Trên cơ sở kiến nghị và vướng mắc của các tổ chức, cá nhân sản xuất, kinh doanh phân bón vô cơ trong việc thực hiện các quy định về sử dụng dấu hợp quy trên bao bì sản phẩm theo quy định tại Thông tư số 29/2014/TT-BCT ngày 30 tháng 9 năm 2014 của Bộ trưởng Bộ Công Thương quy định cụ thể và hướng dẫn thực hiện một số điều về phân bón vô cơ; hướng dẫn về cấp phép sản xuất phân bón vô cơ đồng thời sản xuất phân bón hữu cơ và phân bón khác tại Nghị định số 202/2013/NĐ-CP ngày 27 tháng 11 năm 2013 của Chính phủ về quản lý phân bón; nhằm hạn chế thiệt hại và lãng phí số lượng bao bì sản phẩm phân bón vô cơ do chưa có dấu hợp quy, đã được in trước thời điểm quy định của Thông tư số 29/2014/TT-BCT để phục vụ kịp thời nhu cầu sản xuất, Bộ Công Thương có ý kiến như sau:

1. Các sản phẩm phân bón vô cơ được sản xuất và công bố sản phẩm, hàng hóa theo TCVN, TCCS phù hợp hoặc áp dụng tiêu chuẩn nước ngoài (vỏ bao bì chưa có dấu hợp quy) trước ngày Thông tư số 29/2014/TT-BCT có hiệu lực thi hành (ngày 27 tháng 11 năm 2014) hiện đã và đang lưu thông trên thị trường tiếp tục được lưu hành hết thời hạn sử dụng trên bao bì.

2. Các Sở Công Thương kiểm tra xác định số lượng bao bì đã in TCCS phù hợp, TCVN hoặc tiêu chuẩn nước ngoài còn tồn kho và được sử dụng đến hết ngày 27 tháng 11 năm 2016. Trường hợp sản phẩm đã công bố TCCS, TCVN hoặc tiêu chuẩn nước ngoài hoặc có chứng nhận hợp quy thì được phép bổ sung công bố hợp quy trên bao bì.

3. Các tổ chức, cá nhân sản xuất, kinh doanh phân bón vô cơ trong các trường hợp nêu trên báo cáo về Sở Công Thương số lượng bao bì chưa có dấu hợp quy, có kế hoạch sản xuất và sử dụng bao bì cũ phù hợp.

Bộ Công Thương xin thông báo đến các Sở Công Thương, các cơ quan, tổ chức, cá nhân liên quan được biết./.

To: Departments of Industry and Trade of central-affiliated cities and provinces

In consideration of enquiries of manufacturers and traders of inorganic fertilizers with regard to implementation of regulations on use of conformity markings on product packages according to Circular No. 29/2014/TT-BCT dated September 30, 2014 of the Minister of Industry and Trade on guidelines for some Articles on inorganic fertilizers; guidelines for licensing manufacturing of both inorganic fertilizers, organic fertilizers, and other fertilizers in the Government's Decree No. 202/2013/NĐ-CP dated November 27, 2013 on fertilizer management; for the purpose of minimizing loss and waste of packages of inorganic fertilizers without conformity markings that are printed before the effective date of Circular No. 29/2014/TT-BCT, and for serving manufacturing, the Ministry of Industry and Trade hereby provides some opinions:

1. Inorganic fertilizers that are manufactured and declared under appropriate Vietnam’s Standards, internal standards or foreign standards (the packages of which do not have conformity markings) before the effective date of Circular No. 29/2014/TT-BCT (November 27, 2011) and being sold on the market may be sold until the expiration dates on their packages.

2. Departments of Industry and Trade shall check the quantity of packages bearing internal standards, Vietnam’s Standards, or foreign standards that are in stock and used by the end of November 27, 2016. If internal standards, Vietnam standards, or foreign standards have been declared or the Certificate of conformity is obtained, the declaration of conformity may be added to the packages.

3. Manufacturers and traders of inorganic fertilizers in the cases mentioned above shall send reports on quantity of packages without conformity markings, plans for manufacturing and use of old packages to Departments of Industry and Trade.

Departments of Industry and Trade, relevant organizations and individuals are responsible for implementation of this document./.
