Kính gửi: Các doanh nghiệp sản xuất, kinh doanh dược (Sau đây gọi tắt là Doanh nghiệp)

Thực hiện quy định tại Nghị định số 54/2017/NĐ-CP ngày 08/5/2017 của Chính phủ quy định chi tiết một số điều và biện pháp thi hành Luật Dược và Nghị định số 155/2018/NĐ-CP ngày 12/11/2018 của Chính phủ sửa đổi, bổ sung, một số quy định liên quan đến điều kiện đầu tư kinh doanh thuộc phạm vi quản lý nhà nước của Bộ Y tế, qua kết quả kiểm tra hậu kiểm việc thực hiện các quy định về quản lý giá thuốc tại một số doanh nghiệp,

Cục Quản lý Dược đề nghị các doanh nghiệp thực hiện như sau:

1. Kê khai, kê khai lại giá thuốc đúng trình tự, thủ tục, thẩm quyền quy định. Trong đó, kê khai, kê khai lại giá thuốc nhập khẩu, kê khai giá thuốc sản xuất trong nước tại Bộ Y tế (Cục Quản lý Dược); Kê khai lại giá thuốc sản xuất trong nước tại địa phương nơi cơ sở có trụ sở sản xuất thuốc;

2. Kê khai đầy đủ các nội dung tại Bảng kê khai, kê khai lại giá thuốc (Mẫu số 01, Mẫu số 02, Mẫu số 03, Mẫu số 04 - Phụ lục VII - Nghị định số 155/2018/NĐ-CP), Bảng thuyết minh về cơ cấu giá (Mẫu số 09, Mẫu số 10- Phụ lục VII - Nghị định số 54/2017/NĐ-CP), trong đó lưu ý cần cung cấp thông tin, tài liệu nêu tại mục II, mục III Bảng thuyết minh về cơ cấu giá;

3. Lưu trữ hồ sơ kê khai, kê khai lại giá thuốc đầy đủ, thống nhất với hồ sơ đã nộp tại cơ quan quản lý nhà nước.

Cục Quản lý Dược thông báo để các đơn vị biết và thực hiện theo đúng quy định./.

To: Enterprises manufacturing and/or selling pharmaceuticals (hereinafter referred to as “enterprises”)

Pursuant the Government's Decree No. 54/2017/ND-CP dated May 08, 2017 elaborating some Article of the Law on Pharmacy and the Government’s Decree No. 155/2018/ND-CP dated November 12, 2019 amending some regulations on business conditions under the management of the Ministry of Health; through inspection of implementation of regulations on drug price management in some enterprises,

Drug Administration of Vietnam hereby requests that the enterprises:

1. Declare and re-declare drug prices following established procedures. To be specific: Declare and re-declare prices for imported drugs; declare prices for domestically manufacture drugs at the Ministry of Health (Drug Administration of Vietnam); re-declare prices for domestically manufacture drugs at the local authority of the area where the factory is located;

2. Complete drug price declaration and re-declaration forms (Forms No. 01, 02, 03, 04 in Appendix VII of Decree No. 155/2018/ND-CP), Pricing structure description forms (Forms No. 09 and 10 in Appendix VII of Decree No. 54/2017/ND-CP); provide information and documents specified in Section II and Section III of the Pricing structure description form.

3. Retain drug price declarations and re-declarations, which have to be consistent with those submitted to the authorities.
