Kính gửi:

- Bảo hiểm xã hội các tỉnh, thành phố trực thuộc Trung ương; - Bảo hiểm xã hội Bộ Quốc phòng; - Bảo hiểm xã hội Công an nhân dân.

Ngày 07/7/2016, Bộ Lao động - Thương binh và Xã hội có Công văn số 2533/LĐTBXH-ATLĐ hướng dẫn tạm thời thực hiện chế độ tai nạn lao động (TNLĐ), bệnh nghề nghiệp (BNN) theo quy định của Luật An toàn, vệ sinh lao động. Bảo hiểm xã hội (BHXH) Việt Nam sao gửi Công văn số 2533/LĐTBXH-ATLĐ nêu trên đến BHXH các tỉnh, thành phố, BHXH Bộ Quốc phòng, BHXH Công an nhân dân để tổ chức thực hiện. Trong khi chờ sửa Quy định về hồ sơ và quy trình giải quyết hưởng các chế độ BHXH ban hành kèm theo Quyết định số 636/QĐ-BHXH ngày 22/4/2016, BHXH Việt Nam yêu cầu BHXH các tỉnh, thành phố, BHXH Bộ Quốc phòng, BHXH Công an nhân dân thực hiện:

1. Về hồ sơ và quy trình giải quyết hưởng chế độ TNLĐ, BNN với người bị TNLĐ, BNN điều trị xong, ra viện từ ngày 01/7/2016 trở đi:

- Đối với hồ sơ hưởng chế độ TNLĐ, bỏ thành phần hồ sơ quy định tại Khoản 3, Khoản 6 Điều 14 Quy định về hồ sơ và quy trình giải quyết hưởng các chế độ BHXH ban hành kèm theo Quyết định số 636/QĐ-BHXH ngày 22/4/2016 và các văn bản hướng dẫn của BHXH Việt Nam;

- Đối với hồ sơ hưởng chế độ BNN, bỏ thành phần hồ sơ là biên bản đo đạc môi trường có yếu tố độc hại hoặc kết quả đo, kiểm tra môi trường lao động hoặc bản trích sao của các giấy tờ trên quy định tại Khoản 3 Điều 15 Quy định về hồ sơ và quy trình giải quyết hưởng các chế độ BHXH ban hành kèm theo Quyết định số 636/QĐ-BHXH;

- Đối với văn bản đề nghị giải quyết chế độ TNLĐ, BNN (Mẫu số 05-HSB ban hành kèm theo Quyết định số 636/QĐ-BHXH), ghi bổ sung vào cuối Điểm 1 của văn bản nội dung như sau:

+ Đối với trường hợp hưởng chế độ TNLĐ: Biên bản điều tra TNLĐ số ... ngày ... tháng ... năm ... của Đoàn điều tra TNLĐ cấp cơ sở (nếu do Đoàn điều tra TNLĐ cấp cơ sở thực hiện) hoặc cấp tỉnh (nếu do Đoàn điều tra TNLĐ cấp tỉnh thực hiện) hoặc cấp Trung ương (nếu do Đoàn điều tra TNLĐ cấp Trung ương thực hiện); trường hợp tai nạn giao thông được xác định là TNLĐ thì ghi thêm nội dung: (biên bản khám nghiệm hiện trường và sơ đồ hiện trường vụ tai nạn lập ngày ... tháng ... năm ... của ...);

+ Đối với trường hợp hưởng chế độ BNN: Biên bản đo đạc môi trường có yếu tố độc hại (nếu là biên bản đo đạc môi trường) hoặc kết quả đo, kiểm tra môi trường lao động (nếu là kết quả đo, kiểm tra môi trường) hoặc kết quả quan trắc môi trường lao động (nếu là kết quả quan trắc môi trường) số ... ngày ... tháng ... năm ... của ...

2. Về chế độ bảo hiểm TNLĐ, BNN mà thương tật, bệnh tật tái phát hoặc thương tật, bệnh tật được giám định tổng hợp tạm thời thực hiện theo các văn bản hướng dẫn ban hành trước ngày 01/7/2016.

Trong quá trình thực hiện nếu có vướng mắc, đề nghị phản ánh kịp thời về BHXH Việt Nam để xem xét, giải quyết./.

- Social Security of the People's Public Security.

On July 7, 2016, the Ministry of Labor, War Invalids and Social Affairs promulgated Official Dispatch No. 2533/LDTBXH-ATLD on provisional guidelines for regulations on occupational accidents and occupational diseases in accordance with the Law on occupational safety and hygiene. Vietnam Social Security has sent copies of the Official Dispatch No. 2533/LDTBXH-ATLD to Social Security of provinces and central–affiliated cities (hereinafter referred to as provinces), Social Security of Ministry of National Defense, and Social Security of People’s Public Security for implementation. While awaiting amendments to regulations on documents and procedures for payment of social security benefits issued together with the Decision No. 636/QD-BHXH dated April 22, 2016, Vietnam Social Security requires Social Security of provinces, Social Security of Ministry of National Defense, and Social Security of People’s Public Security to comply with the following regulations:

1. In respect of documents and procedures for payout of occupational accident insurance, occupational disease insurance claimed by victims thereof who have undergone complete medical treatment and have been discharged from the hospital from July 1, 2016:

- With regard to claims on occupational accident insurance, the documents prescribed in Clause 3, Clause 6 Article 14 of Regulation on documents and procedures for payment of social security benefits issued together with Decision No. 636/ QD-BHXH dated April 22, 2016 and their guiding documents of Vietnam Social Security shall be eliminated;

- With regard to claims on occupational disease insurance, the documents consisting of the report of measurement of workplace hazards, or the measurement results of workplace conditions, or copies of excerpts therefrom as prescribed in Clause 3 Article 15 of Regulation on documents and procedures for payment of social security benefits issued together with Decision No. 636/ QD-BHXH shall be eliminated;

- With regard to claims on occupational accident insurance or occupational disease insurance (Form No. 5-HSB issued together with Decision No. 636/QD-BHXH), the following contents shall be added to the end of Point 1 of the form:

+ Regarding claims on occupational disease insurance: “Biên bản đo đạc môi trường có yếu tố độc hại (nếu là biên bản đo đạc môi trường) hoặc kết quả đo, kiểm tra môi trường lao động (nếu là kết quả đo, kiểm tra môi trường) hoặc kết quả quan trắc môi trường lao động (nếu là kết quả quan trắc môi trường) số ... ngày ... tháng ... năm ... của ...” (“Report of measurement of workplace hazards (if relevant), or measurement results of workplace conditions (if relevant) or occupational environment monitoring results (if relevant) No. …dated……..by……”)

2. In respect of occupational accident insurance and occupational disease insurance related to injury/disease relapse or injuries/diseases subject to overall assessment, the guiding documents issued before July 1, 2016 shall apply.

Difficulties that arise during the implementation of this Official Dispatch should be reported to Vietnam Social Security for consideration./.
