QUYẾT ĐỊNH

VỀ VIỆC SỬA ĐỔI QUY CHẾ HƯỚNG DẪN GIAO DỊCH KÝ QUỸ CHỨNG KHOÁN

Căn cứ Luật Chứng khoán ngày 29 tháng 6 năm 2006;

Căn cứ Luật sửa đổi, bổ sung một số điều của Luật Chứng khoán ngày 24 tháng 11 năm 2010;

Căn cứ Nghị định số 58/2012/NĐ-CP ngày 20 tháng 7 năm 2012 của Chính phủ quy định chi tiết và hướng dẫn thi hành một số điều của Luật Chứng khoán và Luật sửa đổi, bổ sung một số điều của Luật Chứng khoán;

Căn cứ Quyết định số 112/2009/QĐ-TTg ngày 11 tháng 9 năm 2009 của Thủ tướng Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Ủy ban Chứng khoán Nhà nước trực thuộc Bộ Tài chính;

Căn cứ Thông tư số 74/2011/TT-BTC ngày 01 tháng 6 năm 2011 của Bộ Tài chính hướng dẫn về giao dịch chứng khoán;

Căn cứ Quyết định số 637/QĐ-UBCK ngày 30 tháng 11 năm 2011 của Chủ tịch Ủy ban Chứng khoán Nhà nước về việc ban hành Quy chế hướng dẫn giao dịch ký quỹ chứng khoán;

Xét đề nghị của Vụ trưởng Vụ Quản lý kinh doanh chứng khoán,

QUYẾT ĐỊNH:

Điều 1. Sửa đổi một số điều Quy chế hướng dẫn giao dịch ký quỹ chứng khoán ban hành kèm theo Quyết định số 637/QĐ-UBCK ngày 30 tháng 11 năm 2011 của Chủ tịch Ủy ban Chứng khoán Nhà nước (sau đây gọi là Quy chế) như sau:

1. Hủy bỏ điểm b khoản 3 Điều 8 của Quy chế.

2. Sửa đổi khoản 1, 2 Điều 16 của Quy chế như sau:

“1. Tỷ lệ ký quỹ ban đầu do công ty chứng khoán quy định nhưng không được thấp hơn 50%.

2. Tỷ lệ ký quỹ duy trì do công ty chứng khoán quy định nhưng không được thấp hơn 30%”.

Điều 2. Quyết định này có hiệu lực thi hành kể từ ngày 01 tháng 02 năm 2013.

Điều 3. Chánh Văn phòng, Vụ trưởng Vụ Quản lý ký kinh doanh chứng khoán, Tổng Giám đốc Sở Giao dịch chứng khoán Thành phố Hồ Chí Minh, Tổng giám đốc Sở giao dịch chứng khoán Hà Nội, Tổng giám đốc Trung tâm Lưu ký Chứng khoán Việt Nam, Tổng Giám đốc (Giám đốc) các công ty chứng khoán và các bên liên quan chịu trách nhiệm thi hành Quyết định này./.

DECISION

AMENDING THE REGULATION GUIDING THE MARGIN TRADING OF SECURITIES

THE PRESIDENT OF THE STATE SECURITIES COMMISSION

Pursuant to the Law on Securities dated June 29^th 2006;

Pursuant to the Law on amending and supplementing a number of articles of the Law on Securities dated November 24^th 2010;

Pursuant to the Government's Decree No. 58/2012/NĐ-CP dated July 20^th 2010, detailing and guiding the implementation of a number of articles of the Law on Securities and the Law on amending and supplementing a number of articles of the Law on Securities;

Pursuant to the Prime Minister’s Decision No. 112/2009/QĐ-TTg dated September 11th 2009 on the defining the functions, tasks, powers and organizational structure of the State Securities Commission affiliated to the Ministry of Finance;

Pursuant to the Circular No. 74/2011/TT-BTC dated June 01st 2011 of the Ministry of Finance, guiding the securities trading;

At the proposal of the Director of the Department of security trading management,

DECIDES:

Article 1. Amending a number of articles of the Regulation guiding the margin trading of securities, promulgated together with the Decision No. 637/QĐ-UBCK dated November 30^th 2011 of the President of the State Securities Commission (hereinafter referred to as the Regulation):

1. Point b Clause 3 Article 8 of the Regulation is annulled.

2. Clauses 1 and 2 Article 16 of the Regulation is amended as follows:

“1. The initial margin is decided by the securities company, but not lower than 50%

2. The maintenance margin is decided by the securities company, but not lower than 30%”.

Article 2. This Decision takes effect from the date on February 01^st 2013.

Article 3. The Chief officers, the Director of the Department of security trading management, the General Director of the Stock Exchange of Ho Chi Minh city, the General Director of the Stock Exchange of Hanoi, the General Director of the the Vietnam Securities Depository, the General Directors (Directors) of securities companies, and relevant parties are responsible for the implementation of this Circular./.
