Ngày 01/10/2015, Tổng Giám đốc Bảo hiểm xã hội (BHXH) Việt Nam ký Quyết định số 1035/QĐ-BHXH ban hành quy định về mẫu sổ BHXH có hiệu lực từ ngày 01/01/2016. Tuy nhiên, Luật Việc làm số 38/2013/QH13 đã được Quốc hội khóa XIII, kỳ họp thứ 6 thông qua ngày 16/11/2013 và có hiệu lực thi hành từ ngày 01/01/2015. Để đảm bảo thống nhất trong công tác quản lý khi thực hiện bảo lưu thời gian đóng bảo hiểm thất nghiệp (BHTN) cho người lao động trước khi Quyết định số 1035/QĐ-BHXH có hiệu lực, BHXH Việt Nam hướng dẫn thực hiện đối với trường hợp người lao động đang hưởng trợ cấp thất nghiệp (TCTN) bị chấm dứt hưởng TCTN và trường hợp người lao động có những tháng lẻ chưa giải quyết hưởng TCTN như sau:

- Cơ quan BHXH cấp huyện nơi chi trả TCTN căn cứ quyết định hưởng TCTN hoặc quyết định chấm dứt hưởng TCTN của Giám đốc Sở Lao động - Thương binh và Xã hội thực hiện cấp Giấy xác nhận thời gian đóng BHTN (mẫu số C15-TS) khi người lao động kết thúc đợt hưởng TCTN để ghi, xác nhận thời gian đóng BHTN bảo lưu.

- Khi người lao động tiếp tục tham gia BHXH, BHTN thì nộp Giấy xác nhận thời gian đóng BHTN cho cơ quan BHXH để bảo lưu thời gian đóng BHTN chưa hưởng TCTN trên sổ BHXH để làm căn cứ tính hưởng TCTN lần sau. Thời gian đóng BHTN được bảo lưu là khoảng thời gian đóng BHTN tính từ tháng đóng BHTN cuối cùng trước khi hưởng TCTN.

Trong quá trình tổ chức thực hiện, nếu có khó khăn, vướng mắc các đơn vị báo cáo BHXH Việt Nam để kịp thời có hướng chỉ đạo giải quyết./.

On October 1, 2015, Director General of Vietnam Social Security signed the Decision No. 1035/QD-BHXH on issuance of the template of social insurance book coming into force from January 1, 2016. Notwithstanding, the Law on employment No. 38/2013/QH13 was passed by the 13th National Assembly in the 6^th session on November 16, 2013 and come into force on January 1, 2015. In order to ensure the consistent implementation of reservation of period of unemployment insurance payment applied to employees before the effective date of the Decision No. 1035/QD-BHXH, Vietnam Social Security provides guidelines for the cases of cutting of unemployment benefit and the remaining payment period in which the unemployment benefit is not received as follows:

- The Social security office of the district where the unemployment benefit is paid shall, according to the decision on unemployment benefit payout or the decision on cutting unemployment benefit issued by the Director of Service of Labor, War Invalids and Social Affairs, grant the document which certifies the period of unemployment insurance payment (using the form No. C15-TS) upon the end of the payout period to record the preserved payment period.

- If the employee wishes to keep paying social insurance and unemployment insurance premiums, he/she shall submit a document which certifies the period of unemployment insurance payment to the Social security office in order to record the preserved payment period into the social insurance book for the next period of unemployment benefit payout. The preserved unemployment insurance period shall be the payment period beginning from the last payment month before the unemployment benefit is received.

The difficulties that arise during the implementation must be reported to Vietnam Social Security for consideration./.
