QUYẾT ĐỊNH

VỀ VIỆC ĐÍNH CHÍNH THÔNG TƯ SỐ 19/2014/TT-BTC NGÀY 11/02/2014 CỦA BỘ TÀI CHÍNH QUY ĐỊNH THỦ TỤC TẠM NHẬP KHẨU, TÁI XUẤT KHẨU, TIÊU HỦY, CHUYỂN NHƯỢNG XE Ô TÔ, XE HAI BÁNH GẮN MÁY CỦA ĐỐI TƯỢNG HƯỞNG QUYỀN ƯU ĐÃI, MIỄN TRỪ TẠI VIỆT NAM

Căn cứ Luật ban hành văn bản quy phạm pháp luật số 17/2008/QH12 ngày 03/6/2008;

Căn cứ Nghị định số 100/2010/NĐ-CP ngày 28/9/2010 của Chính phủ về Công báo;

Căn cứ khoản 7, Điều 1 Nghị định số 09/2010/NĐ-CP ngày 08/02/2010 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 110/2004/NĐ-CP ngày 08/04/2004 của Chính phủ về công tác văn thư;

Căn cứ Nghị định số 215/2013/NĐ-CP ngày 23/12/2013 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Tài chính;

Xét đề nghị của Tổng cục trưởng Tổng cục Hải quan, Vụ trưởng Vụ Pháp chế,

QUYẾT ĐỊNH:

Điều 1. Đính chính một số kỹ thuật trình bày văn bản tại Thông tư số 19/2014/TT-BTC ngày 11/02/2104 của Bộ Tài chính quy định thủ tục tạm nhập khẩu, tái xuất khẩu, tiêu hủy, chuyển nhượng xe ô tô, xe hai bánh gắn máy của đối tượng hưởng quyền ưu đãi, miễn trừ tại Việt Nam như sau:

1. Tại điểm b.2, khoản 2 Điều 4 đã in là:

“Mỗi xe ô tô, xe gắn máy…(theo Mẫu số 01: G/2014/TNK OTO/XEMAY- NG ban hành kèm theo Thông tư này)… chức danh người tạm nhập khẩu xe,… Giấy tạm nhập khẩu xe có giá trị trong thời hạn 30 ngày kể từ ngày cấp”.

Nay sửa thành:

“Mỗi xe ô tô, xe gắn máy…(theo Mẫu số 01: G/2014/TNK OTO/XEMAY- NG ban hành kèm theo Thông tư này)… chức vụ người tạm nhập khẩu xe,… Giấy tạm nhập khẩu xe có giá trị trong thời hạn 30 ngày kể từ ngày cấp”.

2. Tại điểm b.3, khoản 2 Điều 4 đã in là:

“Sau khi cấp giấy tạm nhập khẩu xe, …cấp giấy nhập khẩu vào Sổ định mức …02 bản giấy tạm nhập (kèm 01 vận tải đơn đóng dấu treo của Cục Hải quan nơi cấp) để nộp cho Hải quan cửa khẩu làm thủ tục tạm nhập khẩu”.

Nay sửa thành:

“Sau khi cấp giấy tạm nhập khẩu xe, …cấp giấy tạm nhập khẩu vào Sổ định mức …02 bản giấy tạm nhập (kèm 01 vận tải đơn đóng dấu treo của Cục Hải quan nơi cấp) để nộp cho Hải quan cửa khẩu làm thủ tục tạm nhập khẩu”.

3. Tại điểm d.2, khoản 2 Điều 5 đã in là:

“Trả cho đối tượng…; sao gửi giấy phép tạm nhập khẩu,…không cấp tờ khai nguồn gốc đối với xe ô tô, xe gắn máy tạm nhập khẩu;”.

Nay sửa thành:

“Trả cho đối tượng…; sao gửi giấy tạm nhập khẩu,…không cấp tờ khai nguồn gốc đối với xe ô tô, xe gắn máy tạm nhập khẩu;”.

4. Tại điểm a, khoản 4 Điều 7 đã in là:

“Đối tượng quy định tại khoản 1, 2 và 3 Điều 2 Thông tư này khai 02 tờ khai hải quan hàng hóa xuất khẩu/nhập khẩu phi mậu dịch (HQ/2011-PMD)”

Nay sửa thành:

“Đối tượng nhận chuyển nhượng khai 02 tờ khai hải quan hàng hóa xuất khẩu/nhập khẩu phi mậu dịch (HQ/2011-PMD)”

5. Tại điểm b.1, khoản 4 Điều 7 đã in là:

“Căn cứ giấy chuyển nhượng xe,…; nhận cho biếu, tặng… đề nghị cấp phép chuyển nhượng xe, Cục Hải quan tỉnh, thành phố hoàn tất thủ tục chuyển nhượng theo quy định”.

Nay sửa thành:

“Căn cứ giấy chuyển nhượng xe,…; nhận biếu, tặng… đề nghị cấp giấy chuyển nhượng xe, Cục Hải quan tỉnh, thành phố hoàn tất thủ tục chuyển nhượng theo quy định”.

5. Tại khoản 2 Điều 9 đã in là:

“Cục Hải quan tỉnh, thành phố nơi cấp giấy phép nhập khẩu…theo hướng dẫn của Tổng cục Hải quan;”.

Nay sửa thành:

“Cục Hải quan tỉnh, thành phố nơi cấp giấy tạm nhập khẩu…theo hướng dẫn của Tổng cục Hải quan;”.

6. Tại mẫu số 01: G/2014/TNK-OTO/XM-NG ban hành kèm theo Thông tư số 19/2014/TT-BTC đã in:

“Xét Đơn đề nghị của Cơ quan/ông/bà:........”.

Nay sửa thành:

“Căn cứ văn bản đề nghị của Cơ quan/ông/bà:........”.

Điều 2. Hiệu lực thi hành

Quyết định này có hiệu lực kể từ ngày 28/03/2014 và là một phần không tách rời của Thông tư số 19/2014/TT-BTC ngày 11 tháng 02 năm 2014 của Bộ Tài chính quy định thủ tục tạm nhập khẩu, tái xuất khẩu, tiêu hủy, chuyển nhượng xe ô tô, xe hai bánh gắn máy của đối tượng hưởng quyền ưu đãi, miễn trừ tại Việt Nam.

Điều 3. Trách nhiệm thi hành

Tổng cục trưởng Tổng cục Hải quan và các đơn vị có liên quan chịu trách nhiệm thực hiện đầy đủ các hướng dẫn tại Thông tư số 19/2014/TT-BTC ngày 11/02/2014 của Bộ Tài chính và đính chính tại Quyết định này.

Trong quá trình thực hiện nếu có vướng mắc, đề nghị các đơn vị báo cáo kịp thời về Bộ Tài chính để nghiên cứu, giải quyết./.

DECISION

ON CORRECTION OF CIRCULAR NO. 19/2014/TT-BTC DATED FEBRUARY 11, 2014 OF THE MINISTRY OF FINANCE REGULATING THE PROCEDURES FOR TEMPORARY IMPORT FOR RE-EXPORT, DESTRUCTION AND ASSIGNMENT FOR CARS AND MOTORCYLES OF PERSONS ENTITLED TO PRIVILEGES AND IMMUNITIES IN VIETNAM

Pursuant to the Law on promulgation of legal normative documents No.17/2008/QH12 dated June 03, 2008;

Pursuant to Decree No. 100/2010/ND-CP dated November 28, 2010 of the Government on the Gazette;

Pursuant to Clause 7, Article 1 of Decree No. 09/2010/ND-CP dated February 08, 2010 of the Government amending and supplementing a number of articles of Decree No. 110/2004/ND-CP dated April 08, 2004 of the Government of clerical work;

Pursuant to Decree No. 215/2013/ND-CP dated 23 December, 2013 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Finance;

Article 1. Correcting a number of techniques of text presentation in Circular No. 19/2014/TT-BTC dated February 11, 2014 of the Ministry of Finance regulating the procedures for temporary import for re-export, destruction and assignment for cars and motorcycles of persons entitled to privileges and immunities in Vietnam as follows:

1. At Point b.2, Clause 2, Article 4 printed as:

“Each car or motorcycle … (Form No. 01: G/2014/TNK OTO/XEMAY-NG issued together with this Circular)….. the title of temporary importer of vehicles….The permit of temporary import of vehicles is valid within 30 days after the issue date”.

Now corrected as:

“ach car or motorcycle … (Form No. 01: G/2014/TNK OTO/XEMAY-NG issued together with this Circular)….. the position of temporary importer of vehicles….The permit of temporary import of vehicles is valid within 30 days after the issue date”.

2. At Point b.3, Clause 2 of Article 4 printed as:

“After issuing the temporary import paper, … issue of import paper in the tax-free car and motorcycle quota Book… 02 copies of permit of temporary import (with 01 bill of lading with the seal of issuing customs authorities) in order to submit it to the border gate customs for temporary import procedures”.

Now corrected as:

 “After issuing the temporary import permit, … issue of temporary import permit in the tax-free car and motorcycle quota Book… 02 copies of permit of temporary import (with 01 bill of lading with the seal of issuing customs authorities) in order to submit it to the border gate customs for temporary import procedures”.

“Rturning the temporary importer….; copying and sending the temporary import permit …; no issue of declaration of origin for cars and motorcycles temporarily imported”.

Now corrected as:

“Returning the temporary importer….; copying and sending the temporary import paper …; no issue of declaration of origin for cars and motorcycles temporarily imported”.

4. At Point a, Clause 4 of Article 7 printed as:

“he persons specified in Clause 1, 2 and 3, Article 2 of this Circular shall fill in 02 customs declaration of non-commercial imports/exports (HQ/2011-PMD)”.

Now corrected as:

 “The persons receiving the transfer shall fill in 02 customs declaration of non-commercial imports/exports (HQ/2011-PMD).

5. At Point b.1, Clause 4 of Article 7 printed as:

“Căn cứ giấy chuyển nhượng xe,…; nhận cho biếu, tặng… đề nghị cấp phép chuyển nhượng xe, Cục Hải quan tỉnh, thành phố hoàn tất thủ tục chuyển nhượng theo quy định”.

Now corrected as:

“Based on the permit of car transfer …receive, donate, offer … requesting the issue of permit of vehicle transfer, the Customs Department of province and city shall complete the transfer procedures as prescribed”.

5. In Clause 2, Article 9 printed as:

“The Customs Department of province and city issuing the import permit … under the guidance of the General Department of Customs”

Now corrected as:

“The Customs Department of province and city issuing the temporary import paper … under the guidance of the General Department of Customs”.

6. In the Form No.: 01: G/2014/TNK-OTO/XM-NG issued together with Circular No. 19/2014/TT-BTC printed as:

“On considering the application of Unit/Mr./Mrs.: …….

Now corrected as:

Article 2. Effect

This Decision takes effect on March 28, 2014 and is an integral part of the Circular No. 19/2014/TT-BTC dated February 11, 2014 of the Ministry of Finance regulating the procedures for temporary import for re-export, destruction, transfer of car/motorcycles of the persons who are entitled to the privileges and immunities in Vietnam;

Article 3. Responsibility for implementation

The Director of General Department of Customs and the units concerned are liable to fully implement all guidelines in Circular No. 19/2014/TT-BTC dated February 11, 2014 of the Ministry of Finance and the corrections in this Decision;

Any problem arising during the implementation should be promptly reported to the Ministry of Finance for review and settlement./.
