QUY ĐỊNH MỨC THU, NỘP PHÍ, LỆ PHÍ TRONG LĨNH VỰC CHỨNG KHOÁN

Căn cứ Luật Phí và lệ phí ngày 25 tháng 11 năm 2015;

Căn cứ Nghị định số 87/2017/NĐ-CP ngày 26 tháng 7 nam 2017 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Tài chính;

Theo đề nghị của Vụ trưởng Vụ Chính sách thuế;

Bộ trưởng Bộ Tài chính ban hành Thông tư quy định mức thu, nộp phí, lệ phí trong lĩnh vực chứng khoán.

Điều 1. Mức thu, nộp phí, lệ phí trong lĩnh vực chứng khoán

Tổ chức, cá nhân là người nộp phí, lệ phí theo quy định tại Điều 2 Thông tư số 272/2016/TT-BTC ngày 14 tháng 11 năm 2016 của Bộ trưởng Bộ Tài chính quy định mức thu, chế độ thu, nộp, quản lý và sử dụng phí, lệ phí trong lĩnh vực chứng khoán (sau đây gọi là Thông tư số 272/2016/TT-BTC) thực hiện nộp phí, lệ phí như sau:

1. Kể từ ngày 07 tháng 5 năm 2020 đến hết ngày 31 tháng 12 năm 2020, nộp phí, lệ phí bằng 50% mức thu các khoản phí, lệ phí (trừ 02 khoản phí, lệ phí quy định tại khoản 2 Điều này) quy định tại Biểu mức thu phí, lệ phí trong lĩnh vực chứng khoán ban hành kèm theo Thông tư số 272/2016/TT-BTC.

Trong thời gian áp dụng mức thu phí, lệ phí theo quy định tại khoản 1 Điều này, không áp dụng mức thu phí, lệ phí (mức 100%) quy định tại Biểu mức thu phí, lệ phí ban hành kèm theo Thông tư số 272/2016/TT-BTC.

2. Mức thu lệ phí cấp mới, cấp đổi, cấp lại giấy chứng nhận hành nghề chứng khoán cho cá nhân hành nghề chứng khoán tại công ty chứng khoán, công ty quản lý quỹ đầu tư chứng khoán và công ty đầu tư chứng khoán và phí giám sát hoạt động chứng khoán thực hiện theo quy định tại Biểu mức thu phí, lệ phí ban hành kèm theo Thông tư số 272/2016/TT-BTC.

3. Kể từ ngày 01/01/2021 trở đi, nộp phí, lệ phí trong lĩnh vực chứng khoán theo quy định tại Biểu mức thu phí, lệ phí ban hành kèm theo Thông tư số 272/2016/TT-BTC.

Điều 2. Tổ chức thực hiện

1. Thông tư này có hiệu lực thi hành kể từ ngày 07 tháng 5 năm 2020 đến hết ngày 31 tháng 12 năm 2020.

2. Các nội dung về phạm vi điều chỉnh, đối tượng áp dụng, tổ chức thu, kê khai, thu, nộp, quản lý, sử dụng, chứng từ thu, công khai chế độ thu phí, lệ phí và các nội dung khác liên quan không quy định tại Thông tư này thực hiện theo quy định tại Thông tư số 272/2016/TT-BTC.

3. Trong quá trình thực hiện, nếu có vướng mắc đề nghị các tổ chức, cá nhân phản ánh kịp thời về Bộ Tài chính để nghiên cứu, hướng dẫn bổ sung./.

CIRCULAR

PRESCRIBING FEES AND CHARGES PAYABLE IN SECURITIES SECTOR

Pursuant to the Law on Fees and Charges dated November 25, 2015;

Pursuant to the Government’s Decree No. 87/2017/ND-CP dated July 26, 2017 defining functions, tasks, powers and organizational structure of the Ministry of Finance;

At the request of the Director General of the Department of Tax Policy;

The Minister of Finance promulgates a Circular prescribing fees and charges payable in securities sector.

Article 1. Fees and charges payable in securities sector

Payers defined in Article 2 of the Circular No. 272/2016/TT-BTC dated November 14, 2016 of the Minister of Finance prescribing fees and charges payable in securities sector, collection, management and use thereof (hereinafter referred to as “Circular No. 272/2016/TT-BTC”) shall pay fees and charges as follows:

During the application of fees and charges prescribed in Clause 1 of this Article, no collection of fees and charges in full (100%) as prescribed in the Schedule of fees and charges enclosed with Circular No. 272/2016/TT-BTC shall be made.

2. Fees for processing of applications for issuance, modification or re-issuance of practicing certificates to individuals working at securities companies, securities investment fund management companies, and securities investment companies, and fees for supervision of securities activities shall be paid according to the Schedule of fees and charges enclosed with Circular No. 272/2016/TT-BTC.

3. From January 01, 2021 onwards, fees and charges in securities sector shall be paid according to the Schedule of fees and charges enclosed with Circular No. 272/2016/TT-BTC.

Article 2. Implementation

1. This Circular comes into force from May 07, 2020 to December 31, 2020 inclusively.

2. Scope of application, regulated entities, payers, collectors, collection, management and use of fees and charges, required documents, statement of fees and charges, and other relevant contents, which are not provided for in this Circular, shall comply with the provisions in Circular No. 272/2016/TT-BTC.

3. Difficulties that arise during the implementation of this Circular should be promptly reported to the Ministry of Finance for consideration./.
