Kính gửi: Các doanh nghiệp sản xuất, kinh doanh mỹ phẩm

Ngày 06/9/2016, Cơ quan quản lý thuốc và thực phẩm (FDA) Hoa Kỳ đã ban hành quy định về các sản phẩm xà phòng, nước rửa tay, sản phẩm tắm với tính năng sát khuẩn mà thành phần công thức có chứa 19 chất diệt khuẩn (danh mục 19 chất diệt khuẩn đính kèm công văn này) chỉ được lưu hành trên thị trường Hoa Kỳ đến hết ngày 06/9/2017 (12 tháng kể từ khi quy định ban hành), do các sản phẩm này chưa chứng minh được hiệu quả hơn so với các sản phẩm không dùng các chất này.

Với vai trò là thành viên của Hội đồng mỹ phẩm ASEAN, Cục Quản lý Dược đã đề xuất với Ban Thư ký ASEAN, Hội đồng mỹ phẩm ASEAN về quy định mới của FDA Hoa Kỳ để đưa nội dung này ra thảo luận tại cuộc họp Hội đồng khoa học kỹ thuật ASEAN (ACSB) lần thứ 25 được họp vào tháng 11 sắp tới tại Brunei, để Hội đồng mỹ phẩm ASEAN đưa ra quyết định.

Trong thời gian chờ đợi quyết định chính thức từ Hội đồng mỹ phẩm ASEAN, để đảm bảo hiệu quả, an toàn cho người sử dụng và để tránh lãng phí cho doanh nghiệp sản xuất, kinh doanh mỹ phẩm, Cục Quản lý Dược yêu cầu:

Các doanh nghiệp chủ động rà soát thành phần công thức của các sản phẩm mỹ phẩm đã công bố với cơ quan quản lý (Cục Quản lý Dược, Sở Y tế) với tính năng sát khuẩn và có kế hoạch thay thế chất diệt khuẩn có trong thành phần sản phẩm mỹ phẩm nhập khẩu, sản xuất trong nước để đảm bảo chỉ đưa ra lưu thông phân phối các sản phẩm mỹ phẩm có hiệu quả thực sự cho người tiêu dùng; Báo cáo kết quả về Cục Quản lý Dược và Sở Y tế địa phương nơi doanh nghiệp đóng trên địa bàn.

Cục Quản lý Dược sẽ cập nhật quy định của Hội đồng mỹ phẩm ASEAN đối với 19 chất diệt khuẩn nêu trên và kịp thời thông báo tới các doanh nghiệp để thực hiện.

Cục Quản lý Dược thông báo để các đơn vị biết và thực hiện./.

To: Producers and traders of cosmetic products

On September 06, 2016, the U.S Food & Drug Administration (FDA) has issued the rule for antiseptic soap, hand and body wash products containing one or more of 19 sterilants (the list of 19 sterilants is enclosed hereto) which shall be only sold on the US market up to September 06, 2017 inclusively (12 months as of the issuance of the said rule) because producers did not demonstrate that these products are more effective than products which do not contain any of the said sterilants.

As a member of the ASEAN Cosmetic Committee (ACC), the Drug Administration of Vietnam has proposed the new rule issued by U.S FDA to the ASEAN Secretariat of ACC for discussion at the 25^th meeting of the ASEAN Cosmetic Scientific Body (ACSB) organized in Brunei in the next November in order that ACC may make decision thereof.   

Pending the official decision by ACC, for the purposes of ensuring efficiency and safety of users as well as avoiding waste for producers and traders of cosmetic products, the Drug Administration of Vietnam hereby request producers and traders of cosmetic products to actively check ingredients of antiseptic cosmetic products which have been registered with governing bodies (the Drug Administration of Vietnam or Departments of Health), make plans for replacing sterilants contained in produced and imported cosmetic products in order to ensure that only actually effective cosmetic products are sold to consumers, and submit reports thereof to the Drug Administration of Vietnam and Department of Health of province or city where the producer/trader locates.

The Drug Administration of Vietnam shall update and inform regulations by ACC for 19 sterilants mentioned above to producers/traders of cosmetic products in a timely manner for implementation.
