What are the fines for art performances, which includes Vietnamese history distortion?
Pursuant to Point c, Clause 5, Point a, Clause 9 and Point dd, Clause 10, Article 11 of the Decree 38/2021/NĐ-CP stipulating the fine ranging from 25,000,000VND to 30,000,000VND for one of the following violations:
c) Performing arts, performing arts contests and festivals that distort history, independence, sovereignty and territorial integrity; repudiate revolutionary achievements; offend beliefs, religions; insult national leaders, heroes or celebrities.
9. Other supplementary penalties:
a) The penalty existing in the form of temporary suspension of performing activities for the duration of between 6 and 12 months shall be imposed for the violations referred to in Clause 5 of this Article;
10. Remedies:
dd) Compelling the disgorgement of illegal gains from commission of the violations defined in point a of clause 3, clause 4, 5, 6, 7 and 8 of this Article.
Pursuant to Clause 2, Article 5 of the same Decree stipulating as follows:

The amounts of fine specified in Chapter II and Chapter III of this Decree are imposed on individuals while those specified in clause 1, point c clause 4, point a clause 5 and 6 of Article 6; point c, dd, e and g clause 4 of Article 8; clause 1, 2 and 3 of Article 9; Article 10; point a clause 2, clause 3, 5 and 6, point a, b, c and d clause 7 Article 14; clause 1, 2, 3, 4 and point b clause 5 Article 21; clause 1, 2, 3, 4 and point b clause 5 Article 23; clause 1 of Article 24; Article 30, 38, 39 and 40 of this Decree are applicable to organizations.
As regulations above, individuals who distort Vietnamese history in art performances shall be fined from 25,000,000VND to 30,000,000VND. The fine shall be doubled to organizations. Besides, those who violated shall receive penalty of suspension from performing activities for the duration of between 6 and 12 months and return illegal gains from commission of the violations.
Is Vietnamese history distortion prohibited in art performances?
Pursuant to Article 3 of the Decree 144/2020/NĐ-CP stipulating prohibited acts in performance arts as follows:
1. Scheming against the Government of Socialist Republic of Vietnam.
2. Distorting history, independence, sovereignty and territorial integrity of the Socialist Republic of Vietnam; infringing national security; denying revolution achievement; offending leaders, national heroes and historical figures; damaging national integrity; offending religions and beliefs; discriminating; violating legal rights and benefits of organizations and individuals.
3. Inciting violence, spreading wars of aggression, inciting conflict between ethnic groups and nationals of other countries, impacting diplomatic relationship.
4. Employing outfits, languages, sound, visual, movements, media or methods which go against tradition or affect moral, health and psychology of the general public negatively.
As regulations above, Vietnamese history distortion prohibited in art performances is a violation against the Law of Vietnam.
