The State shall provide adequate funding and facilities, land, offices and construction works for activities of the Vietnam Coast Guard.

2. The State shall give Vietnam Coast Guard preference for investments in modern equipment, research and application of scientific and technological achievements.

Article 33. Equipment of Vietnam Coast Guard

1. Vietnam Coast guard shall be equipped with vessels, boats, aircraft and other means; weapons, explosives, accessories and other technical and professional equipment for implementing delegated functions, duties and powers.

Article 34. Ranks, military ranks, titles, service regimes, compensation policies and interests of officers and soldiers of the Vietnam Coast Guard

1. Appointment, dismissal, discharge, bestowing, raising, lowering, deprivation of ranks, military ranks, salary increases, pay grade lowering, training, education, recruitment, service regimes, service discharge, policies and interests and other regulations applicable to officers and men of the Vietnam Marine Police shall be subject to the provisions of the Law on Officers of the Vietnam People's Army, the Law on Professional Military Personnel, National Defence Workers and Employees, the Law on Military Service and other relevant law soft provisions.

2. Officers and soldiers of the Vietnam Coast Guard shall, while on active duty, receive preferential policies appropriate for the nature of duties and localities prescribed in the Government’s regulations. 

Article 35. Requirements and standards for selection of citizens eligible for admission to the Vietnam Coast Guard

1. Vietnamese citizens aged 18 or over, regardless of male or female, having good moral, ethical, health qualities and CV backgrounds, and making a long-term commitment to voluntarily serving in the Vietnam Coast Guard shall be eligible to apply for admission to the Vietnam Coast Guard.

2. They must hold diplomas, technical and professional certificates and have skills conformable to the requirements of the Vietnam Coast Guard.

3. The Minister of National Defense shall provide specific regulations on this Article.

Article 36. Training and education programs for officers and soldiers of the Vietnam Coast Guard

Officers and soldiers of the Vietnam Coast Guard shall be entitled to political, professional, technical, legal, foreign language and other necessary knowledge training and education programs designed to be appropriate for assigned duties and powers; shall be encouraged to develop their ability to serve in the Vietnam Coast Guard for a long term.

STATE MANAGEMENT OF VIETNAM COAST GUARD AND RESPONSIBILITIES OF MINISTRIES, MINISTRY-LEVEL AGENCIES AND LOCAL AUTHORITIES FOR VIETNAM COAST GUARD

Article 37. Tasks of the state management of the Vietnam Coast Guard

1. Promulgate and submit to competent authorities for promulgation and organize the implementation of legislative normative documents regarding the Vietnam Coast Guard.

2. Organize and direct operations of Vietnam Coast Guard.

3. Provide training and education programs for officers and soldiers of the Vietnam Coast Guard.

4. Implement compensation and other policies granted to the Vietnam Coast Guard.

5. Check, inspect and handle complaints and denunciations; conduct the primary and final review of operations of Vietnam Coast Guard, praise and grant awards for and impose sanctions on violations arising from these operations.

6. Carry out law propaganda, dissemination and educational programs.

7. Implement international cooperation involving the Vietnam Coast Guard.

1. The Government shall be accorded the uniform state management of the Vietnam Coast Guard.

2. The Minister of National Defense shall be accountable to the Government for the state management of the Vietnam Coast Guard.

The Vietnam Coast Guard’s Commander shall be held accountable to the Minister of National Defense for the organization, management, commanding and administration of operations of the Vietnam Coast Guard.

3. Ministers and Ministry-level agencies shall, within their assigned duties and powers, have responsibility for cooperating with the Minister of National Defense in exercising the state management of the Vietnam Coast Guard.

Article 39. Responsibilities of the all-level People’s Councils and People’s Committees

All-level People’s Councils and People’s Committees shall, within their respective duties and powers, have to provide favorable conditions for the Vietnam Coast Guard to use available land lots at their localities to build its base and shelters for its vessels, treasure as well as facilities; carry out propaganda, dissemination and educational programs relating to the Vietnam Coast Guard; implement social housing policies applied to officers and soldiers of the Vietnam Coast Guard as provided by law.  

Article 40. Duties of Vietnam Fatherland Front Committee and its member organizations

Vietnam Fatherland Front Committee and its member organizations shall, within their assigned duties and powers, have responsibility to cooperate with relevant entities to encourage and raise awareness among people in implementing laws on the Vietnam Coast Guard; oversee the Vietnam Coast Guard's activities to ensure compliance with law.

Article 41. Entry into force

1. This Law shall enter into force on July 1, 2019.

2. The Ordinance on Vietnam Coast Guard Force No. 03/2008/PL-UBTVQH12 shall be repealed from the entry into force of this Law.

This Law is passed in the 6^th session of the XIV^th National Assembly of the Socialist Republic of Vietnam held on November 19, 2018.
