Hiệp định Thương mại tự do giữa Việt Nam và Liên minh Châu Âu (EVFTA) có hiệu lực từ ngày 01/8/2020. Để thực hiện các cam kết của Hiệp định về xuất xứ hàng hóa, Bộ Công Thương đã ban hành Thông tư số 11/2020/TT-BCT ngày 15/6/2020 quy định về quy tắc xuất xứ trong Hiệp định EVFTA, có hiệu lực từ ngày 01/8/2020.

Trong khi chờ ban hành Nghị định biểu thuế xuất khẩu ưu đãi, biểu thuế nhập khẩu ưu đãi đặc biệt thực hiện Hiệp định EVFTA, để đảm bảo thực hiện đúng cam kết của Hiệp định, Tổng cục Hải quan có ý kiến như sau:

1. Đối với các tờ khai hải quan nhập khẩu đăng ký từ ngày 01/8/2020, trường hợp người khai hải quan nộp chứng từ chứng nhận xuất xứ hàng hóa được cấp từ ngày 01/8/2020, cơ quan hải quan hướng dẫn người khai hải quan khai thông tin về chứng từ chứng nhận xuất xứ trên tờ khai hải quan theo quy định tại Điều 5 Thông tư số 38/2018/TT-BTC ngày 20/4/2018 (được sửa đổi, bổ sung tại Thông tư số 62/2019/TT-BTC ngày 5/9/2020) và thực hiện tiếp nhận theo quy định.

2. Về áp dụng cơ chế tự chứng nhận xuất xứ của EU trong Hiệp định EVFTA theo nội dung công văn số 6123/BCT-XNK ngày 18/8/2020 của Bộ Công Thương:

Theo thông báo chính thức của EC tại công thư số Ares(2020) 1982973. EU sẽ áp dụng cơ chế chứng nhận xuất xứ theo quy định tại khoản 1(c), Điều 15. Nghị định thư 1 của Hiệp định EVFTA, cụ thể là tự chứng nhận xuất xứ theo hệ thống REX (Registered Exporter System). Quy định này được hướng dẫn tại khoản 1 (c), Điều 19, Thông tư số 11/2020/TT-BCT ngày 15 tháng 6 năm 2020 của Bộ trưởng Bộ Công Thương quy định Quy tắc xuất xứ hàng hóa trong Hiệp định EVFTA.

EU đồng thời thông báo không áp dụng cơ chế chứng nhận xuất xứ được quy định tại khoản 1 (a) và khoản 1 (b), Điều 15, Nghị định thư 1 của Hiệp định EVFTA (được hướng dẫn tại khoản 1 (a) và khoản 1 (b), Điều 19. Thông tư số 11/2020/TT-BCT).

Với thông báo này của EC. Việt Nam sẽ cho hưởng ưu đãi đối với lô hàng có xuất xứ từ EU trên cơ sở chứng từ tự chứng nhận xuất xứ được phát hành bởi nhà xuất khẩu đã đăng ký mã số REX hoặc bởi bất kỳ nhà xuất khẩu nào chứng nhận cho lô hàng trị giá không quá 6.000 euro.

3. Thời điểm nộp chứng từ chứng nhận xuất xứ hàng hóa trong khuôn khổ Hiệp định EVFTA thực hiện theo quy định tại Điều 7, Thông tư số 38/2018/TT-BTC ngày 20/4/2018 (sửa đổi, bổ sung tại Thông tư số 62/2019/TT-BTC ngày 3/9/2020).

Trong giai đoạn dịch viêm đường hô hấp cấp gây ra bởi virus Corona (COVID-19): thực hiện theo quy định tại Thông tư số 47/2020/TT-BTC ngày 27/5/2020 hướng dẫn thời hạn nộp chứng từ chứng nhận xuất xứ, hình thức nộp chứng từ chứng nhận xuất xứ đối với hàng hóa nhập khẩu.

Tổng cục Hải quan thông báo để Cục Hải quan các tỉnh, thành phố thực hiện./.

To: Provincial Customs Departments.

The EU-Vietnam Free Trade Agreement (EVFTA) comes into force from August 01, 2020. In order to implement the EVFTA commitments on rules of origin, the Ministry of Industry and Trade has promulgated the Circular No. 11/2020/TT-BCT dated June 15, 2020 prescribing the rules of origin under EVFTA, which comes into force from August 01, 2020.

Pending the promulgation of a Decree providing the preferential export tariff schedule and special preferential import tariff schedule for implementation of EVFTA, the General Department of Customs hereby gives the following opinions for the purpose of implementing EVFTA commitments on rules of origin:

1. With regard to a customs declaration for imports registered on or after August 01, 2020, if a proof of origin which is issued on or after August 01, 2020 is submitted, the customs authority shall instruct the customs declarant to provide information about that proof of origin on the customs declaration as prescribed in Article 5 of the Circular No. 38/2018/TT-BTC dated April 20, 2018 (as amended in the Circular No. 62/2019/TT-BTC dated September 05, 2020) and then receive the complete customs declaration as prescribed.

2. With regard to application of the mechanism for self-certification of origin by EU under EVFTA according to the Official Dispatch No. 6123/BCT-XNK dated August 18, 2020 of the Ministry of Industry and Trade:

According to the official notice issued by EC in the Formal Letter No. Ares(2020) 1982973, EU shall apply the mechanism for certification of origin as per Clause 1(c) Article 15 in the Protocol 1 annexed to EVFTA, i.e. self-certification of origin carried out according to the REX (Registered Exporter System). This regulation is explained in Clause 1(c) Article 19 of the Circular No. 11/2020/TT-BCT dated June 15, 2020 of the Minister of Industry and Trade prescribing the rules of origin under EVFTA.

EU also stated that the mechanism for certification of origin prescribed in Clause 1 (a) and Clause 1 (b) of Article 15 in the Protocol 1 annexed to EVFTA shall not apply (this is explained under Clause 1 (a) and Clause 1 (b) of Article 19 of the Circular No. 11/2020/TT-BCT).

In compliance with this notice from EC, Vietnam will grant preferential treatment for shipments of EU origin on condition that the origin declration for each shipment is issued by the exporter that has a valid REX number, or by any exporter to certify that total value of the shipment does not exceed EUR 6,000.

3. Origin declarations under EVFTA shall be submitted in accordance with the provisions in Article 7 of the Circular No. 38/2018/TT-BTC dated April 20, 2018 (as amended in the Circular No. 62/2019/TT-BTC dated September 3, 2020).

During the COVID-19 pandemic (disease caused by severe acute respiratory syndrome coronavirus), time for submission of origin declarations shall comply with the Circular No. 47/2020/TT-BTC dated May 27, 2020 governing required time for submission of proofs of origin and types of proofs of origin of imports.

Provincial Customs Departments are requested to comply with instructions herein./.
