SỬA ĐỔI, BỔ SUNG KHOẢN 3, ĐIỀU 3 QUY TRÌNH THU BẢO HIỂM XÃ HỘI, BẢO HIỂM Y TẾ, BẢO HIỂM THẤT NGHIỆP, BẢO HIỂM TAI NẠN LAO ĐỘNG, BỆNH NGHỀ NGHIỆP; QUẢN LÝ SỔ BẢO HIỂM XÃ HỘI, THẺ BẢO HIỂM Y TẾ BAN HÀNH KÈM THEO QUYẾT ĐỊNH SỐ 595/QĐ-BHXH NGÀY 14 THÁNG 4 NĂM 2017 CỦA TỔNG GIÁM ĐỐC BẢO HIỂM XÃ HỘI VIỆT NAM

Căn cứ Luật Bảo hiểm xã hội số 58/2014/QH13 ngày 20/11/2014;

Căn cứ Luật Bảo hiểm y tế số 25/2008/QH12 ngày 14/11/2008; Luật số 46/2014/QH13 ngày 13/6/2014 sửa đổi, bổ sung một số điều của Luật Bảo hiểm y tế;

Căn cứ Luật Việc làm số 38/2013/QH13 ngày 16/11/2013;

Căn cứ Luật An toàn, Vệ sinh lao động số 84/2015/QH13 ngày 25/6/2015;

Căn cứ Nghị định số 89/2020/NĐ-CP ngày 04/8/2020 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bảo hiểm xã hội Việt Nam;

Xét đề nghị của Trưởng Ban Quản lý Thu - Sổ, Thẻ.

QUYẾT ĐỊNH:

Điều 1. Bổ sung Điểm 3.3, Khoản 3, Điều 3 Quy trình thu bảo hiểm xã hội (BHXH), bảo hiểm y tế (BHYT), bảo hiểm thất nghiệp, bảo hiểm tai nạn lao động, bệnh nghề nghiệp; quản lý sổ BHXH, thẻ BHYT ban hành kèm theo Quyết định số 595/QĐ-BHXH ngày 14/4/2017 của Tổng Giám đốc BHXH Việt Nam như sau:

“3.3. BHXH huyện, tỉnh: Cấp lại, đổi thẻ BHYT không thay đổi thông tin theo mẫu thẻ BHYT ban hành kèm theo Quyết định số 1666/QĐ-BHXH ngày 03/12/2020 của Tổng Giám đốc BHXH Việt Nam cho người tham gia BHYT ở huyện, tỉnh khác.”

Điều 2. Quyết định này có hiệu lực thi hành kể từ ngày ký ban hành.

Điều 3. Trưởng Ban Quản lý Thu - Sổ, Thẻ, Chánh Văn phòng, Thủ trưởng các đơn vị trực thuộc Bảo hiểm xã hội Việt Nam; Giám đốc Bảo hiểm xã hội các tỉnh, thành phố trực thuộc Trung ương chịu trách nhiệm thi hành Quyết định này./.

AMENDING CLAUSE 3 ARTICLE 3 OF PROCEDURES FOR COLLECTION OF SOCIAL INSURANCE CONTRIBUTIONS AND PREMIUMS OF HEALTH INSURANCE, UNEMPLOYMENT INSURANCE, OCCUPATIONAL ACCIDENT AND OCCUPATIONAL DISEASE INSURANCE; MANAGEMENT OF SOCIAL INSURANCE BOOKS AND HEALTH INSURANCE CARDS ENCLOSED WITH DECISION NO. 595/QD-BHXH DATED APRIL 14, 2017 BY GENERAL DIRECTOR OF VIETNAM SOCIAL SECURITY

Pursuant to the Law on Social Insurance No. 58/2014/QH13 dated 20/11/2014;

Pursuant to the Law on Health Insurance No. 25/2008/QH12 dated 14/11/2008; and Law No. 46/2014/QH13 dated 13/6/2014 on amendments to certain articles of Law on Health Insurance;

Pursuant to the Law on Employment No. 38/2013/QH13 dated 16/11/2013;

Pursuant to the Law on Occupational Safety and Hygiene No. 84/2015/QH13 dated 25/6/2015;

Pursuant to the Government’s Decree No. 89/2020/ND-CP dated 04/8/2020 on functions, duties, powers and organizational structure of Vietnam Social Security;

HEREBY DECIDES:

Article 1. Point 3.3 is added to Clause 3 Article 3 of procedures for collection of social insurance contributions and premiums of health insurance, unemployment insurance, occupational accident and occupational disease insurance; management of social insurance books and health insurance cards enclosed with Decision No. 595/QD-BHXH dated 14/4/2017 by General Director of Vietnam Social Security as follows:

“3.3. Provincial and district-level social security authorities have the power to reissue and replace health insurance cards without changing information using the health insurance card specimen enclosed with Decision No. 1666/QD-BHXH dated 03/12/2020 by General Director of Vietnam Social Security for health insurance participants of other provinces and districts.”

Article 2. This Decision takes effect from the date on which it is signed.

Article 3. Managers of premium collection department and department for social insurance books and health insurance cards, Chief of Office, heads of affiliates of Vietnam Social Security; and Directors of provincial social security authorities shall implement this Decision./.
