QUYẾT ĐỊNH

CỦA THỦ TƯỚNG CHÍNH PHỦ SỐ 35/2003/QĐ-TTG NGÀY 06 THÁNG 03 NĂM 2003 VỀ VIỆC PHÂN CÔNG CƠ QUAN CHỦ TRÌ, CƠ QUAN PHỐI HỢP SOẠN THẢO CÁC DỰ ÁN LUẬT, PHÁP LỆNH CỦA CHÍNH PHỦ NHIỆM KỲ QUỐC HỘI KHOÁ XI (2002 - 2007) VÀ NĂM 2003

Căn cứ Luật Tổ chức Chính phủ ngày 25 tháng 12 năm 2001;
Căn cứ Nghị quyết số 12/2002/QH11 ngày 16 tháng 12 năm 2002 của Quốc hội về Chương trình xây dựng luật, pháp lệnh của Quốc hội nhiệm kỳ Khoá XI (2002 - 2007) và năm 2003;
Căn cứ Nghị quyết số 222/2003/NQ-UBTVQH ngày 10/02/2003 của Uỷ ban Thường vụ Quốc hội về việc triển khai thực hiện Nghị quyết của Quốc hội về Chương trình xây dựng luật, pháp lệnh của Quốc hội nhiệm kỳ Khoá XI (2002 - 2007) và năm 2003;
Theo đề nghị của Bộ trưởng Bộ Tư pháp,

QUYẾT ĐỊNH:

Điều 1. Ban hành kèm theo Quyết định này Bản phân công cơ quan chủ trì soạn thảo, cơ quan phối hợp soạn thảo các dự án luật, pháp lệnh thuộc Chương trình xây dựng luật, pháp lệnh của Chính phủ nhiệm kỳ Quốc hội Khoá XI (2002 - 2007) và năm 2003.

Điều 2. Uỷ quyền cho Bộ trưởng các Bộ, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ được phân công chủ trì soạn thảo các dự án luật, pháp lệnh thành lập Ban soạn thảo gồm đại diện lãnh đạo các Bộ, ngành và mới đại diện các cơ quan khác có liên quan tham gia Ban soạn thảo.

Bộ trưởng, thủ trưởng cơ quan chủ trì soạn thảo dự án luật, pháp lệnh tổ chức xây dựng dự án đúng tiến độ quy định trình Chính phủ xem xét, thông qua để trình Quốc hội, Uỷ ban Thường vụ Quốc hội.

Điều 3. Quyết định này có hiệu lực sau 15 ngày kể từ ngày đăng Công báo. Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ chịu trách nhiệm thi hành Quyết định này.

ASSIGNING AGENCIES TO DRAFT, AND AGENCIES TO COORDINATE IN DRAFTING, BILLS AND ORDINANCES OF THE GOVERNMENT IN THE XITH NATIONAL ASSEMBLY’S TERM (2002-2007) AND IN 2003

THE PRIME MINISTER

Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to the National Assembly’s Resolution No. 12/2002/QH11 of December 16, 2002 on the law- and ordinance-making programs of the XIth National Assembly for its whole term (2002-2007) and for 2003;
Pursuant to the National Assembly Standing Committee’s Resolution No. 222/2003/NQ-UBTVQH of February 10, 2003 on the implementation of the National Assembly’s Resolution on the law- and ordinance-making programs of the XIth National Assembly for its whole term (2002-2007) and for 2003;
At the proposal of the Justice Minister,

DECIDES:

Article 1.- To promulgate together with this Decision the Table of assignment of agencies to draft, and agencies to coordinate in drafting, bills and ordinances under the Government’s law- and ordinance-making programs in the XIth National Assembly’s term (2002-2007) and in 2003.

Article 2.- To authorize the ministers, the heads of the ministerial-level agencies and the heads of the agencies attached to the Government, which are assigned to draft bills or ordinances to set up drafting committees composed of representatives of the leaderships of the ministries or branches and to invite representatives of other concerned agencies to participate therein.

The ministers, or the heads of the agencies in charge of drafting bills or ordinances shall organize the compilation of the drafts according to the prescribed schedule, submit them to the Government for consideration and adoption before submission to the National Assembly or the National Assembly Standing Committee.
