QUY ĐỊNH CHỨC NĂNG, NHIỆM VỤ, QUYỀN HẠN VÀ CƠ CẤU TỔ CHỨC CỦA CƠ QUAN THẨM QUYỀN QUẢN LÝ CITES VIỆT NAM THUỘC TỔNG CỤC LÂM NGHIỆP

Căn cứ Nghị định số 15/2017/NĐ-CP ngày 17/02/2017 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Nông nghiệp và Phát triển nông thôn;

Căn cứ Nghị định số 06/2019/NĐ-CP ngày 22/01/2019 của Chính phủ về quản lý thực vật rừng, động vật rừng nguy cấp, quý, hiếm và thực thi Công ước về buôn bán quốc tế các loài động vật, thực vật hoang dã nguy cấp;

Căn cứ Quyết định của Thủ tướng Chính phủ: số 28/2017/QĐ-TTg ngày 03/7/2017 quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Tổng cục Lâm nghiệp, Quyết định số 24/2020/QĐ-TTg ngày 27/8/2020 sửa đổi, bổ sung một số điều của Quyết định số 28/2017/QĐ-TTg;

Căn cứ Quyết định số 2903/QĐ-BNN-TCCB ngày 04/7/2017 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn về phân cấp cho Tổng cục trưởng, Cục trưởng ban hành Quyết định quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của các cơ quan, đơn vị trực thuộc Tổng cục, Cục;

Theo đề nghị của Chánh Văn phòng Tổng cục.

QUYẾT ĐỊNH:

Điều 1. Vị trí và chức năng

1. Cơ quan thẩm quyền quản lý CITES Việt Nam là tổ chức thuộc Tổng cục Lâm nghiệp có chức năng tham mưu, tổng hợp giúp Tổng cục trưởng thực hiện quản lý nhà nước và thực hiện quyền, nghĩa vụ của nước thành viên Công ước về buôn bán quốc tế các loài động vật, thực vật hoang dã nguy cấp (sau đây viết tắt là CITES).

2. Cơ quan thẩm quyền quản lý CITES Việt Nam có con dấu để thực hiện nhiệm vụ cấp phép và giao dịch quốc tế; Tổng cục Lâm nghiệp đảm bảo kinh phí hoạt động theo quy định của pháp luật.

Văn phòng Cơ quan thẩm quyền quản lý CITES Việt Nam đặt tại Tổng cục Lâm nghiệp, Thành phố Hà Nội.

Tên giao dịch Quốc tế: The Viet Nam CITES Management Authority.

Điều 2. Nhiệm vụ và quyền hạn

1. Trình Tổng cục trưởng:

a) Chiến lược, chương trình, kế hoạch dài hạn, trung hạn và hàng năm, đề án, dự án, cơ chế, chính sách, văn bản quy phạm pháp luật về thực thi Công ước CITES; Danh mục các loài động vật, thực vật hoang dã nguy cấp và các cơ sở nuôi, trồng động vật, thực vật quy định tại các Phụ lục của CITES. Hướng dẫn, kiểm tra và tổ chức thực hiện theo quy định.

b) Quy chuẩn kỹ thuật quốc gia, quy trình, quy phạm kỹ thuật về nuôi các loài động vật hoang dã thuộc CITES.

2. Tham gia, đảm bảo thực hiện các quyền và nghĩa vụ của quốc gia thành viên CITES:

- Tổ chức, thực hiện các Nghị quyết, quyết định của CITES, xây dựng báo cáo quốc gia hàng năm về thực thi CITES và các báo cáo kỹ thuật theo yêu cầu của Ban thư ký, Hội nghị các nước thành viên và các Ủy ban.

- Cấp, thu hồi giấy phép, chứng nhận quy định của pháp luật Việt Nam và Công ước CITES.

- In ấn, phát hành giấy phép, giấy chứng nhận CITES.

- Đề xuất sửa đổi, bổ sung danh mục các loài động vật, thực vật hoang dã nguy cấp quy định tại các Phụ lục CITES.

- Hướng dẫn, cấp, hủy mã số cơ sở nuôi, trồng thực vật rừng, động vật rừng nguy cấp, quý, hiếm và động vật, thực vật hoang dã nguy cấp; nuôi sinh sản, nuôi sinh trưởng, trồng cấy nhân tạo các loài thủy sản thuộc các Phụ lục CITES; đăng ký với Ban Thư ký CITES các cơ sở nuôi, trồng các loài động vật, thực vật hoang dã nguy cấp quy định tại Phụ lục I CITES vì mục đích thương mại đủ điều kiện xuất khẩu.

- Chủ trì, phối hợp tổ chức kiểm tra hoạt động xuất khẩu, nhập khẩu, tái xuất khẩu, nhập nội từ biển và quá cảnh mẫu vật các loài thực vật rừng, động vật rừng nguy cấp, quý, hiếm và các loài động vật, thực vật hoang dã nguy cấp thuộc các Phụ lục CITES tại khu vực cửa khẩu.

- Tham mưu thành lập đoàn công tác dự các kỳ Hội nghị các nước thành viên, các cuộc họp Ủy ban Thường trực, Ủy ban thực vật, Ủy ban động vật.

3. Chủ trì, phối hợp với các cơ quan khoa học CITES Việt Nam và các cơ quan, tổ chức có liên quan trong việc thực thi CITES tại Việt Nam.

4. Chủ trì phối hợp với các bên có liên quan tổ chức đào tạo, hướng dẫn nghiệp vụ cho các cơ quan quản lý, tổ chức, hộ gia đình, cá nhân có liên quan về việc thực thi CITES theo quy định của CITES và pháp luật Việt Nam.

5. Trình cơ quan có thẩm quyền hướng dẫn, xử lý mẫu vật quy định tại các Phụ lục của CITES bị tịch thu theo quy định của pháp luật Việt Nam và CITES.

6. Dịch và công bố danh mục các loài động vật, thực vật hoang dã nguy cấp quy định tại các Phụ lục CITES sau khi được Hội nghị các quốc gia thành viên thông qua việc bổ sung, sửa đổi; dịch và công bố hướng dẫn của CITES về việc lấy mẫu giám định động vật, thực vật hoang dã nguy cấp sau khi được Tổng cục trưởng Tổng cục Lâm nghiệp phê duyệt.

7. Tham gia đàm phán trình cấp thẩm quyền phê duyệt các hiệp định song phương, đa phương về kiểm soát buôn bán mẫu động vật, thực vật hoang dã nguy cấp thuộc các Phụ lục CITES.

8. Xây dựng hệ thống cơ sở dữ liệu quản lý các trại nuôi sinh trưởng, gây nuôi sinh sản; cơ sở trồng cấy nhân tạo các loài động vật, thực vật thuộc Phụ lục CITES.

9. Đầu mối liên lạc giúp Tổng cục trưởng thực hiện vai trò đại diện quốc gia theo ủy quyền tại Liên minh quốc tế về đấu tranh chống tội phạm xâm hại các loài hoang dã (ICCWC), Diễn đàn hổ toàn cầu (GTF), Chương trình Giám sát săn bắn voi bất hợp pháp (MIKE) và Hệ thống thông tin về buôn bán voi (ETIS), Mạng lưới thực thi Luật các loài hoang dã của ASEAN (ASEAN-WEN) và Nhóm chuyên gia thực thi CITES của ASEAN (AEG-CITES).

10. Cấp, gia hạn, cấp thay thế, cấp lại, thu hồi giấy phép FLEGT theo quy định; xây dựng cơ sở dữ liệu cấp phép FLEGT.

11. Tổng hợp, báo cáo việc thực hiện các nhiệm vụ thuộc phạm vi quản lý theo quy định.

12. Tổ chức các hoạt động tuyên truyền, phổ biến, giáo dục pháp luật về thực thi CITES và phòng chống buôn bán trái pháp luật các loài động vật, thực vật thuộc các Phụ lục của CITES.

13. Thực hiện các nhiệm vụ khác do Tổng cục trưởng giao.

Điều 3. Cơ cấu tổ chức

1. Cơ quan thẩm quyền quản lý CITES Việt Nam có Giám đốc và Phó giám đốc (Số lượng Phó giám đốc thực hiện theo quy định hiện hành). Việc bổ nhiệm, miễn nhiệm Giám đốc và Phó giám đốc Cơ quan thẩm quyền quản lý CITES thực hiện theo quy định của pháp luật hiện hành.

a) Giám đốc chịu trách nhiệm quản lý, chỉ đạo điều hành chung hoạt động của Cơ quan thẩm quyền quản lý CITES Việt Nam, chịu trách nhiệm trước Tổng cục trưởng và trước pháp luật về hoạt động của Cơ quan thẩm quyền quản lý CITES Việt Nam; phân công công chức đúng quy định và phù hợp với nhiệm vụ được giao.

b) Phó giám đốc giúp Giám đốc theo dõi, chỉ đạo một số mặt công tác theo sự phân công của Giám đốc; chịu trách nhiệm trước Giám đốc và trước pháp luật về nhiệm vụ được phân công.

2. Cơ quan thẩm quyền quản lý CITES Việt Nam có đại diện tại phía Nam, Văn phòng đại diện đặt tại Thành phố Hồ Chí Minh.

3. Công chức thực hiện nhiệm vụ chuyên môn do Giám đốc phân công và chịu trách nhiệm trước Giám đốc, trước pháp luật về thực hiện nhiệm vụ được giao.

Điều 4. Hiệu lực thi hành

Quyết định này có hiệu lực thi hành kể từ ngày ký ban hành.

Quyết định này thay thế Quyết định số 293/QĐ-TCLN-VP ngày 17/8/2017 quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Cơ quan quản lý CITES Việt Nam trực thuộc Tổng cục Lâm nghiệp.

Điều 5. Trách nhiệm thi hành

Chánh Văn phòng Tổng cục Lâm nghiệp, Giám đốc Cơ quan thẩm quyền quản lý CITES Việt Nam, các Vụ trưởng, Cục trưởng và Thủ trưởng các cơ quan, đơn vị có liên quan chịu trách nhiệm thi hành Quyết định này./.

DEFINING FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF VIETNAM CITES MANAGEMENT AUTHORITY AFFILIATED TO VIETNAM ADMINISTRATION OF FORESTRY

DIRECTOR GENERAL OF VIETNAM ADMINISTRATION OF FORESTRY

Pursuant to the Government’s Decree No. 15/2017/ND-CP dated February 17, 2017 defining functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Government’s Decree No. 06/2019/ND-CP dated January 22, 2019 on management of endangered, rare and precious species of forest fauna and flora and observation of the Convention on International Trade in Endangered Species of Wild Fauna and Flora.

Pursuant to the Prime Minister’s Decision No. 28/2017/QD-TTg dated July 03, 2017 defining the functions, tasks, powers and organizational structure of the Vietnam Administration of Forestry, Decision No. 24/2020/QD-TTg dated August 27, 2020 providing amendments to Decision No. 28/2017/QD-TTg;

Pursuant to the Decision No. 2903/QD-BNN-TCCB dated July 04, 2017 of the Ministry of Agriculture and Rural Development authorizing Directors General and Directors of Departments and Agencies to promulgate Decisions defining the functions, tasks, powers and organizational structure of their affiliated units;

Article 1. Position and functions

1. Vietnam CITES Management Authority is an organization affiliated to Vietnam Administration of Forestry that has the functions to advising and assisting VNFOREST's Director General in performing state management tasks, rights and obligations of Parties of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (hereinafter referred to as “CITES”).

2. Vietnam CITES Management Authority has its own seal to perform licensing function and international transactions, and has its operating expenses covered by VNFOREST in accordance with law regulations.

The office of Vietnam CITES Management Authority is located in the premises of VNFOREST, Hanoi City.

International name: The Viet Nam CITES Management Authority.

Article 2. Tasks and powers

1. Submit the following documents to Director General:

a) Strategies, programs, annual, medium-term and long-term plans, schemes, projects, mechanisms, policies and legislative documents on implementation of CITES; lists of endangered species of wild fauna and flora, and facilities that cultivate or breed plant or animal species in CITES Appendices. Instruct, inspect and organize the implementation of these documents as prescribed.

b) National technical regulations, technical rules and procedures for breeding of CITES-listed endangered species of wild fauna and flora.

- Organize the implementation of CITES resolutions and decisions, prepare annual national reports on implementation of CITES and other technical reports at the request of the Secretariat, meetings of Conference of the Parties and Committees.

- Issue and revoke permits and certificates in accordance with the Law of Vietnam and CITES.

- Print and issue CITES permits and certificates.

- Propose amendments to lists of endangered species of wild fauna and flora in CITES Appendices.

- Instruct, issue and cancel registration numbers of facilities that cultivate or breed endangered, precious and rare species of forest fauna and flora, and endangered species of wild fauna and flora; captive breeding, captive rearing and artificial propagation of aquatic species in CITES Appendices; carry out registration of facilities breeding endangered species of wild fauna and flora specified in CITES Appendix I for commercial purposes that are eligible to export species mentioned above with the CITES Secretariat;

- Play the leading role and cooperate with relevant agencies in carrying out inspection of export, import, re-export, introduction from the sea and transit of specimens of endangered, precious and rare species of forest fauna and flora and endangered species of wild fauna and flora in CITES Appendices at border checkpoints.

- Provide advices about the establishment of missions to attend meetings of the Conference of the Parties, and meetings of the Standing Committee, Plants Committee and Animals Committee.

3. Play the leading role and cooperate with CITES scientific authority of Vietnam and relevant authorities and organizations in observing CITES in Vietnam.

4. Play the leading role and cooperate with relevant parties in providing professional training for management authorities, organizations, family households and individuals related to CITES observation in accordance with CITES regulations and the Law of Vietnam.

6. Translate and publish lists of endangered species of wild fauna and flora in CITES Appendices after amendments to such lists are approved in the Conference of CITES Parties; translate and publish the CITES guidance on sampling for appraisal of endangered species of wild fauna and flora after obtaining approval from the Director General of VNFOREST.

7. Enter into negotiation of and submit bilateral and multilateral agreements on control of trade in specimens of endangered wild fauna and flora in CITES Appendices.

8. Establish database serving the management of captive breeding and captive rearing farms, and facilities artificially propagating animal and plant species in CITES Appendices.

9. Act as a contact point assisting the Director General of VNFOREST in playing the role of national representative at the International Consortium on Combating Wildlife Crime (ICCWC), Global Tiger Forum (GTF), Monitoring the Illegal Killing of Elephants (MIKE) programme, Elephant Trade Information System (ETIS), ASEAN Wildlife Enforcement Network (ASEAN-WEN) and the ASEAN Experts Group on CITES (AEG-CITES).

10. Issue, extend, replace, re-issue and revoke FLEGT licenses as prescribed; establish FLEGT licensing database.

11. Prepare consolidated reports on performance of tasks under its authority as prescribed.

12. Disseminate and educate about laws on observation of CITES and prevention of illegal trade in animal and plant species in CITES Appendices.

13. Perform other tasks assigned by Director General of VNFOREST.

Article 3. Organizational structure

a) Director shall manage and direct general operations of Vietnam CITES Management Authority, assume responsibility before Director General of VNFOREST and legal liability for operations of Vietnam CITES Management Authority; assign officials to perform tasks in accordance with regulations.

b) Deputy Directors shall assist Director in monitoring and directing some operations as assigned by Director; assume responsibility before Director and legal liability for assigned tasks.

2. Vietnam CITES Management Authority has a Southern Representative Office located in Ho Chi Minh City.

3. Officials performing professional tasks shall be assigned by Director and assume responsibility before Director and legal liability for their assigned tasks.

Article 4. Effect

This Decision comes into force from the date on which it is signed.

This Decision supersedes the Decision No. 293/QD-TCLN-VP dated August 17, 2017 defining functions, tasks, powers and organizational structure of Vietnam CITES Management Authority affiliated to Vietnam Administration of Forestry.

Article 5. Responsibility for implementation

The Chief of Office of VNFOREST, Director of Vietnam CITES Management Authority, Directors/Directors General of Departments/Agencies and heads of relevant agencies/units are responsible for the implementation of this Decision./.
